AN ORDINANCE OF THE CITY OF YELM, ANNEXING PROPERTY,
COMMONLY KNOWN AS 9244 MT VIEW ROAD, TO THE CITY OF
YELM, WASHINGTON
WHEREAS, the record owners of at least sixty percent of the
value of the property described below have petitioned for
annexation to the City of Yelm,
WHEREAS, the Chairman of the Boundary Review Board has ordered
the annexation exempt from review by the Thurston County Boundary
Review Board
WHERK~S, the City Council of Yelm has held a duly-noticed
public hearing regarding such annexation,
WHEREAS, the City council finds that such annexation is in the
best interest of the City and conforms with annexation policles of
the City as set forth in the Comprehensive Plan and Yelm Munlcipal
code Chapter 2 66
NOW, THEREFORE, THE CITY COUNCIL OF YELM DOES ORDp_IN AS
FOLLOWS

hearing at 7 33 pm The time, place, and date were announced
and Mayor Wolf requested that conflicts, obJections to
participants and/or prior information be voiced No response
was given
Shelly Badger explained that this annexation was before
Councll six weeks ago for initial approval to proceed and that
Planning Commission approval was given at their last meeting
The annexation is withln the UGB, is contiguous and that city
services could be brought to the site A Boundary Review Board
waiver will be requested as the site is under ten acres
Jav Tribitt, applicant, expressed his appreciation for the
opportunity to annex
Mayor Wolf closed the public hearing at 7 35 pm

ANNEXATION 8165 AND THE REQUEST FOR A BOUNDARY REVIEW BOARD

Towing Contract - Robert Swy and Richard Averill expressed
concern that the new towlng contract was not awarded to B&H
Towing but was instead awarded to Bill's Towing
BlII Trull indicated that B&H Towing had the contract for the
past two years and that jurisdictional problems are
encountered by the courts when an lmpounded vehicle is stored
outside of the city
Followlng discussion Mayor Wolf explained that the City acted

in good faith and upon a staff recommendation in awarding the
contract Contracts had been submitted to both holders of
Yelm Business Licenses as a courtesy, and that as the contract
had been awarded within established guidelines and following
staff recommendation no change would be made However she
requested that Shelly Badger, Councilmember Parsons and Chief
Dunnam review procedures followed to determine if revisions to
the process should be considered

KEN GARMANN'S REQUEST TO PROCEED WITH THE TRPC GRANT

4) Police - Shelly Badger reported that the Thurston County
Emergency Operations Center had complemented the Police
Department for the smooth operations during the flood

together grant/loan applications for the State Centennial
Clean Water Fund and State Revolvlng Fund for startup money
for the project This would in effect begin a phasing process
with the treatment plant belng Phase I

Curry was thanked for attending the Governor's Heart Month

Mayor Wolf requested that a letter be prepared and sent to the
Fire Department and Nisqually Valley News expressing our
appreciation to the volunteers who responded during the recent
flooding situation and give who give up thelr time to respond
to flres wlthin this community

TO ANNEX TO THE CITY OF YELM
TO: THE CITY COUNCIL OF THE CITY OF YELM
We, the undersigned, being the owners of not less than Slxty (60%), in value
(according to the assessed valuation for general taxation) of the real property
descrlbed on Exhibit "A" attached hereto, do hereby petition that such territory
be annexed to and made a part of the City of Yelm under the provisions of Revised
Code of Washington Section 35A.14.120. This petition is accompanied by a map
which outlines the boundaries of the property sought to be annexed.
This page is a group of ~ pages containing an identical text and petition
intended by the signers of this petition to be presented and considered as one
petition and may be filed with other pages containing additional signatures which
cumulatively may be considered as a single petition.
The undersigned petition the City Council and ask:
1. That approprlate action be taken to entertain this petition, fixing a date
for a public hearing, causing notice to be published and posted, specifying the
time and place of such hearing, and inviting all persons interested to appear and
voice approval or disapproval of such annexation; and
2. That following such hearing and subsequent to approval of the Thurston County
Boundary Review Board if such is convened, the City Council determines by
Ordinance that such annexation shall be effective; and that property so annexed
shall become a part of the City of Yelm, Washington, subject to its laws and
ordinances then and thereafter in force.
The petitioners agree that all property within the territory hereby sought to be
annexed shall be assessed and taxed at the same rate and on the same basis as
property within the City of Yelm or any now outstanding indebtedness of said City,
including assessments or taxes in payments of any bonds issued or debts
contracted, prior to or existing at the date of annexat~on simulta~eous )With
annexation, and that the property shall be zoned as f5fd<urhl.J - & (((-fa and
governed by the zoning ordinance of the City of Yelm.

