At this point the matter is being forwarded to you for issuance of a criminal misdemeanor citations as per Yehn's Nuisance Ordinance ( 9415). Copies of all related correspondence are included. Gary Carlson February 21, 2002 Enforcement Officer NOTICE TO ABATE UNSAFE OR UNLAWFUL CONDITION (NUISANCE) To: Roger and Bev McKown As owner, agent lessee or other person occupying or having charge or control of the building, lot or premises at: 10502 SE Grove Rd You are hereby notified that the enforcement officer of the City of Yelm has determined, pursuant to chapter 9.48 of the Yelm Municipal Code, that there exists upon or adjoining said premises the following condition(s) to the contrary to the provisions of chapter 9.44 of the Yelm Municipal Code. PLEASE SEE ATTACHMENTS FOR DETAILED INFORMATION You are hereby further notified to abate that condition to the satisfaction of the city within 15 days of the date of this notice. If you do not abate the condition within 15 days the city can abate the condition at your expense. In addition, your failure to abate the condition will be considered a violation for which you may incur monetary penalties as provided in sections 9.44.015 and 9.48.040, Yelm Municipal Code, for each day or part of day that the condition continues to exist. Alternatively, failure to abate nuisance may prosecuted as a misdemeanor under section 9.48.050 Yelm Municipal Code. Written Notice has been sent to the owner /lessee by certified mail. Copies of the abatement letter and notice of delivery are attached. Box 929 Yelm, WA 98597 -0929 Re: Abatement Dear Mr. & Mrs. McKown, On November 28, 2001 the City of Yelm sent you a letter (copy attached) requesting removal of parked vehicles and a plan for appliance /construction material clean up of your property at 10502 SE Grove Rd. I have not received a response from you. After several attempts to contact you by phone with no success I have no recourse but to start the abatement process. You will have 15 days from receipt of this letter to complete the clean up requested or face civil action. At this late date I cannot accept anything but full compliance with the letter. Box 929 Yelm, WA 98597 -0929 Re: Business License Dear Mr. & Mrs. McKown, It has come to my attention that you have opened your business, AM /PM Thrift and Gift. Your new business does not change the occupancy of the building and I am processing your application. You will still be responsible for maintaining Fire Safety and ADA requirements as under your previous business. A routine Fire Safety Review will follow this letter in about a week. During by review of your application it was noted that you have a number of vehicles stored on your property. City Ordinances (attached) limit outside storage to 30 days. It was also noted that you have a large number of appliances, construction debris and other miscellaneous debris that are prohibited under our Nuisance Ordinances. Due to the fact that the Holiday Season is the busiest time for a new retail business I am requesting that the vehicles be removed by January 1, 2002 and that the City of Yelm has received a plan from you by January 7, 2002 showing timely and targeted removal of the debris and appliances.
