RE: Additional information to City letter dated November 8, 1995
Dear Ms. Breen:
I would like to clarify the issue of "Conceptual Master Plan" approval that
has been given to the SW Yelm area, which includes the properties currently
owned by DoylejBosequetts, recently adjusted by Boundary Line Adjustment
#8148.
The City of Yelm's Master Plan Ordinance #555 requires two official actions
by the City, the first being the Conceptual Master Plan approval, which
identifies densitles, land uses and major transportation networks. The
Final Master Plan approval must be consistent with the Conceptual Master
Plan which was approved by the City on October 12, 1994 and shown on the
City I s official zoning map (enclosed). In conjunction with Final Mas ter
Plan approval, the entire stretch of the "loop road" must be dedicated to
the City of Yelm. The main "loop road", which includes a portion of the
property described above, shall be constructed according to an ordinance,
adopted prior to Final Master Plan approval, requiring that the road be
developed in phases associated with development (Conceptual approval, Page
7, D( 2) & (3). I have included a copy of the "boulevard" street section
from Yelm I s Development Guidelines which is the required road section for
the "loop road" in the area described above.

Dear Dennis:
As per your letter dated October 9, 1995, requesting a copy of the
Ci ty' s official action disallowing the present use of the land
currently owned by DoylesjBosequetts, recently adjusted by Boundary
Line Adjustment (BLA 8148), I am encloslng a copy of the City of
Yelm's approval of the Conceptual Master Plan on October 12, 1995.
The City Council's approval of the SW Yelm Conceptual Master Plan
requires that a main loop road running from the southwest to the
northeast be constructed to serve the proposed developments. The
southwest portion of the road is situated on parcel #21726420000
and #21726410200, properties currently on the farm and agricultural
land assessment rolls, which must be removed to be available for
road design and future construction.
Please contact me if any additional information is required xor
removal of said property.

1. The meeting was called to order at 7:30 pm by Mayor Wolf, all
present joined in the flag salute.

5. Conceptual Plan Briefing - Shelly Badger explained that the
next briefing is scheduled for 10/26/94 at 6: 45 pm, and
encouraged all interested parties to attend and to pick up a
draft copy at city hall.

7. Public Comment/Questions. Dennis Su introduced Bud Welcome
and Paul Liao.
Bud Welcome stated that he was comfortable with the SW Yelm
Conceptual Master Plan, except for the provisions applying
commercial restrictions. He felt that commercial
restrictions could create difficulties in obtaining funding
and should not exceed five years.
Paul Liao explained that work had been in progress for 4 1/2
years on the annexation and public hearing process and
expressed concerns about the end results. He stated that
while most of the contents of the Conceptual Master Plan were
acceptable, restrictions on commercial development were not

and that commercial restrictions should not go beyond a five
year period. Mr. Liao also expressed concern about
flexibility in developing the club house area and about
obtaining financing with so many restrictions attached to the
project.

9. Old Business
a. SW Yelm Conceptual Master Plan. Shelly Badger explained
that she believed the proponents had expressed legitimate
concerns about commercial restrictions, and that research had
shown a good ration of commercial to be 10%. Yelm is below
this ratio at this time. The Planning Commission's concerns
of the possibility of unrestricted commercial development
resulting in an old/new town sltuation were discussed and
considered. Additional concerns expressed were that delays
in reaching an agreement could negatlvely impact Yelm's water
reuse project. Gene Borges supported removal of commercial
development restrictions after a flve year period and
explained that a five year wlndow should allow eXlsting
businesses time to prepare for competition. He also stressed
that agreements with the SW Yelm proponents must be slgned
and delivered to regulatory agencies on the 20th for the
water reuse project to proceed.
Mayor Wolf requested the opinion of John Huddleston as a Yelm
Chamber of Commerce representative and local buslnessman.
Mr. Huddleston explained that a real concern was the building
of a destination shopping point without residential
development In place to support the businesses. He allowed
that new plats, as well as commercial development, would be
dependent upon sewer service and that this requirement
provided some safeguards. He felt that many local people
support the Thurston Highlands project and added that he
found the 5 year restriction acceptable but would still like
to see some housing buildout requirement as a show of good
faith. He acknowledged that there was really no choice but
to move ahead.
Mr. Liao explained that he belleved that the dollars already
spent on the project demonstrated the proponents' commitment
to the project and community.