The undersigned are owners of not less than ten percent in value
according to the assessed valuation, of the property as described
below We hereby advise the City Council of the City of Yelm that
it is the desire of the undersigned property owners of that area to
commence annexation proceedings ~

PURPOSE. In considering annexation as a means of meeting community needs, it
is first necessary to establish definitive objectives and policies as an
official City position These objectives and policies can then become the
frameWDrk from which specific annexation requests can be reviewed and
evaluated.
SECI'ION 1. DEVELOPMENT OF UNIFDRM CRITERIA
The City of Yelm should develop unifonn criteria to use in evaluating
annexations.
A. Annexations shall comply with all requirerrents with respect to the City's
Annexation Ordinance No. 399. dated May 8. 1991.
B 'Ihe City should evaluate all annexations on the basis of their short- and
long-tenn comnunity impact. Annexations shall be consistent with City
plans for urban densities and uses within the urban area of the City and
to assure adequate financial capability of the annexed area to meet the
criteria for urban areas under SHB 2929 (the Washington State Growth
Managerrent Act) and SHB 1025.
C In response to SHB 2929, the City should, as a rrummJITl, analyze and
evaluate the condition and safety of all streets. the availability and
condition of public utilities and the demand for emergency services
(police. fire and medical) Public services and facilities to be
analyzed may include
1. Public areas;
2 Transportation needs;
3. Necessary utilities;
4 Side\\alks, =bs and lighting;
5 Recreational services (includes parks and open spaces);
6 Hurran services (health care, social services);
7 Developrrent of an urban center; and
8 Support a balance of housing. comrercial and public
recreational needs.
D. The City of Yelm may require the developrrent of a plan for public
transportation to serve the newly annexed area. When possible, plans
should be consistent with plans of Intercity Transit for public
transportation in South Thurston County.
E. Annexation of land should be directly dependent upon the City's ability
to provide. acquire, operate and maintain general services and utility
services. Annexation will take place only after the City is satisfied
that general services. utility re::;ources and necessary utility plan
capacity can be made available in a manner cost effective to the City.
F In order to accanplish the above. the City of Yelm has adopted Ordinance
No 399 to establish uniform annexation procedures
1 In addi tion to procedures s ta ted within Ordinance JIb. 399 ,
the City shall designate staff to perform the following
a. Receive and process annexation requests
b. Furnish the public and City officials with annexation
infornE tion.
c Prepare technical studies and assessments on the
impacts from annexation
2 The City may require property owners wi thin an annexing area to
assume a pro-rata share of the City's bonded indebtedness existing
at the tine of annexation.
3. The City may require impact fees and/or assessments as a condition
of annexation.
4. The City should cause a comprehensive plan andfor proposed

the area may be honored. provided it is consistent witll the
Comprehensive Plan. The zoning classificatiun speciti~d at tl~
time of annexation should be in effect for a reasonable period
of time after annexation, before a change in classification is
considered.
5 Prior to any annexation, the City should confer with affected
special districts and other jurisdictions to assess the impact
of annexation
6. The City ma.y require the applicant to prepare a report assessing
the probable short- and long-term financial, economic and social
impact fran annexations.
7 If the annexation is acceptable to the City, the City shall forward
reports, plans, studies and agreements of areas requesting
annexation to Thurston County and the Boundary Review Board
(when required) to facilitate processing.
SECI'ION 2. ANNEXATIONS TO MEET GOALS AND POLICIES
The City of Yelm should consider annexations that best rreet the growth goals
and policies of Yelm to include the goals of SHB 2929 and SHE 1025
A. The City ma.y, by Council approval, utilize the extension of utilities and
services to encourage and gutde needed and desirable urban growth,
provided that
1. The area served by water andfor sewer be subject to a contractual
arrangement wherein it is agreed that all utility improvements
meet City standards and that residents of the area to annex to
the City at such time as the City deems appropriate.
2. The owners of lands to be ~erved by such water and/or sewer
service agree to participate, financially, to the extent and
in the ma.nner agreeable to the City, in capital improvements
taking place, or projected to take place.
3. The owners of lands to be served by such water and/or sewer
service provide, when requested, by Local Improvement District
or other non-City funds, specified water and/or sewer supply,
transmission, distribution and storage facilities, inter-tied
with City systerrs. Ownership and control of such facilities
shall be transferred to the City following construction,
inspection and acceptance.
4. In those instances where extensions or improvements to City
water and/or sewer are provided, the City ma.y waive all or any
part of surcharges and/or utility charges which might otherwise
be applicable
SECI'ION 3. PRESERVATION OF NEIGHBORHOODS
The City of Yelm should consider annexations that preserve established
neighborhoods and corrmunity identity.
A. The City ma.y support individual area identity and citizen participation
within newly annexed areas by:
1. Adopting land use controls in newly annexed areas which favorable
characterize that particular area.
2. Encouraging and providing opportunities for a maximum degree of
citizen participation in governmental planning and decision-
ma.king processes.
SECI'ION 4. JURISorCI'IONAL CCOPERATION
The City of Yelm should cooperate with Thurston County
jurisdictions in addressing areawide comprehensive planning,
service provision to areas outside its corporate limits that are
its Urban Growth Management Boundary and Sphere of Influence.

