Prairie Heights.-Division HI, received preliminary plat approval from the City on July 18, 1994 At
the time of preliminary approval the project is vested under the adopted development standards,
including zoning designation, in place at the time of approval
The project site was zoned R-2 and the project was approved for up to 13 duplex units Under
the R-2 zone you also have the option of building single family residences on each lot or any
combination of single family and duplex, as long as the overall density of 26 residential units is
not exceeded
The vesting of development standards and the preliminary plat approval run concurrently The
expiration date of the preliminary plat approval and the vesting of development standards expire
on July 18, 1999 A one-year extension may be approved provided the applicant files a written
request for extension at least 30 days prior to the expiration date Extension approval is granted
upon demonstration that the applicant has made a good faith attempt to submit the final plat
within the five-year period

Enclosed IS a copy of the recorded Mitigation Agreement between the
developer and the Yelm CommunIty Schools DIstrict. This document is
now part of the process that leads to final plat approval. Construction
permits will be issued based on receipt of agreed fees as outlined In the
MitIgatIon Agreement. The District collects the fees and issues releases to
the developer. All you need to do IS ensure that the developer has a release
prior to iSSUIng a building permit for any constructIon in PraIrie Vista
development. This Mitigation Agreement is therefore a covenant on the

THIS MITIGATION AGREEMENT ("Agreement") IS made this ItS day of

Washington (the "DIStrict") and EAR Enterprises(the "Developer")
RECITALS
A. The Developer has subrrntted an applIcatIon to City of Yelm for the constructIOn of
13 multI farrnly dwelling (duplex) umts, commonly known as PrairIe HeIghts, DivISIOn 3 (the
"Project") The Project IS located on property that lies WIthin DIStrict boundaries, more particularly
described on Exhibit A, attached hereto and incorporated herem by reference.
B The State EnVIronmental Policy Act, Chapter 43.21C RCW ("SEPA"), provides
processes and procedures whereby major actIons by state and local agencIes, mcludmg, but not
lIrrnted to, plat or PUD approval or the issuance of bUIldmg permIts, may be revIewed to determIne
the nature and extent of theIr Impact on the environment. Impacts on publIc servIces, Including
schools, are envIronmental Impacts for the purposes of SEP A. SEP A reqUIres the mitigatIon of
adverse envIronmental Impacts.
C The DIStrICt's student populatIOn and growth projections mdIcate that the Project
WIll have an Impact on the District, when cumulative 1Illpacts of other projects are considered.
D RCW 82.02 020 authOrIzes the DIStrict to enter Into a voluntary agreement WIth the
Developer for payment to mitIgate the impact of the Developer's Project.
E Pursuant to ResolutIon No 12-16-93-05, It IS the policy of the District to
recommend that the dIrect Impact of development be voluntarIly rmtIgated by the payment of fees

NOW, THEREFORE, In consideratIOn of the above reCItals and the mutual pronuses and
covenants below, the DIstnct and the Developer agree as follows.
1 The Developer acknowledges and agrees that there IS a direct Impact on the DIStrIct
as a result of the Developer's Project and that tills Agreement is necessary as a result of that impact.
2 The Developer acknowledges and agrees that In order to Ill1tIgate the dIrect Impact
of the ProJect, the Developer has offered to pay the Distnct the following sum of money. Five
Hundred and No/lOO Dollars ($50000) for each family dwellIng unit or One Thousand and
No/lOO Dollars ($1,00000) for each duplex umt or the total sum of ThIrteen Thousand and
No/lOO Dollars ($13,000000) (the "MitigatIOn Payment") for the 13 duplex units.
3 Any extensIOn, renewal, modIfication or amendment to the Project that results In an
adjustment In the number of dwelling units shall result In a correspondIng pro rata adjustment In
the MitIgation Payment.
4 The Developer agrees that the payment of the full Mitigation Payment (in the
amount of One Thousand and No/lOO Dollars ($1,00000) per duplex unit or ThIrteen Thousand
and No/lOO Dollars ($13,00000) for the project, shall be a condItion of bUIldIng permIt Issuance
and shall be made pnor to or at the tIme of buildIng permIt Issuance for each duplex umt In the
project.

