KNOW ALL MEN BY THESE PRESENTS
That we, the undersigned, are the owners of the land described by
this declaration and no other contiguous land not contained herein, and are
seeking approval by the Planning Department of the herein described division
of land known as Short Subdivision Number ss- 80 'l (~ subject to the
following covenants and conditions

1 . That the land described by this declaration may not be further
divided in any manner by anyone within five (5) years of the above date of
approval without a final plat having been filed for record with the Auditor of
Thurston County, pursuant to the provisions of Chapter 58 17 RCW, and the
regulations of the Platting and Subdivision Ordinance and subject to penalties
attendant thereto
2 That all subsequent deeds will contain provisions for private
roads in the manner described herein
3 That all maintenance of any private road described by this
declaration shall be by the owners of the parcels having legal access
therefrom or their heirs, assigns, or successors, unless and until such road
is improved to the current public road standards and dedicated to and
accepted by the appropriate governmental jurisdiction
4. That any private road will be subject to the further right of
the grantor or his successor and of any telephone, electric, gas, water, or
sewer company, public or private, to lay or cause to be laid and the right of
ingress or egress for the purpose of maintaining telephone, electric, gas,
water or sewer pipes, mains, or conduits across a described portion of such
road
5 That with respect to any private road described by this
declaration whether it remains private or becomes a dedicated road, there is
the additional right of the Grantor or his Successor to make all necessary
slopes for cuts and fills, and the drainage of said roads and ways over and
across any parcel (s) where the water might take a natural course upon
reasonable grading pursuant to improvement for dedication of the roads and
ways shown herein shall be allowed to continue. Following reasonable grading
pursuant to improvement for dedication of the roads and ways shown herein,
no drainage waters on any parcel(s) shall be diverted or blocked from their
natural course so as to discharge upon any public rights-of-way or to hamper
proper road drainage.
6. That the legal description of the land subject to this Declaration
and being subdivided into not more than four (4) parcels is attached hereto
and incorporated by reference as though fully set out herein
7 That additional covenants, easements, restrictions, if any,
solely for the benefit of the grantor, and his heirs, successors, and assigns
enforceable only by such persons, are attached hereto either as exhibit(s)
or as previously recorded under Auditor's File Number
and incorporated by reference as though fully set out
herein
8 We, the undersigned, hereby waive all claims for damages
against any governmental agency which may be occasioned to the adjacent
land by the established construction, drainage, and maintenance of any
private road described by this Declaration.
9 We, the undersigned, hereby acknowledge that this Short
Subdivision has been made with our free consent and in accordance with our
desires
10 We, the undersigned, hereby indemnify the approving
governmental agency for all costs or damages including attorney's fees
incurred by or charged against that agency as a result of the signatory not
being the owner of the property being subdivided.
That these covenants are for the mutual benefit of the grantor and
his heirs, successors and assigns and are for the further purpose of
compliance with the resolutions and regulations of the appropriate local
governmental jurisdiction, and the local government and such persons are
specifically given the right to enforce these restrictions and reservations by

MINUTES AS PRINTED. MOTION CARRIED.
No additions or deletions were made to the agenda.
2. Cameron Variance (VAR8070). Public Hearing on request
from Doug Cameron for a variance from 5-acre lot size and
20 foot side-yard and 30 foot rear-yard setback
requirements to permit new lot lines 9 feet from an
existing garage and approximately 15 feet from existing
shop, and approximately 15 feet from each existing
residence. The lot to the east would be about 14,400
square feet; the western lot about 31,000 square feet.
Jim Keyes left the room.
Public Hearing Opened at 4:05 p.m. All speakers were
requested to identify themselves prior to speaking. No
conflict of interest was expressed. No audience
objections to any Planning Commission members
participation was voiced. No members had received
information, other than staff reports, prior to the
public hearing.
Todd Stamm gave an overview of his staff report pointing
out that all setbacks meet with building codes but that
the Commission may wish to recommend a minor modification
so that the lots would meet single-family zoning
standards.

