The Department requests the opportumty to reVIew a traffic report for tms development.
The report should examme traffic movements on the opposite Side of the mghway and
match other access locations.
With state laws, ReVIsed Code ofWashmgton (RCW) 47 50 and Wasllington
AdmImstratlVe Code (WAC) 468-51 and 468-52, the Department has established an
Access Control ClassIficatIOn System to the State Highways to prOVIde and mamtam a
safe and efficient transportation system. The Department has classified tms sectIOn of SR
507 as a Class 2 Controlled Access Facihty
Class 2 lughways reqUIre that "pnvate direct access to the state mghway system shall be
pefmItted only when the property has no other reasonable access to the general street
system" Because tms parcel does not appear to have access to a county or City street and
the property frontage exceeds one thousand three hundred twenty feet the Department
may conSider grantmg two access connection pefmIts. However, the traffic report must
show that the additIOnal access will not adversely affect the deSired functlOn of the state
lughway m accordanc~ With operation of the state lughway

completed environmental checklist and other information on file with the It;ladagency This

The applicant shall Gontribute financially to the Five-Corner{i intersection
improvement and/or the Y-2 Alternate Houte as specified' in the 1992 Yelm
Comprehensive Transportation Plan Contribution is based on the number of
automobile trips generated by thiS site during the PM peak hour Total PM
Peak hour: trips proposed to travel through the Five-Corners intersection are
195 trips at $300 00 per tnp = $5,85000 The applicant shall agree to submit
an agreement waiving any right the applicant might have to protest the

2 The applicant shall be responsible for site frontage improvements to SR 507
conforming to an urban arterial standard These improvements shall be
deferred until other adjacent properties develop, so a single project can be
implemented to avoid piece-meal construction The 'applicant shall agree to

5 A wetland area has been identified on the subject property and has been
delineated by a professional wetland biologist using the Federal Manual for
IdentifvinQ and DelineatinQ Jurisdictional Wetlands (1989) The wetland has
been classified using the Washington State Department of Ecology Wetland
RatinQ System for Western WashinQton (1993) The wetland boundaries and
classification have been confirmed in the field by City of Yelm staff The
wetland boundaries have been surveyed by a licensed surveyor in the State
of Washington
The western area of the site contains approximately 5,000 square feet of an
eight acre wetland on the adjacent property to the west. The wetland has
been rated as a Category II wetland
Pursuant to City of Yelm Ordinance 426, Interim Yelm Critical Areas Resource
Lands, the buffer for a Category II wetland can be reduced to a minimum 25
feet from the standard 150 feet. A reduction to a .50 foot wetland boundary
IS allowed provided the wetland buffer remains in a separate tract and in the
ownership of the applicant, that the buffer be protected from human and
domestic animal encroachment with a minimum eight foot solid wood fence
and the buffer vegetation is undisturbed
6 The developer agrees to mitigate impacts to the Yelm School District pursuant
to Mitigation Agreement, file #9508210126 recorded in Volume 2443, Page
617 The developer has agreed to pay the School District $650 00 for each
single family dwelling unit.
This Mitigated Determination of Significance is issued pursuant to Washington Administrative
Code 197-11-340(2) The City of Yelm will not act on this proposal prior to 5 00 pm,

Enclosed is a copy of the recorded Mitigation Agreement between the
developer and the Yelm Community Schools DIstrict. This document is now
part of the process that leads to final plat approval. Construction permits WIll
be Issued based on receipt of agreed fees as outlIned in the MItigation
Agreement. The DistrIct collects the fees and issues releases to the
developer. All you need to do is ensure that the developer has a release prIOr
to issuIng a bUIlding permit for any construction In the development. ThIS
MItigation Agreement IS therefore a covenant on the property.
I have also enclosed a copy of the release of property from mItigation
agreement. (This IS only a copy for your records we WIll prepare the originals
at the DIStrict.)

