RESOLUTION NO. 554
A RESOLUTION AMENDING YELM PERSONNEL POLICIES, SECTION 7.10
RELIGIOUS HOLIDAYS AND UNPAID HOLIDAYS FOR REASON OF FAITH OR
CONSCIENCE AND SECTION 7.05 LEAVE WITHOUT PAY, EXCEPTION.
WHEREAS, Governor Inslee signed into law Senate Bill 5173 giving public employees
two unpaid religious holidays per calendar year for a reason of faith or conscience; and
WHEREAS, the employer must allow the employee to choose those days, unless the
absence would unduly disrupt operations, impose an undue hardship as defined by the Office of
Financial Management, or the employee is necessary to maintain public safety; and
WHEREAS, in determining whether the employee's absence would result in an undue
hardship, the employer must make a case by case determination based on the specific objective
facts and circumstances present at the time of each request; and
WHEREAS, it is advised to establish a policy for the employee requesting and the
employer approving the request;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL TO AMEND THE
PERSONNEL POLICIES SECTION 7.10 and 7.05.
7.10.010 If an employee's religious beliefs require observance of a holiday not
included in the basic holiday schedule, or as an approved unpaid
holiday, the employee may, with the department head's approval, take
the day off by using vacation or compensatory time. or leave witheut pay.
7 10 020 Employees are entitled to two unpaid holidays per calendar year for a
reason of faith or conscience or an organized activity conducted under
the auspices of a religious denomination church or religious
organization Employees may select the days unless the absence would
unduly disrupt operations impose an undue hardship as defined by the
Office of Financial Management or the employee is necessary to
maintain public safety. Unpaid holidays do not carry over from year to
year and must be requested approved and taken within the calendar
year. Employee shall submit a written request for an unpaid holiday to
their Department Head 14 days prior to the requested date.
7.05.010 The Mayor and City Administrator may grant leaves of absence without
pay for an absence from work not covered by any other type of leave or if
other leave balances are exhausted. Examples of situations for which
leave without pay may be granted include time off work for personal
reasons, such as prolonged illness, a Labor and Industries eligible injury
recovery period, parenting, caring for an ill relative, pursuing an
education, or fulfilling a military obligation in excess of fifteen (15) days.
Section 7.05 does not apply to unpaid holiday leave defined in Section
7.10.