Hearing regarding site plan of proposed McDonald's
Restaurant at the western corner of the Yelm Ave. and
Solberg St. intersection.
Public Hearing Opened at 4:10 p.m. All speakers were
requested to identify themselves prior to speaking. No
conflict of interest was expressed. No audience
objections to any Planning Commission members
participation was voiced. No members had received
information, other than staff reports, prior to the
public hearing.
Stamm gave a brief overview of the project stating that
zoning permits the location of this or a similar type of
operation at this location and pointed out a few
problems with the submitted site plan including:
a. pedestrian and handicapped access crossing the drive
through lane.
b. Dri ve through access from Solberg, turn is too
sharp
c. No frontage improvements on Washington St.
d. If Washington St. is extended the Solberg Street
entrance will be very close to the
Washington/Solberg intersection.
e. No landscaping plan submitted yet.
f. Increase in number of left turns at SOlberg/Yelm
Ave. intersection and at Yelm Ave. entrance.
Stamm stated that standards limit arterial entrances to
one per 500 feet eliminating the possibility of future
Yelm Ave. entrances to the unused portions of that block.
He advised the Commission that they could require:
a. architectural style approval
b. relocation of handicapped parking

Dear Mr Cameron,
I have finally reviewed your proposed boundary line
adjustment to divide the two houses on your property on
104th as prepared by Jim Keyes Due to the current
Residential Agricultural zoning of the site the process will
be a little more complex than I had hoped
Before I can approve this proposal it will be necessary for
you to request and for the City Council to grant three
'variances from the regular zoning standards These would
be a lot size variance to permit lots smaller than five
acres; a lot width variance to permit lots narrower than
250 feet; and side yard setback variance to permit buildings
closer than 20 feet to the property lines Given the
existing building all such variances can be granted but
require Council action The necessary forms are enclosed
for your convenience
The only alternative would be to request a general rezone of
the properties along 104th Avenue from Residential
Agriculture to Single-Family Residential zoning That
proposal also would probably be approved but would be
slightly more costlY (The total rezone fee is $250 )

KNOW ALL MEN 8Y THESE PRESENTS
That we the undersigned hav ing a real interes t in the tract of land
described by the declaration, and do hereby declare the herein described
adjustment of land certified as Boundary Line Adjustment Number BLA-
on the day of ,19 , by the Planning
Department, subject to the following covenants and conditions
1 That all subsequent deeds will contain provisions for private
roads in the manner described herein
2. That all maintenance of any private road described by this
declaration shall be by the owners of tt1e parcels having legal access
therefrom or their heirs, assigns, or successors, unless and until such roads
dl-C improved to the subdivision standards and dedicated to and accepted by
the appropriate governmental jurisdiction.
3 That any private road will be subject to the further right of
the grantor or his successor and of any telephone, electric, gas, water, or
sewer company, publ ic or private, to loy or cause to be laid and the right of

water or sewer pipes, mclins, or conduits across a described portion of such

declaration whether it remains private or becomes a dedicated road, tnere is
the additional right to make all necessary slopes for cuts and fills, and the
rights to continue to drain said roads and ways over and across any lot or
lots where the water might take a natural course upon reasonable grading
pursuant to improvement for dedica tion of the roads and ways shown herein.
Following reasonable grading pursuant to improvement for dedication of the
roads and Wi:lYs shown herein, no drainage waters on any lot or lots shall be
diverted or blocked from their natural course so as to discharge upon any
publ ic road rig hts-of-way or to hamper proper road drainage.
5 That the adjusted legal deSCription of each of the tracts being
adjusted is attached hereto and incorporated by reference as though fully set
out herein.
6. That additional covenant, easements, restrictions, if any, solely
for the benefit of the grantor, and his heirs, successors, and assigns
enforceable only by such persons, are attached hereto either as exhibits
or as previously recorded under Audi tor's Fi Ie Number
and incorporated by reference as though fully set our

That these covenants are for the mutual benefit of the grantor and
hiS heirs, successors and assigns and are for the further purpose of
