17.84.010 (A) Site Plan Review
ALLEGATIONS OF FACT
1. On May 1, 2014 you were contacted by letter from the City of Yelm informing you of the need bring your
site into compliance to continue to use your property for fraternal meetings. See attached letter.
2. James M Eagan is the owner of 106 Yelm Avenue West, described as parcel number 85800100100,

ALLEGATIONS OF LAW
1. The above described property is with the City of Yelm
The above described property is Zoned CBD with its current use as a Service Retail.
To date the owner has not brought the site into compliance with the letter of May 1, 2014.
IT IS ORDERED THAT within 15 days of receipt of this notice James M Eagan submit for a presubmission Meeting
and begin the process of Site Plan Review or stop the use of the property as a meeting for a fraternal
organization..
Failure to comply with the terms of this notice of violations by stated time may result in further actions by the City
of Yelm, including, but not limited to the issuance of civil penalties of up to $250.00 per day of violation or further
enforcement action through court of competent jurisdiction.

Re: Use of a Travel Trailer as a Residence
Mr. Eagan,
The City of Yelm has received complaints again that a travel trailer located on your site
at 106 Yelm Avenue West is being used as a residence.
The use of any structure or vehicle as a residence must under State and Local laws meet
minimum requirements for habitation. Specifically heat, connected to domestic water
and sanitation services and provisions for trash removal.
Further more the use of a new residence is allowed in the Central Business district, your
zoning: however it must meet the requirements of the residential zones. Chapter
17.57.060 (C) of the Yelm Municipal Code prohibits the use of a recreational vehicle as
living quarters.
Please halt the use of the travel trailer as a residence. If you have any questions or I

Re: Use of 106 Yelm Ave W as motor cycle club house
Mr. Eagan,
The property located at 106 Yelm Avenue West is being used as meeting place for a
motor cycle club. The use of your property has been for tattoo parlor which is a service
industry business. The use of your property as a motor cycle club house is allowed in the
Central Business District as a fraternal organization. However, such a change in use from
a service to a fraternal organization will require site plan review.
As you are aware from past conversations site plan review will bring your non
conforming site and buildings into conformance with current code standards.
If you intend to use 106 Yelm Avenue West as a motor cycle club house attached is a
pre submission meeting application. The pre submission meeting will describe the
process of site plan review and the requirements to bring the site up to current code
standards.
If you do not intend to proceed with site plan review then replace the motor cycle club
house with a service industry such as the tattoo parlors.