Brunk to the Park Board. The first meeting of the Canal Road
Park group was held on 10/10,
c. Police - Chief Dunnam reported that the department stays
busy and requested that $5,000, that will not be spent in
'94, be used to provide clerical assistance for the Chief
Administrative Officer. Chief Dunnam annbunced that no
budget lncreases are anticipated for '95.

Public Works - Ken Garmann reported that sewer problems at
three sites were expected to be resolved, and that based on
past experience, Yelm had experienced a minlmal number of
alarm call outs.
A letter thanking Tim Peterson for taking the time to
supervise young people working off assigned corrununity serVlce
hours was noted.
Council was informed that DOT had acknowledged receipt of
Yelm's draft ordinance and advised the city that an
engineering study will be conducted concerning requested

speed limit changes.
f. Mayor - Attended: presentation of sandstone monument to
Tumwater from Tenino; would like Yelm to acknowledge our
sister city relationship with Lacey and express our
appreciation to Lacey for assistance received. Other
meetings: Extension School Leadership Class tour of city
hall; Leadership Thurston Co., bus tour; Heart Walk, good
turnout with 19 participants, thanks to Councilmernber Parsons
for being team leader; meeting with the Chief Executive
Officer and Marketing Director of Capital Medical Center.
Anyone able to attend the Hands On Children's Museum function
was asked to contact Agnes to RSVP; Council concurred with
having Ed Bergh, YHS teacher, contacted for recommendations
for young people who might be interested in providing input
to Council.

h. Court report for July and August was reviewed. Case
calendar showed the number of citatlons/infractions: July
179; August 133. Both months showed decreased actlvity
compared to 1992 and 1993 statistics.

Based on the record before the Planning Commission, the findings and conclusions of
the Planning Commission, the testimony and record before the City Council, and the
environmental review, the staff recommends adoption of the Conceptual Master Plan for
Southwest Yelm as provided in the Planning Commission's Findings and Conclusions,

area, the City determines that the net density in that particular area is

Nothing in this paragraph shall be deemed to allow development in excess
of the overall maximum of 5,000 dwelling units in the Master Plan area.
2. Paragraph 4 D 1 of the Conclusions, page 7, shall be modified to read as follows
This conceptual Master Plan approval requires the establishment of two
Essential Utility and Transportation Corridors. The Y-1 Corridor will serve
the park site and school site on the northern boundary and the commercial
property throughout the remainder of the Corridor The second essential

PUBLIC HEARING,
After reVlewmg the applicatI.on, sue plan and environmental checklist
submitted by the applicant, the Planmng ComrmssIOn held a public heanng on July 18,
1994. TIns public heanng was extended to the next regularly scheduled Planmng
ComnnsslOn meetmg on August 1, 1994. The Planmng ComrmsslOn held a public work
sesslOn on August 4, 1994 at a specIal meetIng of the Planmng ComnusslOn.
ENVIRONMENTAL REVIEW
In February of 1993, the City of Yelm published an Environmental Impact
Statement for the annexatI.on and development of the Southwest Yelm area. That EIS
consIdered the unpacts assocIated WIth annexatIOn as well as vanous conceptual
developments scenanos. With tins extensIve envrronmental reVIew in place, the City
detenmned that an addendum to the Final EnvlIonmental Impact Statement would satisfy
the need to review additI.onal mfonnatI.on and analysIs for tins conceptual master plan
reVIew. On July 11, 1994, the City of Yelm Issued an Addendum to the Final
Envrronmental Impact Statement for the Southwest Yelm AnnexatI.on. Based upon the
eVIdence subnntted, the testImony glven, and the analysIs of staff, the Planmng
Comrmssion makes the follOWIng:
FINDINGS:
1. Thurston Highlands Associates is the lead applicant requesting approval of the
Southwest Yelm Conceptual Master Plan. The Master Plan area encompasses
1,860 acres and is located northwest of State Highway 507, southwest of the
downtown core of the City of Yelm, and southeast of the. boundary of the Fort
Lewis reservation. The Master Plan area consIsts of 37 ownership/parcels planned
together as a single planmng unit.
2. The Master Plan submittal includes text~ maps and an envlIonmental checklist.
The Master Plan map shows proposed land use deslgnatlons, major transportatlOn
clIculatlon routes, major phYSICal charactenstics on the property, proposed phases,
and property ownershIp boundaries. The applIcation follows the City of Yelm' 5
Master Plan Ordinance requlIements.
3 The Master Plan area was annexed to the City of Yelm on November 23, 1993.
Pnor to annexatlon, the area was zoned under the County's Rural Resource
Resldennal 1/5 zomng deslgnanon. The Master Plan area IS currently zoned as
RA-5A under Sectlon 17.40020(c) of the Yelm MumcIpal Code, wluch also
allows one umt per 5 acres.
4. Conceptual Master Plan approval is the :first step m the Master Plan process. The
purpose of conceptual reVIew and approval IS II to establish general land use
poliCIes to gmde detailed planmng for and development of the Master Plan area.
The Conceptual Master Plan shallldentlfy the generalized land uses, transportanon
and clIculanon routes~ and servIces proposed for the sue," SectlOn 5(A), Yelm
Master Plan ReVIew Ordinance. RevIew of the Conceptual Master Plan IS
perfonned first by the Planmng ComrmsslOn and then by the City Council.
ReVIew 15 as follows:
The Planning ComrrnsslOn shall review the application for
completeness and, If It detennines that the proposed Master
Plan is conSIstent WIth the ComprehenSIve Plan and the City's
other plans and poliCIes, recommend approval by the City
Council. If the Planmng ComrmsslOn determmes that the
proposed Master Plan IS not so conslstent~ It may eIther
demand for modificanons speCIfically Identlfied or recommend
denial by the City Council. Conceptual approval by the City
Council~ upon a recommendation by the Planmng
CommisslOn, shall consist of an amendment to the
ComprehensIve Plan and an amendment to the OffiCIal zoning
map.

