ORDINANCE NO 451
AN ORDINANCE VACATING THAT ALLEY IN BLOCK EIGHT OF McKENZIE'S
SECOND ADDITION TO YELM AND TRANSFERRING TITLE TO SUCH PROPERTY
ACCORDINGLY
WHEREAS, a petition has been filed bearing the signatures of the
owners of more than two-thlrds of the property abutting on the
alley described below; \
WHEREAS, the Yelm City Council has held a duly-noticed public
hearlng regarding such request.
WHEREAS, the Yelm Planning Commission has recommended and the
Council finds that such vacation would be in the public interest
and therefore the request should be granted, and
WHEREAS, the Council has determined that it is in the public
interest to retain an easement for public and private utilities
along and over such alley
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF YELM DOES ORDAIN
AS FOLLOWS:
Section 1 That the alley extending from Third Street to Fourth
Street as platted within Block 8 of McKenzie's Second Addition to
Yelm and dedicated on November 21, 1916, being ten-feet in width,
is hereby vacated; provided, however, that the City does hereby
retain a utility easement be19w, upon and above said property
including the right to exercise and grant easements for the
construction, 'repair, and maintenance of public and private
utilities and services to the full extent heretofore- possessed by
the Citj
Section 2 That title to said alley shall vest in the owners as
of this date of the abutting properties, one-half to each
Section 3 That a copy of this Ordinance shall be recorded by the
City Clerk with the Auditor of Thurston County

Dear Steve,
On Wednesday, July 22, 1992, the Yelm City Council heard
your request to vacate the alley ln Block 8 of McKenzie's
Second Addition The Council has tabled this request while
it considers the general policy question of compensation to
the City for such vacations of right-of-way The three
options before the Council are to require payment of up to
one-half of the appraised value of the property, payment of
the City's costs of processin~ the request, or no
compensation of any kind Apparently the Council has not
previsously convronted this issue
The Council did indicate that it favored granting your
request to vacate the alley, but needed to determine what
compensation, if any, would be required for any and all
right-of-way vacations At its meeting on Wednesday, August
12, the Council will continue discussion of the compensation
lssue and, hopefully, will resolve the question with respect
to your request You are invited to attend that meeting

The Emanuel Lutheran Church of Yelm and Kevin and Tamilyn Dunn
have petitioned for vacation of the public right-of-way within
Block 8 of McKenzie's Second Addition to Yelm This ten-foot
alley lies along the northeast side of a residential half block
The remainder of the block has never been platted
Basic Facts
Proponent: Emanuel Lutheran Church and Kevin and Tamilyn Dunn
Proposal: Vacation of ten-foot alley
Public Notice: Posted and mailed to neighboring property owners,
and published in Nisqually Valley News
Location: Block 8 of McKenzie's Second Addition to Yelm adjacent
to current site of Lutheran church
Comp Plan: This block is designated for single-family use, the
area along Yelm Avenue is within the central business
district No circulation policies relate directly to
alleys
Zoning: Single-family residential (R-1), area along Yelm Avenue
is commercial (CBD)
Land Use: This block includes the Lutheran church and five
single-family residences The adjoining block along Yelm
Avenue is primarily commercial
Topography: Flat
Parking & Traffic: Alley apparently has never been opened and is
now occupied by church temporary buildings (portables)
Fire Protection: Alternative access to center of two block area
not available at present
Police Protection: Alternative access to center of two block
area not available at present
Other: No utility lines are within alley, undetermined whether
the alley could be useful for sewer system

Applicable Standards and Policies
state Law: RCW 35 79 Petition to vacate must be signed by
owners of 2/3 of adjoining property No vacation permitted
if 50% of owners object City may provide that vacation is
effective only upon compensation by an amount not to exceed
one-half of the appraised value of the area to be vacated
(unless acquired at public expense) City may retain
easements
Comprehensive Plan: No policies regarding alleys Transportation
plan requires alleys in commercial areas and supports in
residential with reduction in adjacent right-of-way widths
Yelm Municipal Code: Commission review procedure established by
Chapter 6 of Ordinance 436 (subdivision ordinance)
Other: In general public rights-of-way are to vacated only if
they do not serve or are not reasonably anticipated to serve
a future public purpose
Staff Analysis
The staff has identified no general need for an alley within this
block, although the pending transportation plan does favor alleys
in residential areas Because utility systems have not all been
designed, the City should retain a general utility and
maintenance easement along this route
The Planning Commission recommends that the vacation be granted
with retention of a utility easement Council should also
consider and prepare a recommendation on the appropriate City
policy regarding compensation Note that no fee is charged for
petition to vacate
Before vacating the right-of-way the Council must find that such
vacation would serve a public purpose, such as enabling efficient
development of the adjacent property or increasing the value of
property on the tax rolls

Subject: Alley Vacation
Dear Planning Department, J
After lengthy discussion with Todd Stamm on this subject, we
are writing this letter seeking vacation (400 feet) of the city
alley (shown in red on the enclosed map) dividing the property
recently purchased by this congregation.
The ultimate goal for the use of this property is the
construction of a new worship and mlnistry facility. It is of
utmost importance in our planning that the land is consolidated
into one parcel.
To this end, we, the undersigned, respectfully request that
the alley be vacated and awarded to the adjacent property owners
in Block 8 of McKenzie I s Second Addition, that being, Emanuel
Lutheran Church and Kevin and Tami Dunn.
We would appreciate being informed of the date and time the
City Council considers this action so we can be in attentance to
answer any questions or concerns. Thank you for your attention
to this matter.
