between the CITY OF YELM, a municipal corporation, hereinafter referred to as the
"CITY", and
hereinafter referred to as the "OWNER".
WIT N E SSE T H:
WHEREAS, the OWNER holds record title to the following described property
located within Thurston County, Washington.
and WHEREAS, the CITY has required as a condition of approval of the
OWNER's site plan/subdivision for said property that the OWNER participate in the
construction of certain utilities and/or street improvements as they directly relate to
said property and the OWNER desires that said requirement be delayed until projects
are formulated for the joint participation of other affected owners.
NOW, THEREFORE, IT IS HEREBY AGREED BETWEEN THE PARTIES as follows:
1. The CITY will delay its requirement for the immediate participation by the
OWNER in the construction of certain utilities and/or street improvements, subject to
the conditions set forth hereinafter.

2. The OWNER will financially participate in the following utility and/or
street projects on an equitable basis with other affected property owners.
Sanitary sewer system improvements;
Storm water system improvements;

x Street lighting improvements;

3. The OWNER hereby waives all rights to protest against future Local
Improvement District (LlD), Utility Local Improvement District (ULlD), or Latecomer
Ordinance and Agreement proceedings for the construction of said improvements
described in Section 2 herein. For purposes of this Instrument, "rights of protest"
shall mean only those formal rights to protest contained within the LID, UUD or
Latecomer Ordinance and Agreement statutes, except, however, nothing herein shall
constitute a waiver by the OWNER or the OWNER's heirs, assigns or successors in
interest, of the right to object to the OWNER's individual assessment amount or
latecomer charge or to appeal to the Superior Court the decision of the Council
affirming the final assessment roll or latecomer ordinance and agreement, which rights
are specifically preserved.
4. The OWNER hereby grants and conveys to the City Engineer of the City
of Yelm, or his successor in interest or designee, a Special Power of Attorney to
exercise any and all rights of the OWNER, including any purchasers, mortgage holders,
lien holders or other persons who may claim an interest in the property described
hereinabove, to accomplish the following: At such time as a Local Improvement
District, Utility Local Improvement District, or Latecomer Ordi'nance and Agreement
is proposed that would cause said improvements to be made available to the
OWNER's property described hereinabove, to exec.ute a Petition on behalf of the
OWNER for the creation of such LID, ULlO or Latecomer Ordinance and Agreement.
This Special Power of Attorney is granted in consideration of the CITY executing this
Instrument, and shall be a power coupled with an interest which may not be

terminated. This Special Power of Attorney shall not be affected by the disability of
the OWNER.
5. If the OWNER fails to perform in good faith in accordance with this
Instrument, it is agreed that the CITY may discontinue utility service to the property
described herein, after giving 20 days notice thereof and an opportunity for hearing
thereon, or may. pursue other equitable or legal remedies.
6. The OWNER hereby declares that is/are the
sole owner(s) of the property described herein and has/have full power to commit said
property to this Agreement, Waiver of Protect and Special Power of Attorney.
7. This Instrument constitutes a covenant running with the land and shall
be binding on all heirs, assigns, transferees, and successors in interest.
8. For purposes of RCW 35.43.182, and any LID or ULlD thereunder, the
effective term of this Instrument shall be a periOd of ten years from the date hereof.
For purposes of RCW 35.72 and RCW 35.91, and any Latecomer Ordinance and
Agreement thereunder, the effective term of this Instrument shall be a period of
fifteen years from the date such an Ordinance and Agreement becomes effective
IN WITNESS WHEREOF the parties hereto have caused this Instrument to be
executed the day and year first hereinabove written.

The City of Yelm has completed Its review of the above referenced project Site plan
approval has been granted based upon the follOWing findings of fact
Please note' All final civil and construction drawings must be submitted to the
Public Works Department for approval. Building permits are not issued until civil
and construction drawings are approved and conditions of approval have been
satisfied. Occupancy can be obtained upon the City's final inspection and
approval of all improvements and the satisfactory completion of all conditions of
approval state hereafter.
1 Transportation
Finding Yelm IS a small compact community most directly affected by two state
highways whIch bisect the community The two state highways are used by local
residents for transportation throughout the city and for access to commercial and
residential areas throughout the community In lieu of Widening eXIstIng streets, the
City has elect to create certain alternatIves, Y-1, Y-2, Y-3 which Will avoid the need to
Significantly widen existing streets, and particularly Yelm Avenue New developments
do in fact burden the city's central streets, and unless the bypass alternatives are
accompltshed, the City would have to reqUire developers to pay the cost of the Internal

street widening The city plans show and the City finds that adequate facilities will be
accomplished better and in a timely fashion by bypass facilities as a substitute for the
widenIng of eXIsting facilitIes As a result, the City finds that the regIonal plans In fact

adequate facilIties to City standards wIthin a reasonable time to serve the demands
created by the proposed project

