Code 197 -11 -340 (2). Comments must be submitted to Nisha Box, Community Development
Department, at City of Yelm, 105 Yelm Avenue West, P.O. Box 479, Yelm, WA 98597, by March 19,
2008, at 5:00 P.M. The City of Yelm will not act on this proposal prior March 26, 2008, at 5:00 P.M.
You may appeal this determination to the Yelm Hearing Examiner, at above address, by submitting a
written appeal no later than March 26, 2008 at 5:00 P.M. You should be prepared to make specific factual

Findings of Fact
1. This Mitigated Determination of Non Significance is based on the project as proposed and the
impacts and potential mitigation measures reflected in the following environmental documents:
• Environmental Checklist (November 2007, Sound Engineering, Inc.)
• Preliminary Storm Drainage Report (September 2007, Sound Engineering, Inc)
• Technical Memorandum (January 2008, Shea Carr Jewell)
• Preliminary Geotechnical Report (August 2007, GeoResources, LLC)
• Wetland Review and Delineation (August 2007, Forest Pro Inc.)
2. The City of Yelm has adopted a concurrency management system as required by the Growth
Management Act. Chapter 15.40 Yelm Municipal Code (YMC) Concurrency Management is
designed to ensure that the improvements required to support development are available at the
time of development. A concurrency determination may be issued for a proposal as it relates to
transportation issues when: the development provides on -site frontage improvements; the project
makes off -site improvements as necessary to provide for the safe movement of traffic; and the
project makes a contribution to projects identified the six year transportation improvement
program in the form of a Transportation Facilities Charge.
3. The Community Development Department reviewed transportation impacts using Synchro and
SimTraffc tools designed to model networks of signalized and unsignalized intersections which is
useful for analyzing complex traffic situations such as closely spaced intersections and the effects
of signals on nearby unsignalized intersections.
Based on the data within the traffic scope, the traffic models show that during the peak hour all
intersections and driveway accesses operated at acceptable levels. The cue analysis identified
left turn conflicts into retail centers along Creek Street during the peak hour. The addition of a
center turn lane would alleviate this conflict. The Creek Street Plaza project occurring at the
corner of Creek Street and SR 507 will be constructing a right turn lane on Creek Street, as well
as extending a center turn lane north.
4. The Shoreline Management Act provides policies and regulations for development along
Shorelines of the State. The Shoreline Master Program for the Thurston Region provides policies
and regulations for development along Yelm Creek. The property is bordered on the east side by
Yelm Creek. A portion of the development is proposed to be located within the Shoreline
Jurisdiction area. Any development within the Shoreline Jurisdiction requires a Shoreline
Substantial Development Permit which allows mitigation of potential adverse impacts to the
shoreline area.
5. Section 14.08.140(D)(2) YMC requires a 150 foot Riparian Habitat Buffer along Yelm Creek. The
development on the site is proposed to be located outside the 150 foot Riparian Habitat Buffer.
6. There is a mapped FEMA 100 year flood zone area adjacent to Yelm Creek, which encompasses
the creek and its associated wetlands. Section 15.32.280 YMC prohibits construction of
residential structures or any construction that results in any increase in flood levels. All proposed
development is located outside of the mapped FEMA 100 year flood plain.
7. The City has adopted the 1992 Department of Ecology Drainage Design Manual, which requires
that stormwater generated from development be treated for sediments before infiltration.
8. Section 14.08.120 YMC states that no development shall locate within 50 feet, measured on a
horizontal plane, from the outer edge of the high ground water hazard area or extending to a
ground elevation two feet above the base flood elevation, whichever is less. The bottom of any
infiltration facility for stormwater discharge shall be located at least 6 feet above the base flood
elevation. Modifications to the prescriptive standards for the protection of critical areas may be
authorized by the City.
Mitigation Measures
1. The developer shall mitigate transportation impacts based on the new P.M. peak hour trips
generated by the project. The Transportation Facility Charge (TFC) shall be based on specific
uses, at the time of tenant improvement.
2. The applicant shall construct a center turn lane as part of required frontage improvements. This
turn lane shall be extended from the center turn lane being constructed as part of the Creek
Street Plaza project, to the north side of the driveway entrance into the Post Office, approximately
350 feet across the property frontage. The drive lane would then be tapered to meet the
existing street at the northern property line.
3. Civil engineering plans shall include temporary erosion control systems to be approved by the
City of Yelm.
4. There are mapped high ground water hazard areas on the proposed site. The bottom of any
infiltration facility for stormwater discharge shall be located at least 6 feet above the base flood
elevation and no development shall locate within 50 feet, measured on a horizontal plane, from
the outer edge of the high ground water hazard area or extending to a ground elevation two feet
above the base flood elevation, whichever is less as identified by a Hydrogeological Report.
5. Any existing wells and on -site sewage disposal systems shall be abandoned pursuant to
applicable Washington State and Thurston County health regulations. Evidence that all wells and
sewage disposal systems have been abandoned in an approved manner shall be provided prior
to approval of civil engineering plans.
