Parkmg ReqUirements
Ongmal Proposal - The code reqUired 62 stalls, however the approved plan reqUired 54
stalls be proVided. As allowed m the Central Busmess Distnct consIderatIOn may be gIven
to mdIvIdual SItes on the abilIty to provIde the reqUired parkmg stalls On the ongInal
approval a reductIOn of 8 stalls was allowed based on the available area for parking.
ReVIsed Proposal - The parking code would reqUire 57 stalls. However, the code does
allow for consIderatIOn of parking m the Central Busmess DIstnct. The staffhas agreed
a 35% (20 stall) reductIOn IS consIstent WIth prevIously approved projects m the Central
Busmess DIStnct. Therefore, the SIte would be requITed to provide 37 parking stalls. Ten
(10) new paved stalls would need to be proVided along the western SIde of the Pharmacy

STEP System
Ongmal Proposal- Phase I (downtown core area), of the STEP System reqUired all pnvate
systems to convert to the STEP System. Your deCISIon dunng the IllitIal planrung and
mstallatIon of the STEP System was not connect the Fire System, When the Fire StatIon
was proposed to be demolished on the ongmal Site plan no condItIons of approval for the
STEP system where applIcable.
Proposed - Your SIte IS m the Phase I area the fundmg source for the STEP Sewer System
and the City ComprehensIve Plan willch do not allow for pnvate on-SIte systems. The Fire
StatIOn IS not connected to the STEP System and IS currently on a septiC tank and
draInfield. The City can not allow the Fire Station to remain on the seotlc tank and
drainfield. To continue usin2 the Fire Station you will need to convert within 90
days to the City STEP System. There are two methods to accomplIsh tills.
The first would be consIdered temporary and m the long term may be more costly On
a temporary baSIS, up to SIX (6) employees at the Computer Busmess, the connection to
the STEP tank could be to the eXIstmg tank shared Wlth Isabel's, Mikey's Pub and the
Mamstreet Silver and Antiques. At such time the Computer Busmess mcreases to seven
(7) employees the building would need to mstall a STEP tank for the buildmg and connect
that tank to the system.
The second method would be to mstall a STEP tank munedtately and connect to the
system. You may want to discuss these opttons m further detail WIth Ken Garmann, Public
Works Director and/or your engineer

Concurrency Ordinance
WHEREAS, the Washington State laws governing the division or development of
property require a specIfic written finding as to the adequacy of facilities necessary to
serve proposed development; and
WHEREAS, the City of Yelm has adopted a comprehensive plan and capital
facility plan Identifying the levels of service necessary to accomplish concurrency; and
WHEREAS, the City desires to specify the standards and criteria for determining
concurrency wIthin the City of Yelm or its associated urban boundary,
WHEREAS, the City desires to set rates whIch are below those of surrounding
commUnities where possible,
NOW, THEREFORE, BE IT HEREBY ADOPTED
Section 1. Definitions
a Concurrencv-A determination that the faCilities necessary to serve a
proposed land development are In place or planned for and properly funded with a
reasonable expectation that the facilities will be in place at the time needed to preserve
adopted levels of service
b Development activity-Any construction or expansion of a building,
structure, or use, any change In use of a building or structure, or any changes In the use
of land, that creates additional demand and need for public faCilities
c Development approval-Any written authorization from the City which
authorizes the commencement of development actIvity
d Land division-The action of dividing land for sale or lease, whether
through the subdiVision process Identified in Chapter 58 17 RCW, the City's binding site
plan review process, or any other process which results in the creation or modification
of the boundanes of a property for purposes of development.
e Land development-Any action with respect to a parcel of real property
which requires plat approval pursuant to Chapter 58 17 RCW or site plan review
approval through Chapter 17 84 of the Yelm City Code, or master plan development
approval through Chapter 1762 of the Yelm City Code
f Owner-The owner of record of real property, although when real property
is being purchased under a real estate contract, the purchaser shall be considered the
owner of the real property if the contract is recorded

