ORDINANCE NO. ~
AN ORDINANCE ANNEXING CERTAIN TERRITORY TO THE CITY OF YELM,
WASHINGTON
WHEREAS, th~ record owners of at least sixty percent of the
value of the property described below have petitioned for
annexation to the City of Yelm,
WHEREAS, the City Council of Yelm has held a duly-noticed
public hearing regarding such annexation,
WHEREAS, the City Council finds that such annexation is in the
best interest of the City and conforms with annexation policies of
the City as set forth in the Comprehensive Plan and Yelm Municipal
Code Chapter 2 66
NOW, THEREFORE, THE CITY COUNCIL OF YELM DOES ORDAIN AS.
FOLLOWS
Section 1 The following described territory is hereby
annexed and made a part of the City of Yelm
Lots 5 of Block 35, excepting therefrom the North 290
feet thereof and Lots 9 through 14, inclusive of Block 36
in the Plat of McKenna Irrigated Tracts Parcels 2, 3
and 4 of Short Subdivision No SS-024, Parcell of Short
Subdivision No SS-1733 and all that part of Railway Road
SE lying adjacent on the North of said Lots 11 through 14
of said Block 36, and lying within the Northerly and
Southerly right of way margins as extended Easterly to
the Westerly boundary of said Parcel 1 of Short
Subdivision No SS-1733
Section 2 Said property shall be subject to the existing
indebtedness of the City of Yelm and to pay said indebtedness shall
be assessed and taxed at the same rate and on the same basis as
other property within the City of Yelm..
Section 3 Upon annexation said property shall be zoned and
the zoning map of Yelm amended as follows.
All properties abutting Middle Road are to be zoned
Single-Family Residential (R-1) All properties abutting
Railway Road are to be zoned Residential Agricultural
(RA) 1-5
Section 3 The City Clerk shall record a copy of this
Ordinance in the Office of the County Auditor and file a certified
copy with the Board of County Commissioners.
Section 4. This Ordinance shall become effective on the 11th
day of May, 1993, being a date not less than five days following

The following documents must be returned wIth an annexation certIficate before the
annexation can be processed (RCW 3513.260 and 35A.14 700)

J~. Three copies of the final ordinance containing the legal descnption of the annexed
territory
~ Three maps of the annexed area. The maps must conform to acceptable engineering
standards, including directional arrow, scale, properly desIgnated streets, highways,
railroads, rivers, blocks, and other physical characteristics relevant to the territory and
boundaries of the annexed area. Clearly mark the existing municipal limits and outline the
annexation boundaries in red.

Re Planning Commission Recomendations
The Planning Commission has the following recommendations
with regard to items on the Council's January 27th agenda
Yelm Creek/Middle Road Annexation and ZoninQ (ANX-8042)
Properties northeast of Middle Road should be deleted from
annexation are to provide logical and clean boundaries
Wood and Grinder property to remain in five-acre zoning
Prairie Creek Preliminary Plat (SUB-8079)
A variance is recommended to permit siting of the "stub
roads as proposed within 200 feet of intersections
Sidewalk construction as each lot is built upon is
acceptable Frontage improvements along Middle Road,
including utilities, is also recommended An access waiver
should be provided to the City for lots along Middle Road
The road cross-section must comply with Yelm's urban
standards The stormwater pond with a depth of two feet or
less should be permitted within the wetland buffer area
Appropriate covenants should be provlded to ensure that
wetlands buffer areas remain vegetated Engineering detail
as required by the city engineer should be provided

