Olympic Region Clean Air Agency(ORCAA)regulations define a demolition project as the wrecking, razing,leveling, dismantling or burning{by a fire department for training purpqses)of a structure making the structure permanenUy uninhabitable or unusable.Renovations include the removing of load bearing structural members,but not to the eutent to make the structure uninhabitable. The following information is merely a reference guide and not a substitute for agency regulations. 1.A good faith asbestos survey must be conducted by a certified Asbestos Hazardous Emergency Response Act(AHERA) building inspector. Qualified contractors and inspectors may be found in your local Yellow Pages,through the Washington State Department of Labor and Industries,or on ORCAA's website. 2.Asbestos samples must be sent to an NVLAP laboratory(National Voluntary Laboratory Accreditation Program)per 40 CFR 763.87. A list o#labs can be found on ORCAA's website. 3.The start date on other structure demolition must be at feast 10 working days from the submission date of the complete application and payment. 4. It is the responsibility of the property owner and/or demofition contractor to ensure there is no asbestos-containing material present in the structure to be demolished. 5.Any and all structures on the same parcel of properry that are not proposed to be demolished must be identified as such. 6.A copy of the asbestos survey and approved Demolition Permit, as well as any subsequent amendments, must be kept on site and available for review by Agency inspection personnel. 7.The original demolition permit will expire on the Completion Date. Under no circumstances will a project be extended beyond 1 year from original start date. ADDITIONAL REQUIREMENTS In addition to Agency requirements, most building departments require a demolition permit(separate from ORCAA's Demolition Permit}.The Washington State Depa�tment of Labor& Industries may also require notification for asbestos removal projects. Sewer Connection � Section 13.08.020(A)of the Yelm Municipal Code requires that all properties in the City dispose of sewage "through the city's sewage collection system or through an approved on-site system as provided in this chapter." The septic system on the subject property was approved by the City in 2003 when the duplex was constructed. Section 13.08.020(D)provides the requirement to connect to the city's municipal sewer system i£ "(1) the sewer collection system is available to the premises, as defined in subsection A of this section; (2)the Thurston County health department has determined that the interests of public health and safety require a connection to the city's municipal sewer system." Both of these conditions must be met. The sewer collection system is now available to the premises, so the first condition is met. However, no determination has been made by the Thurston County health department that a connection is now required, so the second condition has not been met. Without that determination,the City is not authorized to require connection to the municipal sewer system for a property that has an approved septic system. Section 13.08.020(G) of the Yelm Municipal Code requires connection to the municipal sewer system for new construction. However,this property is not new—the permit applied for is to repair the fire damage to the existing structure. This code section does not apply to the current permit application. Section 13.08.020(D)applies to existing buildings and would require connection to the municipal sewer system whenever the on-site system requires repair or replacement. Further, the Sanitary Code for Thurston County would only require connection to a public sewer system upon the failure of an existing on-site system. The on-site system for the property which is the subject of this application has functioned properly without requiring repair or replacement,and therefore constitutes an approved on-site system under Section 13.08.020(A). The Myklands agree that should the septic system fail, they would need to connect to the municipal sewer system at that time. Development Agreement The water meter and onsite sewer system were permitted in May 2003 in their present configuration because city water main and sewer lines were not available on 105`" Way SE. The Development Agreement signed by Jason Mykland provided for the relocation of those lines when services were available on l OSth. Demand was made on behalf of the City on November 3, 2004 for the movement of those lines. At that time, the Myklands worked with the City through their attorney, and the lines were not moved. The Development Agreement was a written contract with the City, and would be subject to the six- year statute of limitations under RCW 4.16.040: "The following actions shall be commenced within six years: (1) An action unon a�-ontract in wr�ting . . ." At this time over ten years has passed since the City made demand for the hookups pursuant to the Development Agreement. The City is not be able to rely on the Development Agreement, as any action now to enforce that Agreement would be time barred by the statute of limitations. Due to the passage of time, the City of Yelm has lost the right to enforce the Development Agreement, so any action on the permit application must be grounded in the Yelm Municipal Code. As set forth above, the property complies with Code requirements for both water and sewer connections. Accordingly, we ask that the City reconsider its determination on the permit application,and issue the permits requested.
