Your question is whether the City has a responsibility to complete the plat with final pl~t approval and whether you have any responsibility to the Gore children The City of Yeln! has an obligation to an applicant to process final plat applications and building pp.rmlt ~pplications in accordance with the procedure set forth in the City of Yelm Code and I state law When an owner or alleged owner or developer seeks final plat approval or !permit approval, the City has an obligation to process such application as swiftly as required by, and under the terms and conditions of, the City's ordinance and state law I There IS no obligation at the time of application to ensure that the applicant is either an owner or an authorized agent of an owner The only releva~t obligation on the City comes at the time of final plat approval State law requires that the final plat contain a certificate that Includes a statement that the subdivision has been made "with the free consent and in accordance with the desires of the owner or 9wners" RCW 58 17 165 The same statute also requires the final plat to be accompanied by a title report confirming that title ownership of the lands is in the name of the owners signing the certificate In most cases, the title company will prepare I OWENS DAVI ES MACKI E A PROFESSIONAL SERV'CfS CORPORATION ATTORNEYS AT LAW CATHIE CARLS10N Page 2 May 18,1995 both the certificate and the title report. The City's obligation is to ensure that the names on the certificate and on the title report match In reality, however, this is an obligation of the title company, since they are essentially guaranteeing that the names match Our recommendation is that the City take a very responsive approach to this matter In other words, If an owner or representative of an owner applies for finai plat approval or for a grading or bUilding permit, the City should respond and process the application as it would any other applicant. The City should treat any such application according to the City's code and state law, until the City either receives a court order requiring it to halt its review and approval, or until a problem arises in the certificate of ownership on the final plat. The estate is very close to being closed. Since you sent the letter on behalf of two of the children, I thought that I would communicate directly with you regarding this matter. One of the assets which the children will have an interest in has to do with the land and building described as 305 Longmire, which was assessed by the County Assessor at $58,400. Under the statute of decent and distribution, Ms. Gore would be entitled to one-half of the interest and the children would each be entitled to a one- sixth interest. Ms. Gore has proposed that she buyout the interest of the three children for $9,733.33 each. In addition, the house on the property has been rented since the date of death. The home rents for $375 per month and in eleven months, it has produced $4,125 of income. Expenses for the home during that period of time are enclosed on the attached handwritten explanation which shows the expenses from June, 1994, through April, 1995. The total expenses were $2,002.20. Sue is responsible for one-half, or $1,001.10, and each child is responsible for $333.70/ The net due then to the children would be $35~. 80 on this particular asset for their share of the income stream. The Mr. Z's contract, which pays $550 per month, has earned $6,050 ~ for the past eleven months. Each child's share would be $1,008.33.-~ In addition, each child will be entitled to $91.66 per month until the contract is paid off. The balance of the contract as of May, 1994, was $54,947.90. This totals $11,095.39. However, please keep in mind that each child would receive their one-sixth interest in the payment on the Mr. Z contract as well. However, the following conditions of approval were set by the Council: 1. The SEPA determination be made and a comment period expire; 2. The water line connection be made between Longmire Street and Berry Valley Road at the developers expense; 3. Sidewalks be constructed, to City standards, along one side of the new street at developers expense; and 4. The developer must submit, to the City, a drainage plan that works within the 15,000 sq. ft area designated for that use. These conditions must be met prior to construction and/or final plat approval. PLEASE RETAIN IN YOUR FILES, THIS LETTER CONSTITUTES APPROVAL OF THE PRELIMIARY PLAT. The Preliminary Plat approval was granted under Title 16 of the Yelm Municipal Code. Pursuant to the requirements of Title 16, if construction has not substantially begun by September 28, 1997 the preliminary plat approval will explre at that time. Title 16 also contains the information on procedures and requirements for Final Plat Approval. Copies of Title 16 are availabe at City Hall. ITH1S MITIGATION AGREEMENT ("Agreement") IS made this I ~h day of 0-e.