GENERAL PROVISIONS
This Hydraulic Project Approval (HPA) pertains only to the provisions of the Fisheries Code (RCW 75.20). Additional authorization
from other public agencies may be necessarv for this project.
This HP A shall be available on the job site at all times and all its provisions followed by the permittee and operator(s) performing
the work.
This HP A does not authorize trespass.
The person(s) to whom this HPA is issued may be held liable for any loss or damage to fish life or fish habitat which results from
failure to comply with the provisions of this HP A.
Failure to comply with the provisions of this Hydraulic Project Approval could result in a civil penalty of up to one hundred dollars
per day or a gross misdemeanor charge, possibly punishable by fine and/or imprisonment.
All HPAs issued pursuaut to RCW 75.20 100 or 75.20 160 are subject to additional restrictions, conditions or revocation if the
Department of Fish and Wildlife determines that new biological or physical information indicates the need for such action. The
permittee has the right pursuant to Chapter 34 04 RCW to appeal such decisions. All HPAs issued pursuant to RCW 75.20 103 may
be modified by the Department of Fish and Wildlife due to changed conditions after consultation with the permittee: PROVIDED
HOWEVER. that such modifications shall be subject to appeal to the Hydraulic Appeals Board established in RCW 75.20 130

Concurrency Ordinance
WHEREAS, the Washington State laws governing the division or development of
property require a specific written finding as to the adequacy of facilities necessary to
serve proposed development; and
WHEREAS, the City of Yelm has adopted a comprehensive plan and capital
facility plan identifying the levels of service necessary to accomplish concurrency, and
WHEREAS, the City desires to specify the standards and criteria for determining
concurrency within the City of Yelm or its associated urban boundary;
WHEREAS, the City desires to set rates which are below those of surrounding
communities where possible,
NOW, THEREFORE, BE IT HEREBY ADOPTED
Section 1. Definitions
a Concurrencv-A determination that the facilities necessary to serve a
proposed land development are In place or planned for and properly funded with a
reasonable expectation that the facilIties will be In place at the time needed to preserve
adopted levels of service
b Develooment activity-Any construction or expansion of a building,
structure, or use, any change in use of a building or structure, or any changes In the use
of land, that creates additional demand and need for public facilities
c. Develooment approval-Any written authorization from the City which
authorizes the commencement of development activity
d Land division-The action of dividing land for sale or lease, whether
through the subdivision process identified In Chapter 58 17 RCW, the City's binding site
plan review process, or any other process which results In the creation or modification
of the boundaries of a property for purposes of development.
e Land development-Any action with respect to a parcel of real property
which requires plat approval pursuant to Chapter 58 17 RCW or site plan review
approval through Chapter 1784 of the Yelm City Code, or master plan development
approval through Chapter 1762 of the Yelm City Code
f Owner-The owner of record of real property, although when real property
is being purchased under a real estate contract, the purchaser shall be considered the
owner of the real property if the contract is recorded

g Proiect improvements-Site improvements and facilities that are planned
and designed to provide service for a particular development project and that are
necessary for the use and convenience of the occupants or users of the project, and are
not system improvements No improvement or facility included In a capital facilities plan
approved by the governing body of the City shall be considered a project Improvement.
h Proportionate share-That portion of the cost of public facility improvements
that are reasonably related to the service demands and needs of new development.
Public facilities-Sewer service, water service, parks, schools, and roads
are the public facilities for which the City will make specific findings of concurrency
based on the comprehensive plan
j Service area-A geographic area defined by the City in which a defined set
of public facilities provide service to development within the area Service areas shall
be designated on the basis of sound planning or engineering principles
k. Svstem Imorovements-PubllC faCIlitIes that are Included In the capital
facilities plan and are designed to provide service to service areas within the community
at large, In contrast to project improvements
I Transoortatlon Facility Charae-payment or money Imposed upon
development as a condition of development approval to pay for public facilities needed
to serve new growth and development, and that is reasonably related to the new
development that creates additIonal demand and need for public facilitIes, that IS a
proportionate share of the cost or the public facilities, and that is used for facilities that
reasonably benefit the new development. "Transportation Facility Charge" does not
Include a reasonable permit or application fee
Section 2. Process
a Whenever a reviewing authOrIty is asked to consider the approval of a
diviSIon of land for sale or lease or the approval of a site plan, the reviewing official shall
make a written determination of concurrency in connection with facilities proposed or
available for the project.
b With respect to each of the public facilitIes Identified above concurrency
shall be established and determined as follows
I Sewer'
(1) The project IS within an area approved for sewer pursuant to
the adopted Sewer Comprehensive Plan for the City
(2) Improvements necessary to provide City standard facilities
and services are present or are on an approved and funded plan to assure
availability in time to meet the needs of the proposed development.

