Proposal
The applicant has applied for a Special Use Permit and Site Plan Review to construct a 5,300
square foot education and administration building on the site of the existing St. Columban
Catholic Church.
Property Characteristics
The property is located at the corner of 15t Street South and Mill Road, Tax Parcel Numbers
22719330801, 22719330805, 22719331100, and 22719331200, known as 506 15Y Street South,
Yelm, WA.
The property is approximately 7.75 acres in area and is identified by the Yelm Zoning Code as
being within the Commercial (C-1) zoning district. Churches and other places of worship are
regulated by Chapters 17.66 and 17.84 YMC. Churches and other places of worship are allowed
in all zones within the City through a special use and site plan review process.
The C-1 district provides building setback requirements of 20 feet for rear yards, 10 feet for side
yards, and 15 feet for front yards. The maximum building height is 40 feet.
The existing church was originally constructed around 1950. The property was annexed into
the City of Yelm in 1969. The church was expanded in 1990, prior to the adoption of the
present Yelm Zoning Code codified at Title 17 YMC, therefore the church and associated
structures are considered a pre-existing non-conforming use. A special use permit is required
pursuant to Chapter 17.66 YMC for the expansion of the non-conforming use.
The site includes an 8,400 +/- sq. ft. church building, a 4,500 +/- sq. ft. education building, a
3,850 +/- sq. ft. social hall, and a 2,500 +/- sq. ft. residence. The site also includes improved
parking for all structures. The adjoining parcel includes a 3,000 +/- sq. ft. social hall with
unimproved parking.
The City of Yelm will provide police protection, water service, and sewer service. Fire
protection services are provided by the Yelm Fire District (SE Thurston Fire/EMS).
Adjacent Land Uses and Zoning
The property abuts the City of Yelm Cochrane Park to the southeast; the properties to the north
of this site are zoned and developed as commercial uses. The Tahoma Valley Golf Course is
across SR 507 to the north.
The proposed building is located on a site with an existing church and associated buildings.
The project as conditioned meets City of Yelm development requirements and is a compatible
use with surrounding properties.
Notice of Application and Public Hearing
Notice of this application was mailed to state and local agencies and property owners within
300 feet of the project site on June 20, 2014. In addition, the Notice was published on the
City's website on June 20, 2014. Washington State Department of Ecology provided comment
that if contaminates are found during construction, they must be notified and that a
stormwater construction permit may be required. A local citizen commented in favor of the
proposal stating it would benefit the congregation.
Notice of the date and time of the public hearing before the Hearing Examiner was posted on
the project site, on the City website, and mailed to the owners of property within 300 feet of
the project site on Wednesday, August 13, 2014.

Concurrency
Chapter 15.40 YMC requires the reviewing authority to determine that required urban
infrastructure is available at the time of development. Concurrency means the facilities
necessary to serve a proposed development are in place or planned for and properly funded
with a reasonable expectation that the facilities will be in place at the time needed to preserve
adopted levels of service.
Concurrency with sewer infrastructure is achieved pursuant to Section 15.40.020 (B)(1) YMC
when the project is within an area approved for sewer pursuant to the adopted sewer
comprehensive plan for the City and improvements necessary to provide City standard facilities
and services are present to meet the needs of the proposed development.
The site is located in the City of Yelm's sewer system service, and is currently connected to the
City sewer system. Improvements required to serve the project will be specifically identified
during civil plan review. This satisfies the requirement for concurrency with sewer
infrastructure.
The Yelm Concurrency Management Code, Chapter 15.40 YMC, requires the Community
Development Department to make a written finding of concurrency for any approval for a land
division or site plan (including any development activity). For water, the finding must include
the fact that "improvements necessary to provide city standard facilities and services are
present or are in an approved and funding plan to assure availability in a time to meet the
needs of the proposed development."
While the City of Yelm has been proactive in water planning since 1994, when application was
made with the Washington Department of Ecology for water rights sufficient to serve the City
and its Urban Growth Area for 20 years of growth, the approval of these water rights by the
Washington Department of Ecology, the Pollution Control Hearings Board, and the Thurston
County Superior Court have been further appealed to the Washington State Supreme Court.
The Supreme Court has yet to determine if it will accept the appeal on direct review. If it does
accept the case, a decision is not anticipated within the next 18 to 24 months. If the Court does
not accept the case, it will be remanded to the Court of Appeals and the timeline for a decision
could be even longer.
The City currently has sufficient water connections to serve some growth and existing
connections. The proposed development is within the City's available capacity to serve and is
expected to be fully complete and connected to the City's water system within the time period
of available connections. As a result, the Community Development Department is able to make

