Dear Mayor Wolf:
Thank you for the opportunity to comment on the determination of
npnsignificance for the division of 15 acres into 60 single
family residential lots adjacent to SR-507 proposed by Mr. Paul
Steadman. We reviewed the environmental checklist and have the
fpllowing comments.
W~tlands are a valuable natural resource that provide many useful
benefits, including wildlife and fisheries habitat, floodwater
attenuation, water quality improvement, and recreational and
aesthetic values. Wetland buffers act to filter surface runoff,
reduce erosion, screen adjacent noise, light and activity, and
protect habitat for wetland dependent species. Our review of
available studies indicates the effective buffer widths range
from 50 feet to 300 feet, depending upon the functions provided
by the wetland, the topography, soils, existing vegetation, and
the additional adjacent land use.
It is likely that the functions performed by a Category II
wetland would not be protected by a 25 foot buffer. We recommend
ipcreasing proposed buffer widths to provide adequate protection
of the wetland values and functions. In some instances, enhance-
m~nt of an existing buffer, by planting of native vegetation, or
constructing a fence, can improve the protection of wetland
functions and allow a minor reduction in the width of a wetland
buffer, without leading to additional adverse wetland impacts.
Land use with significant construction and post-construction
impacts necessitate larger buffers for wetlands protection.
C9nstruction impacts include erosion and sedimentation, debris
disposal, vegetation removal, and noise. Post-construction
i~pacts are variable depending on the land use, but residential
l~nd use in particular, can have significant impacts. Residen-
tial land use is associated with yard maintenance debris, domes-
tic animal predation, removal of vegetation, and trampling.
Wetland areas and their buffers should not be included in resi-
dential lots.

completed envirol1mental checklist and other information on file with the lead agency This
information is available to the public on request.
The following condition imposed pursuant to WAC 197-11-340, -350 is
1 The applicant shall contribute financially to the Five-Corners intersection
improvement and/or the Y-2 Alternate Route as specified in the 1992 Yelm
C9mprehensive Transportation Plan Contribution is based on the number of
automobile tnps generated by this site during the PM peak hour Total PM
Peak hour trips proposed to travel through the Five-Corners jntersection are
1 ~ 5. trips at $300 00 per trip = $5,850,00 The applicant ~hall agree to. submit
an .agreement waiving any right the applicant might have to protest the
formation of a Local Improvement Dlstrict-(L1D or Latecomer's Agreement.)
2 The applicant shall be responsible for site frontage improvements to SR 507
conforming to an urban arterial standard These improvements shall be
deferred until other adjacent properties develop, so a single project can be
implementeq to avoid piece-meal construction The applicant shall agree to
submit an agreement waiving any right the applicant might have to protest the

Ratinq System for Western Washinqton (1993) The wetland boundaries and
classification have been confirmed in the field by City of Yelm staff The
wetland boundaries have been surveyed by a licensed surveyor In the State
of Washington
The wetland in the northeast area of the site has been rated as a Category III
wetland Pursuant to City of Yelm Ordinance 426, Interim Yelm Critical Areas
Resource Lands, the buffer for a Category III wetland shall be 50 feet.
6 The developer agrees to mitigate impacts to the Yelm School District pursuant
to Mitigation Agreement, file #95062210116 recorded in Volume 2419, Page
313 The developer has agreed to pay the School District $650 00 for each
single family dwelling unit.
This Mitigated Determination of Significance is Issued pursuant to Washington Administrative
Code 197-11-340(2) The City of Yelm will not act on this proposal prior to 500 pm,

Dear Ms. Carlson.
Enclosed is a copy of the recorded Mitigation Agreement between the
developer and the Yelm Community Schools District. This document is
now part of the process that leads to final plat approval. Construction
permits will be issued based on receipt of agreed fees as outlined in the
MItigation Agreement. The District collects the fees and issues releases to
the developer. All you need to do is ensure that the developer has a release
prior to issuing a building permit for any construction in Prairie Vista
development. This Mitigation Agreement is therefore a covenant on the
property .
I have also enclosed a copy of the release of property from mitigation
agreernent. (This is only a copy for your records we will prepare the
originals at the District.)

A The Developer has submitted an applicatiOn to the City of Yelm for the construction
of 60 single family dwellmg umts, commonly known as Nisqually Estates Division l(the
"Project") The Project is located on property that lies wIthm Distnct boundaries, more partIcularly
described on Exhibit A, attached hereto and incorporated herem by reference.
B The State EnvIronmental Polley Act, Chapter 43.21C RCW ("SEPA"), proVIdes
processes and procedures whereby major actIOns by state and local agencies, includmg, but not
luruted to, plat or PUD approval or the issuance of buildmg penruts, may be reviewed to detenrune
the nature and extent of their Impact on the enVIronment. Impacts on publIc services, mcludmg
schools, are envIronmental Impacts for the purposes of SEP A. SEP A requires the ffiltIgatIon of
adverse envIronmenta1Impacts.
C The DIstnct's student population and growth projections mdicate that the Project
WIll have an Impact on the District, when cumulatIve impacts of other projects are conSIdered.
D RCW 82.02.020 authonzes the Distnct to enter into a voluntary agreement WIth the
Developer for payment to lTIltigate the impact of the Developer's Project.
E Pursuant to ResolutIOn No 12-16-93-05, it is the policy of the DIstnct to
recommend that the dIrect Impact of development be voluntanly ffiltigated by the payment of fees
and other mitigatIOn measures where appropnate,
F The Developer has agreed to mitigate, on a voluntary basis, the adverse Impact of
the Project on the Distnct.
AGREEMENT
NOW, THEREFORE, 10 conSIderatIon of the above reCItals and the mutual promises and
covenants below, the Distnct and the Developer agree as follows.
1, The Developer acknowledges and agrees that there is a dIrect Impact on the DIStrict
as a result of the Developer's Project and that tlus Agreement IS necessary as a result of that Impact.
2 The Developer acknowledges and agrees that in order to IllitIgate the direct Impact
of the Project, the Developer has offered to pay the Dlstnct the followmg sum of money. SIX
Hundred and fifty and NollOO Dollars ($65000) for each smgle family dwellmg unit or the total
sum of thirty nme thousand and NollOO Dollars ($39,00000) (the "MitIgatIon Payment") for the
SIXty smgle family dwellmg uruts.
3 Any extensIon, renewal, modIficatIon or amendment to the Project that results m an
adjustment in the number of dwelling units shall result in a corresponding pro rata adjustment m
the MitIgatIOn Payment.
4 The Developer agrees that the payment of the full Mitigation Payment (in the
amount of SIX hundred and fifty and NollOO Dollars ($65000) per dwelling unit or thIrty rune
thousand and No/IOO Dollars ($39,00000) for the project, shall be a condItIon of building permIt
Issuance and shall be made pnor to or at the time of building perrrut issuance for each single fanuly
dwellmg umt constructed m the project or at the tIme the developer sells a lot to another party for
future constructIOn. A one-tIme sale/transfer of the entIre plat IS perrrutted pnor to payment of the
IllitIgatIon fees.
5 The DIstrict agrees to record thIS Agreement after it has been executed by the
partIes,
6 The Developer acknowledges and agrees that the MitigatIOn Payment IS authorized
to be used for capItal improvements to the following facIlItIes. Fort Stevens Elementary School,
Mill Pond IntermedIate School, Yelm Middle School, and/or Yelm High School and/or any other
facIlItIes that may be affected by the Project and/or the purchase of portable facIlItIes and/or school
buses
7 The Developer agrees that the DistrIct has five (5) years from the payment date to