Enclo find a copy of a site plan for the Yelm Veterinary Clinic. Present ,Dr Brown
an Dr. Henricksen applying for a building permit for the expansion of their buil .
The . nned ~g<:rwtttIttTe-rntEfnliOn 0 expanding the building. More
than adequate parking was installed originally and current and future uses will not require
additional parking spaces. The new addition to the building will be about 2,600 square feet
and the new total floor area will be 5,700 square feet. The new floor area will be 2,600/5,700
or 46% of the total floor space.
Per section 1772.030, paragraph 0, of the Yelm Development Guidelines, pg. 1772-3 under
medical clinics, the required parking is stated as being "One-and-one-half per patient
treatment room/area, plus one space per employee based on the greatest number of
employees on a single shift." Based on this and using five examining rooms plus one
operating room or six total, the required parking for this site will be (6 x 1 1/2) + (6 employees)
or 15 spaces. Presently, the site has 20 paved parking spaces As for any possible future
uses of the building, the City requires that, at that time, the parking be reevaluated and added
to, if necessary (Yelm Development Guidelines, chapter 17 72.020, paragraph C)

The addition of more floor space to the clinic is not a change in use and additional parking is
not needed The question of turnarounds and off-street loading was reviewed for the site and
uses were found to be adequate Although section 1772.060 of Yelm's Development
Guildelines does not apply (The clinic is not engaged in retailing or wholesaling merchandise ),
there is a need to back up horse trailers and such, normally associated with a veterinary clinic,
to the back of the building from time to time This has been standard procedure in the past
and will continue after the addition is built. The existing gravel driveway has functioned
adequately in the past and will remain unchanged. See site plan for'V' turnaround area.
The addition to the building will require only minor changes to the existing site. The net total
impervious area of the site will increase as follows (new addition area) minus (existing gravel
and concrete areas removed) for a net increase in impervious area of 1,240 square feet. Two,
underground drainage galleries will be installed to collect new roof area runoff (see site plan)

Enclosed please find a copy of a site plan for the Yelm Veterinary Clinic. Presently, Dr Brown
and Dr Henricksen are applying for a building permit for the expansion of their building
The site was planned several years ago with the intention of expanding the building More
than adequate parking was installed originally and current and future uses will not require
additional parking spaces The new addition to the building will be about 2,600 square feet
and the new total floor area will be 5,700 square feet The new floor area will be 2,600/5,700
or 46% of the total floor space
Per section 1772030, paragraph 0, of the Yelm Development Guidelines, pg 1772-3 under
medical clinics, the required parking is stated as being "One-and-one-half per patient
treatment room/area, plus one space per employee based on the greatest number of
employees on a single shift." Based on this and using five examining rooms plus one
operating room or six total, the required parking for this site will be (6 x 1 1/2) + (6 employees)
or 15 spaces Presently, the site has 20 paved parking spaces As for any possible future
uses of the building, the City requires that, at that time, the parking be reevaluated and added
to, if necessary (Yelm Development Guidelines, chapter 1772020, paragraph C)
The addition of more floor space to the clinic is not a change in use and additional parking is
not needed The question of turnarounds and off-street loading was reviewed for the site and
uses were found to be adequate Although section 1772060 of Yelm's Development
Guildelines does not apply (The clinic is not engaged in retailing or wholesaling merchandise ),
there is a need to back up horse trailers and such, normally associated with a veterinary clinic,
to the back of the building from time to time This has been standard procedure in the past
and will continue after the addition is built The existing gravel driveway has functioned
adequately in the past and will remain unchanged See site plan for 'Y' turnaround area,
The addition to the building will require only minor changes to the existing site The net total
impervious area of the site will increase as follows (new addition area) minus (existing gravel
and concrete areas removed) for a net increase in impervious area of 1,240 square feet. Two
underground drainage gallenes will be installed to collect new roof area runoff (see site plan)
The drainage galleries will be more than adequate to handle the additional runoff

SECTION 1 INTRODUCTION
The Yelm Veterinary Clinic is located on the north side of Yelm Ave in the City of Yelm. The
Clinic has been in operation at this site since 1980 The existing building floor area is 3100
square feet. The expansion will add approximately 3000 square feet of floor area to the
building, and 2400 square feet of asphalt and concrete to existing pervious surface

Increase in stormwater runoff resulting from the addition of paved surfaces will be mitigated by
an infiltration basin sized to infiltrate 100% of the 2-yr, 24-hr design storm

After collection from the pavement, runoff will be re-dispersed and forced to sheet flow across
one of two biofilter strips where it will then be infitrated into the existing ground

SECTION 2 EXISTING CONDITIONS
The total site is 1 41 acres of which 57 acres will be impervious and 84 acres will remain
pervious. There are two access driveways and 20 parking stalls including 1 ADA accessible
and a loading zone for two horse trailer and vehicles The existing vegetation consists of
grass, several mature trees and landscape shrubs Landscaping is limited to beds adjacent to
the building

The site has a local low point in the southwest region The front part of the site slopes from
the southeast toward the southwest at one percent. The existing asphalt parking area and
roadway slopes to a low point at the west edge of the parking area

There is no well defined downstream drainage courses It is evident in the existing condition
that storm runoff percolates rapidly and none leaves the site During the heavy rain event this
past winter, all stormwater infiltrated within a few hours.

