Recommended School Mitigation Condition:
The applicant shall work with the Yelm School District to determine whether there is
a need to mitigate any impacts on Yelm Schools resulting from the addition of
students from the project. Prior to occupancy, the Yelm School District and the
applicant shall reach an agreement concerning any possible mitigation and shall notify
the City of Yelm Planning Department. Alternatively, the applicant may request that
the Planning Commission modify, clarify or eliminate the terms of this condition.
Upon such a request, the School District bears the burden of establishing the legal
basis for any requested mitigation Including, but not limited to, the following: the
number of new students projected to be added to the school district, the existing
capacitY of schools, the number of students that will be under-funded by state and
local revenue sources, the facilities planned by the school district to alleviate lost
capacity, and the revenue shortfall per student to be assessed to this applicant. In
the event that the Planning Commission makes a determination that mitigation either
is or Is not required, both the applicant and the School District shall have the right to
appeal the decision to the Yelm City Council pursuant to YMC 16.04.090. In no
event shall any mitigation be imposed or collected unless and until the School District
signs an agreement with the City of Yelm obligating the School District to fully
indemnify the City.

The Rants Group IS proposmg to construct a 72 famIly apartment complex on
NE Creek Street ill the CIty of Yelm. (Lots 1,2 & 3 of SS 8028 located ill NW
1 I 4 of NW 1 14 of Section 9, Twp 17N Range 2 East, WM.)
The Yelm Commumty Schools DIStrIct IS Impacted by Yelm Apartments We
are currently seeking a voluntary mItigation agreement between Rants Group
and the School DIStrIct to off set thIS Impact.
TItle 82 RCW paragraph 82.02.020 allows the Yelm Commumty Schools
DIstnct as a "mumcIpal corporation to mitigate a direct Impact that has been
IdentIfied as a consequence of a proposed development. On December 16, 1993
the Board of DIrectors of the School District authorIzed us to seek mItigation
fees from land developers We use the State Environmental Protection Act
gUIdelmes of five Oimore famIly umts in a development as the pomt where
we enter mto voluntary mitigation agreements.
Once an agreement has been reached between the developer and the DIStrIct,
It becomes a bmdmg covenant that IS m force during the permItting process.
The City does not collect any fees The School DIStrIct collects any mItigatIOn
fees andlor ensures that modIfications to the development meet the
parameters of the covenant. The School DIstnct then prepares a release for
the developer to proceed The CIties only role ill thIS process IS the
enforcement of the covenant and msurmg that the developer has a release
from the School District prior to Issuance of a bUlldmg permIt.
Yelm Community Schools is an Equal Opportunity Employer and follows Title IX requirements.

Title 58 RCW paragraph 58 17110 requires the CIty of Yelm to determme if
appropnate prOVISIons are made for schools. Since the Plannmg Commission
reVIews all proposed developments, you are the first step for approval. Under
the State EnVIronmental ProtectIon Act and the Urban Growth Act, the CIty
must ensure that the School DIstnct and developer come to an agreement If
the project has an Impact on the operatIon of the Distnct. Without a

developers As stated m the referenced correspondence, thIS could only occur

Dear Steve.
Thank you for your call last week. I can certainly understand your client's concern
over the prospect of school mitigation It is in the best interest of both your client and
mine that any attempt to mitigate for impacts to schools resulting from your client's
project is done within the authority of the law.
Apparently, the City of Yelm issued a Determination of Non-Significance on February
7, 1994. The City did not attach any conditions to the DNS relying on the
commitment in the environmental checklist submitted by your client to the effect that
he would be discussing with the School District any school mitigation.
It is our interpretation that your client is bound by his commitment in the
environmental checklist The City of Yelm expects that your client will negotiate in
good faith the appropriate school mitigation measures for any impact connected to the
project. If agreement cannot be reached between your client and the Yelm School
District, we would expect that any dispute would be returned to the City of Yelm
Planning Commission.
The City of Yelm can certainly withdraw the Determination of Non-Significance and
issue a Mitigated Determination of Non-Significance and include a condition requiring
your client to negotiate school mitigation with the Yelm Community Schools. Given
the delay that would result from such a withdrawal and re-issue, we do not expect
that you would favor this option.
With regard to the Planning Commission hearing on February 22, 1994, the Planning
Commission will consider any proposed conditions dealing with school mitigation as
a condition of site plan approval It is our advice to the City and to the Planning

