Dear Shelly.
Last week I spoke wIth Ken Garmann, Pubhc Works Director, and got an update on
the available capacIty of the CIty'S sewer treatment plant. Ken mentIoned that
there were approximately 150,000 gallons per day available out of the total
treatment plant capacIty of 300;000 gallons per day
Based upon thl8 good news, our chents have notified us of therr intentions to proceed
WIth a prehmmary plat proposal for therr 30 acre ownershIp We understand that
WIth the upcoming adoptIon of the City's comprehensIve plan in February the zonmg
of the Lorrmar property will change from the interim agricultural 1 umt per 5 acres
to resIdential 4 umts per acre. In VIew of thIS, we will be submItting plans for a
project WIth 80 to 110 smgle family umts.
It IS our understandmg that, WIth the approval of a prehmmary plat, the needed
ERU's sewer capacIty, is reserved for that project for the duration of the preliminary
approval, generally three years. Or, an owner can pay the general facility fees, at
$1,000 per ERU, and the sewer capacIty would be reserved for that property forever
Please let me know if my understandmg IS not completely accurate.
With thIS m mmd, we will be workmg toward a presubmlsslon conference WIth the
CIty and eventually to a preliminary plat submIttal. The purpose of thIS letter 18 to
inform the CIty of our plans and our desire to reserve the needed sewer capacIty for
thl8 project.

AN ORDINANCE ANNEXING CERTAIN TERRITORY TO THE CITY OF YELM,
WASHINGTON AND AMENDING THE YELM ZONING MAP AND COMPREHENSIVE PLAN.
WHEREAS, the record owners of at least sixty percent of the
value of the property described below have petitioned for
annexation to the City of Yelm,
WHEREAS, the City Council of Yelm has held a duly-noticed
public hearing regarding such annexation,
WHEREAS, the City Council finds that such annexation is in the
best interest of the City and conforms with annexation policies of
the City as set forth in the Comprehensive Plan and Yelm Municipal
Code Chapter 2.66.
NOW, THEREFORE, THE CITY COUNCIL OF YELM DOES ORDAIN AS
FOLLOWS:
Section 1. The following described real property situated in
Sections 17, 18, 19, and 20, Township 17 North, Range 2 East, W.M.,
Thurston County, State of Washington, to-wit:
That portion of the plat of McKenna Irrigated Tracts as
recorded in volume 9 of plats, Page 43, records of Thurston
County, Washington, lying northeasterly of Lot 2, in block 9,
and northwesterly of the southeasterly right-of-way line of
the Burlington Northern Railroad.
Also:
That portion of said Section 17, lying southerly of the right
of way of the Centralia Power Canal and northwesterly of the
southeasterly line of the Burlington Northern Railroad right-
of-way.
Also:
That portlon of the East Half of the Southeast Quarter of sald
Section 18 lying southerly of the Centralia Power Canal and
northeasterly of the southwesterly right-of-way line of Canal
Road.
In Thurston County, Washington.

Section 3. The Comprehensive Plan and Yelm Zoning Map be
and are hereby amended to incorporate the provisions of this
Ordinance.
Section 4. Said property shall be subject to the existing
indebtedness of the City of Yelm and to pay said indebtedness shall
be assessed and taxed at the same rate and on the same basis as
other property within the City of Yelm.
Section 5. The City Clerk shall record a copy of this
Ordinance in the Office of the County Auditor and file a certified
copy with the Board of County C6mmissioners.
Section 6. This Ordinance shall become effective on the
6th day of December, 1994, being a date not less than five days
following publication.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF YELM
SETTING FORTH THE DECISION OF THE COUNCIL REGARDING A
NOTICE OF INTENT TO CIRCULATE A PETITION TO ANNEX CERTAIN
TERRITORY TO THE CITY OF YELM.
WHEREAS, the Yelm City Council has received the attached notice of
intent to commence annexation proceedings,
WHEREAS, pursuant to the procedures established by Revised Code of
Washington 35A.14.120 and Yelm Municipal Code Chapter 17.64, the
City Council has met with the initiating parties,
WHEREAS, the Council has duly considered said request to initiate
annexation,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF YELM DOES RESOLVE,
AS FOLLOWS:
Section 1 - Decision. That the Council hereby [accepts / rejects
/accepts with modifications ] the proposal to initiate annexation
and [ does / does not ] grant the initiating parties permission to
circulate a final petition to annex.
Section 2 - Comprehensive Plan and Zoning. That the Council [ will
/ will not] requrie the simultaneous adoption of proposed zoning
and comprehensive plan use designations for the area to be annexed.
(If zoning and plan designations are requried such requirement must
be clearly indicated in the final petition.)
Section 3 - Assumption of City Indebtedness. That the Council
[ will/will not] require the assumption of a proportionate
share of existing city indebtedness by the area to be annexed. (If
assumption of debt is required such requirement must be clearly
indicated in the final petition.)
Section 4_= Local Improvement District. That the Council [will
/~ill no~]~require simultaneous formation of or consent to be
inc~uded-wifhin a local improvement district.
SEction 5 - Water and Sewer District. That the Council [will /

