described below have petitioned for annexation to the City of Yelm, / .".
WHEREAS, the City Council of Yelm has held a duly-noticed public hearing
regarding such annexation,.
WHEREAS, the City Council finds that such annexation is in the best interest of the
City and conforms with annexation policies of the City as set forth in the Comprehensive "-
Pian and Yelm Municipal Qode Chapter 2.66.

commUnICatIOn m our office and the final documents for the Morris Road annexation were not
dIstributed following the CIty Council's adoption of the annexatIOn ordmance. Also, yesterday
it came to my attentIOn that your office was not included on the final distribution matlmg hst.
We did send out the final documentation on the above referenced annexations approxImately

legals provIded where we don't have valid sIgnatures and we are mIssmg deeds wIth legals that
describe certam propertIes wIth valid sIgnatures I have made notes, and enclosed you WIll find
everythmg you sent. (So It can be sent back as an entire package)
Smce a legal deSCrIptIOn of the entire proposed annexatIOn area, or legal deSCrIptIOns of each
property mcluded Will need to be recorded WIth the actual annexatIOn, is It possible to have the
title company prepare the legal descnptIOns? I am assummg that all of these mdIVIduals deeds

Hannah E. Schmidt, as Trustee of the Hannah E. Schmidt Living Trost, as "Seller" and Loren C.
Schmidt, Kathy A. Schmidt, Roger F Schmidt and Cheryl A. Schmidt as "Buyers."
2. SALE AND LEGAL DESCRIPTION Seller agrees to sell to Buyers and Buyers agree to
purchase from Seller the following described real estate in Thurston County, State of Washington.

(b) PAYMENT OF AMOUNT FINANCED BY SELLER. Buyers agree to pay the
sum of $70,000 as follows:
$500 or more at buyers' option on or before the 1st day of January, 1998, including
interest from December 31, 1997 at the rate of 5% per annum on the declining balance
thereof, and a like amount or more on or before the 1st day of each and every month
thereafter until paid in full.
(c) Payments are applied first to interest and then to principal. Payments shall be made at
7920 340th Street East, Eatonville, Washington or such other place as the Seller may
hereafter indicate in writing.
4 FULFILLMENT DEED Upon payment of all amounts due Seller, Seller agrees to
deliver to Buyers a Quit Claim Deed in fulfillment of this Contract.
5 POSSESSION Buyers are entitled to possession of the property from and after the
date of this Contract, subject to any existing tenancies.
6. TAXES, ASSESSMENTS, AND UTILITY LIENS Buyers agree to pay by the date due all
taxes and assessments becoming a lien against the property after the date of this Contract. Buyers may
in good faith contest any such taxes or assessments so long as no forfeiture or sale of the property is
threatened as the result of such contest. Buyers agree to pay when due any utility charges which may
become liens superior to Seller's interest under this Contract. If real estate taxes and penalties are
assessed against the property subsequent to date of this Contract because of a change in use prior to the
date of this Contract for Open Space, Farm, Agricultural, or Timber classifications approved by the
County or because of a Senior Citizen's Declaration to Defer Property Taxes filed prior to tl'.e date of
this Contract, Buyers may demand in writing payment of such taxes and penalties within 30 days. If
payment is not made, Buyers may pay and deduct the amount thereof from the payments next becoming
due Seller under the Contract.
7 INSURANCE. Buyers agree to keep all buildings now or hereafter erected on the property
described herein continuously insured under fire and extended coverage policies in an amount not less
than the balance due Seller, or full insurable value, whichever is lower All policies shall be held by
the Seller and be in such companies as the Seller may approve and have loss payable first to any
holders of underlying encumbrances, then to Seller as their interests may appear and then to Buyers.
Buyers may within 30 days after loss negotiate a contract to substantially restore the premises to their
condition before the loss. If the insurance proceeds are sufficient to pay the contract price for
restoration or if the Buyers deposit in escrow any deficiency with instructions to apply the funds on the
restoration contract, the property shall be restored unless the underlying encumbrances provide
otherwise. Otherwise the amount collected under any insurance policy shall be applied upon any
amounts due hereunder in such order as the Seller shall determine. In the event of forfeiture, all rights
of Buyers in insurance policies then in force shall pass to Seller
8. NONPAYMENT OF TAXES, INSURANCE, AND UTlLmES CONSTITUTING LIENS If
Buyers fail to pay taxes or assessments, insurance premiums, or utility charges constituting liens prior
to Seller's interest under this Contract, Seller may pay such items and Buyers shall forthwith pay