a written determination that adequate provisions for potable water will be available when
needed by the proposal.
However, the State Building Code at Section 19.27.097 RCW requires evidence of water
availability, and the issuance of a building permit by the City of Yelm is the City's commitment
to serve a proposal with potable water. If the City does not have sufficient approved water
connections at the time a building permit for the proposed development is ready to issue, the
permit will be denied until additional water resources are available.
The applicant is responsible for ensuring that the requirements of the adopted Fire Codes are
met through the provision of adequate fire flow, or construction methods that reduce the
required fire flow.
Concurrency with transportation infrastructure is achieved pursuant to Section 15.40.020 (5)(c)
YMC when the project:
• Makes on-site and frontage improvements consistent with City standards and roads
necessary to serve the proposed project consistent with safety and public interest;
• Makes such off-site facility improvements, not listed on the capital facilities plan, as are
necessary to meet City standards for the safe movement of traffic and pedestrians
attributable to the project;
• Makes a contribution to the facilities relating to capacity improvements identified in the
adopted six-year traffic improvement program, in the form of a transportation facility
charge.
The project has frontage along 15t Street South (SR 507) and Mil) Road. Frontage improvements
for these roads are currently incomplete and are required to be constructed to current
standards.
Section 4B.080 (C) Yelm Development Guidelines allows the City to determine when frontage
improvements are required, and under certain circumstances may permit deferral of
installation of such improvements to a later date.
The applicant has requested a deferral of frontage improvements. There is public benefit in
coordinating small improvements with a larger project such as through Local Improvement
Districts (LID). The Traffic Impact Analysis submitted shows no significant impact to the two
accesses to the site. Deferred frontage improvements shall be secured for installation at a later
date by a waiver of protest, and commitment to participate in a local improvement district.
This satisfies the requirement for concurrency with transportation infrastructure.
Concurrency with school infrastructure is achieved pursuant to Section 15.40.020 (B)(4) YMC
when the developer provides a letter from the local school district that the school facilities
impacted by the proposed development are present, or are on an approved and funded plan, to

assure that facilities will be available to meet the needs and impacts of the proposed
development.
The proposed development will have no impact on the school system as it will not increase the
number of students within the school district.
Concurrency with fire protection is achieved pursuant to Section 15.40.020 (6) YMC when the
developer makes a contribution to the fire protection facilities as identified in the most current
version of the capital facilities plan adopted by the SE Thurston Regional Fire Authority and
endorsed by resolution of the Yelm City Council. The Council has waived the fire impact fee by
Resolution 533 until the SE Thurston Regional Fire Authority establishes a region wide impact
fee. This fee is subject to change by City Council resolution and is collected at the time of
building permit issuance.
State Environmental Policy Act
The City of Yelm SEPA Responsible Official issued a Determination of Non-significance based on
WAC 197.11.340(2) on July 25, 2014. This determination is final and fulfills the City's
responsibility for disclosure of potential significant environmental impacts. The Hearing
Examiner may take action to deny or condition the proposal based on impacts identified in the
environmental checklist or other environmental documents.
Critical Areas
The Mazama Pocket Gopher has been listed as a threatened species by the Washington
Department of Fish and Wildlife since at least 2008. Yelm has protected this species through
the implementation of the Critical Areas Code, Chapter 14.08 YMC. When a development
occurs on property suspected to be occupied by the Mazama Pocket Gopher, the Community
Development Department has required the applicant prepare a critical areas report which
would include mitigation measures if it was determined that pocket gophers would be
impacted by the proposed development. The Washington Department of Fish and Wildlife is
provided with notice of all threshold determinations issued pursuant to the State
Environmental Policy Act and the City consults with the Department when a critical areas report
is required.
In April, 2014, the U.S. Fish and Wildlife Service listed the Yelm subspecies of the Mazama
Pocket Gopher as threatened under the Endangered Species Act. While the City of Yelm is not
responsible for implementation or enforcement of the Endangered Species Act, it consults with
the Service and provides notice to applicants that the pocket gopher is a federally protected
species and a permit from the U.S. Fish and Wildlife Service may be required.
As part of the environmental review process for the subject application, Community
Development Department staff reviewed soil maps, which show the area of the proposed
project to be of low suitability as habitat for the pocket gopher. Visual reconnaissance by City

