Dear Mr and Mrs. Rothwell,
In regards to your request for a fence or shrub planting to restore the privacy for the rental home
that IS next to our Yelm Branch, the CredIt UnIOn agrees to the help restore the area subject to the
followmg conditIOns.
1) Any plantmg of shrubs or constructIOn of a fence wIll occur on the mutual property line;
2) The choice of shrubs or fence materIal wIll be mutually agreed upon by both yourselves and
the Credit UOlon,
3) You agree to mamtain the fence or shrubs;
4) All costs for purchase and mstallatIon of eIther shrubs or a fence wIll be shared equally
between yourselves and the Credit UOlon, wIth a maximum contribution of $500 on behalf of
the Credit UnIOn.
Please let me know when you decide which type of material you would like to use so that we can
take care of this. as soon as possible. If you have any questions, please feel free to contact me at

Dear Board Members
We are writing this letter in hope that you will respond to our concern of safety
(security) and a privacy situation We are your new neighbors of your new branch in
Yelm Numerous fruit trees, hedges, bushes, and limbs of fir trees have been removed
to take away privacy and security we have always had for over 50 years The modular
home that Sharon Iverson resides in now sits a few feet from constant traffic with
people being able to look straight into her home 24 hours a day Being a single
person presents a safety concern now on a daily basis
Out of courtesy to us, before any limbs were cut down, a meeting with us would have
been very helpful and would have prevented what has happened The ice storm we
had last winter did a lot of damage, and the limbs needed a trim The first time it was
done, it was a very healthy trim and looked good. Within a week, they were trimmed
for the second time, and they were "scalped" Now, everyone can see her home from
the road. We feel very "naked."
Within a few days, we had to chase off high school kids on different occasions who
were smoking on the back porch and hiding in the storage room, since they had direct
access from the high school and used it as a short cut. Before that, they never even
knew it existed The reason we were given why the limbs were cut the first time was
that they didn't want people hiding behind the trees and brush. At another time, it was
mentioned that they didn't want the branches brushing against vehicle windows as
they came driving through
Vlfhy were just the branches cut down in the middle of the tree line and not on each
side? You would think they would want to keep them uniform Trimming branches is
one thing, cutting them down is a completely different thing Those fir trees were
planted years ago as a boundary line, they were historic and were just beautiful! So
many people have come to us since the trees were stripped and could not believe
what was done to those beautiful trees and destroying the privacy that we always had
They also commented that they didn't know that there was anyone living there until it
happened
In February, we (Steve, Darlene, and Sharon) spoke with Mr Kennedy on separate
occasions to simply request that something be done to restore what was taken away,
maybe some arborvitaes-type trees to be put inbetween the fir trees and pavement (we
would do the watering) or a fence There is plenty of room for this to be done, which
would block the view of drivers coming in on the side We talked to Jeff Kennedy as

soon as the damage was done in February to find out what happened and what other
surprises they were going to throw in without letting us know first as a courtesy He
told us to talk to the site manager who was in charge of the tree-cutting project. He has
taken very lightly the severaJ conversations all of us have had with him in concern of
this and have "passed the buck" to someone else, etc.
We decided not to get "carried away" in the beginning stages, assuming that this
would be taken care of. We didn't go to the initial planning meetings or compJain
about all the fruit trees, hedges, etc. being removed. Jt seems as though Twin County
hasn't cared about our feelings or how it would affect our lives.
We wrote two letters on February 12th to the Facilities Committee and TCCU
expressing our concern and requesting something be done to block the view
Leonard Timmons responded on May 20th (over 3 months later) saying that they had
reviewed the situation und felt t'1at adequate steps were taken to retain our privacy
and did not feel that any type of trees or fence were necessary In the meantime, we
contacted one of your board members, he was not aware of any problems that we had
and was surprised that he didn't know anything about it (since he was on the
Committee). We wonder if this was ever brought up before the Committee in the first
place, or did Mr Timmons write a letter on his own personaJ opinion without going to
them. Cathy Carlson, who works for the City of YeJm, said she wouJd speak with Twin
County to see what could be done. She got back to us within two weeks and told us "in
a nutshefJ" that nothing else could be done.
Sharon Iverson has been a member of TCCC for over 18 years, and Steve and
Darlene RothwefJ have been members for about 15 years. We have had numerous
transactions over the years, and we are happy that we have a branch here in Yelm.
You wjJJ do very weJJ here, and it looks beautiful when you drive by, with the exception
of the back view of Sharon's home A lot of work has been done in such a short time.
We invite any board member to come and look at this present situation and are willing
to talk to anyone about our concerns. An auditor from the State of Washington made a
statement a couple of years ago that is worth quoting. "When life becomes a
lemon, you make lemonade out of it#" Nothing can be done to restore the
branches that were removed, but we beHeve that something can be done to make it
better than what it is.

