; by and befinreen the City of Yelm, a municipal corporation, hereinafter referred to
; as the "CITY", and Woodworth Caqital, Inc., hereinafter referred to as the
' "OWNER."

� WITNESSETH:
; WHEREAS, the OWNER holds record title to the following described
; property located within Thurston County, Washington:
�
Lot 4, Block 34 of McKenna Irrigated Tracts, as per plat recorded in
volume 9 of plats, page 43; Tax Parcel #64303400400, �
and
� WHEREAS, the CITY has required as a condition of approval of the
; OWNER's development of said property that the OWNER decommission pre- !

; existing potable water well/s on the property and connect to the CITY's water
� system; and
NOW, THEREFORE, IT IS HEREBY AGREED BETWEEN THE PARTIES ;
; as follows: '

1. The OWNER attests that they are the legal owner(s) of the water ;

� rights and/or well previously located on the property.
2. The well has been decommissioned as required in Section 173-160- ;
�
; 381 WAC.
3. The OWNER assigns all rights associated with the water rights
�
; and/or well located on the property to the CITY for transfer to the CITY.
; This agreement is being re-recorded to reflect the correct landowner's name ;
'; from Ye/m Creek Apartments, LLC to Woodworth Capital, Inc., origina/ly