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF YELM EXPRESSING
THE INTENT OF THE COUNCIL WITH RESPECT TO THE ANNEXATION PETITION
PRESENTED FOR PROPERTY ADJACENT TO RAILWAY AND MIDDLE ROADS
WHEREAS, Season's Development Company and others have petitioned
for annexation of property as described in amended Yelm
resolution #240,
WHEREAS, said petition includes the signatures of the record
owners of over 60% of the value of the described area,
WHEREAS, the Council finds that this proposal forms a set of
logical properties for road and utility service
WHEREAS, this property lies within the proposed urban growth area
of the City of Yelm, and
WHEREAS, the Planning Commission has held public hearings and
recommends that those properties abutting Middle Road should be
zoned as single family residential (R-1) and the those properties
abutting Railway Road (lots 11 through 15) should be zoned as
Residential Agriculture Five-Acre (RA-5
NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF YELM DOES
RESOLVE, AS FOLLOWS
Section 1 It is the intent of the City of Yelm to annex that
property depicted upon the attached map and including all
adjacent public rights-of-way
Section 2. That the Thurston County Boundary Review Board shall
be notifed of said intent Upon receipt of approval of the Board
it is the intent of the Council to adopt an ordinance implement-
ing the above express intent and to zone said property as
recommended by the Planning Commission
Section 3. That the Yelm Comprehensive Plan Map shall be amended
to designate the first listed parcels as single-family
residential
Section 4. That consistent with the policies of the City of
Yelm, all pending or subsequent development proposals within said
area, including that preliminary plat known as Prairie Creek
shall not be considered vested pursuant to RCW 58 17 033 until
such time as this annexation is final Accordingly such
applications shall be not be considered complete and shall be
subject to any changes in City standards, regulations, codes or
ordinances during the intervening period

Thank you for the opportunity to comment on the Praine Creek Preliminary Plat.
From a transportation perspective, this proposal could be improved in several ways.
An additional access point to the development would make the transportation system
work not just for cars, but for people using alternatives. Pedestrian pathways between
some lots or at least sidewalks along the streets would provide for better access to
potential future bus service along Middle Road. We would also encourage the
placement of a concrete pad southeast of the entrance instersectlOn with Middle Road,
so that in the future the transit stop WIll be wheelchaIr accessible and shelter
installation will be possible.
As development proceeds in this area, we would be happy to provi~e additional
information and input. Please keep us apprised of its progress, 1'1.1

Yelm Creek Annexation - Prairie Creek Subdivision
(ANX-8042)/(SUB-8079)
Issues identified by the city staff (thus far) for consideration by
the Planning Commission:
(1) Should Single-Family Zoning be applied throughout the area?
Note that the Yelm Comprehensive Plan designates the Wood
property for industrial use
(2) 'Stub' roads of Prairie Creek to the northwest and southeast
are not well located Yelm's subdivision standards require at
least a 200-foot centerline separation for intersections The
staff recommends locations nearer Yelm Creek in mid-block
further from the intersections Should they be dedicated?
Need they be constructed?
(3) Timing of sidewalk construction Should sidewalks be required
for final plat approval or in association with building
construction A policy issue not resolved by Yelm's
subdivision ordinance (Please consider commercial
subdivisions as well)
(4) Should an access waiver be required for lots along Middle
Road? (Technically not required by transportation plan)
(5) Note: applicant proposes Thurston County rural local street
standard instead of Yelm urban local standard; an apparent
oversight
(6) Applicant proposes stormwater ponds within wetland buffer
area This use is not provided for by Yelm's critical areas
ordinance, nor is it specifically prohibited. Vegetation is
required in buffer areas A policy should be established.
(7) Provisions are needed to ensure that wetland buffer area
remains in vegetation; especially where in private lots.
(8) Additional engineering details and revision format will be
needed for the staff to complete preliminary plat review.
Dennis Cochran, city engineer, will confer with the applicant
regarding these details.