The DIstnct agrees to record this Agreement after it has been executed by the

7 The Developer agrees that the District has five (5) years from the payment date to
spend the MitIgation Payment for the capItal Improvements or expenditures described in
paragraph 6 In the event that the MitigatIon Payment IS not expended withIn those five years, the
moneys WIll be refunded wIth Interest at the rate applied to judgments to the property owners of
record at the tIme of refund, however, If the MitIgation Payment is not expended within five years
due to delay whIch IS attributable to the Developer, the Payment shall be refunded WIthout interest.
8 The Developer waives and relInquishes its right to protest or challenge the payment
of the MitIgation Payment pursuant to this Agreement and hereby covenants and undertakes that It
forever refraInS and deSIsts from instItuting, assertIng, filIng or bnngIng any lawsUIt, lItigatIon,
claIm, or challenge or proceeding to challenge this Agreement, claim any repayment or
reImbursement of funds, performance or Improvements provided for thereIn, or any of ItS terms
fu'1d conditIOns, on any ground or basis whatsoever
9 The Distnct hereby WaIves any objectIOn to the Project as presently proposed.
10 The DIstnct and the Developer agree that the MitIgatIOn Payment wIll be full and
complete Ill1tigatIon for the impact of the Project as presently proposed on the DistrICt.
11 This Agreement shall be bIndIng upon and Inure to the benefit of the heirs,
executors, adIll1mstrators, successors, and aSSIgns of both of the Developer and the District.
12 If an action must be brought to enforce the terms of thIS Agreement, such actIOn
shall be brought In Thurston County Superior Court. The preVaIlIng party shall be entItled to
payment of its costs and reasonable attorneys' fees.
13 This Agreement constItutes the entIre agreement between the partIes and any other
agreement eIther written or oral shall be null and VOId.

BACKGROUND:
The City received an application for prel~inary plat on May 18, 1994. Since
that time, the City has been working with the proponent on the application.
BASIC FACTS:
Proponent: E.A.R. Enterprises
Proposal: Prel~inary plat approval for a 13-lot residential multi-family
(R-2) subdivision.
Public Notice: Notice of Public Hearing was published in the Nisqually
Valley News on June 23, 1994, posted in public area on June 23 and mailed to
adjacent property owners on June 23, 1994. Mailed to all on the Planning
Commission mailing list on July 1, 1994.
Location: 3.1:t acres on the east side of Vancil Road, adjacent to and north
of prairie Heights, Division 1, approximately BOO' south of Yelm Ave.
Comprehensive Plan: This proposal rreets the Comprehensive Plan designation
for this area.
Zoning: Multi-family residential (R-2).
Area Land Use: Irrmediately adjacent area to the north is zoned C-1
Corrmercial (current use - apartrrents), to the east is Thurston County
residential 1/5, to the west multi-family residential (Prairie Heights
Division 2), and to the south multi-family residential (Prairie Heights
Division 1).
Shoreline: N/A
Critical Areas: Sensitive Aquifer
Resource Lands: N/A
Historic Structures: N/A
Soils and Geology: Nisqually loamy fine sand and Spanaway gravelly sandy
loam.
Topography: Mostly flat, approximately a 2% slope.
Air Quality: Should not substantially affect the air quality.
Parking & Traffic: 52 off-street parking spaces are included in the
proposal, which meets Yelm' s requirements. Mitigation through SEPA for
traffic ~pacts for the Five-Corners intersection/Y-2 Alternate Route: 9
evening peak hour trips @ $300.00 per trip = $2,700.00 mitigation.
Solid Was te: LeMay Garbage Service.
Wastewater: ERU's are available for this proposal. Hookup shall be to the
Yelm STEP sewer system.
Water Supply: City of Yelm water supply.
Stormwater: Must meet the requirements of the Drainage and Erosion Control
Manual for the City of Yelm. A re-submittal of the Preliminary Drainage
Report is currently under review (by Bob Connolly, Skillings-Connolly) i a
recorrmendation will be provided at the July 7 Public Hearing.
Open Space: Open space for prairie Heights Division 3 has been provided for
in Prairie Heights Division 2. This open space area meets the requirements
for Division 1-3.
Power and Energy: Puget Power, Washington Natural Gas.
Noise: Low.
Disaster Risks: Low.
Fire Protections: Thurston County Fire District #2.
Police Protection: City of Yelm.
APPLICABLE STANDARDS AND POLICIES:
State Law: This proposal has conformed to all applicable State laws.
State Environmental Policy Act (SEPA): The City of Yelm has issued a
Mitigated Determination of Non-Significance, the corrment period expires on
Friday, July 15, 1994.
Yelm Municipal Code: This project shall conform to the City's Municipal
Code.
Comprehensive Plan: Comprehensive Plan designation is R-2, multi-family
residential. This proposal conforms with the R-2 zoning requirements.
Design and Development Standards: The internal road section in the "draft"
Yelm development standards has been used for this project (30' paved roadway
section, concrete wedge curbing and concrete sidewalks on one side of the
street, with no roadside swales).
City of Yelm Public Works and Engineering: A recorrmendation lS forthcoming
by July 7 from Bob Connolly, Skillings-Connolly.

