Yelm, WA 98597 Re: Notice of Final Decision - Use of Storage Containers for Storage of Seasonal Merchandise Dear Mr. Stahl: The Site Plan Review Committee (SPRC) has reviewed and considered your request to use storage containers to store seasonal merchandise. The SPRC review and decision is based on Yelm Municipal Code, Chapter 17.57.060, Storage which states: In the conduct of any business, the storage of merchandise, raw materials, equipment, fixtures, scraps or solid wastes shall comply with the following requirements: A. Every reasonable effort shall be made by persons operating a business to store all such materials within an enclosed building, with the following exceptions: 1. Where such inside storage is not practical or desirable for reasons related to health, fire or safety codes; 2. Where the outside storage of merchandised, manufactured products or raw materials is normal and standard practice, such as in the sale of automotive equipment, mobile homes, lumber, gardening materials, nursery stock and the like, or on the site on construction projects; 3. When materials or products are temporarily stored outside incidental to shipping, delivery, loading or unloading thereof. The SPRC finds that the request is not consistent with the Yelm Municipal Code and must deny your request. I have enclosed Chapter 17.57.060 for your review. Use of the storage containers is a violation of Chapter 17, Zoning and subject to remedy. Chapter 17.102, Violations states that: Violation of the provisions of this title or failure to comply with any of its requirements shall constitute a misdemeanor and such violation shall be punished as provided by the statutes of the state for the commission of a misdemeanor. Each day such violation continues shall be considered a separate offense. The per day fine will be assessed as per the city's bail schedule. I have enclosed a copy of Chapter 17.102 for your review. This decision is a Type I Permit, Ministerial Decision and can be appealed to the City Council. Pursuant to Chapter 15.49.160, a notice of appeal shall be filed within fourteen days of notice of final decision. If you would like to file an appeal to the City Council, it must be filed no later than October 31, 2001. I have included an application for your convenience. I have also enclosed a copy of City correspondence, dated November 8, 2000, regarding the same request last year.