HIGHWAY 507 ANNEXATION AND ZONING
& DETERMINATION OF NONSIGNIFICANCE
The Yelm City Council and the Yelm Planning Commission will each
hold a public hearing regarding a proposal to annex and zone
approximately 120 acres extending about thre-quarters of a mile
east Creek Street and north of Highway 507 to 103rd Avenue, and
lying on either side of Grove Road but not including Tranquility
Lane subdivision, and to amend the Yelm Comprehensive Plan
accordingely The Planning Commisison will hold its hearing at
4 00 P m on Monday, January 25, 1993 The Ci ty Counci 1 wi 11
hold its hearing at 7 30 p m on Wednesday, January 27, 1993
These hearings will be held to receive comments on a proposal to
annex Lots 4 through 11 of Block 31 of the McKenna Irrigated
Tracts and all of that portion of Block 34 now lying outside the
city limits The petitioners propose that upon annexation that
portion of the property lying west of Yelm Creek would be zoned
as Commercial (C-1), the remaining area within 900 feet of the
centerline of Highway 507 would be zoned as low-traffic

50 acres lying south of Railway Road and northeast of Yelm Creek

SUBJECT: Projected annexation
Dear Sir;
This is in response to your letter dated November 24, 1992 and received
December 2, 1992. The time-gap is puzzling. The said letter does not
give sufficient time for a property owner to respond nor attend at this

We wish to object very strenuously to any proposal of annexation into
the City of Yelm. We have not now nor have we ever broached the subject
of having our land annexed. We moved to our present 10 Acre site in
June, 1972 with the express understanding that we were purchasing farm
land and the land was coded as such at that time. We came to Yelm with
several sheep and Shetland ponies.
Several years later, while we still owned sheep and ponies, the planning
commission notified all neighboring land owners there was a plan being
considered for the building of five (5) low-cost houses on a two-acre
plot. At that time, approximately 30 land owners signed a petition as
being against the proposal. The petition was ignored and four houses
were erected over a period of a couple of years.
Then came the occasion of the Zoning Commission and their proposals.
We were invited to attend a re-zoning meeting to view the proposals as
set forth by the Zoning Commission and to present our views. After
several hours in the meeting, it was quite evident that they were there
just to TELL all concerned that "this is the way it is going to be".
It is true, we all had the option to write a letter to the County objecting
to the proposals but that was just the "democratic" form they had to
follow. They had no intention of doing a thing other than what they
"planned". Now, our farm land was planned to be "light industrial".
Now, we are being "invited" to discuss annexation into the City of
Yelm. Why do we feel we are being invited to our own hanging, again?
Will we, after voicing our objections be told that "this is the way it
will be",?
When we purchased this land, we do not recall the City of Yelm or
Thurston County being co-signors on the contract. Neither do we remember
realizing any donations from either to help us make the payments. It
would appear that we had purchased 10 Acres and it was our land. What
we do notice is the dictatorship government where the City or the County
tell us what we are going to do and how much we are going to pay and
whether we can sell and to whom. Since we paid for the land, don't we
own it?
We wish to stipulate our reasons for not wishing any further develop-
ment of annexation into the City of Yelm. We have sufficient and exist-
ing water supply on our property and the Septic system is kept working
-2.

and in good condition. You state we can be included in a special
taxing or improvement district. With all the costs involved in the
annexation process, there is bound to be additionsl costs to the
property owner. Here again, we do not wish to be included. We pay
our bills, taxes included and shop locally to help the local economy.
Our taxes will increase. You, as a city are being evasive when you
state that "historically speaking, taxes in the city have been lower
than in the County". There are more regulations in cities than in
rural areas surrounding, "historically speaking", because most of
the regulations pertain to City living as opposed to rural. You also
state we would not be required to "hook up" to sewer or water. What
you do not add is that once a water line and sewer line is laid, the
property owners are charged an initial cost of running the line and
then the monthly charge is additional, even when there has been no
"hook up" made. This is supposedly for havinlJ access to said lines.
These assessments are usually made on a per foot frontage scale and
on-going. We have existing fire protection, which the City doesn't
have the right to regulate. The County taxes include both fire and
police protection. The County maintains the roads as well as the
City of Yelm would be able to do. Said letter also states that any
existing farm animals can be "grandfathered" but what would happen
if the property is sold? You are requesting a letter to be filed
with the City regarding farm animals. Why now? It is not any bus-
iness of the City whether we are feeding sheep, ponies, cattle etc.
Are we faced with decision having already been reached, as our past
exposure to the way meetings are held? We are aware the City can
annex property without our consent---haven't we been told our land
that we thought we owned was being re-zoned without any consideration
to the proposals we might have for the future of our property?
Now for a look at the other side---. To annex more acres, hold
preliminary meetings and perhaps hearings, is this not going to cost
the City of Yelm? Won't these costs be passed on to the newly
annexed property owners in the form of "special taxes"? What about
existing police force and street maintenance personnel? Can they
handle the additional duties or will there be a need to hire more?
You failed to mention special paving for county roads without curbs
and sidewalks. Who's buying?
We are aware the City of Yelm is not considering this measure with
our benefits in mind. Considering this, we would, at this time, like
to request a full public hearing, with all parties concerned being
timely notified with at least ten (10) days notice and having the
option of legal council attending. To be presented at this meeting,
the City should provide anyone interested, the names of any land
owner who has requested this action and the reasons noted.

