YELM WASHINGTON October 9, 2014 C &E Development PO Box 2983 Yelm, WA 98597 City of Yelm Community Development Department 105 Yelm Avenue West Yelm, WA 98597 NOTICE IS HEREBY GIVEN pursuant to Chapter 1.16 of the Yelm Municipal Code (YMC) that the residence within the City of Yelm described below is in violation provisions of Chapter 17.18 of the YMC for permitted uses. ALLEGATIONS OF FACT 1. C & E Developments, LLC is the owner of Thurston County Assessor's Parcel number 75300800100 addressed as 315 Washington Ave. SW, abbreviated legal description: Section 19 Township 17 Range 2E Plat SOLBERGS FIRST ADDITION TO YELM BLK 8 LT 1 -2- 3 Document 009/031 2. The above described property is within the City of Yelm and zoned High Density Residential District (R -14). 3. Section 17.18.020 YMC lists specific permitted uses in the High Density Residential District. 4. Section 17.18.020 (B) (1) YMC accessory buildings or structures clearly incidental to the residential use of the lot is permitted. 5. Section 17.18.020 YMC does not specify outdoor construction material storage, construction warehousing, outdoor construction equipment storage or repair as a permitted use. 6. C & E Development, LLC was notified by U. S Mail on April 21, 2014 regarding R -14 zoning violations for the outdoor storage of a Dump truck, utility trailers and a roller compactor. 7. Furthermore, C & E Development, LLC was notified by U S Mail on September 23, 2014 of continuing R -14 zoning violations for the outdoor storage and repair of an excavator. 8. To date C & E Development continues use of the site not permitted by the Chapter 17.18 YMC. ALLEGATIONS OF LAW A. The above described real property is within the City of Yelm. B. C & E Development, LLC per Section 1.16.020 (B) YMC failed to comply with notices or orders pursuant to this chapter and continues use of the property not permitted by Chapter 17.18 YMC. IT IS ORDERED THAT within 7 calendar days of the date of this notice, C & E Development, LLC remove from the property Thurston County Assessor lists as Parcel number 75300800100, addressed as 315 Washington Ave. SW all construction related activity and material. Failure to comply with the terms of this notice of violation may result in further actions by the City of Yelm, including, but not limited to the issuance of additional civil penalties of up to $250.00 per day of violation or further enforcement action through a court of competent jurisdiction. The written appeal must be include the name and mailing address of the petitioner, a separate and concise statement of each error alleged to have been committed, and a concise statement of facts upon which the petitioner relies to sustain the statement of error. 2
