Upon review of WSDOT of the annexation ordinance they found that one of the legal
descriptions used in the ordinance had an error in it. So Jordyn, from WSDOT sent the
attached language and requested an ordinance amendment.
I believe the amendment will need to be forward to OFM, who will in turn send it to WSDOT

to process a newer annexatIOn in the area (Ordinance #648) a questIOn arises about
annexation ordInance #528. Would you please prOVIde us a map showmg:
Lot 4 of CIty of Yelm Short Plan No 8001 as recorded in Auditor's File No. 940847 m
Volume 1 of Short Plats, Pages 675-680, Records of Thurston County, Washmgton.
This should have been included with Ordinance 528 before It was approved by OFM, and
we need it to contmue processmg Ordmance 648
Also, Elease conSIder correctmg a small error III the legal descnptIOn.

WHEREAS, the record owners of at least sixty percent of the
value of the property described below have pet~t~oned for
annexation to the City of Yelm,
WHEREAS, the City Council of Yelm has held a duly-noticed
public hearing regarding such annexation,
WHEREAS, the City Council finds that such annexation is in the
best interest of the city and conforms with annexation policies of
the City as set forth in the Comprehensive Plan and Yelm Municipal
Code Chapter 2.66.
NOW, THEREFORE, THE CITY COUNCIL OF YELM DOES ORDAIN AS

We, the undersigned, being the owners of not less than sixty (60%), in value
(according to the assessed valuation for general taxation) of the real property
described on Exhibit -A- attached hereto, do hereby petition that such territory
be anneXed to and made a part of the City of Yelm under the provisions of Revised
COde of Washinqton Section 35A.14 .120. ~his petition is accompanied by a map
which outlines the boundaries of the property sought to be annexed.

contracted, prior to or existing at the date of annexation simultaneous with

7 Thurston Regional Planning Council. Thurston County Commissioner and TRPC
Chairman Judy Wilson reported on TRPC activity in 1998. Projects included.
adoption of a new regional transportation plan, joining with Economic
Development Council, region-wide infrastructure financing planning and water
resources.
Harold Robertson, TRPC Executive Director, reported on transportation issues
including rail transportation. TRPC will allocate a portion of surface
transportation planning money to Yelm's project. Additional funding may be
available for freight rail transit. Future issues include consideration of road
fInancing through a voter approved gas tax and a possible county established $15
motor vehicle license fee. The road tax has not passed anywhere in the state.
Before people will vote for additional taxes, they must be convinced that road
funds are spent well, and understand the limits on how those monies can be spent.

Public Hearing - Nisqually Estates Assessment Reimbursement Contracts. Mayor
Wolf opened the pu1?lic hearing at 7'47 pm and announced the time, date, place
and purpose of the hearing. No objections to participants or conflicts were
voiced. Mayor Wolf called for a staff report.
Ken Gannann explained that the Water and Sewer Latecomers Agreement would
allow the developel\' Barr Family Homes, to ~ver some of the costs incurred
for water and sewer system improvements. Under the agreements, the City would
accept ownership of the improvements and responsibility for collecting a pro rata
share of the costs from future system(s) users. The agreement runs for 15 years,
and 10010 of the collected fees would be retained by the City to cover
administrative costs. Fees are calculated on an area (per square foot) and frontage
assessment.
The floor was opened for comment/questions. Being no comments or questions,
Mayor Wolf closed the public hearing at 7:53 pm.

9 Public Hearing - Annexation Petition ANX988226YL, Cowles, 13 acres,
Rhoton/Canal. Mayor Wolf opened the public hearing at 7:55 pm and announced
the time, date, place and purpose of the hearing. No objections to participants or
conflicts were voiced. Mayor Wolf called for a staff report.
Cathie Carlson explained that this is the 2M step in the annexation process.
Council reviewed the Notice of Intent to Annex in November and the Thurston
County Assessor has established the value to the properties. The current request
is for approval of the annexation in content and authorization to fOlWard the
annexation to the Thurston County Boundary Review Board.
The floor was opened for comment/questions. M.J Mitzner, 8155 Canal Rd.,
Yelm, stated her objection to having her parcel of property included in the
annexation. Ms. Mitzner did not want to connect to municipal water and sewer or
to garbage service, and wishes to continue to raise livestock on her property
Council discussion provided information that Ms. Mitzner would not be required
to connect to city utilities unless her system failed, and that the livestock use
could be grandfathered in as part of the process. Problems created by omitting
the parcel include road maintenance, and police coverage. Ms. Mitzner still
wished to be excluded from the annexation.
Being no additional questions/comments, Mayor Wolf closed the public hearing at
8:07 pm.