Seller the amount thereof plus any costs and attorney's fees incurred in connection with making such
payment.
9 CONDmON OF PROPERTY Buyers accept the property in its present condition and
acknowledge that Seller, her agents, and subagents have made no represe!ltation or warranty
concerning the physical condition of the property or the uses to which it may be put other than as set
forth herein. Buyers agree to maintain the property in such condition as complies with all applicable
laws.
10. RISK OF LOSS. Buyers shall bear the risk of loss for destruction or condemnation of the
property Any such loss shall not relieve Buyers from any of Buyers' obligations pursuant to this
Contract.
11 WASTE. Buyers shall keep the property in good repair and shall not commit or suffer waste
or willful damage to or destruction of the property Buyers shall not remove commercial timber
without the written consent of Seller
12 AGRICULTURAL USE. If this property is to be used principally for agricultural purposes,
Buyers agree to conduct farm and livestock operations in accordance with good husbandry practices.
In the event a forfeiture action is instituted, Buyers consent to Seller's entry on the premises to take
any reasonable action to conserve soil, crops, trees, and livestock.
13. CONDEMNATION Seller and Buyers may each appear as owners of an interest in the
property in any action concerning condemnation of any part of the property Buyers may within 30
days after condemnation and removal of improvements, negotiate a contract to substantially restore the
premises to their condition before the removal. If the condemnation proceeds are sufficient to pay the
contract price for restoration or if the Buyers deposit in escrow any deficiency with instructions to
apply the funds on the restoration contract, the property shall be restored unless underlying
encumbrances provide otherwise. Otherwise, proceeds of the award shall be applied in payment of the
balance due on the purchase price, as Seller may direct.
14 DEFAULT If the Buyers fail to observe or perform any term, covenant, or condition of this
Contract, Seller may'
(a) Suit for Installments. Sue for any delinquent periodic payment; or
(b) Specific Performance, Sue for specific performance of any of Buyers' obligations
pursuant to this Contract; or
(c) Forfeit Buyers' Interest. Forfeit this Contract pursuant to Ch. 61.30, RCW, as it is
presently enacted and may hereafter be amended. The effect of such forfeiture includes: (i) all right,
title, and interest in the property of the Buyers and all persons claiming through the Buyers shall be
terminated; (ii) the Buyers' rights under the Contract shall be canceled, (Hi) all SUIDS previously paid
under the Contract shall belong to and be retained by the Seller or other person to whom paid and
entitled thereto; (iv) all improvements made to and unharvested crops on the property shall belong to
the Seller; and (v) Buyers shall be required to surrender possession of the property, improvements, and
unharvested crops to the Seller 10 days after the forfeiture.

(d) Acceleration of Balance Due. Give Buyers written notice demanding payment of said
delinquencies and payment of Seller's reasonable attorney's fees and costs incurred for services in
preparing and sending such Notice and stating that if payment pursuant to said Notice is not received
within thirty (30) days after the date said Notice is either deposited in the mail addressed to the Buyers
or personally delivered to the Buyers, the entire balance owing, including interest, will become
immediately due and payable. Seller may thereupon institute suit for payment of such balance,
interest, late charge, and reasonable attorneys' fees and costs.
(e) Judicial Foreclosure. Sue to foreclose this contract as a mortgage, in which event
Buyers may be liable for a deficiency
15 RECEIVER. If Seller has instituted any proceedings specified in Paragraph 14 and Buyers are
receiving rental or other income from the property, Buyers agree that the appointment of a receiver for
the property is necessary to protect Seller's interest.
16. BUYERS' REMEDY FOR SELLER'S DEFAULT If Seller fails to observe or perform any
term, covenant, or condition of this Contract, Buyers may, after 30 days' written notice to Seller,
institute suit for damages or specific performance unless the breaches designated in said notice are
cured.
17 NON-WAIVER. Failure of either party to insist upon strict performance of the other party's
obligations hereunder shall not be construed as a waiver of strict performance thereafter of all of the
other party's obligations hereunder and shall not prejudice any remedies as provided herein.
18. ATIORNEYS' FEES AND COSTS In the event of any breach of this Contract, the party
responsible for the breach agrees to pay reasonable attorney's fees and costs, including costs of service
of notices and title searches, incurred by the other party The prevailing party in any suit instituted
arising out of this Contract and in any forfeiture proceedings arising out of this Contract shall be
entitled to receive reasonable attorney's fees and costs incurred in such suit or proceedings.
19 NOTICES Notices shall be either personally served or shall be sent certified mail, return
receipt requested, and by regular first class mail to:

20. TIME FOR PERFORMANCE. Time is of the essence in performance of any obligations
pursuant to this Contract.
21 SUCCESSORS AND ASSIGNS. Subject to any restrictions against assignment, the provisions
of this Contract shall be binding on the heirs, successors, and assigns of the Seller and the Buyers.
22. ENTIRE AGREEMENT This Contract constitutes the entire agreement of the parties and
supersedes all prior agreements and understandings, written or oral. This Contract may be amended
only in writing executed by Seller and Buyers.

annexation boundary was expanded to included all of tax parcel 64303500400 and reduced to
exclude tax parcel 64300600401
I have enclosed copies of the legal documentation giving Elizabeth A. Sartain the authority to
sign in matters of the estate of Dorothy R. Hall Mr Otremba is away on vacation and I have
been unable to obtain the documentation verifying his authority to sign for Reuben Otremba.
However, I believe that with the reduction in the annexation boundary and the assessed value of
the annexation area, Mr Otremba's signature is not necessary to meet the signature requirement
of owners representing 60% of the assessed valuation of the property

