Dear Ms Carlson,
As you are probably aware, we were Issued a bUilding permit for thiS project and have
begun construction Our last communications with the City of Yelm were with Jerry Prock.
At the very beginning of the project in early 1995, you requested a "conceptual" landscape
plan which we provided and you deemed adequate for a final approved landscape plan
However, dUring the course of the Civil Engineering reView, Cosmopolitan Engineering
questioned our plan due to our specification of "salal" ground cover in the area of drainage
swale #1 We have removed the ground cover In that part of the site and feel that native
grasses allowed to grow around the swale IS In agreement with the intent of Cosmopolitan's
comment
Hence, we wish to resubmit the attached (revised 10/31/96) Landscape Plan L 1 for your
review and final approval Also, by making the minor changes to the landscaping that
correspond to the approved CIVil Plans, we were able to make, what we feel are thoughtful
aesthetiC Improvements as well

2. Financial contributions = $2700.00 toward formation of local
improvement district (LID) and improvements of the "Five-Corners"
intersection and/or the Y-2 alternate route as specified in the
1992 Yelm Comprehensive Transportation Plan.
3. The OWNER hereby waiVes all rights to protest against future Local
Improvement District (LID), Utllity Local Improvement District (ULlD)t or Latecomer
Ordinance and Agreement proceedings for the construction of said Improvements
described in Section 2 herein. For pUrposes of this lnstrumentt "tights of protest"
shall mean only those formal rights to protest contained wlthlr1 thf3 LID, UlIO or
latecomer Ordinance and Agreement statutes. exceptt howevert nothing herein Shall
constitute a waiver by the OWNER or the OWNf:R's heirs, assigns or SUccessors In
Interest; of the right to object to the OWNER's Individual assessment ~mount or
latecomer charge or to appeal to the Superior Court the declslOr1 of the Council
affirming the final assessment roll or latecomer ordinance and agreemeht, which tights
are specifically preserved.
4. The OWNER hereby grants and conveys to the City Engineer of the City
of Yelm, or his successor in Interest or designee; a Spacial Power of Attorney to
exercise any and all rights of the OWNER; Including any purchasers; mortgage holders,
lien holders or other persons who may claim an Interest In the property described
hereinabove, to accomplish the following: At such time as a local Improvement
District, Utility local Improvement District, or Latecomer Ordfnance and Agreement
Is proposed that would cause said Improvements to be made availabfe to the
OWNER's property described hereinabove, to execute a Petition on behalf of the
OWNER for the creation of such UD, UUD or Latecomer Ordinance and Agreement.
This Special Power of Attorney is granted In consideration of the CITY executing this
Instrument, and shall be a power coupled with an Interest which may not be

terminated. This Special Power of Attorney shall not be affected by the disability of
the OWNER.
5. If the OWNER falls to perform in good faith In accordance with this
Instrument, It Is agreed that the CITY may discontinue utility service to the property
described herein, after giving 20 days notice thereof and an opportunity for hearing
thereon, or may.. pursue other equitable or legal remedies.
6. The OWNER hereby declares that D-Squared IRe. Islare the
sole owner(a) of the property described herein and has/have full power to commit said
property to this Agreement, Waiver of Protect and Special Power of Attorney.
7. This instrument constitutes 8 covenant running with the land and shalt
be binding on all heirs, assigns, transferees, and successors In Interest.
8. For purposes of RCW 35.43.182, and any LID or UUD thereunder, the
effective term of this Instrument shall be a period of ten years from the date hereof.
For purposes of RCW 36.72 and ROW 35.91, and any Latecomer Ordinance and
Agreement thereunder, the effective term of this Instrument shall be a period of
fifteen years from the date such an Ordinance and Agreement becomes effective