Barbara Wood) would like to remove our signatures from the

Therefore, please be aware that we have no wish to have any of our property
included in this proposed annexation, and under no circumstances would
we agree to have our property divided for this purpose.

that we had no interest in annexation at this time. We resent having

Dear Petitioners,
On Wednesday, April 8, the Yelm City Council granted
permission to circulate a petition of annexation to the City
of Yelm A copy of the Council's Resolution #240 is
enclosed
The Council's resolution provides one year in which to
present a petition for annexation That petition must
include the signatures of 60% in value of the owners of the
annexation area as illustrated by the map attached to the
resolution The petition must clearly state that the
property to be annexed will be subject to a proportionate
share of the City's existing indebtedness and that the
annexation area will be subject to a comprehensive plan
designation and zoning to be adopted simultaneous with
annexation, You may prepare your own petition or modify
copies of the enclosed form
The final petition must be presented at City Hall by April
8, 1993 It must be accompanied by a legal description and
map of the area to be annexed, a zoning application, an
environmental checklist, a list of owners of record of
property within 300 feet of the area, and the appropriate
fees ($1100 as of this date) Upon receipt of a sufficient
and complete petition, a public hearing will be scheduled
During this preannexation period, City policy also permits
any owner of property within the proposed annexation area to
submit land development applications However, no final
action will be taken nor are such applications considered
complete by the City prior to final annexation approval
Accordingly, such development proposals are subject to any
changes in regulations or standards enacted by the City

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF YELM SETTING
FORTH THE DECISION OF THE COUNCIL REGARDING A NOTICE OF
INTENT TO CIRCULATE A PETITION TO ANNEX CES~AIN TERRITORY TO
THE CITY OF YELM
WHEREAS, the Yelm City Council has received the attached notice of
intent to commence annexation proceedings,

WHEREAS, pursuant to the procedures establ ished by Revised Code of
Washington 35A 14 120 and Yelm Municipal Code Chapter 17.64, the City
Council has met with the initiating parties,
WHEREAS, the Council has duly considered said request to initiate
annexation,
Now, Therefore, THE CITY COUNCIL OF THE CITY OF YELM DOES RESOLVE, AS
FOLLOWS
Section 1 - Decision, That the Council hereby [~pts> rejects /

Municipal Code must be presented to the City Clerk prior to such date

proceedings for property along Yelm Creek, the Yelm City
Council is scheduled to discuss this proposal at its regular
meeting at 7:30 p m on Wednesday, April 8, 1992, at City

Due to the large mnnber of annexation requests received by the City of
Yelm in the last several months, the Yelm City Council has asked that a
qualified Planner review the requests and make a recommendation back to
the Council on how the requests fit into Yelm's short-term annexation
plans and how to proceed with the individual annexation petitions
submi tted by property owners such as yourself.
Your particular annexation request will be discussed on WEDNESDAY,
FEBRUARY 27, 1991 at 7:30 PM at the Regular Meeting of the Yelm City
Council, 105 Yelm Ave. W. We encourage you to attend to hear the
recommendation and give any input you feel would be useful to the City to
make its determination regarding your annexation petition.