5. The effect of Conceptual Master Plan approval is as follows:
Upon conceptual approval by the City Council, the proposed
Master Plan boundanes~ proposed use distncts, transportatlon

routes and case file number, shall be identified upon the
official zoning map. These districts and routes shall only be
effective upon approval of a Master Plan meeting the
requirements of Conceptual Approval and this Ordinance.

6. The Planning Comrmssion held public heanngs to consider the Conceptual Master
Plan on July 18, 1994 and August 1, 1994. Wntten comments were receIved
through August 15, 1994
7 The original Conceptual Master Plan subrmttal shows a planmng area In excess of
200 acres in a sIngle ownership. The Plan also proposes a rruxture of uses
Including single family resIdentIal, muIn-family resIdentIal, general commerclal,
neIghborhood commercIal, and public facilitIes mcluding schools, parks and water
system facilities. The applicant proposes to serve the entrre Master Plan area WIth
public servIces mcluding transportation, water, sewage, stonn dnllnage, other
utilities and open space. Tne subrmttal mcludes two proposed eIghteen hole golf
courses and an eXISting public golf course, all Intended to be mamtamed as
qualified open space. The subrmttal also includes wo school SItes, totalling 23
acres, and a five (5) acre park site. The subrmttal mcludes an area proposed for
community service and commercial, for the purpose of Sltmg fire, police, or other
governmental services, if needed. The subrmttal does not mclude any proposed
mdustnal uses.
8. The Southwest Yelm Conceptual Master Plan subrmttal proposes the
accommodatlon of 5,000 dwelling umts, the number also used for consldenng
Impacts m the ElS. The Master Plan currently conSISts of 108 acres of multI-
family and 948 of smgle family,
9. The City intends to analyze densities on the basIS of dwelling umts per net
developable acre. "Net developable acres II are the number of acres remammg
after subtracting from gross area all land that is unbuildable because it IS
enVIronmentally sensIllve, park site, open space, transportanon or utility comdor,
or for any other reason IS Incapable of supportmg development.
10. The applicant has proposed two areas for commerCIal uses. The first is an area
near the intersecnon of the proposed Y -1 Comdor and the mtemai mam loop road
within the Plan area. The applicant currently proposes the designation of 51 acres
as GeneI'3l Commercial in this area. The Planning CommissIon received testunony
expressing concern over the scale of commercial development in the Southwest
Yelm area as a potentIal threat to existing commercial businesses witlun the
current City of Yelm. A phasing plan for the buildout of commercial development