SUBJECT: SPR8137 - Site Plan Approval
On Monday, June 5, 1995, the YelmCity Planning Commission granted
approval of the Site Plan application for the prairie Lumber and
Hardware Store located on the east side of Creek Street, between
103rd Avenue and Yelm Avenue East. However, the following
conditions of approval were set by the Planning Commission:
1. The applicant shall contribute financially to the Five-Corners
intersection improvement and/or the Y-2 Alternate Route as
specified in the 1992 Yelm Comprehensive Transportation Plan.
Contribution is based on the number of automobile trips
generated by this site during the PM peak hour. Total PM Peak
hour trips proposed to travel through the Five-Corners
intersection are nine trips at $300.00 per trip = $2,700_00.
The applicant shall agree to submit an agreement waiving any
right the applicant might have to protest the formation of a
Local Improvement District (LID o~ Latecomer's Agreement.)
2. The elevation of the Yelm Creek is approximately 96.05' and
adjacent to the site on its easterly property line. The Site
Plan and all future drawings shall be required to show the
Yelm Creek bank at its approximately location. A 100' buffer
from the approximate location of the creek bank shall be shown
on the site plan and all future drawings. The 100' buffer
shall not be disturbed.
3. A detailed Landscaped Plan, in accordance with YMC 17.38.,
shall be submitted for approval by the City. The plan shall
be submitted with construction drawings.
4. The MDNS comment period expire.
5. Frontage improvements to Creek Street are required as per City
Development Standards. The applicant may request a deferral
of improvements and enter into an agreement waiving any right
to protest the formation of a LID or Latecomer's.

6. The Drainage Plan shall meet the requirements of the City's
Drainage and Erosion Control Manual. The plans shall be
submitted to the Public Works Department and approved by the
City.
These conditions must be met prior to construction or as stated in
the individual condition. PLEASE RETAIN IN YOUR FILES, THIS LETTER
CONSTITUTES APPROVAL OF THE SITE PLAN.

Dear Mr. Turpin,
Thank you for your letter dated May 30, 1995 regarding the proposed
PRAIRIE LUMBER & HARDWARE project slated for construction on Creek
Street in Yelm, Washington.
As you are well aware, the City of Yelm by Council action has
adopted the "Draft" Yelm Development Guidelines as the interim
standard for project design and review. The "Draft" Yelm
Development Guidelines will be used as the basis of review for the
PRAIRIE LUMBER & HARDWARE project and Sound Design Incorporated is
advised to proceed with your design accordingly.
It is okay to utilize the control datum as depicted on the
preliminary site plan. The only thing we ask is to tie the
elevations back to existing datum on Creek Street.
The review of the preliminary drawings by Cosmopolitan Engineering
Group was originated by this office with an eye to assisting your
firm in fast tracking the project. The Cosmopolitan Engineering
Group review of the preliminary drawings only relat~s to on-site
storm water issues. Please disregard any other comments at this
time.

Dear Ms. Wolf:
Thank you for the opportunity to comment on the determination of
nonsignificance for the construction of the prairie Lumber and
Hardware supply store, as proposed by M. J. Detlefsen. We
reviewed the environmental checklist and have the following
comments.
The owner of a construction site which disturbs five acres or
more of total land area, and which has or will have a discharge
of storm water to a surface water or to a storm sewer, must apply
for coverage under Ecology's Baseline General Permit for storm
Water Discharges Associated with Industrial Activities.
Owners of sites where less than five acres of total land area
will be disturbed must also apply if the construction activity is
part of a larger plan of development or sale in which more than
five acres will eventually be disturbed. Discharge of storm
water from such sites without a permit is illegal and subject to
enforcement action by the Department of Ecology.
Application should be made at least 30 days prior to commencement
of the construction activities. A storm water permit application
form, referred to as a Notice of Intent, can be obtained by
calling (360) 407-7156.
Proper disposal of construction debris must be on land in such a
manner that debris cannot enter the stream channel or cause water
quality degradation of state waters.
Proper erosion and sediment control practices must be used on the
construction site and adjacent areas to prevent upland sediments
from entering the stream channel. All areas disturbed or newly
created by construction activities must be revegetated, use
bioengineering techniques, use clean durable riprap, or some
other equivalent type of protection against erosion when other
measures are not practical.