Proposed Finding: The City's Sewer Comprehensive Plan identifies a
portion of the City area for service The City is pursuing additional land
areas for approval and the extension of facilities Completion of such
activities IS dependent on grant and developer funding, as well as planned
bonding and existing public funds The status of such plans and funding
sources must be considered in any review of concurrency Developer
extensions and or dedications, latecomer agreements, oversizing
agreements, and the creation of local improvement districts may all be
considered In the event of a new funding source, however, concurrency
is not found until the funding source is in fact in place-e g award of a
grant, a binding letter commitment for third party funding, or the successful
formation of a local improvement distnct.

Proposed Finding: The park fee-in-lieu proviSIon of the City Code
provides for the acquisition, development, and operation of the City's park
system consistent with the requirements of the comprehensive plan to

updated no less than annually, by July 1, of each year; provided, however,
the plan in effect shall remain in effect until a successor plan is fully
adopted
Section 3. Determination and Payment of the Transportation Facility Charge
a The Transportation Facility Charge shall be based on the per peak hour trip
rate Identified in the report from transportation trip calculations based on a transportatIon
report consistent with City standards
b City Standards shall include
Standard transportation assumptIons as Identified in Table 1
ii For facilities not on the standard transportation assumptions, the
Institute of Traffic Engineers trip generation manual for the most recent
year
III For projects with nontraditional peal hour impacts or different from
standard projects modelled in Table 1, a special report, based on generally
accepted traffic engineering principles may be submItted and considered
c CredIts shall be given to reflect the projected Impact on the community
system such as, traffic decreases where an existing facility on site IS removed or
replaced, and traffic reduction systems which are binding and likely to remain effective
for the life of the project.
d Credits may also be given for projects which create a significant economic
benefit to the community, including Industrial or manufacturing uses with an excess of
500 trips per day The size of the credit shall be measured at an appropriate percentage
of the anticipated annual tax revenue Increase to the community and avaIlable for capital
contribution to transportation facilities on the approved plan as a result of the project.
e Payment of the Transportation Facility Charge shall be as follows
i For proiects involvina the division of land for sale of lease-upon the
issuance of a building permit for construction of each lot of record, for the
traffic attributable to that lot.
Ii For projects approved throuqh site plan review-upon the Issuance
of the building permit authorizing the construction of any phase, for the traffic
associated with that phase
Iii For any proiect over 100 peak hour triOS per day-the fee may be
paid in installments, at the municipal rate of Interest in effect on the day of
building permit Issuance, with 50% being paid at the issuance of the building

Proposed Findings: Yelm is a small compact community most directly
affected by two state highways which bisect the community The two state
highways are used by local residents for transportation throughout the City
and for access to commercial and residential areas throughout the
community In lieu of widening existing streets, the City has elected to
create certain alternatives, Y-1, Y-2, and Y-3, which will avoid the need to
SIgnificantly WIden existing streets, and particularly Yelm Avenue New
developments do in fact burden the City's central streets, and unless the
bypass alternatives are accomplished, the City would have to reqUIre
developers to pay the cost of the internal street widening The City plans
show and the City finds that adequate faCIlities will be accomplished better
and in a timely fashion by building the bypass facilities as a substitute for
the wldemng of existing facilities As a result, the City finds that the
regIonal plans in fact benefit projects rn all areas of the City and will
accomplish the goal of providing adequate facilities to City standards
wrthrn a reasonable time to serve the demands created by the proposed
project.
The City specifically finds
1 The facilities on the list benefit all projects in the commumty
2 The facilities on the list will be Impacted by all projects withrn the
community
3 Projects on the lIst are specrfically area WIde, as well as within all
Qf the affected subareas The funds to be collected from any
project will be spent for system improvements roughly proportional
to the anticipated Impacts from the project.

demands on facilities contemplated due to new growth, and
facilities necessary to accomplish adequate service for new
development.
In reviewing the fee proposed
1 The City considered the cost of the proposed new facility
2. ProVided an adjustment for tax and other payments made or
antiCIpated, whether through grants, gas taxes, other taxes, or other
sources of revenue from the property to be charged
3 Considered alternate sources of funding and the appropnate mix
between repair, public share of new facilities to meet existing needs, and
the private share of new facilities to meet growth generated demands on
the community.