staff showed no evidence that the property contains any protected species. Based on these
facts, the Yelm Critical Areas Code would not require the preparation of a special report prior to
approval of the project and the SEPA Responsible Official issued a determination of non-
significance and forwarded the determination to both the Washington State Department of Fish
and Wildlife and the U.S. Fish and Wildlife Service. Neither agency commented on or objected
to the determination.
Compliance with Yelm's requirements under the Critical Areas Code does not ensure
compliance with the provisions of the Endangered Species Act. The applicant should contact
the US Fish and Wildlife Service with any questions about compliance with Federal standards
for threatened species.
Design Standards
The proposal is required to meet the City of Yelm Design Guidelines for the Mixed Use District.
The existing church and associated structures meet the intent of the design standards, and the
new educational building is proposed to be located behind two existing structures and to the
side of the church building.
Building design standards require human scale buildings elements. Building elevation plans
show the structure to have a gabled roof, and covered entry, building details to include
cultured stone foundation with board and batten siding and articulation over doorways.
To reduce the visual impact and apparent size of large blank walls, architectural and landscape
treatment is required. The wall shown on the east elevation does not meet this requirement.
In addition to the landscaping proposed, architectural treatment is required.
The preliminary site plan shows sidewalks connecting the new building to all other buildings
and parking areas within the site.
Refuse
The City of Yelm Development Guidelines, Design Guidelines, and Municipal Code provide
guidance for refuse storage and screening. If additional refuse areas are needed, they are
required to follow the following standards:
Refuse areas are required to be accessible by LeMay, screened with a material and design
compatible with the overall architectural theme of the associated structure, at least as high as
the refuse container, and must be at least six-feet in height with a gate enclosure.
No refuse container is allowed between a public street and the front of a building. Refuse
collection areas must be designed to contain all refuse generated on site and deposited
between collections, and refuse should not be visible from outside the refuse enclosure.

Transportation
Yelm is a small compact community most directly affected by two state highways, SR 510 and
SR 507, which bisect the community. These state routes are used by local residents for
transportation throughout the City, and for access to commercial and residential areas
throughout the community as well as serving regional traffic.
The updated Transportation element of the Yelm Comprehensive Plan identifies a number of
improvements designed to avoid the need to significantly widen existing streets, and
particularly Yelm Avenue. New development impacts the transportation system in Yelm and,
unless the improvements identified in the transportation plan are constructed, the City would
need to require developers to pay the cost of internal street widening.
The applicant has requested a deferral of frontage improvements. There is public benefit in
coordinating small improvements with a larger project such as through Local Improvement
Districts (LID). The Traffic Impact Analysis submitted shows no significant impact to the two
accesses to the site. Deferred frontage improvements shall be secured for installation at a later
date by a waiver of protest, and commitment to participate in a local improvement district.
Water Supply
The site is within the water service area as identified in the Yelm Water System Plan and is
currently connected to the water system. The site plan submitted with the proposal shows
water connection to this building at an existing meter located on 15t Street SE (SR 507). Civil
engineering plans must prove that the existing meter size is adequate to serve this additional
building.
An engineers estimate for water usage will be required as part of the civil plan submission.
Water connections are based on a consumption rate of 875 cubic feet per month. Connection
fees will be calculated utilizing the water consumption calculations provided by the civil
engineer as part of the civil plan review process.
Section 246-290-490 WAC, requires that the City take measures to ensure that contamination
does not occur as a result of cross connection. The applicant is required to install a Reduced
Pressure Backflow Assembly device at the service at all water meters.
The site is irrigated with City of Yelm reclaimed water. If any additional irrigation meters are
installed, a backflow prevention device will be required for all irrigation connections between
the irrigation system and the water meter.
The State Building Code at Section 19.27.097 RCW requires evidence of water availability and
the issuance of a building permit by the City of Yelm is the City's commitment to serve a
proposal with potable water.