Erosion control measures must be in place prior to any clearing,
grading, or construction. These control measures must be
effective to prevent soil from being carried into surface water
by stormwater runoff. Sand, silt, and soil will damage aquatic
habitat and are considered pollutants.
Any discharge of sediment-laden runoff or other pollutants to
waters of the state is in violation of Chapter 90.48 RCW, Water
Pollution Control, and WAC 173-201A, Water Quality Standards for
Surface Waters of the State of Washington, and is subject to
enforcement action.
Any work in or adjacent to waterways that will adversely affect
water quality must receive specific prior authorization from the
Department of Ecology pursuant to WAC 173-201A-110. A short-term
water quality standards modification may be issued if the
proponent agrees to a number of specific construction practices
and techniques designed to minimize water quality impacts. The
construction schedule will be tied to the schedule on the
Hydraulic Project Approval (HPA). Contact Ms. Loree Randall at

Transportation Plan. Contribution is based on the number
of automobile trips generated by this site during the PM
peak hour. Total PM Peak hour trips proposed to travel
through the Five-Corners intersection are nine trips at
$300.00 per trip = $2,700.00. The applicant shall agree
to submit an agreement waiving any right the applicant
might have to protest the formation of a Local
Improvement District (LID or Latecomer's Agreement.)

2. The elevation of the Yelm Creek is approximately 96.05'
and adjacent to the site on its easterly property line.
The Site Plan and all future drawings shall be required
to show the Yelm Creek bank at its approximately
location. A 100' buffer from the approximate location of
the creek bank shall be shown on the site plan and all
future drawings. The 100' buffer shall not be disturbed.

Dear Mr. Turpin,
As per our recent discussion of the Preliminary applicatlon for the
above referenced prairie Lumber and Hardware project that went to
the City of Yelm's Planning Commission this past Monday/ May 15,
1995. The City of Yelm has completed our review of the Preliminary
Drainage Plan and the Prelimlnary Drainage Report and offers the
following comments.
A variance wlll be recommended to the City of Yelm Planning
Commission provided the following items are addressed and the
results included as a part of the final submittal.
1. Infiltration testing is required to be conducted for the
proposed infiltration pond. Test depth shall be at the
proposed pond bottom elevatlon in native material.
2. If sand is to be utilized in the pond bottom as proposed/
infiltration rates and/or permeability rate information
is required for this material.
3. In order to provide for more pre-treatment of the
stormwater prior to lnfiltration/ the proposed
biofiltration swale size should be increased from 2,000
square feet p~r acre of impervious area to a mlnimum of
2/500 square feet per acre of impervlous area.

4. If Item #3 above is implemented, native soils may be
utilized for infiltration.
5. As per our agreement, lf the proposed method of treatment
fails to meet discharge requirements, and water quality
levels as required by the City of Yelm Drainage Manual the
drainage system will be upgraded at the owners expense.
Additionally, lt appears the proposed wet pond elevation of 98.75
is the same as the rim elevation of the catch basin in the parking
area.

prepared by Edward Stevens & Associates. Total PM peak
traffic generated by the proposed use would be 28
vehicle trips. Of those 28 trips it is estimated that
9 trips corne from or go to the Five Corners
Intersection.

The City has reviewed your application for site plan review on the
above referenced property. The Planning Department and Engineering
Department have the following comments:

Please provide the Planning Department with a landscape plan
per Yelm Municipal Code, Chapter 17.38, Off-Street Parking.
The landscape plan can be conceptual at this time and included
on the Site Plan Drawings. However a separate detailed
planting plan will need to be submitted to the Public Works
Department for approval prior to issuance of a building
permit.
The Traffic Generation and Trip Distribution Report needs to
be revised to reflect the total square footage of the building
(8,500 sq. ft.). The formulas for trip generation provided in
the Institute of Traffic Engineers Handbook, page 1110, takes
into consideration storage areas which are necessary to
support the type of use proposed. Also, the methodology used
to establish PM peak hour distribution is based on a different
type of use (residential), and does not represent traffic
distribution consistent with commercial tl;"affic distribution.
The current PM peak hour distribution at five-corners would be
a more accurate measure for commercial traffic distribution
from your site.
Please refer to the enclosed detail list from Cosmopolitan
Engineering Group for comments and changes on the submitted
Drawings and Drainage and Erosion Control Plan Report.
Please provide the City with three sets of revised drawings
and two copies of the revised Drainage and Erosion Control
Plan Report.