Comments on/Status of Jenness Annexation
My comments are divided into three categories: Immediate
Tasks/Needs, SEPA Tasks/Needs, and Boundary Review Board
Tasks/Needs.
I. IMMEDIATE TASKS/NEEDS
A. A new notice of intent is needed, signed only by those
wanting to be included in the annexation (the petition
supplied also lists people who don't want to be
included and people who didn't even sign themselves) .
A full legal description for the area to be annexed is
also needed as part of the notice of intent.
ACTION REQUIRED: Ask the proponents to submit a proper
notice of intent with the items noted above.
B. A legal description is needed for the notice of intent
and generally for the request.
ACTION REQUIRED: Ask the proponents to have a title
company. surveyor. or other appropriate person to
prepare a leqal description addressing the points
outlined above.
C. Verify the signatures and certify them as accurate,
ACTIQN REQUIRED: certify the siqnatures in this case
and place the completed form in the file.
D. Schedule the initial meeting before the City Council.
The proposed comprehensive plan designation and zoning
designation should be specified by the City Council at
this meeting, unless you decide to use the closest
comparable zone to county zoning (as allowed by your
annexation ordinance).
ACTION REQUIRED: Either ask the city Council to decide
upon the appropriate plan desiqnation and zoninq now.
or specifY the closest zone to county zoninq when the
ordinance annexinq the properties is adopted.

E. Once the initial meeting occurs with the city Council,
the 60% petition is needed from the proponents. The
signatures will need to be verified and certified as in
B above.
ACTION REQUIRED: After the initial citv Council
meeting, have the proponents submit a completed
petition and verifY and certify the siqnatures as in A
above.
II. SEPA TASKS/NEEDS
A. An environmental checklist needs to be filled out and a
DNS issued (if appropriate).
ACTION REQUIRED: Have the proponents fill out a new
cover paqe and the nonproiect action paqe. and then
issue a DNS (if appropriate).
III. BOUNDARY REVIEW BOARD TASKS/NEEDS
A. After the completion of all steps outlined above, the
package needs to be prepared for submittal to the
Boundary Review Board. This includes the BRB
application, necessary maps, SEPA documentation, and
$50 filing fee. (NOTE: this proposal does not qualify
for the waiver because it is over ten acres in size.)
ACTION REQUIRED: The city prepares the necessary
documents and submit to Boundary Review Board staff.
NOTE: I recommend the city prepare the BRB application
because it actuallY is an application by "the city for
annexation. .

ANNEXATION ELEMENT
Goal #1: To ensure that the Town expands in a consistent and econom-
i ca 1 manner in accordance with the communi ty I s sphere of
influence.
Policies: 1) Areas outside of Town requesting Town water service
should be encouraged to annex as a prerequisite to rec~iving
such service.
2) Zoning of annexed areas should be consistent with the
land use category as shown on the Comprehensive Plan Map or

3) Areas to be annexed should be in a location where they
can economically be provided with Town services.
4) Developed areas requesting annexation should be en-
couraged to upgrade all facil ities and util ities to Town
standards before annexation occurs.
5) Annexations should occur in a progressive manner which
results in an efficient and logical Town ,1 imits config-
uration.
Goal #2" Provide land for future community development, preservation,
and recreation.

Policies: 1) Yelm should continue to be receptive to annexation
proposals from areas contiguous with the boundaries of Yelm.

2) Plans for use and zoning of the annexed property should
be presented to the Yelm Council for consideration.
3) Before annexation of an appropriate property adjacent to
Yelm, the Council will hold hearings to determine the most
appropriate use of the land within a 30 day period.
4) Yelm should continue to be receptive to annexation
proposals for any additional land which will improve the
Yelm area.
