NOW, THEREFORE, IT IS HEREBY AGREED BETWEEN THE PARTIES AS FOLLOWS: 1. From the time of acceptance by the City, the facilities have belonged to the City and the City has been and will be responsible for their maintenance and operation, and shall be entitled to all revenues derived from the transmission of water through said lines. 3. There is attached to this contract, designated as Exhibit "B", a listing of the cost of construction of said lines, including all direct benefits of said watermain construc- tion and a determination of all applicable sales taxes, a listing of parcel numbers of all properties along said lines which can be directly connected thereto, said prop- erty parcel numbers being also shown on Exhibit "A", and which properties have not paid their full pro rata share of the cost of construction of said water facilities. SE SEWER MAIN EXTENSION AGREEMENT THIS AGREEMENT, entered into this _rL /I d-cf- day of IG~ 1994, between the City of Yelm, a municipal corporation, herein- after referred to as the "City", and The Springfield Development Company, Inc., a Washington Corporation, herelnafter referred to as the "Developer", WITNESSETH: WHEREAS, the Developer has extended the City's sewer system to property owned by the Developer by the construction of a six inch (6") sewer line, which said sewer line will pass by properties which will benefit directly from said construction, as shown by Exhibit "A", and the Owners of which may wish to use said sewer llne In the future; and WHEREAS, the City has accepted said sewer line as part of the City's sewer system and in return is willing to collect from future users of sald sewer line their pro rata share of the cost of said lines to be reimbursed to the Developer. NOW, THEREFORE, IT IS HEREBY AGREED BETWEEN THE PARTIES AS FOLLOWS: 1. The developer has supplied all materials and performed all labor for the construction in accordance with the stand- ards of the City of Yelm a six inch (6") sewer line, to- gether with all valves, fittings, and other necessary ap- purtances over the following described route. Said sewer line extensions have been completed to the City of Yelm standards, and in accordance with the plans re- ferred to herein and approved by the City and the City has accepted ownership of said sewer line and facilities, and the Developer has executed the documents necessary to place complete ownership of said lines in the City. From the time of acceptance by the City, the facilities have belonged to the City and the City has been and will be re- sponsible for their maintenance and operation, and shall be entitled to all revenues derived from the transmission of sewage through said lines. 3. There is attached to this contract, designated as Exhibit ~B", a listing of the cost of construction of sald lines, including all direct benefits of said sewer main construc- tion and a determination of all applicable sales taxes, a listing of parcel numbers of all properties along said line which can be directly connected thereto, said proper- ty parcel numbers being also shown on Exhibit "A", and which properties have not paid their full pro rata share of the cost of construction of said sewer facilities. For a period of fifteen (15) years from the date of final ac- ceptance of said sewer mai~ by the City of Yelm sald date being nt-V- 2. ,Y>. No person, firm or corporation shall be granted a permit or be authorized by the City to connect to or use such facilities during the period of time described in Para- graph 3 of this Agreement without first paying to the City for its own account for such connection or use, the amount required to reimburse the Developer for the pro rata share of cost of said construction of each of said facilities in accordance wlth the schedule ln Exhiblt "B" hereto. All sums so received by the City shall be re- mitted to the Developer within sixty (60) days after the receipt thereof. 5. Whenever any connection is made into the facilities cov- ered by this Agreement without such payment having first been made in accordance with Exhibit ~B", the City may re- move or cause to be removed such unauthorized connection and all connecting lines or pipes located in the facility right-of-way and dispose of such material removed with- out any liability whatsoever. 6. Box 479 Yelm, WA 98597 Re: Prairie Creek Latecomer Agreement and Wood Field Subdivision Dear Ms. Carlson: This letter is to confirm our telephone conversation yesterday_ (7/31/95) wherein I lnquired about some work being done adjacent to my Prairie Creek subdivision on Middle Road. The work turns out to be a subdivision (Wood Field), which is being developed on the property immediately adjacent on the west side of Prairie Creek. As I am an adjacent property owner, owning approximately 32 parcels of land within a 300-foot radius of the project, you are required to notify me of the public hearing concerning the application for preliminary plat on this property. I have owned these parcels of land since April 30, 1993 (see enclosed Warranty Deed). As you can see, my property purchase was handled by Transamerica Title Company, the same company that you say furnished the property owners list for a 30G-foot radlus of the Wood Field project. I failed to receive any notice concerning the development of Wood Field. I believe that when you have failed to give proper notice, that the process of plat application and public hearing must be redone. I am partlcularly concerned, because I am supposed to have a latecomer agreement with the City of Yelm for the installation of utilities which front Wood Field subdlvision. This latecomer agreement was begun in