10 Final Plat SUB-98-8228- YL, Nisqually Estates, Phase I, Division I and II. Cathie
Carlson explained that council had approved the plat in 1995 with various
conditions attached. With the exception of two items all conditions have been
addressed. The first of the two conditions still in question is fencing for a
pedestrian easement. Original requirements called for a 6-ft. wooden fence.
Because of safety concerns a 4-ft. chain link fence was substituted. The second
item was a request to delay planting of trees at entrances and around the
stormwater facilities u$llater in the year to impro'le survival rates. Also
requested is an arrangement to plant rerntJining trees as lots are developed. The
developer has submitted a Letter of Credit and Assigned Savings. No building
permits beyond the first S for model homes will be issued until planter strip and
stormwater facilities trees are planted.
Council discussed the fencing and tree planting issues.

Tribe entered into a compact with the state of Washington Gambling Commission.
The compact requires that a committee be established to decide how to distribute
the 2% of the net wins they have been collecting. Distribution will be to impacted
jurisdictions or agencies. The committee will consist of a representative and one
alternate from the Tribal Council, the Tribal Gaming Commission, Yelm,
Thurston County, and the State Gambling Commission. Glenn, Brian and Shelly
have attended meetings. Mayor Wolf and an alternate will represent Yelm on the

WHEREAS, the record owners of at least sixty percent of the value of the property
described below have petitioned for annexation to the City of Yelm,
WHEREAS, the City Council of Yelm has held a duly-noticed public hearing regarding
such annexation, -
WHEREAS, the City Council finds that such annexation is in the best interest of the
City and conforms with annexation policies of the City as set forth in the Comprehensive Plan
and Yelm Municipal Code Chapter 2.66

B. BACKGROUND:
The City Council approved the Notice of Intent to Commence Annexation upon consideration of the
findings and conclusions as detailed in the staff report presented to the Council on November 24, 1998
Upon City Council approval of the Intent to Commence Annexation the applicant was authorized to
circulate a petition to annex to the property owners included in the annexation boundary
The applicant submitted to the planning department a completed Petition to Annex to the City of Yelm
The petition (Exhibit II) contains the signatures of property owners representing approximately 72% in
value of the real property within the annexation boundary Upon receipt of the Petition to Annex staff
forwarded the petition to the Thurston County Assessor's office to verify the signatures and the
assessed valuation of the properties in the annexation area. Upon verification by the Thurston County
Assessor's office a public hearing was scheduled
C. COUNCIL ACTION.
The City Council may' approve the petition and instruct staff to forward the annexation to the Thurston
County Boundary Review Board for final review or deny the petition

The Yelm City Council will hold a public hearing to receive comments on a petition to annex. The
proposed annexation area represents approximately 13 acres and is located on Canal Road and Rhoton
Road.
Testimony may be given at the hearing or through any written comments on the proposal, received
by the close ofthe public hearing on January 13, 1998. Such written comments may be submitted
to the City of Yelm at the address shown above or mailed to City of Yelm, PO Box 479, Yelm W A

PETITION TO ANNEX TO THE CITY OF YELM
TO: THE CITY COUNCIL OF THE CITY OF YELM
We, the undersigned, being the owners of not less than sixty (60%), in value
(according to the assessed valuation for general taxation) of the real property
described on Exhibit -A- attached hereto, do hereby petition that such territory
be annexed to and made a part of the City of Yelm under the provisions of Revised
Code of Washington Section 35A.14.120. This petition is accompanied by a map
which outlines the boundaries of the property sought to be annexed.
This page is a group of pages containing an identical text and petition
intended by the signers of this petition to be presented and considered as one
petition and may be filed with other pages containing additional signatures which
cumulatively may be considered as a single petition.
The undersigned petition the City Council and ask:
1. That appropriate action be taken to entertain this petition, fixing a date
for a public hearing, causing notice to be published and posted, specifying the
time and place of such hearing, and inviting all persons interested to appear and
voice approval or disapproval of such annexation; and
2. That following such hearing and subsequent to approval of the Thurston County
Boundary Review Board if such is convened, the City Council determines by
Ordinance that such annexation shall be effective; and that property so annexed
shall become a part of the City of Yelm, Washington, subject to its laws and
ordinances then and thereafter in force.
The Petitioners agree that all property within the territory hereby sought to be
annexed sh~ll be assessed and taxed at the same rate and on the same basis as
property within the City of Yelm or any now outstanding indebtedness of said City,
including assessments or taxes in payments of any bonds issued or debts
contracted, prior to or existing at the date of annexation simultaneous with
annexation, and that the property shall be zoned as Pt -+ and
governed by the zoning ordinance of the City of Yelm.