MITIGATION AGREEMENT
THIS MITIGATION AGREEMENT ("Agreement") IS made this Y day of
Atl. I-H I' , 1995, between the YELM COMMUNITY SCHOOLS DISTRICT NO 2, Yelm,
Washington (the "District") and Mark Carpenter (the "Developer").
RECITALS
A. The Developer has subffiltted an applicatIon to the City of Yelm for the construction
of 60 smgle faffilly dwelling Units, commonly known as Nisqually Estates Division 2(the
"Project") The Project IS located on property that lIes within District boundaries, more particularly
described on Exhibit A, attached hereto and incorporated herein by reference.
B The State EnVironmental PolIcy Act, Chapter 43.21C RCW ("SEPA"), proVides
processes and procedures whereby major actions by state and local agencies, including, but not
limited to, plat or PUD approval or the issuance of budding perrmts, may be reviewed to determine
the nature and extent of their impact on the environment. Impacts on public services, mcluding
schools, are environmental Impacts for the purposes of SEP A. SEP A requires the mitigation of
adverse environmental impacts.
C The District's student populatIOn and growth projections indicate that the Project
will have an impact on the DIStrict, when cumulatIve Impacts of other projects are conSIdered.
D RCW 82.02.020 authonzes the District to enter mto a voluntary agreement With the
Developer for payment to mitIgate the unpact of the Developer's Project.
E Pursuant to Resolution No 12-16-93-05, It is the policy of the DIStrict to
recommend that the direct Impact of development be voluntanly ffiltigated by the payment of fees
and other ffiltlgatIon measures where appropnate.
F The Developer has agreed to mitigate, on a voluntary baSIS, the adverse Impact of
the Project on the District.
AGREEMENT
NOW, THEREFORE, in conSideration of the above recitals and the mutual proffilses and
covenants below, the District and the Developer agree as follows:
1 The Developer acknowledges and agrees that there IS a direct Impact on the Distnct
as a result of the Developer's Project and that thiS Agreement is necessary as a result of that Impact.
2 The Developer acknowledges and agrees that in order to mitigate the direct Impact
of the Project, the Developer has offered to pay the District the following sum of money. Six
Hundred and fifty and No/lOO Dollars ($65000) for each single family dwelling unit or the total
sum of thirty nIne thousand and No/lOO Dollars ($39,000.00) (the "Mitigation Payment") for the
sixty SIngle family dwelling UnIts.
3 Any extension, renewal, modification or amendment to the Project that results in an
adjustment in the number of dwelling units shall result in a corresponding pro rata adjustment in
the Mitigation Payment. Multi-family units will be mitIgated at $500/family unit.
4 The Developer agrees that the payment of the full Mitigation Payment (in the
amount of six hundred and fifty and No/lOO Dollars ($650.00) per dwellIng unit or thirty nIne
thousand and No/lOO Dollars ($39,000 00) for the project, shall be a condition of building permit
issuance and shall be made pnor to or at the time of building permit issuance for each single family
dwelling unit constructed In the project or at the tIme the developer sells a lot to another party for
future construction.
5 The Distnct agrees to record thIS Agreement after it has been executed by the
parties.
6 The Developer acknowledges and agrees that the MitIgatIOn Payment IS authorized
to be used for capItal Improvements to the following facilitIes. Fort Stevens Elementary School,
Mill Pond Intermediate School, Yelm Middle School, and/or Yelm High School and/or any other
facilIties that may be affected by the Project and/or the purchase of portable facilItIes and/or school
buses.
7 The Developer agrees that the District has five (5) years from the payment date to
spend the Mitigation Payment for the capItal improvements or expenditures described in
paragraph 6. In the event that the Mitigation Payment is not expended within those five years, the
monies will be refunded with interest at the rate applied to Judgments to the property owners of
record at the tIme of refund, however, if the Mitigation Payment is not expended within five years
due to delay which is attributable to the Developer, the Payment shall be refunded WithOUt Interest.
8 The Developer waives and relinqUIshes its nght to protest or challenge the payment
of the MitIgatIon Payment pursuant to this Agreement and hereby covenants and undertakes that it
forever refrains and desists from institutIng, asserting, filIng or bringing any laWSUIt, litigation,
claim, or challenge or proceeding to challenge this Agreement, claim any repayment or
reimbursement of funds, performance or improvements provided for therein, or any of its terms
and conditions, on any ground or basis whatsoever.
9 The District hereby WaIves any objection to the Project as presently proposed.
10 The District and the Developer agree that the MitIgation Payment will be full and
complete rmtigatlon for the impact of the Project as presently proposed on the District.
11 This Agreement shall be bIndIng upon and Inure to the benefit of the heIrs,
executors, adrmnIstrators, successors, and aSSIgns of both of the Developer and the District.
12 If an action must be brought to enforce the terms of this Agreement, such action
shall be brought In Thurston County Superior Court. The prevailing party shall be entItled to
payment of ItS costs and reasonable attorneys' fees.
13 This Agreement constitutes the entire agreement between the parties and any other
agreement either written or oral shall be null and void.