g Proiect improvements-Site improvements and facilities that are planned
and designed to provide service for a particular development project and that are
necessary for the use and convenience of the occupants or users of the project, and are
not system improvements No Improvement or facility included In a capital facilities plan
approved by the governing body of the City shall be considered a project improvement.
h Proportionate share-That portion of the cost of public facility improvements
that are reasonably related to the service demands and needs of new development.
Public facilities-Sewer service, water service, parks, schools, and roads
are the public facilities for which the City Will make specIfic findings of concurrency
based on the comprehensive plan
j Service area-A geographic area defined by the City in which a defined set
of public facIlities provide service to development within the area Service areas shall
be designated on the basis of sound planning or engineering prInciples
k. System imorovements-Public facilities that are included in the capital
faCllities plan and are deSigned to provide service to service areas Within the community
at large, In contrast to project Improvements
I Transportation FaCllitv Charqe-payment of money Imposed upon
development as a condition of development approval to pay for public facilities needed
to serve new growth and development, and that is reasonably related to the new
development that creates additional demand and need for public facilities, that IS a
proportionate share of the cost of the public facilities, and that is used for facilities that
reasonably benefit the new development. "Transportation Facility Charge" does not
include a reasonable permit or application fee
Section 2. Process
a Whenever a revieWing authority IS asked to consider the approval of a
diviSion of land for sale or lease or the approval of a site plan, the revieWing official shall
make a written determination of concurrency in connection with facilities proposed or
available for the project.
b With respect to each of the public facilities identified above, concurrency
shall be established and determined as follows
I Sewer'
(1) The project is within an area approved for sewer pursuant to
the adopted Sewer Comprehensive Plan for the City
(2) Improvements necessary to provide City standard faCIlities
and services are present or are on an approved and funded plan to assure
availability in time to meet the needs of the proposed development.

updated no less than annually, by July 1, of each year; provided, however,
the plan in effect shall remain in effect until a successor plan IS fully
adopted
Section 3. Determination and Payment of the Transportation Facilitv Charqe
a The Transportation Facility Charge shall be based on the per peak hour trip
rate identified in the report from transportation trip calculations based on a transportation
report consistent with City standards
b City Standards shall Include
Standard transportatIon assumptions as identified In Table 1
ii For facilities not on the standard transportation assumptions, the
Institute of Traffic Engineers tnp generation manual for the most recent
year
III For projects with nontraditional peal hour impacts or different from
standard projects modelled in Table 1, a speCial report, based on generally
accepted traffic engineering principles may be submitted and conSidered
c Credits shall be given to reflect the projected Impact on the community
system such as, traffic decreases where an existing facility on site IS removed or
replaced, and traffic reduction systems which are binding and likely to remain effective
for the life of the project.
d Credits may also be given for projects which create a significant economic
benefit to the community, Including Industnal or manufacturing uses with an excess of
500 trips per day The size of the credit shall be measured at an approprIate percentage
of the antiCipated annual tax revenue increase to the community and available for capital
contributIon to transportation facilities on the approved plan as a result of the proJect.
e Payment of the Transportation Facility Charge shall be as follows
i For proiects involvina the diviSIon of land for sale of lease-upon the
Issuance of a building permit for construction of each lot of record, for the
traffic attributable to that lot.
ii For projects approved throuqh site plan review-upon the issuance
of the building permit authoriZing the construction of any phase, for the traffic
associated with that phase
iii For any proiect over 100 peak hour trIPS per day-the fee may be
paid In Installments, at the mUnicipal rate of Interest in effect on the day of
building permit issuance, with 50% being paid at the issuance of the bUilding