Sewer System
The site is located in the City of Yelm's sewer system service, and is currently connected to the
sewer system. The site plan submitted with the proposal shows sewer connection to this
building via a shared S.T.E.P. sewer tank with an existing building. Civil engineering plans must
include S.T.E.P. tank sizing calculations showing that the existing S.T.E.P. tank is sized
adequately to serve this additional building.
Sewer connections are based on the water consumption rate of 875 cubic feet per month.
Connection fees will be calculated utilizing the water consumption calculations provided by the
civil engineer as part of the civil plan review process.
Parking
The City of Yelm Development Guidelines, Design Guidelines, and Municipal Code address
parking regulations from many aspects. These considerations include the design of lots, the
number of stalls required, pedestrian pathways within lots, and safety.
The requirements of off-street parking and loading facilities and their design are regarded as
the minimum; however, the owner, developer or operator of the premises for which the
parking facilities are intended shall be responsible for providing adequate amounts and
arrangement of space for the particular premises even though such space or its arrangement is
in excess of the minimum set forth.
A church is required to provide one parking stall for each 10 occupants, based on the maximum
occupancy load. The site has adequate parking for the church. The new building will be used
for children during church services, as well as classroom and administration during non-service
times. No additional parking is required for this building.
Stormwater Quality and Quantity
Impervious surfaces create stormwater runoff which, when uncontrolled and untreated can
create health, safety, and environmental hazards.
This proposal does not include any additional impervious surfaces. Roof runoff will be
infiltrated onsite via individual drywells
Landscaping
Landscaping and screening are necessary to provide screening between compatible and
incompatible land uses, to safeguard privacy and to preserve the aesthetic assets of the City.
Chapter 17.80 YMC requires all development to provide on-site landscaping.

Landscaping is required around the proposed building. The preliminary landscape plan shows
landscaping around the building that meets minimum landscape requirements, as well as
adding additional trees adjacent to the parking area. Existing landscaping on site is adequate
for the remaining parking areas and perimeter.
The site is irrigated with City of Yelm reclaimed water. If any additional irrigation meters are
installed, a backflow prevention device will be required for all irrigation connections between
the irrigation system and the water meter.
The City of Yelm also promotes water conservation and will require the final landscaping plan to
address the following requirements:
• Specify water efficient plant species for the Pacific Northwest.
• Choose irrigation devices and design the irrigation system to positively prevent runoff
or overspray onto impermeable hardscape under all conditions regardless of wind or
possible equipment misalignment.
• Assign separate station/zones (hydrozones) to areas with dissimilar water or scheduling
requirements. For example; separate zones should be designed for trees, shrubs,
flowers, shady areas, sunny areas, drip irrigation and sprinklers.
• Locate sprinkler heads based on a thorough evaluation of physical, environmental, and
hydraulic site conditions, including wind. The design must not permit sprinklers to
overspray onto impermeable hardscape under any condition.
• Specify drip irrigation for all zones planted in one-gallon or larger size.
� Specify weather-based irrigation controllers (WBIC).
• Specify check valves wherever necessary to prevent low-head drainage.
The final landscaping plan shall provide complete detail of the landscape plants, features and
irrigation requirements.
Staff Recommendation
Based on the Analysis, Findings, and Conditions of Approval, staff finds that the project, as
conditioned, meets the City's minimum requirements and standards. Staff recommends that
the Hearing Examiner approve 20140179 Special Use Permit for the St. Columban education
building, as proposed and conditioned herein.
1. The proposed building shall connect to the City S.T.E.P. sewer system. Civil
engineering plans shall include a S.T.E.P. tank sizing report to show that the existing
S.T.E.P. tank is sized appropriately for the additional connection of this building, or if a
new tank is required. Additional sewer connections may be required based on water
usage calculations.
2. The proposed building shall connect to City water service. An estimate of water usage
is required as part of civil plan review. The civil plans shall include calculations to

