University Place, WA 98466 Dear Mr. Zicaro: City of Yelm Community Development Department 105 Yelm Avenue West P.O. Box 479 Yelm, WA 98597 It has been brought to the attention of the Community Development Department that your property located at 303, 301 McKenzie Avenue SE, Yelm WA 98597 is in violation of the provisions of the Yelm Municipal Code (YMC). The Community Development Department has been notified of 3 Hawthorn trees located within the city right -of -way that have been destroyed. No contact was made with the City for the removal of these trees. The City has adopted a Tree and Vegetation Ordinance for the protection and maintenance of trees located in the right -of -way. The Hawthorn Trees that line Yelm Avenue, and adjoining streets were planted in the 1930's, and are historically significant to the City. Section 14.16.070 YMC,states; "The planting or removal of Hawthorn or other trees of city historical significance located in the city right -of -way or other public place shall require approval of the city council, based on recommendation by the tree board." Section 14.16.150 YMC states "Any person who violates the provisions of this chapter or fails to comply with any of the requirements shall be guilty of a misdemeanor and shall be punished by the statutes of the state for the commission of a misdemeanor." The City of Yelm Tree Advisory Board conducted a street tree inventory in 2004 which included Hawthorn Trees along Yelm Avenue. The Hawthorn Trees are of approximate size, health, and age to the ones that were destroyed. An appraisal of a Hawthorn tree was performed in 2003 by a Certified Arborist found the value of the tree to be $900.00. Based on the age and location of the tree, I am confident that the value of the trees destroyed are equal. If you have rental tenants at this site, you may wish to make them aware of this, to prevent further damage to the remaining trees.