permIt and the balance paid within 24 months, recognizing the lead time for the
City to bring major projects on line
Section 4. Accountinq and Appeals
a All fees collected under this chapter shall be placed in separate accounts
for the dedicated purpose for which collected Such funds may only be expended for
identified facilities on an approved plan, and must be spent within six years absent a
specIfic situation where the City can justify a longer period
b If an applicant desires to challenge the calculation or assessment of any
fee, such fee shall be paid under protest and the permit may be issued Appeals shall
be heard by the City Council upon a de novo hearIng
c Any such appeal shall consIder the issues raised, the proper fee to be
assessed, and the necessity to find concurrency as a precondition to any project
approval The proper fee to be charged on appeal IS determined (1) by compltance with
the terms of this ordinance, and (2) if for any reason the terms of this ordinance are
found Inappropriate, such fee as necessary to assure concurrence for all facIlities
identified hereIn, but not to exceed the fee collected pursuant to thIs ordInance
SectIon 5. Effective Date
The ordinance shall be applicable to all land divisions and land developments and
master plan reviews for whIch applications are complete after the adoption date of this
ordinance

Thank you for the opportunity to comment on the determination of
nonsignificance for the expansion of Tim's Pharmacy at 106 First
street South. We reviewed the environmental checklist and have
the following comments.
Water Ouality
Erosion control measures must be in place prior to any clearing,
grading, or construction. These control measures must be
effective to prevent soil from being carried into surface water
by stormwater runoff. Sand, silt, and soil will damage aquatic
habitat and are considered pollutants.
Any discharge of sediment-laden runoff or other pollutants to
waters of the state is in violation of Chapter 90.48, Water
Pollution Control, and WAC 173-201A, Water Quality Standards for
Surface Waters of the State of Washington, and is subject to
enforcement action.
Dry wells are not an acceptable method of disposing of
stormwater. Grassy swales, percolation areas, and wet and dry
ponds provide better treatment and protection to groundwater.
Dry wells should only be used where alternatives, such as
retention/detention basins or storm sewers, are not practical or
feasible.
If a drywell is used, the owner should notify Ecology and should
place a warning next to the collection grate that says: Dump No
Waste - Protect Your Groundwater. This stencil is available from
Ecology.
Routine inspection and maintenance of all sediment and erosion
control devices is recommended both during and after development
of the site.

Solid Waste Services
The applicant should consult the local comprehensive solid waste
management plan to see if it contains recycling requirements that
may impact the project. Contact local solid waste officials,
garbage haulers, and recyclers for available recycling services.
The applicant should consider designing the facility so
opportunities to recycle are at least as convenient as waste
disposal. Try to provide adequate, properly located space inside
and outside the facility to accommodate equipment and containers
for processing and storage of recyclables. Plan to recycle items
such as paper, glass, aluminum and other metals, corrugated
containers and plastics.
We encourage the applicant to use construction products
containing recycled materials whenever possible. (Please refer
to the enclosed handout on Recycled Content Products and
Materials for Construction and Landscaping.)
We encourage the applicant to reuse or recycle all possible
demolition and leftover construction materials and reduce waste
generated. Recycling demolition and/or construction debris is
often less expensive than landfill disposal. Call Ecology's 1-
800-RECYCLE Hotline for recycling locations for construction and
demolition debris.
During daily operations of the facility, we recommend using
products and supplies that are recyclable and/or made from
recycled materials. Use of low-toxic or non-toxic products for
cleaning, maintenance, and other purposes is encouraged.
Practicing waste prevention methods is also important.

