CITY OF YELM
ORDINANCE NO. 846
AN ORDINANCE of the City of Yelm, Washington, increasing the
number of councilmanic offices in the City from five to seven
members, providing for appointment of qualified persons to such
offices, and fixing their terms in accordance with law.
WHEREAS, the City of Yelm is a municipal corporation organized and
operating as a non-charter code city under Optional Municipal Code, title 35A
RCW, and specifically under the mayor-council plan of government pursuant to
chapter 35A.12.RCW, and
WHEREAS, the City currently has a five member Council as established in
Ordinance 363 (12/1989) adopting the city classification of non-charter code city and
mayor-council plan of government, and
WHEREAS, RCW 35A.12.0120 provides that a mayor-council code city, with a
population of twenty-five hundred or more inhabitants, may increase the number of
councilmanic offices in the city from five to seven members upon the affirmative vote of
a majority of the existing council to do so, and
WHEREAS, RCW 35A.12.0120 requires that when the population of a mayor-
council code city having five councilmanic offices increases to five thousand or more
inhabitants, the number of councilmanic offices in the city shall increase from five to
seven members, and
WHEREAS, the population of the City as determined by the Washington State
Office of Financial Management is expected to meet or exceed five thousand inhabitants
in 2007, and
WHEREAS, RCW 35A.12.01 0 further provides that in the event of an increase in
the number of councilmanic offices, the vacancies shall be filled pursuant to RCW
35A.12.050, the City Council shall appoint two persons to serve in these offices until the
next municipal general election, at which election one person shall be elected for a two-
year term and one person shall be elected for a four-year term, and
WHEREAS, RCW 35A.12.050 in turn provides that the vacancies shall be filled
as provided in chapter 42.12. RCW, and
WHEREAS, RCW 42.12.070 provides with respect to filing non-partisan offices
that the members of the governing body shall appoint one qualified person to fill one of
the vacant offices, and the governing body and the newly appointed person shall appoint
another qualified person to fill another vacant position, and so on until each vacant
position is filled, with each of the new appointees participating in each appointment that
is made after his or her appointment,

NOW, THEREFORE, be it ordained by the Yelm City Council, Yelm,
Washington, as follows:

The number of councilmanic offices in the city is hereby increased from
five to seven.
The City Council shall by a majority vote appoint two persons in the
manner provided in RCW 42.12.070, to-wit: the members of the City
Council shall appoint one qualified person to fill the first vacant office, and
the City Council and the newly appointed person shall appoint another
qualified person to fill the next vacant position, with the first new
appointee participating in the appointment that is made after his or her
appointment.
The appointments to fill the newly created councilmanic offices shall be
made as soon as is practicable, with due time allowed to solicit qualified
applicants and for City Council to evaluate their qualifications.
The persons appointed shall serve in these offices until the next
municipal general election in November 2007, at which election one
person shall be elected for a two-year term and one person shall be
elected for a four-year term.
This ordinance shall be effective from and after the date of its adoption
and the expiration of five days after its publication as provided by law.
PASSED by the City Council of the City of Yelm, Washington, this 1 ih day of
