20070355 Re TMobile at Railway Rd 03212008Matt, I apologize for the delayed response. In regards to the Waiver of
Protest and the Right of Way Dedication Deed, we prefer that both the
applicant and the owner sign both documents. This would ensure the city
that both party’s waive all rights to protest against future Local
Improvement District (LID), Utility Local Improvement District (ULID),
or Latecomer Ordinance.
Frontage improvements generally include half street improvements from
the centerline back towards the property. Sewer and water line
extensions may be included as part of the frontage improvements along
with curb, gutter, sidewalk, and planter strip depending on the street
classification for the two frontage streets.
Responsibility for paying the assessment that will result if an LID or
if a Latecomer’s agreement is established must be determined by the
applicant and owner.

Hi Nisha,
Per our discussion this morning. What are the requirements of the
"Agreement of Waiver and the Right-of-Way Dedication deed" as in whom is
to sign the documents, T-Mobile or property owner? Can you
explain/define Frontage Improvements? In section 2 of the Agreement of
Waiver, which improvements is the owner financially obligated to; e.g.
Sanitary sewer, water system, storm ect? It seems most of those
improvements do not apply to our project and I want to be able to tell
the landlord exactly what improvements they'll be responsible for. At
the time of BP submittal will I need the two waivers signed or can they
be due at permit release rather than at the time of submittal?
As I understand the building department requirements:
(5) sets of full size plans
(2) sets of structural's
(2) waivers
fee's will be due at permit release
