WA 98499 City of Yelm Community Development Department 105 Yelm Avenue West Yelm, WA 98597 NOTICE IS HEREBY GIVEN pursuant to Section 18.18.030 YMC that your use of property and building within the City of Yelm and described below are in violation of provisions of the Yelm Zoning Code, Title 18 YMC and the provisions of the Yelm Building Code, Chapter 18.23 YMC, adopting the International Building Code. ALLEGATIONS OF FACT 1. Fawcett Street Storage, LLC owns property located at 925 Northern Pacific Road SE in Yelm, Washington. The property is occupied by an abandoned warehouse known as the Yelm Yeast Plant. 2. Fawcett Street Storage is a Limited Liability Corporation registered with the Washington State Secretary of State and Gary W. Ross is the registered agent of the corporation. 3. The Yeast Plant has been unoccupied for over 18 months and any use of the property must be in conformance with the provisions of the City's Unified Development Code — [Section 18.01.090 YMC]. 4. On Tuesday July 7, 2015, the Thurston County Narcotics Task Force served a search warrant on the premise and found the building was being used for a medical marijuana collective garden. 5. The property is located within an Industrial zoning district, which does not allow agricultural activities [Chapter 18.39 YMC]. 6. The property was previously owned by Innovative Wholesale Supply Company, who constructed improvements to the building without a building permit from the City of Yelm, in violation of Chapter 18.23 YMC. The building currently does not have a certificate of occupancy for any purpose. ALLEGATIONS OF LAW A. The above described real property is within the City of Yelm. B. Use of the property as a medical marijuana collective garden is not allowed in the Industrial zoning district. C. Occupancy of the building for human habitation and agricultural use without a Building Permit is in violation of Chapters 18.23 YMC and 51.50 WAC. IT IS ORDERED THAT Fawcett Street Storage shall cease the use of the property and use and occupancy of the building. Failure to comply with the terms of this notice of violation may result in further actions by the City of Yelm, including, but not limited to the issuance of additional civil penalties of up to $250.00 per day of violation or further enforcement action through a court of competent jurisdiction.
