However, the area was rezoned to R -6 to allow for Woodfield. I find no reference to your grandfathering in that documentation. After speaking with you yesterday, it was good to hear that there were no complaints from neighbors. Instead, it was an inquiry from an existing City of Yelm employee; a building inspector, regarding the cattle in the field. It is unclear why he was concerned enough to bring it to your attention? As stated in a previous correspondence, the neighbors we have spoke with are very happy that the cattle are there:) We believe that there are multiple benefits to the Yelm community of the cattle being there. However, we also realize that those benefits need to be recognized by the Administration and Council. We are more that happy to present those benefits to the Yelm Administration, and the Council. However, I did see your first email and brought into our Site Plan Review Committee your response. Based on the zoning and the use listed with the Thurston County's Assessor's Office we cannot determine a continuous use of Agriculture on the site. Chapter 17.93, Nonconforming uses, Section 17.93.030 YMC states: "Abandonment or discontinuance. A nonconforming use shall be deemed abandoned by discontinuance or abandonment for a period of eighteen month, and any subsequent future use of such land or buildings shall be in conformity with the provisions of this title." Annexation would allow existing uses, i.e. agriculture, to continue as long as it is consistent with Section 17.93.030. Unless you can produce documents listing you as an exception to the cited section we are going to enforce the zoning regulations and not allow the cows. Please respond with a time table of bringing your property into conformance. Thank you.
