Dear John and Nancy Andersonr
On February 23, 1994, the Yelm City Council, after ~ecommendation
from the Yelm'Planning Commission, approved your request for a
front yard setback variance from 25ft to 20ft based upon the
findings that granting the variance would not jeopardize the best
interest of the City and because the existing house had been
constructed prior to the Ordinance, the proposed addition
fulfilled the criteria for granting a variance The City Council
also waved the 15 ft height restriction
This variance was granted under Title 17, Chapter 52r of the Yelm
Municipal Code Pursua~t to the requirements of this chapter, if
construction has not substantially begun by March 4,1995" the
variance will be expired and revoked at that time

made the following conclusions:
1) A var ianpe may be grantecd for a pr iVi3te garage' or other
struoturewhen the location of buil~ings p~ior to the
effective date of the ordinance makes cdmpliance with
the provisions govern'ing the location ,of p!"'ivat€
garag~s and other str~ctures imoossible

2) It is the intent for variances to provide relief in
special circumstances where strict .appl ication pf the'
ordinance would deprive the property owner of
rights and privileges 'enjpyed by other properties in
the vici.nity, s~me zone, a~d due to the size,
topography, location or surroundings of particular
property

1994, at 7:~OP M. Both meet'ings will take place in the Yelm
City Hall Councicl Chambers located at 105 Yelm Ave. W , Yelm, WA.
The request 'is for a variance from the minimum frbntyard

Variances are for the modification of size, dimension or design requirements in situations where unusual physical
conditions of the property, such as shape or topography, make it impossible or unduly difficult to meet require-
ments of the zoning district or other City standards The power to vary is limited to the minimum change nec-
essary to overcome the inequality inherent in the property
Variances are granted only when the following specific circumstances exist:
1 The cllange must not constitute a rezone It must not be for a use not permitted in the district
2. Special physical conditions must exist on the property which makes ordinary standards or requir,ements im-