rhe undersigned petition the City Council and ask:
1. That appropriate action be taken to entertain this petition, fixing a date
for a public hearing, causing notice to be published and posted, specifying the
time and place of such hearing, and inviting all persons interested to appear and
voice approval or disapproval of such annexation; and
2. That following such hearing and subsequent to approval of the Thurston County
Boundary Review Board if such is convened, the City Council determines by
Ordinance that such annexation shall be effective; and that property so annexed
shall become a part of the City of Yelm, Washington, subject to its laws and
ordinances then and thereafter in force.
The Petitioners agree that all property within the territory hereby sought to be
annexed shqll be assessed and taxed at the sarne rate and on the sarne basis as
property within the City of Yelm or any now outstanding indebtedness of said City,
including assessments or taxes in payments of any bonds issued or debts
contracted, prior to or existing at the date of annexation simultaneous with
annexation, and that the property shall be zoned as and
governed by the zoning ordinance of the City of Yelm.

WHEREAS, the record owners of at least sixty percent of the value of the property
described below have petitioned for annexation to the City of Yelm,
WHEREAS, the City Council of Yelm has held a duly-noticed public hearing regarding
such annexation,
WHEREAS, the City Council finds that such annexation is in the best interest of the City
and conforms with annexation policies of the City as set forth in the Comprehensive Plan and
Yelm Municipal Code Chapter 2.66
NOW, THEREFORE, THE CITY COUNCIL OF YELM DOES ORDAIN AS FOLLOWS
SECTION 1. The following described territory is hereby annexed and made a part of the City

That part of the Northeast quarter of the Southwest quarter of Section 18, township 17 North,
Range 2 East, W M , lying South of Crystal Springs Road except the East 20 feet and the West
20 feet for roads
AND EXCEPT tracts described as follows.
Commencing at the Southwest corner of the Northeast quarter of the Southwest quarter of
Section 18, Township 17 North, Range 2 East, W M , thence 1275 feet East along the South line
of the Northeast quarter of the Southwest quarter to the true point of beginning of this
description, thence 471 feet Northerly to a point which is 1352 feet Easterly of the West line of
the Northeast quarter of the Southwest quarter and on the South boundary of the Crystal
Springs Road, thence Westerly along the South boundary of the Crystal Springs Road 683 feet;

NOTICE OF INTENT TO CCMvENCE
ANNEXATION PROCEEDINGS
TO The City Council of the City of Yelm
The undersigned are owners of not less than ten percent in value,
according to the assessed valuation, of the property as described
below We hereby advise the City Council of the City of Yelm that
it is the desire of the undersigned property owners of that area to
commence annexation proceedings:
The property referred to is described on Exhibit A
hereto and as shown by the attached map
attached
It is requested that the City Council of the City of Yelm set a
date not later than sixty days after receipt of this request for a
meeting with the petitioners to determine:
Whether the City Council will permit a petition regarding this
annexation to be circulated;
2 Whether the City Council will require designation of zoning
upon annexation,
3 Whether the City Council will require the assumption of
existing City indebtedness by the area to be annexed

PETITION TO ANNEX TO THE CITY OF YELM
TO: THE CITY COUNCIL OF THE CITY OF YELM
We, the undersigned, being the owners of not less than sixty (60%), in value
(according to the assessed valuation for general taxation) of the real property
described on Exhibit "A" attached hereto, do hereby petition that such territory
be annexed to and made a part of the City of Yelm under the provisions of Revised
Code of Washington Section 35A.14.120. This petition is accompanied by a map
which outlines the boundaries of the property sought to be annexed.
This page is a group of pages containing an identical text and petition
intended by the signers of this petition to be presented and considered as one
petition and may be filed with other pages containing additional signatures which
cumulatively may be considered as a single petition.
The undersigned petition the City Council and ask:
1. That appropriate action be taken to entertain this petition, fixing a date
for a public hearing, causing notice to be published and posted, specifying the
time and place of such hearing, and inviting all persons interested to appear and
voice approval or disapproval of such annexation; and
2. That following such hearing and subsequent to approval of the Thurston County
Boundary Review Board if such is convened, the City Council determines by
Ordinance that such annexation shall be effective; and that property so annexed
shall become a part of the City of Yelm, Washington, subject to its laws and
ordinances then and thereafter in force.
The Petitioners agree that all property within the territory hereby sought to be
annexed shqll be assessed and taxed at the same rate and on the same basis as
property within the City of Yelm or any now outstanding indebtedness of said City,
including assessments or taxes in payments of any bonds issued or debts
contracted, prior to or existing at the date of annexation simultaneous with
annexation, and that the property shall be zoned as and
governed by the zoning ordinance of the City of Yelm.