requried by the City to evaluate the proposal In accordance with
Chapter 2.66 of the Yelm Municipal Code must be presented to the

deSignated growth area boundary ThIS boundary encompasses an area

accommodate the growth which can be accomphshed cost effectIvely and
efficIently The current County zOlllng deSignatIOn for your property IS Rural
Resldentwl1l5 Under tillS zonmg, you can contmue to use your property the
way you are currently uSll1g It (thiS IS called "grandfathered rights") or you can
subdIvide It Il1to Il1dlvIdual 5 acre tracts to be sold
However, If your property IS annexed to the city you will have more optwns m
what you can do with It. The most Important thmg IS that you WIll still
mamtam your "gramlfathered rIghts" and can contmue to use your property
exactly the way you are now for as long as you or your heIrs WIsh. But, you
will now also have the optlOn of convertmg your land to a more mtense urban
type use whIch could prOVide slgmficant financial benefits for you.

After going through the preliminary process, the city council and City
Planning staff have indicated specific properties that should be included
in the annexation area. After some discussion with the City Planner, it
was determined that your property should be included in the annexation with
a zoning designation of RA RESIDENTIAL AGRICULTURAL. Kindly note on the
enclosed map that the green area would be proposed to be zoned RESIDENTIAL
AGRICULTURAL. The blue area is proposed to be zoned residential for the
purpose of developing a quality single family living area after approval by
the City of Yelm.
I have enclosed a pamphlet from the City of Yelm along with a photo copy
of the City's zoning requirements for RESIDENTIAL AGRICULTURAL. This
pamphlet answers most of the questions that you may have regarding the
proposed annexation to the City. Should you have more I will be calling
you within the next week to help with any questions or concerns.
This zoning designation (copy enclosed) is not restrictive and allows you
to use your land in the same manner that you are now using it. It is also
consistent with the Thurston County zoning Residential 5 Acre which is your
current zoning and would not change unless it was approved by the Yelm city
Council. As there would be no change to your ability to use your land we
would like your help in completing the City of Yelm annexation request.
Vinnie and Leonard Julson, who own property on the other side of Wilkenson
Road, have already joined us in the annexation process, so you may want to
call them with any questions.

SUBJECT: Staff Report for Canal Rd Annexation
PROPOSAL
The City first received petition for annexation in this area over
a year ago A resolution was passed and the Commission/Council
directed the applicant to pursue annexation of the entire araa
between the City limits and the canal, northeast of the railroad
tracks (see map) Since then the applicant has been pursuing the
necessary signatures to do this
In June, the applicant resubmitted the annexation request for the
proposed area (see map) The City met with the applicant to
discuss the boundary and future zoning At that time, the
applicant presented information and evidence supporting that they
had exhausted all reasonable efforts to contact the property
owners and convince them to join the annexation The applicant
is requesting that the property adjacent to the City and on the
east side of canal Rd be zoned Industrial The remaining
property be zoned R-1 Single-Family
RECm-1f'.1ENDA TION
The issue regarding 'irregular or -illogical" boundaries is upon
us once again The Planning Department recognizes the potential
hazards of creating boundaries that are not easily identified,
(police protection, road crews etc ) and goal to square up"
boundaries when possible However, in light of the Growth
Management Act(GMA) and the Urban Growth Boundar)(UG8), this
proposal could be construed asa step in filling the already
established future boundary of the City corporate limits
After finding that the applicant did indeed make a thorough
attempt at trying tc convince the other property owners to annex,
the current proposal is contiguous to the existing City limits.
the petition represents 100% of property owne~s in the proposed
area, and the established Interim Urban Growth Boundary, the
Planning Department recommends approval of the annexation
Furthermore, The Planning Department recommends Industrial zQning
to property between Canal Rd and City limits The remaining
area is not included in the Ci~s Sewer Service Boundary,
therefore should retain a Resi~tial Agricultural 1-5 Zoning, at
least until the City's Compr~~~~~e Plan is adopted and Sewer
Boundary extended

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF YELM SETTING
FORTH THE DECISION OF THE COUNCIL REGARDING A NOTICE OF
INTENT TO CIRCULATE A PETITION TO ANNEX CERTAIN TERRITORY TO
THE CITY OF YELM
WHEREAS, the Yelm City Council has received the attached notice of
intent to commence annexation proceedings,
WHEREAS, pursuant to the procedures establ ished by Revised Code of
Washington 35A 14 120 and Yelm Municipal Code Chapter 17 64, the City
Council has met with the initIating parties,
WHEREAS, the Council has duly considered said request to initiate
annexation,
Now, Therefore, THE CITY COUNCIL OF THE CITY OF YELH DOES RESOLVE, AS
FOLLOWS
Section 1 - Decision, ~ at the Council hereby [ accept~ I rejects /