Commission that the Planning Commission has the authority to condition its approval
of a binding site plan on a requirement that the developer provide mitigation for its
impacts upon schools. The authority for such a condition can be found in the Yelm
Municipal Code at Section 16.32 060 There, the binding site plan ordinance requires
the Planning Commission to "determine whether the proposed use is served and
makes adequate provision for the public health, safety and general welfare" I have
attached a copy of that section of the Code for your review
Further authority can be found at RCW 82 02 020, where the Legislature has, in
effect, endorsed the concept of developer/municipality agreements for the mitigation
of project impacts. Such agreements were considered and approved in the case of
Henderson Homes v. Bothell. 67 Wn. App. 196, 834 P.2d 1071 (1992).
While the City has the authority to impose such a condition, I can find nothing in the
law that mandates such a condition Apparently, the School District has argued that
the City is so mandated, but they have failed to cite to any authority imposing such
a mandate.
In order to avoid a protracted argument at the February 22 hearing, I will recommend
that the Planning Commission either assure itself that your client's commitment to
negotiate with the School District is being fulfilled, or impose such a condition on its
approval of the binding site plan. Of course, if your client would prefer that the City
re-issue a Mitigated Determination of Non-Significance, that will also resolve the
matter.

Schools servmg tlus development area are Fort Steven's
Elementary, Mill Pond Intermediate, Yelm Middle School and Yelm
High School. All four of these school are currently operahng With
portables to handle therr excess students. The mcrease ill students
wIll requIre the future purchase of addItional portables. Current cost
of portables average $54,000. Tlus does not mclude site preparation
ADA requrrements or amortization costs for purchase and IS very
conservative. A mmrmum of one portable classroom IS reqUITed for
each 25 students Therefore for purchase of a portable, the
cost/ student IS $54,000 dIvIded by 25 or $2,160 per student. For tlus
proJect, the cost would be 17.06 tune $2,160 or $36,849.60. Tlus would
result m a umt Impact for the rune elght-plex apartments of
$4,094.40/ umt.
Under state law, the State Subdivision Act, and ill particular RCW
5817110(2), reqUlres the City of Yelm to make sure that proposed
plats have appropnate provisions for schools and school Sites.
SimIlarly, the State Envrronmental Pohcy Act (SEP A) further requrres
proposed developments to rmtIgate certam impacts on the human
bUllt envrronment, wluch mcludes public schools.

It IS not the mtent of the Yelm Community Schools DistrIct to place a
unreasonable burden on the developer, only to offset the rmpact
through voluntary mitIgatIon of the mcrease in students as a result
of the development. We would only pursue the amount necessary to
purchase portables to offset tills rmpact. We would therefore
consIder $4,094.40 for each elght-plex apartment urut as reasonable
mItIgatIon.
As mentIoned m our meetmg, constructIon of a bus stop on the Mam
Road m front of the Apartments wIth ample space for the bus to pull
off the road and sIdewalks WIthm tills development to provIde safety
for students walkmg to the deSIgnated bus stop IS requested m
accordance wIth the prOVIsIons of RCW 58.17.110
Hopefully, tills letter will answer the questIons you had concernmg
the number of students If you agree wIth our request for $4,094.40

I received your mformatIOn on the number of children you project for both
phases of your proposed development.
On December 16, 1993 the Board of DIrectors of the Yelm School Distnct
authonzed the School District to seek mItigating fees from land developers.
I have enclosed an mformation sheet that bnefly explains the process.
We would lIke to enter mto a mItIgation agreement between fIR<: i\ssociates
and the School DIstrict.
Our mItIgatIOn procedure is simIlar to other school districts m Thurston
<:ounty We do not address one bedroom apartments as impacting the
Distnct. However, the two bedroom apartments do Impact the DIstnct and we
need to dISCUSS that Impact.
Should we be able to reach a mutual agreement, the school dIstrict would be
wIllmg to not seek impact fee:) greater than our mut4al agreed upon amount
If Thurston <:ounty adopted an ordinance authonzmg the assessment and
collection of impact fees on new residential development.

boundaries of the Yelm Community School District.
The State Environmental Policy Act (SEP A) and State Law makes
provisions for school districts to negotiate mitigation for impacts of
new development. Such negotiation can include fees, reduced land
cost for school facilities, donation of land, school bus stops ect.
Mitigation Fees are a short term fix for growth as a result of new
development. Schools can collect mitigation fees in those
jurisdictions where there are no impact fees collected by the City or
CGunty. These fees are to offset expenses until normal procedures
can fund the growth.
The collection of mitigation fees is a voluntary agreement between
the developer and the school district.
Once completed, the agreement becomes part of the process that
leads to final plat approval. The agreement becomes a binding part
of the development. Construction permits are issued based on receipt
of agreed fees as outlined in the Mitigation Agreement.
The mitigation process begins when a developer applies for plat
approval. The City or County will require input from the school
district before allowing the development to begin.