We have completed our review of the submitted Drawings and Drainage and Erosion,
Control Plan Report for Prairie Lumber and Hardware Both the Drawings and Report are
labeled "Preliminary" and lack the detail required on a typical submittal We have tried to
be as through as possible, however, $,e Drawings are generally unclear and therefore, based
on the information contained in the design submittal, it was difficult to complete the review

The Report was prepared in response to requirements contained
in the Pre-Submission Notes/Comments as per the meeting held
on Thursday, February 2, 1995.
All site-generated traffic will access onto Creek Street.
Traffic was distributed onto Creek Street in conformance with
a separate study of actual distribution of the traffic from
the ~Creek Apartments.

Traffic generation rates should be based on the character and
intensity of the land use. Character is represented by the
function a land use fulfills. A building materials and lumber
store is defined as a free-standing building which sells
hardware, building materials, and lumber. The lumber may be
in the main building or in a yard or storage shed.
The Institute of Transportation Engineers in their fifth
edition of "Trip Generation" state that the studies for
generation rates were conducted in the 1980's in the San
Francisco area and upstate New York. The sites averaged 25
employees and 19,000 square feet gross floor area. Although
trip generation could be estimated by site size, this is
generally not desirable due to the considerable varIance in
local zoning codes, etc.
The estimated traffic depicted in this report was based on
gross floor area and includes AM-PM site-generated traffic
during peak hour of adjacent street traffic.

As can be seen above, peak hour site traffic and peak hour
traffic of the proposed lumber store do not coincide.
Obviously this lessens the impact on adjacent streets and
intersections in the near area.

Prairie-Pro Home Center proposes direct ingress and egress of
Creek Street. It has been indicated that traffic impact
mitigation fees of $300.00 per PM peak hour trip will be
assessed for the Five Corners intersection.
To estimate the total trips generated in the PM peak hour
distributed toward the Five Corners intersection, a study of
the actual distribution of traffic onto Creek Street from the
Prairie Creek Apartments was accomplished on Wednesday and
Thursday, February 15 and 16, 1995 as follows:

The above data indicates that of 47 vehicles exiting the
Prairie Creek Apartments, 32% exited south to Five Corners
intersection and 68% exited to the north toward 103rd Ave.
S.E.
Based on the results of the above study, trip distribution
was calculated and is indicated on Figure 2.
As can be seen, of the 20 PM trips generated by the
Development, 7 of those come from or go toward the Five
Corners intersection

Based upon the data generated in this report and the personal
knowledge of the area gained by the Author, it is concluded
that the development of "Prairie-Pro Home Center" will not
adversely impact traffic flow on Creek Street nor at its
intersections with State Route 507 or 103rd Ave S.E.
1. The proPf~e~Building Materials and Lumber Store will
generate~trips during the PM peak hour of adjacent
street traffic on a weekday, 4 PM to 6 PM. It is
estimated that~of these trips come from or go to
the Five Corners intersection.
2. Maximum trips generated are estimated to be.~ trips
at peak hour occurring on a Saturday, 10 AM to 1 PM.
3. Weekday maximum generator trips are estimated to be
24 and occur between 10 AM and 3 PM. All peak hour
generator trips occur on off-peak adjacent street
traffic.
4. On Thursday, February 16, 1995, twenty-two vehicles
were counted on Creek Street between 4 and 6 PM. This
factors to an Average Daily Traffic Volume of 147
vpd. This further translates into an Annual Average
Daily Traffic (AADT) of 192 vpd.
5. Based on the minimum traffic volumes generated and
those existing on Creek Street, no adjacent road
improvements are recommended.

Site design intends to keep activity toward Creek St. and toward
the south side of the property in order to minimize noise
transferred northward. Operation of the proposed business is
limited to normal daytime hours.
