This is in response to your email of November 20, 2009, relating to your two similar
public records requests of November 9, 2009. In your email, you seek clarification of
the initial response to your public records request. You also pose a series of questions
that are not requests for public records, respond to the notice of potential violation, and
make a new request for public records.
Clarification of initial records request.
1. Provide all complaints against 16135 Railway Rd from 1999 to present
2. Provide all permits issued to 16145 Railway Rd from 1999 to present
3. Provide the access agreement to Woodsfield's stormwater pond for
maintenance. And dates that the pond was maintained by the HOA or the City
In your latest email, you indicate that none of your Freedom of Information Act (sic)
requests were fulfilled with the exception of request number 3. However, the City did
search for and provide all responsive documents for all your requests as described
below.
First request , all complaints against 16135 Railway from 1999. There are no
documents that are responsive to this request.
In addition to the address listed, the City searched for complaints related to other
possible addresses including XXX and XXXX. The search included citizen action
requests, land use or nuisance investigations, and police reports.
Second request, all permits issued to 16145 Railway from 1999. The following
documents were provided as being responsive to this request:

treatment facility for Donovan Court. The following records were provided which are

In your latest letter you also ask as series of questions that are not requests for specific
records pursuant to the Public Disclosure Act and which typically the City would
respond with
Is the 2009 inspection of the Woodfield pond the only inspection by City staff over the
past 10 years?
Verify how the pond was accessed, as you question how the pond could be accessed
for maintenance or inspections.
Was the engine block and exotic specifies removed from the pond?
To whom was the inspection for sent?
Why are there complaints about the debris on your property at this time?
Why has the City initiated an investigation of a potential violation of Section 9.44.015
YMC now?

Finally, in your email you also make a new records request for "all complaints regarding
Yelm Code 9.44.015 to all properties located within the City of Yelm from 1999 to
present ".
Because of the breadth of this request, the City anticipates that it will take two weeks
from the date of this letter to gather all responsive documents. Please note that that
City is not required to maintain nuisance code violation investigation records except for
two years after the case file is closed, so there may be limited records that are
responsive to the request.
