NOTICE IS HEREBY GIVEN pursuant to Section 17.102.010 YMC that your use of
property at 10535 Grove Road SE, Yelm WA is in violation of the Yelm Zoning Code,
Title 17 YMC.
ALLEGATIONS OF FACT
Del Regnow owns or controls real property within the City of Yelm, identified by
tax parcel number 64303400600 and described as Section 29 Township 17
Range 2E Plat MCKENNA IRRIGATED TRACTS BLA -8118 LT 1 Document
015/612 and located at 10535 Grove Road SE, Yelm WA 98597.
2. On or before December 28, 2006, the portion of the property located at the
corner of Grove Rd. and SR 507 was found to be utilized as RV storage and
being operated by Del Regnow.
3. Although the subject property is identified by the Yelm Zoning Code as being
within the Large Lot Commercial district which allows recreational vehicle
storage, the previous land use approval for the mini storage required that the
portion of land at the corner of Grove Road and SR 507 be reviewed separately
for site development and use.
4. Del Regnow was contacted by Nisha Box, Assistant Planner with the City of
Yelm through a first violation letter dated December 28, 2006 stating that the
previous land use approval for the site did not include the portion that is currently
being used for RV storage. Any commercial use of that portion of the site would
require additional site plan review. The letter also suggested that the owner
attend a pre- submission meeting.
5. On January 17, 2006, Mr. Regnow called Nisha Box at the Community
Development Department in response to the letter providing reassurance that he
would be scheduling a pre- submission conference to address the problem.
6. To this date, no action has been taken by the property owner between the date of
the first violation letter and the date of this notice of violation to bring the property
into compliance.
ALLEGATIONS OF LAW
A. The above described real property is within the City of Yelm
B. The above described development is in violation of the Yelm Zoning.

C. The property owners failed to comply with a letter of correction issued by Nisha
Box, Assistant Planner.
IT IS ORDERED THAT Del Regnow or any other person acting as his employee or
agent shall either desist the use of the above mentioned property, or submit a complete
site plan review application to the Community Development Department no later than
March 15, 2006
Failure to comply with the terms of this notice of violation may result in further actions by
the City of Yelm, including, but not limited to the issuance of civil penalties of up to
$250.00 per day of violation or further enforcement action through a court of competent
jurisdiction.