\a.:fe m!J;(1994, between the YELM COMMUNITY SCHOOLS DISTRICT NO 2, Yelm, Washington (the "DiStrIct") and Susan Gore (the "Developer") RECITALS A The Developer has subillltted an application to the City of Yelm for the construction of 17 duplex family dwelling umts, commonly known as Berry Valley Estates Yelm File No SUB 8112, (the "Project") The Project IS located on property that lies wIthm DIstrict boundanes, more particularly described on Exhibit A, attached hereto and mcorporated herein by reference. B The State Environmental Policy Act, Chapter 43.21C RCW ("SEPA"), provIdes processes and procedures whereby major actions by state and local agencIes, mcludmg, but not lIilllted to, plat or PUD approval or the issuance of bUIldmg permits, may be revIewed to determine the nature and extent of their Impact on the enVIronment. Impacts on public services, including schools, are enVIronmental impacts for the purposes of SEP A. SEP A requires the illltigatIon of adverse environmental impacts. C The DistrICt'S student population and growth projections mdicate that the ProJect will have an Impact on the DIStrict, when cumulative impacts of other projects are consIdered. D RCW 82.02.020 authonzes the DIStrict to enter into a voluntary agreement WIth the Developer for payment to illltIgate the Impact of the Developer's ProJect. E Pursuant to ResolutIOn No 12-16-93-05, It IS the polIcy of the DIStrICt to recommend that the dIrect Impact of development be voluntarIly mitigated by the payment of fees and other illltigation measures where appropnate. F The Developer has agreed to illltIgate, on a voluntary baSIS, the adverse Impact of the ProJect on the District. AGREEMENT NOW, THEREFORE, in consideration of the above reCItals and the mutual promises and covenants below, the DIstnct and the Developer agree as follows. I The Developer acknowledges and agrees that there is a direct Impact on the Distnct as a result of the Developer's Project and that tills Agreement is necessary as a result of that Impact. 2 The Developer acknowledges and agrees that m order to mitIgate the direct Impact of the Project, the Developer has offered to pay the DistrIct the following sum of money' One thousand and No/lOO Dollars ($100000) for each duplex family dwelling UnIt constructed or the total sum of seventeen thousand and No/lOO Dollars ($17,00000) (the "MitIgatIon Payment") for the 17 duplex fanuly dwellmg units. 3 Any extension, renewal, modification or amendment to the Project that results in an adJustment m the number of dwellmg units shall result m a corresponding pro rata adjustment m the Mitigation Payment. If the developer constructs smgle famIly umts the amount WIll be $650 00 per unit. 4 The Developer agrees that the payment of the full MitIgation Payment (m the amount of one thousand and No/lOO Dollars ($100000) per duplex famIly dwellmg unit or seventeen thousand and No/lOO Dollars ($17,00000) for the proJect, shall be a condItion of buildmg permit Issuance and shall be made pnor to or at the time of bUIldmg permIt Issuance for each family dwelling umt constructed m the project. 5 partIes. DRAINAGE REPORT Section 1 - Project Description The proponent of thts project IS applYIng for prelimInary plat approval, clearing, grading and utilitIes permits for the plat of Berry Valley Estates. The project site address IS 301- 305 Longmire Street; Yelm, Washington. The legal descnptIon of thIS parcel of land is found on the face of the prelinunary plat. The Assessor's Parcel numbers for this tract of land is 21724410800 and 21724410801. This property is zoned R-2, Multi-Family ReSIdential. There are no other known permits required for tlus project. This project is to create 17 residential lots with an open space tract on 4 95 acres of land. There is one existing duplex and one existing single family home on this parcel with separate lots being created around each of the existing structures. All of the newly created lots will be served by City of Yelm water and sanitary sewer There will be one infiltration pond constructed to infiltrate the storm water runoff from the developed SIte into the natIve soils. There will be an emergency overflow constructed for flows In excess of the 100 year storm event. This overflow spillway will be directed