"CITY," and TWin County Credit Union,

NOW, THEREFORE, IT IS HEREBY AGREED BETWEEN THE PARTIES as
follows
1 The CITY will delay its reqUirement for the Immediate participation by the
OWNER in the construction of certain utilities and/or street Improvements, subject to
the conditions set forth hereinafter
2 The OWNER will financially participate Int he following utility and/or street
projects on an equitable basis With other affected property owners
_ Sanitary sewer system Improvements,
_ Storm water system improvements,
_ Street improvements,
-L Street lighting improvements,
-L Sidewalk improvements,
-L Planter Strip
which Improvements are more specifically described as follows
Dedication of a maximum of 15' along property frontage on Yelm Avenue At
time of dedication property owner will Include a 10' strip adjacent to the new
rlght-of.way for an utility easement. Street lighting, sidewalk improvements and
planter strip shall be in accordance with Yelm Development Standards at the
time of construction
3 The OWNER hereby waives all rights to protest against future Local
Improvement District (LID), Utility Local Improvement District (ULlD), or Latecomer
Ordinance and Agreement proceedings for the construction of said improvements
described in Section 2 herein For purposes of thiS Instrument, "rights of protest" shall
mean only those formal rights to protest contained within the LID, ULlD or Latecomer
Ordinance and Agreement statutes, except, however, nothing herein shall constitute a
waiver by the OWNER or the OWNER's heirs, assigns or successors In interest, of the
right t object to the OWNER's Individual assessment amount or latecomer charge or to
appeal to the Superior Court the decision of the Council affirming the final assessment
roll or latecomer ordinance and agreement, which rights are specifically preserved
4 The OWNER hereby grants and conveys to the City Engineer of the City
of Yelm, or his successor in Interest or deSignee, a Special Power of Attorney to
exercise any and all rights of the OWNER, Including any purchasers, mortgage
holders, lien holders or other person who may claim an interest in the property
deSCribed hereinabove, to accomplish the follOWing At such time as a Local
Improvement District, Utility Local Improvement District, or Latecomer Ordinance and

OWNER for the creation so such LID, ULlD or Latecomer Ordinance and Agreement.
This special Power of Attorney is granted In consideration of the CITY executing this
Instrument, and shall be a power coupled With an interest which may not be terminated
This Special Power of Attorney shall not be affected by the disability of the OWNER.
5 If the OWNER fails to perform In good faith In accordance With this
Instrument, it is agreed that the CITY may discontinue utility service to the property
described herein, after giving 20 days notice thereof and an opportunity for heanng
thereon, or may pursue other equitable or legal remedies
6 The OWNER hereby declares that TWin County Credit Union is the sole
owner(s) of the property described herein and has/have full power to commit said
property to this Agreement, Waiver of Protest and Special Power of Attorney
7 This Instrument constitutes a covenant running With the land and shall be
finding on all heirs, assigns, transferees, and successors In interest.
8 For purposes of RCW 3543 182, and any LID or ULlD thereunder, the
effectIve term of thIs Instrument shall be a penod of ten years from the date hereof For
purposes of RCW 35 72 and RCW 35 91, and any Latecomer Ordinance and

We have designed our lITIgation system based upon usage of the well instead of City water We
belIeve this will be most cost-effective for us 10 our operations, and request that the City Waive
this reqUirement, and grant us permIssIon to use the well water for irrigation indefiOltely
We have no intent of using the well for any purposes other than irngation. We would be wilhng
to supply a statement to that effect, as well rescindmg any and all rights for an extension of the

2. The OWNER will financially participate in the following utility and/or
street projects on an equitable basis with other affected property owners:
Sanitary sewer system improvements;
Storm water system improvements;
Street improvements;

which improvements are more specifically described as follows:
Dedication of a maximum of 15' along property frontage on
Yelm Avenue. AT time of dedication property owner will include
a 101 strip adjacent to the new R-O-W for an utility easement.
Street lighting, sidewalk improvements and planter strip shall
be in accordance with Yelm Development Standards at the time of
construction.
3. The OWNER hereby waives all rights to protest against future Local
Improvement District (LID), Utility Local Improvement District (ULlD), or Latecomer
Ordinance and Agreement proceedings for the construction of said improvements
described in Section 2 herein. For purposes of this Instrument, "rights of protest"
shall mean only those formal rights to protest contained within the LID, ULlD or
Latecomer Ordinance and Agreement statutes, except, however, nothing herein shall
constitute a waiver by the OWNER or the OWNER's heirs, assigns or successors in
interest, of the right to object to the OWNER's individual assessment amount or
latecomer charge or to appeal to the Superior Court the decision of the Council
affirming the final assessment roll or latecomer ordinance and agreement, which rights
are specifically preserved.
4. The OWNER hereby grants and conveys to the City Engineer of the City
of Yelm, or his successor in interest or designee, a Special Power of Attorney to
exercise any and all rights of the OWNER, including any purchasers, mortgage holders,
lien holders or other persons who may claim an interest in the property described
hereinabove, to accomplish the following: At such time as a Local Improvement
District, Utility Local Improvement District, or Latecomer Ordi"nance and Agreement
is proposed that would cause said improvements to be made available to the
OWNER's property described hereinabove, to execute a Petition on behalf of the
OWNER for the creation of such LID, ULlD or Latecomer Ordinance and Agreement.
This Special Power of Attorney is granted in consideration of the CITY executing this
Instrument, and shall be a power coupled with an interest which may not be

This letter serves as an amendment to the site plan review application for the above
mentioned project.
As we discussed on the telephone yesterday, we are planning to move the parking lot on
the northeast side of the project toward the Olympia- Y elm Road. The new location for the
northeastern-most stalls wit! be six (6) feet from the expanded Olympia-Yelm Road right of
way, or in other words, approximately fifty-one (51) feet from the centerline of the Olympia-
Yelm Road right of way
This new location will provide for approximately six (6) feet of landscaping between the
revised property line (after the 15 foot dedication) and the parking paving. The revised
landscaping along the Olympia-Yelm Road will therefore be reduced in area, but will remain
similar in proposed type and size.
We understand that this revision, along with any additional revisions requested by the City
of Yelm, will be re-submitted in drawing form, at the appropriate time, for your records.