boundaries but within its Sphere of Influence to ensure that land uses
are compatible with the Yelm Comprehensive Plan policies and land use
designations.
SECI'ION 5
ANNEXATION LEGISLATION
The City should encourage the provision of rrore favorable urban annexation
legislation to facilitate rrore orderly planning and growth of the City
A. The City should support state legislation which improves, simplifies, and
gives cities rrore authority in the annexation process.
B The City should support state legislation to simplify Boundary Review
Board procedures and otherwise make annexations easier, while complying
with the goals of SHB 2929 and SHE 1025.
C The City should participate with other municipalities in proposing
improved state legislation on annexation policy and procedure.
SECI'ION 6
ACCEPI'ANCE
A. The decision to annex a property is vested in the discretion of the Yelm
City Council. The acceptance of a Notice of Intent by the City
represents a ccmnitrrent by the City to process an annexation consistent
with the requirements of the Annexation Ordinance No 399 and the
annexation policies described above.
B. The decision to accept an annexation will depend upon the decision of the
Council that the applicant has adequately satisfied the requirements of
the annexation ordinance and these annexation policies Final acceptance
of the annexation is within the sole discretion of the City upon a
finding that the annexation, as proposed, is beneficial to the City and
consistent with the City's adopted plans and policies at the tine the
annexation request was considered for approval
SECI'ION 7. SEVERABILITY
If any provision of this chapter be held invalid, such invalidity shall not
affect any other provision, or the application thereof, which can be given
effect without the invalid provision or application, and to this and the
provisions of this ordinance are declared to be severable
SECTION 8
EFFECTIVE DATE
The City Council of Yelm determines that this Ordinance is essential for the
public health and safety of the community and shall take effect immediately
upon its passage and approval.

TO: THE CITY COUNCIL OF THE CITY OF YELM
We, the undersigned, being the owners of not less than sixty (60%), in value
(according to the assessed valuation for general taxation) of the real property
described on Exhibit "A" attached hereto, do hereby petition that such territory
be annexed to and made a part of the City of Yelm under the provisions of Revised
Code of Washington Section 35A.14.120. This petition is accompanied by a map
which outlines the boundaries of the property sought to be annexed.
This page is a group of pages containing an identical text and petition
intended by the signers of this petition to be presented and considered as one
petition and may be filed with other pages containing additional signatures which
cumulatively may be considered as a single petition.
The undersigned petition the City Council and ask:
1. That appropriate action be taken to entertain this petition, fixing a date
for a public hearing, causing notice to be published and posted, specifying the
time and place of such hearing, and inviting all persons interested to appear and
voice approval or disapproval of such annexation; and
2. That following such hearing and subsequent to approval of the Thurston County
Boundary Review Board if such is convened, the City Council determines by
Ordinance that such annexation shall be effective; and that property so annexed
shall become a part of the City of Yelm, Washington, subject to its laws and
ordinances then and thereafter in force.
The Petitioners agree that all property within the territory hereby sought to be
annexed shall be assessed and taxed at the same rate and on the same basis as
property within the City of Yelm or any now outstanding indebtedness of said City,
including assessments or taxes in payments of any bonds issued or debts
contracted, prior to or existing at the date of annexation simultaneous with
annexation, and that the property shall be zoned as and
governed by the zoning ordinance of the City of Yelm.

AN ORDINANCE OF THE CITY OF YELM, ANNEXING PROPERTY,
COMMONLY KNOWN AS 9244 MT VIEW ROAD, TO THE CITY OF
YELM, WASHINGTON
WHEREAS, the record owners of at least sixty percent of the
value of the property described below have petitioned for
annexation to the City of Yelm,
WHEREAS, the Chairman of the Boundary Review Board has ordered
the annexation exempt from review by the Thurston County Boundary
Review Board
WHEREAS, the City Council of Yelm has held a duly-noticed
public hearing regarding such annexation,
WHEREAS, the City council finds that such annexation is in the
best interest of the City and conforms with annexation pollcies of
the City as set forth in the Comprehensive Plan and Yelm Munlcipal
code Chapter 2 66 /
NOW, THEREFORE, THE CITY COUNCIL OF YELM DOES ORDAIN AS
FOLLOWS
