WHEREAS, a petition has been filed bearing the signatures of
the owners of more than two-thirds of the property abutting on the
otreet right-af-way described below,
WHEREAS, the Yelm City Council han held a duly-noticed public
hearing regarding such request,
WHEREAS, the Yelm Plannina Conunis:3ion has recorrunended and the
Council finds that such vacation would be in the public interest
and therefore the request should be granted,
WHEREAS, the Council has determi~ed that it is in the public
interest to retain an easement for public and private utilities
along and over such alley
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF YELM DOES
OkDAIN AS FOLLOWS
Section 1.
That portion ~f vacated McKenzie Street right-of-way
lying between Block 16 1/2 and Block 17 of Solberg' 6
First Addition to Yelm, as recorded in Volume 9 of Plats,
page 31, County of Thurston, State of I'lashington, is
hereby vacated
Section 2 That title to said right-ai-way shall vest in tbe

AND NOTICE OF HEARING
A RESOLUTION IDENTIFYING PROPERTY AND ESTABLISHING A
PUBLIC HEARING DATE TO CONSIDER THE VACATION OF AN ALLEY
RUNNING NORTH AND SOUTH AND LOCATED ON THE WEST SIDE OF
FIRST STREET SOUTH BETWEEN YELM AVENUE AND WASHINGTON
STREET.
WHEREAS, the owners of the above described property have
petitioned the City to vacate the alley lying between Lots 1 and 2,
and the Northeasterly half of Lots 3 and 4 of McKenzie's First
Addition to Yelm, as recorded in volume 8 of Plats, Page 26; and
WHEREAS, a past City Council action indicates the intent of
the City to vacate this alley;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF YELM, WASHINGTON,
DOES RESOLVE AS FOLLOWS:
Section 1. Vacation of the following describe property has been
requested:
That portion of the alley lying between Lots 1 and 2, and
the Northeasterly half of Lots 3 and 4 of block 2 in
McKenzie's First Addition to Yelm as recorded in Volume
8 of Plats, Page 26, in Thurston County, Washington and
lying between the westerly line of First Street and the
easterly line of the Northern Pacific Railroad Company
right-of-way.
Section 2. A public hearing to consider vacation of said alley
shall be held as part of the regular City Council meeting scheduled
for 7:30 pm, August 9, 1995, in Council Chambers at Yelm City Hall,
105 Yelm Avenue West, Yelm, Washington. Written comments or
objections of any abutting property owners shall be addressed to
the City Clerk's Office, PO Box 479, Yelm, WA 98597.
ADOPTED by the City Council of the City of Yelm, Washington, and
APPROVED by its Mayor, at a regularly scheduled open public meeting
thereof this 27th day of June, 1992.

The Yelm City Council approved your request for vacation
of the McKenzie Street right-of-way at their April 14,
1993, regular council meeting. A copy of the minutes
with the related motion, number 93-74 is enclosed for

Your offer of March 30, 1993, for payment to the City in
the amount of $7,221.60 is acceptable. Payment made be
made at City Hall. The City will be retaining easements
for utility purposes.
We are in the process of preparlng an ordinance to be
approved by City Council and sent to the Thurston County
Auditor for recording.

Dear Mr. & Mrs. Harding:
As per our telephone conversation of today regarding your offer to the City
of Yelm for your half of the McKenzie Street right-of-way. I understand
that you and Brian and Nancy Thornton are negotiating a quit claim deed to
transfer title of their half of the McKenzie Street right-of-way to you.
Upon receipt of a signed quit claim deed by the Thorntons, you may submit
that to the City of Yelm, to my attention, along with a new offer for the
McKenzie Street right-of-way southeast of Railroad Street.
I have received confirmation from our legal counsel, that the quit claim
deed and new offer are sufficient documentation for Yelm to accept payment
from you and proceed with the formal vacation of the McKenzie Street right-
of-way southeast of Railroaq Street. This formal process involves passage
of a street vacation Ordinance by the Yelm City Council and recording of the
document with the Thurston County Auditor.

Dear Mr Harding,
In response to your letter of June 23 requesting abandonment
of the end of the McKenzie right-of-way where it abuts the
Burlington Northern railroad right-of-way, the Yelm City
Council has tentatively scheduled a public hearing for the
evening of Wednesday, September 23 However to proceed with
this hearing the City must receive a petition to vacate
right-of-way signed by yourself and the owner of the
property abutting the right-of-way on the southwest There
is no fee for this petition but so I may proceed with
advertlsing this hearing, I need to receive this document by
noon on Monday, August 31

regarding the details of such a petition

A request to vacate the dead-end portion of McKenzie Avenue
immediately northwest of the Burlington Northern right-of-way
Basic Facts
Proponent: James Harding of Harding Greens Company
Proposal: Vacation of portion of McKenzie right-of-way between
blocks 16t and 17 of Solberg's First Addition
Public Notice. None - hearing to be held by City Council
Location: One block southwest of City Hall
Comprehensive Plan: Property on both sides of right-of-way
designated for commercial use
Zoning: Property on both sides of right-of-way zoned as central
business district
Area Land Use: Harding Greens commercial to northeast; railroad
at end of right-of-way; remaining area is single-family
residential
Topography: Flat
Utilities Utility easement may be required; public works has not
yet been consulted
Applicable Standards and Policies
State Law: RCW 35 79 Petition to vacate must be signed by
owners of 2/3 of adjoiing property No vacation permitted
if 50% of owners object City may provide that vacation is
effective only upon compensation by an amount not to exceed
one-half of the appraised value fo the area to be vacated
(unless acquired at public expense) City may retain
easements
State Environmental Policy Act (SEPA): Environmental checklist
not yet received
Comprehensive Plan: Since City Park 1S directly across First
Street, Yelm Transportation Plan does not include extension

Property has intrinsic value do to its site as the property is
the size of one lot (60 feet by about 100 feet) Appropriate
compensation may be in order