ANNEXATION PROCEEDINGS
TO: The City Council of the City of Yelm
The undersigned are owners of not less than ten percent in value,
according to the assessed valuation, of the property as described
below We hereby advise the City Counci 1 of the City of Yelm that
it is the desire of the undersigned property owners of that area to
commence annexation proceedings:
The property referred to is described on Exhibit "A". attached
hereto and as shown by the attached map
It is requested that the City Council of the City of Yelm set a
date not later than sixty days after receipt of this request for a
meeting with the petitioners to determine:
1 Whether the City Council will permit a petition regarding this
annexation to be circulated,
2 Whether the City Council will require designation of zoning
upon annexation;
3 Whether the City Counci 1 wi 11 require the assumption of
existing City indebtedness by the area to be annexed

APPLICANT: Margo and William Cowles
The Yelm City Council will hold a public hearing to receive comments on a petition to annex. The
proposed annexation area represents approximately 13 acres and is located on Canal Road and Rhoton
Road.

AN ORDINANCE relating to procedures and fees for the
annexation of property to the City of Yelm, Washington.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF YELM,
COUNTY, WASHINGTON:
THURSTON
Section 1.
Pl"ocedul"es.
A. All annexations will use the petition method.
B. An annexation will be considered either a
(i) simple annexation, involving a single anne/.ation within
an urban area and exempt from Boundary Review Board
procedures (items G through K below), or a
(ii) complex a.nn.exation, which is any othel" type of
annexation and will involve the Boundary Review Board.

The applicant meets with City officials to discuss the
~nnexation. and the first petition, a Notice of Intent
(sample fOl"m attached) is pl"epal"ed and Cil"Culated among all
affected property owners. It must be signed by owners of
to'l. or more of tht:' assessed value of the p\-oposed annt:O'>~ation
area. Value is determined according to current Thur~ton
County tax record.
D. Aiter the signatures on the Notice oi Intent are validated
and iound to be suiiicient, the City Council holds a ~ublic
weeting, usually within 60 days o~ ~iling the petition. The
City Council decides whether to accept the propo~ed
annexation, and it so, under what conditions.
E. At a public meeting, the City Council decides whether to
require: (a) the adoption ot a comprehensive plan and
zoning; and/or (b) the assumption of a proportionate share
oi existing City debts by the area to be annexed.

owners to iorm a Local Improvement District (LID); and/or'
(d) jurisdiction oi existing sewer and water districts.
F. A~ter the City Council accepts the Notice oi Intent, it is
reierred to the Planning Commission to review the plbnni~9
and zoning at a pubic hearing. The Planning Commission
makes their recommendation to the City Council ior iurther
heb:cings.
G. The City Council holds the first o~ two public hearings to
review the Planning Commission's recommendations on the
planning and zoning ior the area to be annexed.
H. Ii approved, the Council then instructs the applicant to
prepare a Petition for Annexation (sample for attached)
signed by the property owners oi not less than 60Y. vi the
assessed valuation 01 the property being annexed.
I. Aiter the signatures on the Petition tor Annexation are
validated and iound to be sufiicient, a notice is sent tu
the Thurston County Boundary Review Board.
J. The Boundary Review Board holds a public meeting to decide
ii the annexation proposal should be approved.

in the newspaper and the annexation becomes effective five
days after the publication date. Copies of the annexation
ordinance are sent to various state and local government
agencies.
Section 2.
Fees.
A.

(B) (i), shall be $250, payable to the City o~

The ~ee ~or a complex annexation, described in Section
1 (A)(ii), shall be $1000, payable to the City o~ Yelm.
(ii) In addition, the applicant shall pay the City's actual
casts for the annexation by advancing the City tor it~
out-of-pocket expenses, hourly rates, using the
procedure as :follows:
(a) The applicant shall deposit a sum o~ money, the
amount of which will be determined by the City
Administrator, into a separate :fund which shall be
maintained by the City.
(b) The City will bill ~or the charges pertaining to
applicant's ~nnexation against this ~und.
(c) When lOX of this :fund remains, the City shall
notify applicant and request applicant to deposit
an amount similar to what was previously paid.
This procedure shall continue until the project
has been completed.
Cd) At any time, applicant may terminat~ the pruject
and receive a refund of the remaining monies in
the fund.
Section 3. Effective Date. This Ordinance shall be
eifective immediately upon its passage.