Section 4. Accountina and Aooeals
a All fees collected under this chapter shall be placed in separate accounts
for the dedicated purpose for which collected Such funds may only be expended for
identified facilities on an approved plan and must be spent wlthm SIX years absent a
specific situation where the City can Justify a longer period
b If an applicant desires to challenge the calculation or assessment of any
fee, such fee shall be paid under protest and the permit may be Issued Appeals shall
be heard by the City Council upon a de novo hearing
c Any such appeal shall consider the issues raIsed, the proper fee to be
assessed, and the necessity to find concurrency as a precondition to any project
approval The proper fee to be charged on appeal is determined (1) by compliance With
the terms of this ordinance, and (2) If for any reason the terms of thIS ordinance are
found inapproprIate, such fee as necessary to assure concurrence for all facilities
identified herein, but not to exceed the fee collected pursuant to thiS ordinance
Section 5. Effective Date
The ordinance shall be applicable to all land diviSIons and land developments and
master plan reviews for which applications are complete after the adoption date of thiS
ordinance

payment of the Transportation Facility Charge (TFC) for two pm peak hour trips generated by
the completed project. The City shall pay one Transportation Facility Charge fee at time of
building permit issuance for Phase I and one Transportation Facility Charge fee at time of
building permit issuance for Phase II

A. Public Hearing Objective: The Planning Commission must determine if the proposed Water
Reuse Project is consistent with the applicable City of Yelm Municipal Code(s) After consideration of the
facts and public testimony the Planning Commission must take one of the following actions request
additional information from the applicant and/or staff, continue the public hearing or make a
recommendation of action to the City Council
B. Proposal. The City is requesting Special Use approval for the Water Reuse Project. Phase I will
include an increase in the daily capacity of the plant from 300,000 gallons per day to 1 million gallons per
day; the plant's ablity to provide clearner effluent; piple line construction to deliver reclaimed water to
various water reuse features throughout the City; and construction of reuse features including connection
to the existing City Park; construction of Cochrane Park and an experimental wetlands
Phase II will consist of reclaimed water distribution lines to the Thurston Highlands, rapid infiltration basins
and storage facilities in Thurston Highlands Phase II construction is depended upon future funding

applicant proposes a total of 19 stalls

required for the upgrade
11 Water Supply The site is currently served by the City of Yelm. No additional capacity is
required for the upgrade

16 Environmental Review A Determination of NonSignificance (DNS) and adoption of existing
environmental documents was issued on August 8, 1997, which meets the requirements of
the State Environmental Policy Act. A finding of no Significant impact (FONSI) was issued

Protection Act.

In regard to your May 9, 1996 letter we would like to offer the following responses
1 Phase I work will include expansion and upgrade of the treatment plant and it's ability to
provide cleaner effluent quality; pipe line construction to deliver reclaimed water to various
water reuse features throughout the City; and construction of reuse features including
connection to the eXisting City Park, construction of Cochrane Park and an experimental
wetlands
Additional facilities that will be included in Phase II consist of reclaimed water distribution
line to the Thurston Highlands, rapid infiltration basins and storage facilities in the Thurston
Highlands It is unknown at this time when Phase II will be constructed It will depend on
available funding
2 Please find attached a site plan for Phase I of the project. The plant will provide 16 new
parking stalls in addition to the existing stalls This meets the minimum six new stall
requirement.
3 Final project plans for landscaping and the irrigation system were submitted to Jerry Prock
in the Building Department earlier this month

The Site Plan Review Committee has completed its preliminary review of the site plan
for the above reference project. The use is classified as a special use in the zoning
code, Chapter 17 66 Therefore the proposed project is required to obtain City
Council approval
Prior to application for a special use permit the site plan review committee has the
following comments which need to be incorporated into the site plan for the project.
1 Please identify areas for phase I and II of the project. The project proposal
should include as much information as possible on phase II, including the
intended use, approximate location of improvements and timing
2 Minimum parking requirements for phase I would include one stall per
employee (three stalls required) and 1 stall per vehicle/machinery used at the
treatment plant (three stalls required)
3 Landscaping is required per Chapter 17 80 A conceptual landscape plan will
need to be included in the special use application packet. The code requires
Type II landscaping be used and if the site contains any above ground facilities
such as a sewage pumping station it will require Type I landscaping Final
plans for planting and the irrigation system can be submit to the engineering
department with civil construction drawings Conceptual and final landscaping
plans for phase II do not need to be included at this time

the envIronmental Impacts of a proposal before making decisions The purpose of this
checklIst IS to provide information to help identify impacts from your proposal, to reduce