Staff Recommendation:
The City of Yelm Planning Department recommends approval; conditioned on the
environmental checklist and SEPA canment period on the MDNS ending on July
15, 1994, and a favorable recommendation from Bob Connolly regarding the
drainage.
Also, that the Site-Plan approval include the Five-CornersjY-2 Alternate
Route mitigation from the MDNS (9 evening peak hour trips @ $300.00 per trip

Section 1 - PROJECT DESCRIPTION.
The proponent of this residential subdivision is applying for preliminary plat approval
and will be applying for clearing, grading and utility permits when the final designs are
submitted to the City of Yelm for their review and approval This project is located on
the Vancil Road, 530 feet south of State Route 507. The legal description of this
project is as follows
Boundary Line Adjustment BLA-8113 as recorded under Auditor's File #9403250286
in Volume 15 of BLA's at Pages 324-327, records of Thurston County, Washington
The assessor's tax parcel number 227-30-140500 This project is zoned residential
multi-family residence, R-2 No other permits are known to be required for this project
This project will create thirteen (13) residential lots when the project is completed.
The project will be served by City of Yelm water and sewer, no septic systems will
be installed Infiltration trenches will be utilized to infiltrate the stormwater runoff into
the native soils There will not be a point of discharge from this project, all stormwater
will be infiltrated into the native soils
Best Management Practices such as the use of filter fabric fences, straw mats and
plastic sheeting will be used during construction to prevent siltation of the existing
and proposed storm drainage facilities All disturbed areas shall be stabilized and
seeded after the roadway and utility construction is complete. There will be an erosion
control plan prepared as part of the final designs of this project
Section 2 - EXISTING CONDITIONS.
This property and the surrounding area is very open with very few trees or understory
The existing cover is mainly grasses as this site has been used as pasture land in the
past The land, generally speaking, slopes from the south to the north with the
average slope being approximately 1 8% The steepest slope on this site is
approximately 2% There is no defined drainage coarse(s) entering or leaving this
property Any stormwater runoff that would find its way onto this property from off-
site is by sheet flow
There are no creeks, lakes, wetlands, gullies, steep slopes or other environmentally
sensitive areas on this site or immediately down gradient of this site
This property is located in an Aquifer Sensitive Area as mapped by Thurston County
There are no other known reports or plans that will impose additional requirements on
this project