show that the existing meter is adequately sized for this building connection or if a
new water meter is required to be installed. Water connection fees are based on a
consumption rate of 875 cubic feet per month.
3. The State Building Code at Section 19.27.097 RCW requires evidence of water
availability and the issuance of a building permit by the City of Yelm is the City's
commitment to serve a proposal with potable water.
4. All conditions for cross connection control shall be met, as required in Section 246-
290-490 WAC.
5. Deferred frontage improvements shall be secured for installation at a later date by a
waiver of protest, and commitment to participate in a Local Improvement District
(LID).
6. Architectural treatment is required for the blank wall at the east elevation pursuant to
the City of Yelm Design Guidelines.
7. The civil engineering plans shall include a detailed landscape plan consistent with the
preliminary landscape plan, to include water efficient plant species.
If additional irrigation is proposed, it shall be consistent with the following water
conservation requirements:
• Choose irrigation devices and design the irrigation system to positively prevent
runoff or overspray onto impermeable hardscape under all conditions regardless
of wind or possible equipment misalignment.
• Assign separate station/zones (hydrozones) to areas with dissimilar water or
scheduling requirements. For example; separate zones should be designed for
trees, shrubs, flowers, shady areas, sunny areas, drip irrigation and sprinklers.
• Locate sprinkler heads based on a thorough evaluation of physical, environmental,

8. Best Management Practices (BMP's) are required during construction. All roof drain
runoff shall be infiltrated on each lot utilizing individual drywells.
9. The civil engineering plans shall include a fire hydrant plan consistent with the Yelm
Development Guidelines which includes the proposed location of all hydrants and
service lines and fire flow calculations for all existing and proposed hydrants.
10. The civil engineering plans shall show that the requirements of the adopted Fire Codes
are met through the provision of adequate fire flow, or construction methods that
reduce the required fire flow.

This notice has been provided to appropriate local and state agencies, and property owners within 300
feet of the project site. These recipients wil!also receive the following items when available or if
applicable: Environmental Threshold Determination, Notice of Public Hearing and Notice of Final
Decision. If the proposed project requires a City Council decision, it will be mailed to all those who
participate in the public hearing and to anyone else requesting the decision in writing. Additionally, there
will be a 14-day public comment period if an environmental determination is issued. Opportunities for
appeal occur within twenty one (21) days after the date the environmental determination is issued. City
Council decision can be appealed through Superior Court. Appeals of site plan review decisions may be

Erosion control measures must be in place prior to any clearing, grading, or consmiction_
These control measures must be effective to prevent stormwater runoff from carr_ying soil
and other pollutants into surfac�water or storm drains that lead to waters of the state_ Sand,
silt, clay particles, and soil will damage aquatic habitat and are considered to be pollutants.
Any discharge of sediment-laden runoff or other poltutants to waters of the state is in
violation of Chapter 90.48 RCW, Water Pollution Control, and WAC 173-201A, Water
Quality Standards for Surface Waters of the State of Washington, and is subject to
enforcement action.
The following construction activities require coverage under the Construction Stormwater

(. Clearing, grading and/or excavation that results in the disturbance of one or more
acres and discharges stormwater to surface waters of the State; and

waters of the State.
a) This includes forest practices (including, but not limited to, class IV conversions)
that are part of a construction activity that will result in the disti.ubance of one or
more acres, and discharge to surface waters of the State; and
3_ Any size construction activity discharging stormwater to waters of the State that
Ecology:
a) Determines to be a significant contributor of pollutants to waters of the State of
Washington.
b) Reasonably expects to cause a violation of any water quality standard.
If there are known soillground water contaminants present on-site, additional information
(including, but not limited to: temporary erosion and sediment control plans; stormwater
pollution prevention plan; list of known contaminants with concentrations and depths found;

