Findings of Fact, Conclusions of Law, and Decision
FINDINGS OF FACT
1. Penske Truck Leasing Co., L.P. applied for a City of Yelm Business License on February 23,
2015 for a truck rental and leasing business at 801 Northern Pacific Road SE, Yelm, WA
98597.
2. Based on Thurston County Assessor information, the property is owned by Hytec, Inc out of
Dallas Texas. The property is approximately 26 acres in area and is identified by the Unified
Development Code, Chapter 18.30 YMC as being within the Industrial (I) zoning district.
3. The Industrial district is intended for industrial activities, to protect the industrial areas from
other uses which may interfere with the purpose of industrial uses, and to protect adjacent
areas from adverse or damaging impacts resulting from activities in the industrial areas.

4. Permitted uses in the Industrial district include manufacture, assembly and repair of goods
or products, assembly of manufactured products, warehousing and storage of equipment,
commodities and products, and accessory uses clearly subordinate to, and an integral part
of the primary use of the property. [Section 18.39.020 YMC]
5. Retail service activities are not identified in the Industrial district unless as an accessory use
subordinate to and an integral part of the primary use of the property.
CONCLUSIONS OF LAW
A. Section 18.10.020 YMC allows the Site Plan Review Committee to approve a proposal when
the site plan conforms to the standards, provisions and policies of the City as expressed in
its various adopted plans and ordinances.
B. The proposed use of the property for truck rental and leasing is not consistent with the
standards of the Industrial district and the Unified Development Code.

DECISION
The request for business license 11126 for truck rental and leasing located at 801 Northern
Pacific Road, SE, Yelm is hereby denied.