October 1994 by the then current Planner for the Clty of Yelm. To date, I have received no copy of the recorded latecomer agreement. Now I discover that the City of Yelm has a NEW Planner who has no knowledge of this latecomer agreement, and I am concerned that the ball has been dropped. Washington state law concernlng latecomer agreements requires that the latecomer agreement be recorded prior to a subject property connectlng to the utilities, otherwise, the latecomer agreement is invalid. Wood Field is reaching the stage in their construction where they are close to connecting to the utilitleS. YOU ARE HEREBY ON NOTICE THAT IF THE LATECOMER AGREEMENT IS NOT RECORDED IN A TIMELY MANNER IN ORDER TO SECURE ITS ~IDITY, THE CITY OF YELM WILL BE HELD RESPONSIBLE FOR ANY LATECOMER FEES walCH I AM UNABLE TO COLLECT. We reviewed the environmental checklist and have the following comments. 1. Stormwater, including highway runoff, should be collected and treated according to an acceptable standard before stormwater is discharged to ground and/or surface waters. For those jurisdictions that have not adopted Ecology's technical manual (stormwater Management Manual for the puget Sound Basin) or a manual approved by Ecology, the Ecology manual is considered an acceptable standard for the design and maintenance of water quality best management practices. 2. It is our understanding that the proposed development will be supplied domestic water by the City of Yelm. The Department of Ecology encourages the development of public water supply systems to provide water to regional areas and developments. It is, however, the responsibility of the water purveyor to ensure that adequate water rights have been secured for any service expansion. 3. State Board of Health rules require every owner of a public water supply to obtain written approval from the Office of Drinking Water, Environmental Health Programs, prior to any construction or alteration of a public water supply. 4. The proponent is responsible for inspecting the site to determine the location of all existing wells. Any unused wells must be properly abandoned and abandonment reports submitted to Ecology as described in WAC 173-160-415. Staff Recommendation: The City of Yelm Planning Department recorrmends approval of the rezone (fran R-A to R-1) and 26 lot preliminary plat application for Woodfield located South of Railway Road, East of First Street and West of Middle Road with the following conditions: 1. All applicable latecomers and planning fees to be paid prior to final pla t approval. 2. SEPA corrment period ending February 10, 1995. 3. As stated in the Mitigation of Non-Significance, the applicant shall contribute financially to the Five-Corners intersection improvement and/or the Y-2 Alternate Route as specified in the 1992 Yelm Comprehensive Transportation Plan. Contribution is based on the number of automobile trips generated by this site during the EM peak hour. Contribution for the proposed site shall be for 7new peak hour trips through the Five-Corners intersection at $300.00 per trip = $2,100.00. The applicant shall agree to submit an agreement waiving any right the applicant might have to protest the formation of a Local Improvement District (LID) or Latecomer's Agreement. 4. Sewer system hydraulic analysis and water system fire flow verification as stated on page #2. 5. Railway Rd. right-of-way dedication is required as shown on the site plan for frontage improvements. This letter provides the results of a traffic engineering analysis of the proposed Woodfield residential subdivision located in Yelm, Washington. The proposed subdivision consists of 26 single-family dwelling unit lots located on the south side of Railway Road, approximately 440 feet west of the Railway Road/Middle Road intersection. Based upon past traffic impact assessments performed for the City of Yelm, the following two issues are addressed · The number of vehicular trips per day generated by the project. · The number of PM peak hour tnps using the Five Corners intersection. In accordance with Table 4 1 of the Thurston County Drainage Design and Erosion Control Manual, the minimum live storage for the retention/detention facility with a 20 in/hr infiltration rate is 3,000 ft3 per acre of impervious surface and 1,000 ft3 per acre of pervious "disturbed area" As shown on sheet C2, each of the twenty six lots will be equipped with roof downspout french drain systems, similar to that shown in Appendix A, Figure A 14 of the Thruston County Drainage Design and Erosion Control Manual This decreases the amount of impervious area entering the storm system by 1 43 acres (2400 sf * 23 lots - neglecting 250 sf driveway area) The minimum storage volume calculations are as follows: Vimp = 3,000 * 076 = 2,280 ft3 V per = 1,000 * 5 08 = 5,080 ft3 Total min. storage = 7,360 ft3 A computer simulation utilizing the Santa Barbara Unit Hydrograph (King County, Washington) was also used to determine the minimum size of the infiltration facility This was done by taking the difference between the post developed hydrograph and infiltration discharge as shown in Figure 1 The data used for determining the post-developed hydrograph is listed below Area = 4.50 acres CN = 86 (fable D,2 - Lawns) Tc = 10 min. The methodology used in Appendix '0' in the design manual does not appear to take into account the extremely high infiltration rate of 20 in/hr This method takes the difference of total runoff of the post-developed site for the 100 year, 24 hour storm event, and the infiltration rate and used that for the infiltration volume. The pre-developed conditions of the site do not affect