Findings of Fact
1. This Determination of Non Significance is based on the project as proposed and the impacts and potential
mitigation measures reflected in the following environmental documents:
✓ Environmental Checklist(BCRA Engineers May 2014)
✓ Geotechnical Engineering Report(Associated Earth Sciences, May 2014)
✓ Traffic Memo(Heath&Associates,May 2014)
2. The City of Yelm is identified as a Critical Aquifer Recharge Area, a designated environmentally sensitive
area. Existing development regulations require the treatment of stormwater prior to infiltration into the
ground as well as the containment of hazardous materials on site. No additional impervious surfaces are
proposed for this project.
To protect the Critical Aquifer recharge area,any existing wells and on-site sewage disposal system must
be abandoned pursuant to applicable Washington State and Thurston County health regulations at the
time of development of the property.
3. The U.S. Fish and Wildlife Service listed the Yelm subspecies of the Mazama Pocket Gopher as threatened
under the Endangered Species Act. Soil maps show the area of the proposed project to be of low
suitability as habitat for the pocket gopher. Visuai reconnaissance by City staff showed no evidence that
the property contains any protected species. Based on these facts, the Yelm Critical Areas Code would
not require the preparation of a special report prior to approval of the project.
Compliance with Yelm's requirements under the Critical Areas Code does not ensure compliance with the
provisions of the Endangered Species Act, and this determination does not authorize violation of the
Endangered Species Act,including the take of a member of a protected species or its critical habitat.
3. Review of transportation impacts by Heath and Associates shows no significant impacts to First Street(SR
507)or Mill Road at driveway locations to the site.

proposed by Stephanie Ray, St. Columban Catholic Church_ The Department of Ecology
(Ecology) reviewed the infonnation provided and has the following cotnment(s):

If contamination is suspected, discovered, or occurs during the proposed SEPA action,
testing of the potentially contaminated media must be conducted. If contamination of soil or
groundwater is readily apparent, or is revealed by testing, Ecology must be noti�ed. Contact
the Environmental Report Trackin� System Coordinator in the Southwest Regional Office
(SWRO) at(360)407-6300. For assistance and information about subsequent cleanup and to
identify the type of testing that will be required, contact Mohsen Kourehdar with the SWRO,

Erosion control measures must be in place prior to any clearing, grading, or construction.
These control measures must be effective to prevent stormwater runoff from carryina soil
and other pollutants into surface water or storm drains that lead to waters of the state. Sand,
silt, clay particles, and soil will damage aquatic habitat and are considered to be pollutants_
Any discharge of sediment-laden runoff or other pollutants to waters of the state is in
violation of Chapter 90.48 RCW, Water Pollution Control, and WAC 173-201A, Water
Quality Standards for Surface Waters of the State of Washington, and is subject to
enforcement action.
The following construction aetivities require coverage under the Construction Stormwater
General Permit:

I_ Clearing, grading and/or excavation that results in the disturbance of one or more
acres and discharges stormwatzr to surface waters of the State; and
2. Clearing, grading and/or excavation on sites smaller than one acre that are part of a
larger common plan of development or sale, if the common plan of development or
sale will ultimately disturb one acre or more and discharge stormwater to surface
waters ofthe State_
a) This includes forest practices (including, but not limited to, class IV conversions)
that are part of a construction activity that will result in the disturbance of one or
more acres, and discharge to surface waters of the State; and
3_ Any size construction activity discharging stormwater to waters of the State that
Ecology:
a) Determines to be a significant contributor of pollutants to waters of the State of
�Vashington.
b) Reasonably expects to cause a violation of any water quality standard.
If there are known soil/ground water contaminants present on-site, additional information
(includinj, but not limited to: temporary erosion and sediment control plans; stormwater
pollution prevention plan; list of l:nown conta�ninants v��ith concentrations and depths found;
a site map depicting the sample location(s); and additional studies/reports regarding
contaminant(s))will be required to be submitted.

site operators must apply for a permit at least 60 days prior to discharging stormwater from
