Dear Bob:
We are requesting temporary use of the parking lot at 906 Algiers Drive North West
Yelm WA 98597. (906 Yelm Ave East. Parcel # 22730110204. We will be setting up a
40' X 40' tent for the use of class C 1.4G Consumer Fireworks sales during June 28,
2014 until July 4, 2014. The fireworks tent will be open to the public starting June 2gtn
upon inspection. Operating hours from June 29th to July 4t" will be from 9:00 am to 11:00
pm. We will be setting up a 10 x 40 Trailer for the New Years sales season December
28tn. 2014 thru January 1, 2014.
There will be electrical usage, such as; cash registers, credit card machines, overhead
lighting. All appliances will be plugged into an outside generator using approved
extension cords.
There will be a minimum of two people on site 24 hours a day. There will be
approximately 4 employees.

Lessee, its agents,cantraotors,sub-cantractars,guests and invitees,in a
clean and sanitary manner.

(e) Comply witl�any and all la�vs,ruies,regulations and requirements
imposed upon it by any bovecnmental agency governing Yhe Lessee's
proposed use of t�e Premises and post any reyuired performance bonds

7.USE: Licensee will use the Premises to conduct retail sales of approved"l.4G"
or commanly knawn as Class"C"and/or Consumer Firetivorks along
with those activities attez�dant to that iiltended use. Lessee may place
temporary striping or cones and a tent as necessary and erect appropriate
signage and will reroove the same at the end of the term. Lessee shall
Yzot use the Premises for any illegal purpose. Lessee a�ees ta conform to
all state,county and municipal codes,statutes,ordinances and
regulations concarning the use and occupatiqn ofthe Prexnises and to
obtain the prior receipt of approval of authorities of competent
jurisdiction far its intended use of the Premises with copies thereaf ta
Land Owner. If the Lessee is unable to procure the necessary firework
permits from the State of Washin�ton and the City ofYelm to operate a
�reworks tent on the above mentioned Premises then this Lease
Agreement s}�all be nu(!and void.
, 8.ALTERATIONS: Lessee agrees not to make alteratians to the Preynises�vith the prior
written consent of the Land Owner.
9. SURRENDER: At the expiration of said term of this Lease Agreement Thunder
Fireworks,tne will surrender the Premises to Land Orvner in a canditian
equivalent to or better that when first made available to Licensee.
10.ACCESS: Lessee will liave unlimited access to the Premises durin�the term of the
Lease at the entrance/exit shown on the attached ExhiGit A.
11.TAXES: Land Owner shall be solely responsible for any taxes on the real
properly. Lessee shall be salefy responsible for any t�es on its personal
property andlor the conduct of its activities.
12.COSTS,ATTdRNEY'S FEES AND VENUE:
If,by reason af any c�efault or breach an the part of either parly in the
performance of any of the provisions of this agreement,enforcement af
any term of tliis Lease is sou�ht,whether or not legal action is instituted,
the lasin�party agrees to pay ail��easonable costs and attorney's fees af
the prevailing party in connection therewitli. In the event any claim for