in the Master Plan area was suggested in conjunctlon Wlth this testimony. The
Planning Commission heard testimony from the applicant that a severe limit on the
scale of commercial structures would preclude any reasonable market for the
commerC1al property. The applicant proposed a linut of 400,000 square feet of
commercIal space in the Y -1 Comdor area and a cap of 40,000 square feet for one
commercIal structure. The applicant would be agreeable to a phasing plan for the
buildout of commercIal space In the Y -1 Comdor area. The Master Plan subIllittal
also proposed the deslgnatlOn of five (5) acres near the clubhouse as CommercIal
Semce. The Staff Report has recommended that commercIal development in the
commercIal district near the clubhouse be linuted. The applicant has acqUlesced
to an overalllinut of 12,000 square feet of commercIal space WIth a linnt of 3,000
square feet per commercIal structure In the clubhouse area. Tne Master Plan map
has shown the designatIon of a 16 acre parcel on the property owned by
Bosequette as General CommerCIal. Staff has recommended the replacement of
tins deslgnallon WIth muln-family on the grounds that the additional commerCIal
area is not necessary to serve the Southwest Yelm area and would unreasonably
compete WIth and draw market share from the eXlsllng busmess core of the City
of Yelm.
11. The City IS In the process of amending Its Open Space and Park Ordinance to
prOVIde for the dedicatIon of open space ill the amount of five percent (5 %) of net
built area ill sillgle family deslgnallons and ten percent (10%) of net built area ill
multI-family deslgnanons. Applymg the proposed amendment to the Open Space
Ordinance, the followmg approXlmate dedicanons of open space will be reqUITed:
Thurston Highlands ASSOCIates - 56 Acres
Rainier Estates - 11 Acres
Other Parcels - 16 Acres
Some concerns among Planmng ComrmSSlOn members were nused that the pnvate
golf course on the Thurston Highlands ASSOCIates parcel should not be mcluded
in the open space calculations because the golf course will be a pnvate golf course.
12. The Master Plan subrmttal proposes that the Plan area be served entirely by public
and private utilitIes, mcluding sewer, water, electnclty, telephone, and cable TV
13. The applicant has shown the possible location for a future State Highway known
as the Y -1 Comdor. The applicant has shown the route for an illternal main loop
road through the Plan area. The applicant has shown the dedication of nght-of-
way access onto the Fort Lewis nillitary reservatlon in the locations shown on the
Master Plan map.

14. In conjunction with the Annexatio.q of the Southwest Yelm area, the applicant
signed an agreement obligating it to pay the costs of the City' s Wastewater Reuse
Program to the extent attributable to the annexed area. The City has obtamed a
Centenmal Clean Water Act grant that requITes a local matcmng share. Staff has
detenmned that the applicant's share is forty percent (40 % ). Staff has notIfied the
applicant that fifty percent (50%) of Its share is due by August 15, 1994. Staff
recommends that, as a condition of Conceptual Master Plan approval, tlns payment
first be made. The Wastewater Reuse Program will require areas of open land for
irngatlOn. The proposed golf course In the Thurston Highlands ASSOCIates
ownersmp IS well-SUIted for such applicatlOn. Staff recommends that the
mstallatIon of water and sewer lines necessary to serve the Plan area, as well as
all the pertlnent facilitles, be constructed In phases concurrent WIth development.
As such, staff also recommends that, pnor to final Master Plan approval, the City
adopt an ordinance requmng Installatlon of sewer and water lines ill phases as well
as a latecomer agreement proVlding for the reImbursement of the costs of such
mstallatlon, also m phases.
15 The Planmng CornnusslOn receIved testlmony from the Yelm Commumty Schools
that the proposed populatIons m the Plan area would reqUITe the consrrucuon of
approximately seven new schools. The applicant has proposed wo new school
SIteS.
CONCLUSIONS:
1, The Southwest Yelm Conceptual Master Plan IS conSIstent Wlth the Master Plan
ReVIew Ordinance, Ordinance No. 495 of the City of Yelm, except to the extent
necessary to modify the Plan as prOVIded hereIn.
2. The envrronmental reVIew and documentatIon prepared by the City of Yelm for
the Southwest Yelm Conceptual Master Plan adequately describes the proJect, the
impacts and potentIal ITIltlgation. The Addendum to the Final Envrronmental
Impact Statement for the Southwest Yelm Annexation, Issued on July 11, 1994,
satlsfies the State Environmental Policy Act and rules promulgated pursuant
thereto. Particular project specIfic unpacts and rmtlgatlon will be IdentIfied at the
hme of development reVIew and approval.
3, The Staff Report accurately describes the project, background mfonnatlon,
applicable regulatory requrrements, and analYSIS of staff concerns WIth the
revisions noted herein. The Staff Report is attached as ExhibIt A, and
mcorporated herein by reference.
4. The Planning Commission recommends approval of the Southwest Yelm
Conceptual Master Plan by the City Council of the City of Yelm subject to the

