AN ORDINANCE ANNEXING CERTAIN TERRITORY TO THE CITY OF YELM~ WASHINGTON.

WHEREAS, the record owners of at least sixty percent of the value of the
property described below have petitioned for annexation to the City of Yelm,
WHEREAS, the City Council of Yelm has held a duly-noticed public hearing
regarding such annexation,
WHEREAS, the City Council finds that such annexation is in the best
interest of the City and conforms with annexation policies of the City as set
forth in the Comprehensive Plan and Yelm Municipal Code Chapter 2.66.
NOW, THEREFORE, THE CITY COUNCIL OF YELM DOES ORDAIN AS FOLLOWS:
Section 1. The following described territory is hereby annexed and made
a part of the City of Yelm:
Parcel A:
That portion of the Northwest one quarter of the Northeast one
quarter of Section 25, Township 17 North, Range 1 East W .M. ,
described as follows:
Beginning at the Northwest corner of the Northeast quarter of said
section, then North 89045'40~ East along the North line of said
Northeast quarter 213.00 feet, thence South 0025'05~ East 582.10
feet, thence South 81046' East 773.07 feet to the Northerly right
of way line of Northern Pacific Railroad, thence South 50034' West
along said right of way 1138.07 feet, thence North 9024 I West
591.71 feet, thence North 0025'05" West 831.61 feet to the point of
beginning. Excepting therefrom any railroad right of way in the
Southwest quarter of the Northeast quarter of said section.
Parcel B:
That portion of the Northwest one quarter of the Northeast one
quarter of Section 25, Township 17 North, Range 1 East, W .M. ,
described as follows:
Beginning at the Northwest corner of the Northeast quarter of said
Section 25, thence North 89045'40~ East along the North line of
said Northeast quarter 213.00 feet to the true point of beginning.
Thence continuing along the same course 303.37 feet, thence South

Section 3. The City Clerk shall record a copy of this Ordinance in the
Office of the County Auditor and file a certified copy with the Board of
County Commissioners.
Section 4. This Ordinance shall become effective on the 24th day of
August, 1994, being a date not less than five days following publication.

indebtedness of the City of Yelm and to pay said indebtedness shall
be assessed and taxed at the same rate and on the same basis as
other property within the City of Yelm.
Section 3. The City Clerk shall record a copy of this Ordinance in the
Office of the County Auditor and file a certified copy with the Board of
County Commissioners.
Section 4. This Ordinance shall become effective on the 24th day of
August, 1994, being a date not less than five days following publication.

I am writing in response to the notice of the impending annexation into the City
of Yelm of the property adjacent to me
Although I have no objection to the annexation itself, I am concerned over a
possible zoning change from R-5 to city lot subdivision
It would be my hope that after a master plan has been accomplished it will be
the Planning Commision's recommendation and the City Council's choice to develop
this property at It'S highest and best use! It is a beautiful piece of land with golf course
frontage, mountain view and groves of beautiful old trees.
Since it is also a main entry into the city I hope the development of it will be
done with sensitivity to the character and nature of the property and that the typical row
after row of high density city lots with "affordable" homes not be the destiny of this
particular piece of land
If however, higher density than R-5 is deemed appropriate I urge the
commission and council to require the developer to leave a natural existing buffer of
shrubs and trees of 100 feet along my property line This buffer would protect the
character and value of my property which as been developed over the last 8 years as
a rural estate
There is wetlands on one corner of the adjacent property and it is my
understanding that a 100 foot buffer is required for wetlands anyway, 50 a continuation
of this buffer along this same line to Hwy 507 seems appropriate
Thank you for your understanding and consideration of this matter It is of
utmost importance to me and my family

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF YELM
SETTING FORTH THE DECISION OF THE COUNCIL REGARDING A
NOTICE OF INTENT TO CIRCULATE A PETITION TO ANNEX CERTAIN
TERRITORY TO THE CITY OF YELM.
WHEREAS, the Yelm City Council has received the attached notice of
intent to commence annexation proceedings,
WHEREAS, pursuant to the procedures established by Revised Code of
Washington 35A.14.120 and Yelm Municipal Code Chapter 17.64, the
City Council has met with the initiating parties,
WHEREAS, the Council has duly considered said request to initiate
annexation,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF YELM DOES RESOLVE,
AS FOLLOWS:

