L ""'i-'~j 1~ ): :~l; ....(} ;..' f: ... ~ ' ~ ....i, 'i ,1 :-. :11. l.X~ ..::,.rj ~~~ A, AN ORDINANCE ANNEXING CERTAIN TERRITORY TO THE CITY OF YELM~ WASHINGTON. ;}l WHEREAS, the record owners of at least sixty percent of the value of the property described below have petitioned for annexation to the City of Yelm, WHEREAS, the City Council of Yelm has held a duly-noticed public hearing regarding such annexation, WHEREAS, the City Council finds that such annexation is in the best interest of the City and conforms with annexation policies of the City as set forth in the Comprehensive Plan and Yelm Municipal Code Chapter 2.66. NOW, THEREFORE, THE CITY COUNCIL OF YELM DOES ORDAIN AS FOLLOWS: Section 1. Sherrill MacNaughton I am writing in response to the notice of the impending annexation into the City of Yelm of the property adjacent to me Although I have no objection to the annexation itself, I am concerned over a possible zoning change from R-5 to city lot subdivision It would be my hope that after a master plan has been accomplished it will be the Planning Commision's recommendation and the City Council's choice to develop this property at It'S highest and best use! It is a beautiful piece of land with golf course frontage, mountain view and groves of beautiful old trees. We at City Hall would like to welcome you and give you some basic information on what being in the City means to you. One of the most important issues for residents is that you are now permitted to vote in City of Yelm elections and to run for an elected office. To run for office you must be: 1) at least eighteen years of age, 2) a registered voter, and 3) a resident, for one year, of the City or any territory which has been annexed to the City. You don't have to re-register to vote in City elections. Your polling place will probably change so watch the paper jvoter pamphlet for details. _X,Ql.lwill, also be receiving a letter or new voter registration card from the ~lections section of the Thurston County Auditor's Office. Public Hearing - (ANX8099) Request to annex 40 acres located between Railway St. and N.P. Rd., north of Middle Road. Public Hearing opened at 7: 37 pm. Ty Peterson explained that this area lS identified in the Comprehensive Plan as future industrial and that at the 3/21/94 Public Hearing, the Planning Commission recommended approval of the annexation request. Also recommended was R/A, 1-5 zoning, with the intent of looking at rezone potential at a later date following completion of the revised Comprehensive Plan. The Commission expressed its desire to see a portion of property used as a buffer between industrial and residential if those zoning designations were approved at a later date. Being no public comment the Public Hearing was closed at 7:42 pm. Mayor Wolf asked if the Commission and staff had addressed concerns stated in Ms. MacNaughton'S letter. Ty Peterson responded affirmatively and indicated that the major concern was buffering and indicated that the letter would be attached to any potential proposals to that property. Being no additional comment the Public Hearing was closed at 8:07 pm. Councilmember Forrester requested that the record reflect her intent to abstain from voting due to conversations concerning this issue. MOTION CARRIED. 94-59 4) Public Works - Councilmember Lawton reported that three cottonwood trees need to be removed from city right-of-way. Two trees located on Mosman SE would be removed by city staff. A bid of $95 has been submitted by Mac's Tree Service to remove the tree on VanTrump NW. Also discussed was staff limitations due to the way the current ordinance is written. Approval is currently required for removal of any shrub or tree. Suggested revisions will be submitted in the near future. When questioned staff responded that as of this time McDonald's had not replaced two trees removed during construction. 94-61 MOTION BY MARTHA PARSONS, SECONDED BY AMOS LAWTON APPROVING REMOVAL OF TWO TREES ON MOSMAN SE AND ONE ON VAN TRUMP NW. Mayor's Report Mayor Wolf, as a point of information, indicated that she would be meeting with Councilmember Lawton and Shelly Badger to discuss the possibility of adding a Public Works Director position, information was distributed. Funds budgeted for the assistant engineer's position would be used to defray costs. Council input was requested. Meetings attended included one to discuss mitigation fees imposed by the school, Thurston Regional Planning Council, Mayor's Forum, Fire District representative re Medic 1, and Transportation Advisory Board (TRPC) for Bob Gallagher. e. Sewer Update - Shelly Badger reported that three responses to Yelm's request for qualifications for engineering services had been received and reviewed.
