NOTICE IS HEREBY GIVEN pursuant to Section 1.16.040 YMC that your use of property at 501 103rd Ave NE is in violation
of the Yelm Zoning Code and Building and Construction Code, Titles 15 and 17 YMC.
ALLEGATIONS OF FACT
Yelm Prairie Christian Center owns or controls real property within the City of
Yelm, identified by tax parcel number 64303601802 and described as Section 19 Township 17 Range 2E Quarter SE SE Plat MCKENNA IRRIGATED TRACTS; SS-8019 LT 2.
Although the subject property
is identified by the Yelm Zoning Code as being within the C-1 Zone Prairie Christian Center was constructed prior to the existing zoning code and per Chapter 17.93 is a nonconforming
use
The pole barn was allowed as an exemption per Chapter 17.84.010 (B) YMC as storage only requiring review only a building permit.
On August 3, 2011an application for a conditional
use permit for additional storage was received by the City of Yelm
On August 18, 2011 a letter of stop work was delivered to the Yelm Prairie Christian Center
On or before August 18, 2011 the Storage Only pole Barn completed per building permit 20100133 was converted to a warehouse/food bank in violation of Chapter 15.08 YMC, International
Building Code Chapter 34 and Chapter 17.84 YMC Site Plan Review.
On January 22, 2013 Yelm Prairie Christian Center requested to continued the violation without formal land use processes
the use of the pole barn as a warehouse distribution center/food bank
ALLEGATIONS OF LAW
A. The above described real property is within the City of Yelm.
B. The above described development
is in violation of the Yelm Zoning code and Yelm Building Code.
C. The property owners failed to complete the Conditional Use Permit process started applied for in August of 2011
IT
IS ORDERED THAT Yelm Prairie Christian Center or any other person acting as their agent shall remove within seven days (7) of receipt of this letter all merchandise, vehicles, storage
containers, storage trailers or vans and offices associated with the food bank and warehouse.
Failure to comply with the terms of this notice of violation may result in further actions
by the City of Yelm, including, but not limited to the issuance of civil penalties of up to $250.00 per day per violation or further enforcement action through a court of compentent
jurisdiction.