following conditions. These conditIons are imposed to mitlgate impacts identtfied
by staff during Master Plan Review and Environmental Review. The
recommended conditions are as follows:
A. Zoning.
(1) Zomng in the Southwest Yelm Master Plan area shall be as
desIgnated III the attached ExhibIt B, Southwest Yelm Conceptual Zomng
Plan.
(2) The Conceptual Zomng Plan reflects the followmg changes from the
last verSlOn of the applicant's Master Plan map:
a. ConverSlOn of apprmamately 13 acres north of Berry Valley
Road from smgle family to mulh-family.
b. ConverSlOn of 16 acres owned by Bosequette from
commercIal to mula-family
No other recommended changes to the last verSlOn of the applicant's Master Plan
map were detenmned to be of ment based on planmng cnrena.
B. Phasmg
(1) The Southwest Yelm Master Plan area will be developed III phases
as generally outlined III the attached ExhibIts C, D and E.

(1) The total numbeJ:", of dwelling umts allowed ill the Southwest Yelm

subtracting open space, enVIronmentally sensItive areas, parks,
transportatlon and utility comdors, and any other unbuildable area.
The minunum density shall be applied and enforced according to the
minimum dwelling umts allowed by the attached ExhibIts C, D and
E.

(3) Accordingly, therefore, development in the Southwest Yelm Master
Plan shall be between 3,946 dwelling units and 5,000 dwelling umts.
D. Transportation and Utilities
(1) This conceptual Master Plan approval requires the establishment of
two Essennal Utility and Transportation Corndors. The Y-l
Corridor will serve the park SIte and school SIte on the northern
boundary and the commercIal property throughout the remaInder of
the Comdor The second essentlal comdor 1S the maIn loop road
that connects to State Highway 507, loops through the Tnurston
Highlands ASSOCIates parcel, mtersects the Y-1 Comdor, follows
Berry Valley Road and connects to State Highway SlOat Killion
Road.
(2) The Planmng CommiSSIOn recommends the followmg mecharusm for
dedicatlng the Essentlal Utility and Transportatlon Comdors, All
property owners whose property will be burdened by the Comdors
will execute a recIprocal easement for the Comddrs that will glVe
each property owner the nght to use the Comdor on every other
property. The easement will be executed pnor to City Council
approval of the Conceptual Master Plan. The easement will glVe
each property owner the nght to dedicate the entrre stretch of the
Comdor to the City ill conjunctIon WIth Final Master Plan approval.
Dedicanon will be reqUIred as a conditIon of final Master Plan
approval. In addition to the easement~ the Planmng ComnnsslOn
requires a Conconutant Agreement~ whereIn Conceptual Master Plan
approval by the City Council will be condinoned on executIon of the
recIprocal easement. For purposes of the recIprocal easement~ the
Comdors will be described generally as shown on the Conceptual
Zomng Plan. For purposes of final Master Plan approval, the
Comdors will be fixed by the mechamsm described m the recIprocal
easement.
(3) The maIn loop road runmng from the southwest to the northeast In
the Master Plan area shall be constructed according to an ordinance,
adopted pnor to final Master Plan approval, requIring that the road
be developed in phases assocIated with development. In those areas
where the road is not yet constructed In full to serve development,
the road will be constructed to sub-grade elevatIon Wlth a
mamtenance coarse surface for the entrre remaimng length of the
right-oi-way. The City shall also negotiate and adopt a latecomer
agreement for the construction of this road in a manner that proVIdes

reimbursement according to the phases of construction. The
applicant shall, as a condition of this approval, agree to waive any