to Berry Valley Road's eXistIng roadSIde ditch. "Best Management PractIces" (BMP's) will be used throughout thIS project to control erosion and treat the stormwater runoff before infiltrating Into the soils The use of mulches, seeding, filter fabric fences, plastic sheeting, etc., will be used to control erosion from the SIte during construction. BlOfiltratIon swales will be incorporated into the final designs to treat the stormwater runoff from the fimshed project. All dIsturbed soils shall be seeded upon completIon of thIS project. A maIntenance schedule for the storm drainage facilities IS included in thIS report. Section 2 - ExistIng Conditions This project IS located on the eastern edge of the Thompson Creek SubbaSIn of the Nisqually RIver Drainage Basin. The site coverage is typical of the greater Yelm area within this subbasin. The coverage consists mainly of grasses native to the McKenna Prairie. There area few scattered trees around the existIng homes on this site. The slope of the ground is from the southwest to the northeast corner of the site. The average slope of the site is approximately 3.5 %. The ground is fairly flat in the area of the stormwater infiltration pond. There is no known surface water runoff entering this SIte from off sIte properties. There are no creeks, lakes, wetlands, ravines, steep slopes or other environmentally sensitive areas on or adjacent to this project site. Page 10 This site is located in an aquifer sensitIve area as mapped by Thurston County. There are no existing storm drains, channels or swales within the subject property There are no known reports that will impose additional measures on this project. Section 3 - Soils The SCS soils classIficatIon for this site IS a Spanaway gravelly sandy loam. This soils series IS a very deep and excessIvely drained soils. This soil was formed in the glaCIal outwash of the Vashion Glacier. The surface layer of the Spanaway series IS typically a black gravelly sandy loam that is approXImately 15 inches deep The subsoil is approximately 5-mches tluck and IS a yellowish brown very gravelly loam. The substratum is a dark yellowish brown extremely gravelly sand that is 60-inches deep or more. Permeability of this soil series is moderately rapid, 2-6 inches per hour in the subsoil horizon with the substratum having permeability rates bemg very rapId, greater than 20- inches per hour. The Spanaway gravelly sandy loam has a low water holdmg capacity Runoff from this soils series is slow and the eroSIOn hazard IS slight. Soil logs will be dug on this site to verify the soils series as part of the final designs of this project. This soils series is consistent with the soils found on various construCtIon projects in the surrounding area. Section 4 - Wells and Septic Systems: There are no known wells on this site. This property along with the surrounding SItes are currently served by the City of Yelm Water System. The two eXIStIng homes on tlus SIte have existing metered water servIces. The two existing homes on this project site currently have on SIte septIc systems that will be connected to the City of Yelm's new S T E.P sanitary sewer system. Section 5 - Fuel Tanks There are no known eXIstIng fuel tanks located on this SIte. Fuel tanks are not planned as part of this project. Page 11 Section 6 - Subbasm Descnption: There is no offsite dramage that is directed to this site from other properties. Surface water runoff from this soils senes is slight as stated in the soils section of tlus report. There is no evidence of any surface water runoff entering this property The existing drainage system from thIS site is along Berry Valley Road's roadsIde ditch. ThIS roadway slopes northwesterly towards Thompson Creek the receiving waters. All runoff generated from this project will be inf11trated into the native soils. There are no emergency servIces located along the above described flow path. There are no known hazardous matenals that are or will be handled or transported in the area tributary to the storm dramage facilitles proposed for thIS project. Sectlon 7 - 1 00 Year Flood ThIS property does not contain or abut an existing stream, nor does this SIte lie WIthin the 100 year flood hazard zone of any stream. GeotechnIcal Analysis: There are no slopes steeper than 25% on or near this project. The average slope is 3.5% in the project site. Smce the 25% slope is not exceeded on this project, a geotechnical analysis is not required. E. Inspection Sequence. CIty of Yelm and Howard Godat & Associates shall inspect all erosion and drainage facilities for this project.