Section 3 - SOIL REPORT:
The SCS soil survey for Thurston County has mapped this area as a Spanaway
gravelly sandy loam This is consistent with the soil test pits that were dug on this
site for Divisions One and Two The soil log map and the soil descriptions can be
found at the end of this section of this report New soil logs will be dug for the final
designs of Division Three
The Spanaway series soils is a very deep somewhat excessively drain soil that was
deposited by glacial meltwater of the Vashon Glacier as it receded This soils series
has a low water holding capacity and has a high hydraulic conductivity The
permeability is moderately rapid to very rapid with infiltration rates in the range of 2 0
to 6 0 inch/hour Erosion of this soil is slight and runoff is slow The SCS hydrologic
group for the Spanaway soil is a Class "B" Groundwater was not encountered in any
of the soil test pits

Section 4 - WELLS.
There is one well on this site that will be abandoned as per the State Department of
Ecology standards for well abandonment. Potable water for this project will be
supplied by the City of Yelm
Section 5 - FUEL TANKS.
There are no known fuel tanks on this site nor are any planned as part of this project
Section 6 - SUB-BASIN DESCRIPTION.
This project is located in the Yelm Creek Sub-Basin of the Nisqually Drainage Basin as
mapped by Thurston County
The off-site tributary area for Division One is approximately 12 acres and Division
Two, the off-site tributary area is approximately 10 acres, Division Three offsite
tributary area is 1 14 acres Both off-site areas for the most part are undeveloped and
is being used as pasture land The average slope of the land is approximately 1 5 %
for both off-site tributary areas. There is no evidence that any runoff from the off-site
area is entering this site in a defined drainage channel If runoff is entering this site
it is by sheet flow across the existing terrain Since the existing soils are very porus
with very high infiltration rate, the runoff rate is very low
All the stormwater runoff from this project will be infiltrated into the native soils
There will not be a metered release rate to off-site properties There are no emergency
services located on or in the immediate area of this project
There are no known hazardous materials that will be handled on this site or
transported in the area tributary to this projects drainage facilities
Section 7 - 100 YEAR FLOOD ANALYSIS.
This project does not contain or abut a stream nor is this projected located within a
100 year flood hazard zone
Section 8 - AESTHETIC CONSIDERATIONS.
All disturbed areas of this project will be seeded upon completion of construction The
biofilter swales and detention ponds will be seeded or sodded with a grass seed
mixture compatible for this use

EROSION CONTROL PLAN
A Construction Sequence and Procedure'
Prior to the commencement of any clearing, grading or filling activity for these
improvements, all erosion control measures, including installation of a stabilized
construction entrance if required, shall be installed in accordance with the
details and specifications shown on the erosion control plan
B Trap Sediment.
The installation of a filter fabric fence as shown on the erosion control plan to
treat silt laden runoff from the exposed soils As indicated in Section IV-A of
the drainage and erosion control manual, protection of proposed and existing
storm drainage facilities is an absolute necessity Additional erosion control
measures may be necessary during construction and is the contractor's
responsibility to ensure that erosion to future and existing drainage facilities

The storm drainage for this project include catch basins, a piping conveyance
system, a grass lined biofilter swale, an infiltration pond and an infiltration
trench

Operation and maintenance of the storm drainage facilities within the public
rights-of-way is the sole responsibility of the City of Yelm The association will
maintain the infiltration pond

Maintenance of the drainage facilities shall, as a minimum, follow the schedule

significant environmental impact:
The applicant shall contribute financially to the Five-Corners
intersection improvement and/or the Y-2 Alternate Route as specified in
the 1992 Yelm Comprehensive Transportation Plan. Contribution is based
on the number of evening peak hour autanobile trips generated by this
site. Contribution for the proposed site shall be for 9 evening (PM)
peak hour trips through the Five-Corners intersection at $300.00 per trip
= $2,700.00.
The applicant shall agree to submit an agreement walvlng any right the
applicant might have to protest the fornation of a Local Improvement
District (LID) or Latecomer's Agreement.