the retention of the 100-year storm for the post-developed site, therefore it is our best judgement that this section does not apply to the design of this particular development. Water quality will be BMP RD 11 Extended Detention Dry Pond per Puget Sound Stormwater Manual. This BMP will detain the design volume (6 month, 24 hour storm) for 24 hours for, thereby allowing removal of oil, grease, metals, and sediments from the runoff The pond will be lined with an impermeable fabric to ensure no percolation to groundwater Above the fabric will be a layer of sand and washed granular material, with a perforated pipe wrapped in permeable filter fabric to allow stagnant water to filtrate through the system. The perforated pipe will be connected to a control structure which uses a small orifice to achieve the required detention time. Once the design storm is exceeded, a modified catch basin will allow the excess flow to safely pass through the system into the infiltration facility The proposed infiltration facility will be a pond 134' long, with a 27' bottom width, a bottom slope of 1 0%, and a water depth of 4.9' to achieve the required volume of 18,373 fe SECTION #2 - EXISTING CONDITIONS The site is currently vacant and zoned 'For Residential Use' The 5.8 acre site is relatively flat with approximately 2% slopes toward the south west corner of the property The northern border of the site is Railway Road which is proposed to serve as access. The property further east along Railway Road is currently used as residential farmland, and because of the high infiltration rate and the flat slopes of the area, runoff from this property is not anticipated to impact this project. The southern border of the site is bounded by the existing Prairie Creek single family residential subdivision. This property is also relatively flat and appears to drain into the streets which serve as access. The westerly border of the project is currently used as residential farmland. This site is also predominately flat and slopes gently away from the project. The proposed 47,000 square feet of open space tract that surrounds the project is intended to provide a buffer to the adjacent land use. Utilities are currently adjacent to the site. An existing 10" waterline, gas line, and 6" pressurized sanitary sewer main are underground within the right-of-way of Railway Road. Power and telephone lines are currently above ground on poles within the right-of-way of Railway Road n ~ C C [ c c c c c c c c c c c c c c c c c c WOODFIELD DRAINAGE REPORT Yelm, Washington Page 6 SECTION #3 - INFILTRATION/SOILS REPORT A copy of the A soil report from Northwest Resource Consultants, prepared for a nearby project has been submitted with this report. SECTION #4 - WELLS and SEPTIC SYSTEMS According to the Thurston County Health Department, Environmental Services, there is no public record of any wells within the project area and no wells are proposed to serve the project. There is a well located approximately 30' from the north-western property line that is currently used to serve the adjacent farm. SECTION #5 - FUEL TANKS No fuel tanks are known to currently exist on the property The property is vacant. SECTION #6 - SUBBASIN DESCRIPTION From the subdivision entrance to the east and west edge of the property, a small drainage ditch currently handles runoff from Railway Road. After the 1/2 street construction, approximately 3200 sf of surface area will drain into this ditch. Because this drainage area is equal to the drainage area generated from two standard roof-drains, we propose to install two drywells with grated tops located at the East and West end of the project to provide infiltration of the runoff (250 ft3 including rock volume) There are no emergency services or environmentally sensitive areas along the flow path. Hazardous materials will not be transported or handled in the area tributary to detention/retention facilities proposed for this project. SECTION #7 - 100 YEAR FLOOD PLAIN The project is not located within the 100-year flood plain. SECTION #8 - AESTHETIC CONSIDERATIONS The buffer area that surrounds the property will be graded and landscaped to provide a visual screen from the adjacent properties. The existing vegetation will be saved and utilized when possible for aesthetics. The design of the street system will be completed to minimize the amount of excavation and disturbance to the area. SECTION #9 - DOWNSTREAM ANALYSIS The runoff generated from on-site street improvements and the off-site 1/2 street improvements will be infiltrated in several on-site infiltration facilities. NA SECTION #2 - TRAPPING SEDIMENT. As shown on sheet C3, Preliminary Erosion Control Plan, the primary erosion control measures to be utilized in construction conform with the Thurston County, Erosion Control Manual. The filter fabric fence will be placed on the west, south and east property lines to prevent any sediment from crossing the property line. In addition, a stabilized construction entrance will be constructed at the access point from Railway Road, and straw and hay bale barriers will be placed in the drainage ditch on Railway Road. Because of the mild slopes associated with the site, these measures should provide an adequate level of erosion control protection. The contractor shall be responsible for cleaning up any soil from vehicles leaving the site by means of broom and/or high pressure water SECTION #3 - PERMANENT EROSION CONTROL. NA SECTION #4 - GEOTECHNICAL REPORT. The retention/detention facility is not near the top of a slope steeper than 25%, thereby eliminating the potential for slope failure during any storm event.
