Dear Mayor Parsons:
Thank you for the opportunity to comment on the determination of
nonsignificance for the extension of a watermain from Nisqually
Plaza to Grove Road, a long Highway 507 and Bald Hills Road, as
proposed by prairie Lumber and Hardware (#8164). We reviewed the
environmental checklist and have the following comments.
The applicant should contact the u.s. Army Corps of Engineers in
Seattle at (206) 764-3495 regarding additional permit
information.
Any work in or adjacent to waterways that will adversely affect
water quality must receive specific prior authorization from the
Department of Ecology pursuant to WAC 173-201A-110. A short-term
water quality standards modification may be issued if the
proponent agrees to a number of specific construction practices
and techniques designed to minimize water quality impacts. The
construction schedule will be tied to the schedule on the
Hydraulic Project Approval (HPA).
Proper erosion and sediment control practices must be used on the
construction site and adjacent areas to prevent upland sediments
from entering the stream channel. All areas disturbed or newly
created by construction activities must be revegetated or use
some other equivalent type of protection against erosion.
Erosion control measures must be in place prior to any clearing,
grading, or construction. These control measures must be
effective to prevent soil from being carried into surface water
by stormwater runoff. Sand, silt, and soil will damage aquatic
habitat and are considered pollutants.
Any discharge of sediment-laden runoff or other pollutants to
waters of the state is in violation of Chapter 90.48 RCW, Water
Pollution Control, and WAC 173-201A, Water Quality Standards for
Surface Waters of the State of Washington, and is subject to
enforcement action.

A sedimentation and erosion control plan for the project site may
be required and must be developed by a licensed engineer. The
plan must be implemented before and during construction. The
site must be carefully monitored to determine effectiveness of
the plan. The plan must be upgraded as necessary during the
construction period.
During construction, all releases of oils, hydraulic fluids,
fuels, other petroleum products, paints, solvents, and other
deleterious materials must be contained and removed in a manner
that will prevent their discharge to waters and soils of the
state. The cleanup of spills should take precedence over other
work on the site.
Proper disposal of construction debris must be on land in such a
manner that debris cannot enter the stream channel or cause water
quality degradation of state waters.
Routine inspection and maintenance of all sediment and erosion
control devices is recommended both during and after development
of the site.

In response to your memo of today, no shoreline permit is required However, because
the construction involves a flowing stream and associated wetlands, you should require
the contractor to show evidence that he has contacted the Washington State Dept. of
Fish & Wildlife about hydraulic project approval and the U S Army Corps of Engineers
about Section 10 and 404 approval The Army Corps of Engineers permit process
should be very streamlined, as the activity described falls under a "nation-wide permit"
which involves simple letter approval

The classification of Yelm Creek as t. understood from the Urban
Growth Management Plan or our Zoning Codes adoption has been down
graded to a flow level below the threshold which would require
federal and state permits to work within the creek boundary
area.
The City has a developer who needs to install a. 10 inch water
main to their site which includes crossing Yelm Creek and the
most efficient and permanent method will be to bury the pipe
below the stream bed than backfill and restore the construction
zone. During the construction of the City's sewer system two (2)
such crossings were made, with, great success.
Will you please advise on this matter.