7 Bernardean Broadous, Thurston Co. Prosecutor reported on the results of the Juvenile Diversion
Program. The program goal is to bring young offenders before a community accountability
board comprised of local volunteers within 12 days of arrest. Review of recidivism rates within
180 days showed a substantial drop in felony repeats. Misdemeanor re-offenses however,
showed only a small decrease.
Analysis of the misdemeanor data contributed to development of a new program. The "Choices"
program developed for sixth grade students is designed to teach them how to make smart choices
and avoid the consequences of criminal behavior The program focuses on accountability for
actions and educates students about criminal law and the consequences of criminal behaVIor
Yelm's Mill Pond was the ftrst schools to participate in the program.
Mayor Wolf thanked Ms. Broadous for taking the time to explain the programs and results in
detail.
8 Old Business:
a) Revision to Proposed Annexation boundary (ANX978208YL) WestlMiddle Rd. Cathie Carlson
explained that two of the properties included in the annexation lie within two different sections,
and that the boundary should be revised to either include or exclude the two effected properties.

9 New Business.
a) 1998 Economic Development Council Services Contract. Shelly Badger reported that the 1998
contract was similar to past contracts. The work plan presented an overview of specific goals for
the current year Council discussed actual benefits provided to Yelm as a participant to the
benefits provided to other jurisdictions. The Contract fee for 1998 is $3,000, the same as the
past years contract.
98-39 MOTION BY ADAM RIVAS AUTHORIZING THE MAYOR TO SIGN A CONTRACT FOR
SERVICES WITH THE ECONOMIC DEVELOPMENT COUNCIL. CARRIED
b) Proposed Amendments to Yelm's Concurrency Ordinance No. 580 (YMC15 40).
Cathie Carlson gave an overview of the proposed changes outlined in her March 5, 1998 Staff
Report. Issues identified since passage of the original ordinance include consideration of the
installment fee payment, and a formula for calculating credits for projects that create a
significant economic benefit to the community.
The proposal presented to Council recommended: 1 An update to Table I that merges projects
and creates a generalized category allowing Transportation Facility Charges to be used on
intersection improvements at the time of need. 2. Implementing a payment schedule that would
include interest on any TFC balance paid after occupancy 3. Approval of a formula for
determining TFC credits. 4 Including language authorizing the purchase of available right-of-
way for the Y -3 corridor
Following discussion Council requested preparation of a revision incorporating changes creating
a generalized category of intersection/realignment improvements; a Y -3 right-of-way purchase
authorization, a payment schedule for use only if the project doesn't require immediate
improvements; requiring TFC payment to begin at the time the building permit is issued, and the
TFC credit formula.
10 Reports:
a) Library
1) The librarian's written report for 2/98 was included in packets.
2) 2. Mayor Wolf reviewed the options contained in a letter from the Friends of the Library Option
One, which was not recommended by the Friends of the Library, was an expansion to the
present library Option Two, which was recommended, is to notify Timberland that the present
library space is required by the City and request that Timberland seek a suitable site adjacent to
city boundanes and budget for construction within the next 2-3 years.
Mayor Wolf expressed concern that if the recommended option was implemented, the City
would be left with no library Shelly Badger added that Timberland has hired an space planner
to evaluate existing space and recommend changes. Payment for the changes are being
discussed and there will probably be some costs to the City for adding a door
Mayor Wolf pointed out that while the City is cramped for space, we are adjusting. She added
that the size of the current library is adequate for the City's citizens. The problem is that 8,000
cards are issued to this library But that it is not really the responsibility of the 2400 people in
the City to provide the library for those 8,000 people.

The Yelm City Council received your notice of intent to commence annexation for the
above referenced parcel At the May 28, 1997, City Council meeting the Council
approved the notice of intent.
The next step involves both the applicant and city staff You, as the applicant need to
supply the City with a list of regist~red property owners for all tax parcelS within 300
feet of the annexation site and a completed Petition to Annex to the City of Yelm form
(enclosed) I have enclosedafbrm explaining how to obtain the list of property owners
and the format of the information When yoU submit the adjacent property owners list
and the completed Petition to Annex please include the annex application fee qf
$1,250'00
City staff Will begin an analysis of the proposed annexation The analysis will ihclude
elements such as inventory of existing infrastructure (roads, sewer lines, water 'lines
etc.),la~d use, comprehensive plan policies and the indebtedness the City will be
asSuming
Upon receipt of the application fee, adjacent property owners list, the Petition to Annex
and completion of the staff report, a 15 day comment period will begin At the ana of
the comment period the City Council will hold a public hearing to consider the
annexation petition. Upon approval of the petition by the City Council the City will
forward the information to the Thurston County Boundary Review Boardfbr their review