(4) The dedicatlon of the Y-l Corridor will be a sixty (60) foot nght-of-
way to the City In order to allow the potentIal future Improvement
to a State Highway, the City will impose a fifty-five (55) foot
setback from each sIde of the dedicated nght-of-way. TIns will
ensure that structures are not constructed In the area that could
potentIally serve as the State Highway
(5) Pnor to final :Master Plan approval, the apphcant shall prOVIde the
dedication of the access pomts shown on the attached ExhibIt B,
Conceptual Zonmg Plan.
(6) All development wItlun the Master Plan area will be served by the
City of Yelm's sewer and water systems All costs of such servIce
extenslOn and construcnon shall be borne by the applicant. All such
utility semce mstallatlons shall be desIgned and constructed In
accordance WIth the reqmrements of the City of Yelm, the
Department of Ecology, the Department of Health, the applicable
Fire Distnct and any other agency WIth JunsdictlOn over such
utilihes.
(7) The applicant shall pay fifty percent (50 %) of Its share of the local
matdllng funds for the Centenmal Clean Water Act grant pno! to
City Council approval of the Conceptual Master Plan. Thurston
Highlands ASSOCIates shall agree to enter mto agreements WIth the
City to proVIde land acres for wastewater reuse applications, under
the tenns of the Wastewater Reuse Program.
(8) Pnor to final Master Plan approval, the City shall adopt an
ordinance requinng the mstallatlon of water and sewer lines
necessary to serve the Southwest Yelm Master Plan area at the hme
of the first IDlUal development wItlun the area. The City will also
negotlate and adopt a latecomer agreement for the relmbursement of
the costs of installing such utility lines. The applicant shall, as a
conditIon of tins approval, agree to waIVe any and all protests to any
such ordinance and latecomer agreement regarding the extensIOn of
sewer and water.
(9) The City will allow development of the Clubhouse and Restaurant in
the Thurston Highlands ASSOCIates ownership on an approved septJ.c

system that is compatible with future hook-up to the sewer system,
to the extent allowable by the Thurston County Health Code.
E. CommercIal Development
(1) CommercIal development along the Y-l Comdor of the Southwest
Yelm Conceptual Master Plan area shall be linnted to a total of
165,000 square feet of floor space Wlth no more than 40,000 square
feet of commercial floor space attributable to anyone commercIal
structure. The total of 165,000 square feet along the Y-1 Comdor
shall be phased WIth development according to the folloWlng phasmg
plan:
a. Fifteen thousand (15,000) square feet of commercIal floor
space will be allowed until the constructlon of 1,250 dwelling
umts m the enure Master Plan area IS complete.
b. An addinonal fifty thousand (50,000) square feet of
commercIal floor space will be allowed after the constructlOn
of 1,250 dwelling umts m the enure Master Plan area, but
before the construcnon of the Y -1 State Highway.

An addinonal one hundred thousand (100,000) square feet of
commercIal floor space will be allowed after the constructlon
of the Y -1 State Highway.
(2) Access to such commercIal development from the maln loop road
shall be lirmted to no less than 300 feet from the mtersecuon of such
road WIth the Y -1 S tate Highway. No access to such commercIal
development will be allowed from the Y-1 State Highway,

(5) The applicant shall obtaln from Thurston County all necessarj
penmts for crossrng the trail recently acquIred by Thurston Counry
from Burlington Northern.
G, Schools
(1) The Conceptual Master Plan map and Conceptual Zomng Plan
should show the reservatlon of a total of three school sites for future
dedication or purchase. The applicant has shown one fifteen (15)

Instructlon for the SItIng of school sItes.
(3) In the event that any of the school sItes reserved pursuant to tills
Conceptual Master Plan are detenmned by the School DIstnct or the
City of Yelm to be unacceptable for the development of a school
site, the School DIStnct may elect to W3.lve the reservatlOn and
accept a voluntary agreement ill lieu of such school SIte under the
terms of RCW 82.02.020.

