CHAPTER 1S.G5 — HOME OCCUPATIONS
18.65.010 Intent
It is the intent of this section to permit residents of the community a broad
choice in the use of their homes as a place of livelihood, and the production
of supplementing of personal/family income, while protecting residential
areas from potential adverse impact of activities defined as home
occupations. Home occupations are activities conducted for financial gain or
profit in a dwelling unit, incidental or secondary to the residential use, and
conducted only by the person(s) residing in the dwelling unit.
18.65.020 General requirements
A. Home occupations shall occupy not more than 25 percent of the total
floor area of the residence. In no event shall such occupancy exceed 400
square feet, nor shall an accessory building for such home occupation
exceed 500 square feet, nor shall the total floor area in the residence
and/or an accessory building exceed 500 square feet.
B. Any occupation which may produce waste products of a quality or
quantity not normally associated with residential use shall not qualify as
a home occupation.
C. Home occupations shall comply with all other local, state or federal
regulations pertinent to the activity pursued, and the requirements or
permission granted or implied by this chapter shall not be construed as
an exemption from such regulations.
18.65.030 Development and performance standards
A. Exterior structural alterations or additions or the use of accessory
buildings for home occupations shall be so designed and built as to
maintain or preserve the residential character of the premises. In no
event shall such structural alterations or additions exceed the
Engineering Specifications and Standard Details permitted for structures
in the zoning district in which the premises are situated;
B. Traffic generated by home occupations shall not exceed three
commercial vehicles per week. All parking of customers' or clients'
vehicles shall be off street;
C. Off-street parking spaces shall not be reduced in size or number below
the minimum required in the district, nor used for any purpose other
than parking;
D. When merchandise, material or equipment is stored, altered, repaired or
displayed, such storage, alterations, repairs or displays shall be entirely
within the residential structure or in an accessory building which meets
Design Standards—Page 63
the criteria of Section 18.64.030(A), except as provided in Section
18.51.050 YMC.
E. Home occupation signs shall be wall-mounted and shall not exceed four
square feet in area, and cannot be internally illuminated, but may be
indirectly illuminated.

Findings of Fact, Conclusions of Law, and Decision
FINDINGS OF FACT
1. Tristan and Brittany Kennedy own the parcel of land at 16499 Greenbrier Street SE,
Yelm, WA 98597, identified by Assessor's Tax Parcel Number 56510003300 and
described as Lot 33 of Johns Meadows Subdivision.
2. The property is approximately 0.11 acres in area and is identified by the Yelm Zoning
Code, Title 18 YMC, as being within the Moderate-Density Residential (R-6) zoning
district. The R-6 zoning district allows home occupations subject to ministerial review
[Section 18.12.080 YMC].
3. The ministerial review process is to ensure that projects are consistent with applicable
development, construction and design standards of the Unified Development Code
[Title 18, YMC]. Ministerial permits do not require public notice.
4. Tristan and Brittany Kennedy propose to operate a custom woodworking business from
their home. The application materials state that the business will be conducted in the
garage only. Saws, drills and other related machinery would be used. Materials used
include wood, paints, stains, cleaners and other supplies. Customers would come to the
home to pick up finished property. A sign is proposed in the front yard.
5. Chapter 18.65 YMC provides requirements and standards for home occupations. These
include ,
• The home occupation shall not occupy more than 25 percent of the total floor area
of the residence, or exceed 500 square feet if in an accessory building.
• Traffic generated by the home occupation shall not exceed 3 commercial vehicles
per week, and all parking of customers' vehicles shalt be off-street.
• Storage of inerchandise, material or equipment must be entirely within the
residence or accessory building.
• Home occupation signs shall be wall mounted, and shall not exceed four square feet
in area. The sign cannot be internally illuminated, but may be indirectly illuminated.
Findings of Fact, Conclusions of Law, and Decision
6. Section 246-290-490 Washington Administrative Code requires that the City take
measures to ensure that contamination does not occur as a result of cross connection
with the water system. This is achieved by installing a Reduced Pressure Backflow
Assembly (RPBA) device at the water service.
CONCLUSIONS OF LAW
A. Section 18.12.080 Yelm Municipal Code allows the Site Plan Review Committee to
approve a home occupation when complies with all applicable development,
construction, and design standards of the Unified Development Code.
B. Tristan and Brittany Kenney have established that the request for ministerial review
approval can satisfy all criteria set forth in Chapter 18.65 YMC, meet all requirements of
the Moderate Density zoning classification, and meet all other requirements of the Yelm
Municipal Code. Therefore, the site plan should be approved subject to the following
conditions:
1. The applicant shall install a Reduced Pressure Backflow Assembly to protect the
City water service from contaminants.
2. The home occupation sign shall be wall mounted and not exceed 4 square feet.
C. A home occupation approval is effective upon approval. The home occupation permit
maybe be revoked upon determination that there has been a violation of any conditions
of approval or standards of the Unified Development code.
DECISION
The request for a home occupation approval is hereby granted subject to the conditions
contained in the conclusions above.