Dear City of Yelm Resident:
You are probably aware that your property was recently annexed to the City of
Yelm. We at City Hall would like to welcome you and give you some basic
information on what being in the City means to you.
One of the most important issues for residents is that you are now permitted
to vote in City of Yelm elections and to run for an elected office. To run
for office you must be: 1) at least eighteen years of age, 2) a
registered voter, and 3) a resident, for one year, of the City or any
territory which has been annexed to the City.
You don't have to re-register to vote in City elections. Your polling place
will probably change so watch the paper jvoter pamphlet for details. _X,Ql.lwill,
also be receiving a letter or new voter registration card from the ~lections
section of the Thurston County Auditor's Office. You tan reach them'at 1,-800-
624-1234 ext. 5408 if you have questions, if your annexation occurs close to
an election" you will want to contact the Auditor for instructions. When you
go to your new polling place to vote, if you find that your name has not~ been
included on the rolls please request a questioned ballot. This. allows you to
vote, your address will be verified by the Thurston County Auditor's -Office
prior to counting your ballot. .
Current Yelm elected officials are: Mayor Kathy Wolf, Council: Amos Lawton,
Martha Parsons, Don Miller and Bob Gallagher. Mail may be directed to them
at the City Hall address shown above. You may also leave messages for
elected officials at City Hall.
The Yelm Planning Commission, Historic Preservation' Conunission,Parks
Advisory Committee, Library Board of Trustees and Historical Society members
are advisory committees to the City Council. positions are appointed by' the
mayor with council approval. If you would like more information about any of
these, please call City Hall,.
At some point in the future Yelm will assign a new addresses to your
property. We will notify you of the change and we will also notify Thurston
County Communications (911), utility companies, UPS, Thurston County Auditor
and the post office of the address change when it occurs.
Another change you will see following the readdressing is a change in your
garbage service. Current county~ick-uPI contracted with LeMay, will, change
to City service which is also with Lemay and includes residential recycling.
Yelm's annual "Spring Cleanup" is limited to City garbage customers-only and
the change would allow you to participate. City' garbage rates, are slightly

Police responie time is faster-within the City as officers ~re oB ~~ty
24 hours per day," have less land area to cover and are usually within
the-City limits'. Calls from county residents go out first to the
Thurston Co., Sheriff's Office, they have a much larger land area to
cover, after county notification Yelm P.D. will respond as/if needed.
Street standards are higher in the City.
Pedestrian areas-are required, in the City.
Permits would be handled locally, except for those requiring health
department approval i. e. septic.,
Fire protection remains unchanged.

Public Hearing - (ANX8099) Request to annex 40 acres located between
Railway St. and N.P. Rd., north of Middle Road. Public Hearing
opened at 7: 37 pm. Ty Peterson explained that this area lS
identified in the Comprehensive Plan as future industrial and that
at the 3/21/94 Public Hearing, the Planning Commission recommended
approval of the annexation request. Also recommended was R/A, 1-5
zoning, with the intent of looking at rezone potential at a later
date following completion of the revised Comprehensive Plan. The
Commission expressed its desire to see a portion of property used as
a buffer between industrial and residential if those zoning
designations were approved at a later date.
Being no public comment the Public Hearing was closed at 7:42 pm.

Public Hearing - (ANX8098) 15 acres located southwest of current city
limits between SR507 and the Nisqually Valley Golf Course. Public
Hearing opened at 8:02 pm. Ty Peterson explained that the Planning
Commission recommended approval of this annexation as RIA 1-5 zoning,
until the SWY annexation master plan is completed with rezone of the
property possible at that time.
Mayor Wolf asked if the Commission and staff had addressed concerns
stated in Ms. MacNaughton'S letter. Ty Peterson responded
affirmatively and indicated that the major concern was buffering and
indicated that the letter would be attached to any potential
proposals to that property.
Being no additional comment the Public Hearing was closed at 8:07 pm.
Councilmember Forrester requested that the record reflect her intent
to abstain from voting due to conversations concerning this issue.

Hearings. Ty Peterson reported that his bi-monthly report would be
ready in approximately two weeks. Shelly Badger explained that while
there had been a slack period, an increase in construction has begun
and proJects on the board include three subdivisions proposals with
200 plats proposed.

circulation but continuing registration of new patrons.

van and convertible had been taken to auction and explained that
Chief Dunnam was requesting approval of two positions,
administrative sergeant and patrol sergeant. The positions
would be used as career development tools and would not preclude
officers from regular duties or responsibilities.

4) Public Works - Councilmember Lawton reported that three
cottonwood trees need to be removed from city right-of-way. Two
trees located on Mosman SE would be removed by city staff. A
bid of $95 has been submitted by Mac's Tree Service to remove
the tree on VanTrump NW. Also discussed was staff limitations
due to the way the current ordinance is written. Approval is
currently required for removal of any shrub or tree. Suggested
revisions will be submitted in the near future.
When questioned staff responded that as of this time McDonald's
had not replaced two trees removed during construction.

Shelly Badger to discuss the possibility of adding a Public Works
Director position, information was distributed. Funds budgeted for
the assistant engineer's position would be used to defray costs.
Council input was requested.
Meetings attended included one to discuss mitigation fees imposed by
the school, Thurston Regional Planning Council, Mayor's Forum, Fire
District representative re Medic 1, and Transportation Advisory Board
(TRPC) for Bob Gallagher.
e. Council Report - Councilmember Forrester reported that she had
visited the Senior Center.

f. Sewer Update - Shelly Badger reported that three responses to
Yelm's request for qualifications for engineering services had been
received and reviewed. Staff recommended that Skillings and Connolly
be selected because of their knowledge of Yelm and their experience
working with funding agencies involved in the project.