Yelm Conceptual Master Plan. Those rmtlgaung measures are

(1) This Conceptual Master Plan approval does not mclude or llTIply
approval of specIfic development proposals such as subdiVISIons,
plats, SIte plans, or planned resIdenhal developments. Such specmc
development proposals shall be subject to the laws and regulahons

shall sahsfy all condiuons of tills Conceptual Master Plan that apply

final Master Plan approval, prOVIded that the overall requIrements of
tins Conceptual Master Plan approval are sansfied.
(5) TIns Conceptual Master Plan approval shall take effect upon the
executlOn and recording of a Conconurant Agreement pursuant to
conc1uslOn 4.D. herem.
RECOMMENDA nON:
Tne Planmng CommissIOn of the City of Yelm recommends approval of the
Southwest Yelm Conceptual Master Plan by the City Council of the City of Yelm

DECLARATION OF BOUNDARY LINE ADJUSTMENT AND COVENANTS
KNOW ALL MEN BY THESE PRESENTS
That we, the undersigned, are the owners of the land described by
the declaration, and are seeking approval by the Planning Department of the
herein described adjustment of land known as Boundary Line Adjustment
Number B LA- subject to the following covenants and conditions
1 , That all subsequent deeds will contain provisions for private
roads in the manner described herein.
2. That all maintenance of any private road described by this
declaration shall be by the owners of .the parcels having legal access
therefrom or their heirs, assigns, or successors, unless and until such roads
are improved to the current public road standards and dedicated to and
accepted by the appropriate governmental jurisdiction.
3. That any private road wi II be subject to the further right of
the grantor or his successor and of any telephone, electric, gas, water, or
sewer company, public or private, to lay or cause to be laid and the right of
ingress or egress for the purpose of maintaining telephone, electric, gas,
water or sewer pipes, mains, or conduits across a described portion of such
road.
4. That with respect to any private road described by this
declaration whether it remai ns private or becomes a dedicated road, there is
the additional right of the Grantor or his Successor to make all necessary
slopes for cuts and fills; and the drainage of said roads and ways over and
across any lot or lots where the water might take a natural course upon
reasonable grading pursuant to improvement for dedication of the roads and
ways shown herein shall be allowed to continue. Following reasonable grading
pursuant to improvement for dedication of the roads and ways shown herein,
no drainage waters on any parcel(s) shall be diverted or blocked from their
natural course so as to discharge upon any public road rights-of-way or to
hamper proper road drainage.
5. That the adjusted legal description of each of the tracts being
adjusted is attached hereto and incorporated by reference as though fully set
out herein.
6. That additional covenant, easements, restrictions, if any, solely
for the benefit of the grantor, and his hei rs, successors, and assigns
enforceable only by such persons, are attached hereto either as exhibits
or as previously recorded under Auditor's File Number

$50,00 for this application fee for revising the property lines between Thurston
Highland parcel and the Doyle and Bosequett properties.
The Doyle and Bosequett parties will be SIgning the notarized signature at Yelm's CIty
hall. They have copy of the package and were told that the original is at your office
The resulting land will enable the development of the Loop Road for the SW Yelm
subarea. The original BLA with a slight modification in the Doyle portion has been
approved and recorded when the land was under county jurisdiction.
We are hoping that this can be tentatively approved and ready for recording within a
couple weeks so that the title of these parcels can be processed immediately afterward.

are improved to the current public road standards and dedicated to and
accepted by the appropriate governmental jurisdiction.
3. That any private road will be subject to -:'ne further right of
the grantor or his successor and of any telephone, electric, gas, water, or
sewer company, public or private, to lay or cause to be laid and the right of
ingress or egress for the purpose of maintaining telephone, electric, gas,
water or sewer pipes, mains, or conduits across a described portion of such
road.
4. That with respect to any private road described by this
declaration whether it remains private or becomes a dedicated road, there is
the additional right of the Grantor or his Successor to make all necessary
slopes for cuts and fills; and the drainage of said roads and ways over and
across any lot or lots where the water might take a natural course upon
reasonable grading pursuant to improvement for dedication of the roads and
ways shown herein shall be allowed to continue. Following reasonable grading
pursuant to improvement for dedication of the roads and ways shown herein,
no drainage waters on any parcel (s) shall be diverted or blocked from their
natural course so as to discharge upon any public road rights-of-way or to
hamper proper road drainage.
5. That the adjusted legal description of each of the tracts being

for the benefit of the grantor, and his heirs, SUcc(;ssors, and assigns

or as previously recorded under Auditor's File Number

7. We, the undersigned, hereby indemnify the approving
governmental agency for all costs or damages including attorney's fees