BACKGROUND:
The City received an application for SITE PLAN APPROVAL on March 6, 1995.
Since that time, the City has been working with the proponent on the
application.
BASIC FACTS:
Proponent: Tim's Pharmacy, Yelm, WA and Bob Howard (Owner's Representative)
Proposal: Site-plan proposal in the CBD, Central Business District of Yelm
to expand the existing Pharmacy by 5,000 square feet, demolish fire station
and revise and add to parking and ingress/egress. Site is located at 106 1st
St. S. at the southeast corner of Yelm Ave. and 1st Street.
Public Notice: Notice of Public Hearing was published in the Nisqually
Valle}r News on March 9, 1995, posted in public areas on March 7 and mailed to
adjacent property owners on March 7, 1995. Mailed to all on the Planning
Commission mailing list and applicant on March 15, 1995.
Location: Southeast corner of Yelm Ave. and 1st Street.
Comprehensive Plan: This proposal meets the Comprehensive Plan designation
for this area.
Zoning: CBD, Central Business District.
Area Land Use: All immediately adjacent areas are zoned CBD.
Shoreline: N/A
Critical Areas: Sensitive Aquifer
Resource Lands: N/A
Historic Structures: The Yelm Fire Station building is currently listed on
the Yelm Inventory of Historic Places, but is not listed on the Yelm Register
of Historic Places. A listing on the Yelm Register requires special
considerations prior to a demolition permit and approval.
Soils and Geology: Spanaway gravelly sandy loam.
Topography: Paved and graveled, slope approximately 3%.
Air Quality: Should not substantially affect the air quality.
Parking & Traffic: The proposal shows 54 parking stalls: calculated at 1
staff per every 200 sf of floor area, requlres 62 stalls. Staff has worked
wlth the appllcant to obtain as many stalls as possible in the limited space
and feels that the mnnber proposed is sufficient. YMC 17.38.010 states
"consideration from the Planning Conmission should be given as to the
requirements/standards for off-street parking as they pertain to the Central
Business District".
The Site Plan proposes a right-in/right-out only ingress/egress on Ye~ Ave.
in the location of the fire station. Public Works staff has met with the
applicant and with Department of Transportation regarding this proposal and
recorrmends approval. The Site Plan also proposes a one-way alley traveling
west towards 1st Street. This is consistent with the alley to the east
behind the Senior Center and Ye~ Telephone. The City Council will need to
make the final decision regarding the alley.
Solid Was te : LeMay Garbage Service.
Wastewater: City of Ye~ S'IEP system already in place for existing
building. May need to be expanded depending on future use.
Water Supply: City of Ye~ water supply.
Stormwater: Parking areas must meet the requirements of the Drainage and
Erosion Control Manual for the City of Ye~. A Final Drainage Report and
construction drawings for the parking areas and impervious surfaces will be
prepared after site plan approval and prior to construction approval.
Landscaping:

State Environmental Policy Act (SEPA): Issuance of SEPA on this proposal is
pending. A MONS is expected due to the Five-Corners/Y-2 mitigation strategy
( $300.00 per each PM peak hour trip generated by the site through Five-
Corners) .
Ye~ Municipal Code: This project shall confonn to the City's Municipal Code
and draft Development Guidelines.
Comprehensive Plan: Comprehensive Plan designation is CBD, Central Business
District. This proposal conforms with the CBD zoning requirements/intent and
the proposed use is pennitted outright.
Design and Development Standards: This site plan meets the City of Yelm site
plan requirements. Detailed construction drawings (both on-site and
building) will be required prior to construction approval.
STAFF RECOlVlMENDATION:
The City of Yelm Planning Department recorrmends approval of the site plan
application of Tim's Pharmacy for a 5,000 sf addition, revise and addition of
parking and demolition of the fire station with the following conditions:
1. The completion of SEPA, together with the required comment period.
2. As will be stated in the Mitigation of Non-Significance, the applicant
shall contribute financially to the Five-Corners intersection improvement
and/or the Y-2 Alternate Route as specified in the 1992 Yelm Comprehensive
Transportation Plan. Contribution is based on the number of automobile trips
generated by this site during the EM peak hour. Total PM Peak hour trips
proposed to travel through the Five-Corners intersection are 7 trips at
$300.00 per trip = $2,100.00. The applicant shall agree to submit an
agreement waiving any right the applicant might have to protest the formation
of a Local Improvement District (LID) or Latecomer's Agreement.
Staff requests that the Planning Commission authorize the Planning Department
to work with and give approval to the applicant on site plan revisions if the
applicant chooses to phase the project and not demolish the fire station
initially. Applicant may decide to remodel the fire station and lease the
facility. Parking would need to be addressed to ensure adequacy.
