Sox 479 Yelm, WA 98597 This is a follow -up to the Pre - Application meeting held on June 4, 2008 at the Yelm Community Development Department to discuss the smoking /beer garden area at the rear of your building located at 107 Yelm Avenue East. The meeting was held to inform you that the smoking /beer garden area was in violation of provisions of the Yelm Municipal Code. Specifically, the existing covered area at the rear of the building which is currently being used for the smoking /beer garden is considered an expansion of use and additional square footage. In order to comply with the City regulations, the covered area would only be allowed through the process of Site Plan Review. I have also attached a copy of the notes from that meeting for your reference. As a result of the meeting, you informed the City that you would comply with City regulations by submitting an application to begin the Site Plan Review process. The only document that has been submitted by you is a building permit application. Although a building permit is also required for the expanded use, it cannot be processed until a Site Plan Review approval has been issued. Please note that the City has not approved the use of the existing outside smoking /beer garden area therefore, your business is in violation of the City of Yelm Zoning Code, Chapter 17.84 YMC the International Building Code as adopted by the City of Yelm requires the issuance of a building permit for such an expansion.