SECTION 3 INFIL TRA TlON RA TE / SOILS REPORT
Site soils are identified by the Soil Conservation Service Soil Survey of Thurston County,
Washington as a Spanaway gravelly sandy loam, a Type'S' soil This soil is characterized as
very deep, somewhat excessively drained and formed on terraces

An investigation of the site soils was performed by Skillings-Connolly, Inc. and in essence
verifies the presence of the Type'S' gravelly sandy loam soil for the site.

Infitration tests were performed in the vicinity of the proposed basins The soils were found to
be dark brown to gray brown, very gravelly, medium to coarse sand. The soil was very
consistent throughout the two infitration test sites Therefore, all infiltration surfaces can
safely be assumed to exhibit the characteristics described

that the stormwater drainage design will utilize existing conditions for the infiltration areas

The site will be served by City of Yelm STEP system. The holding tank is maintained by the
city and is pumped on a regular basis. There are no known wells or septic systems within 1 DO'

There are no known underground storage tanks in the immediate area,

SECTION 6 SUB-BASIN DESCRIPTION
Local topography and the surrounding roadways preclude any off-site contributions of runoff
The on-site area can be broken into two sub-basins for treatment and for retention The South
Basin will have the majority of paved surfaces The stormwater from these surfaces will sheet
flow southwesterly over a vegetated filter strip to the retention basin in the southwest corner
Approximately 0 34 acres of the paved parking area drains directly to the west through a filter
strip then to the basin The vegetated areas are very porous and do not shed runoff

The North Basin will be treating and infiltrating runoff from < 1 acres and the roof runoff via
directed overland flow

The biofiltration strips are sized per the DOE Manual based on contributing impervious area.
The facilities were then checked hydraulically for compliance

During the 2-yr, 24-hr design event the level of the water is expected to be less than 4" in the
south basin If the volume should exceed the design event the level pool would be contained
on-site in the grass area which is l' lower than the parking area pavement.

Because of the high permeability of the site soils, it is anticipated that there will be no post-
development runoff The site is approximately one half mile upstream of Thompson Creek.

SECTION 7 ANAL YSIS OF THE 100- YR FLOOD
The site is not subject to flooding during a 100-yr, 24-hr storm event, nor will development of
the site contribute to flooding on downstream property

SECTION 8 AESTHETIC CONSIDERATIONS FOR FACILITIES
The ponds will feature gentle side slopes at 5 horizontal to 1 vertical maximum and will take
the shape of the existing lawn area. The pond areas will be replanted after construction as
needed They will be constructed so that during the summer months the gentle slopes will
facilitate use of the area as open space

The basin was sized and analyzed on water works software using the Santa Barbara unit
hydrograph method for a 2-yr, 24-hr Thurston County storm event. As previously described,
conservative infiltration rates were used for the design calculations Please see the
calculations in Appendix B section of this report.

Notes of 8-12.91 Meeting te Coyote Situation:
See attached listing of participants.
This meeting was an opportunity for the complalntants to express their concerns, and
for the coyote -experts" and agencies with authority over wildlife to offer factual
information, suggestions and recommendations for dealing with l;:oyotes.
After almost two hours of testimony. the following conclusionshiolutions were agreed
upon
1) Residents should keep their domestic pets inside their homes at niqht and during
early morning hours (unless the animal is already inside a kennel)
2) All dog ::!nd cat food. water, etc., should also be brought Inside.
3) Do lli21leave food out for Raccoons (It will attract the coy()tes)I
4) If a coyote's food source is cut off, they will go back into the heavily forested areas
such as Squak Mtn State Park, Lake Sammamish State Park, etc.
S) Coyotes will not attack children. they are basically -timid" animals that are easily
scared oH

6) Fence property. if possible.
7} Professlonai trappers will not go IOto populated residential areas (such as Forest
Rim) to Hap coyotes, as there is too much risk and liability of accidently 'rapping
someone's domestic pets In the leg traps.
8) Killing or trapping the coyotes will not solve the problem: It only makes it worse,
let the more attempts to exterminate them, the more they reproducel
9) There is a need to -educate" the residents on the above infonnation; and for the
complalnl:.~nts to educate their neighbors, in particular, felr some immediate
results
1 0) The City will include an article in its nett City Newsletter advising residents ~f the
above information. and will publish a similar article .each SprlnQ In an effort to
alert and educate residents (partIcularly neYi residents) on how to protect their
pets and co-e,dst with the wildlife.
1 1) Debbie Hill will contact Susan Ewing or Dave Workman, Director Of Information
and Education for the State Wildlife Dept. in Olympia. requiesting a Press Release be
mailed to the news media to help Inform/educate the public. in general, about
coyotes and protection of domestic pets
1 2) Debbie Hill will also work with PAWS Wildlife Clinic and the Issaquah School
DIstrict to try to get programs/assemblies in the schools to educate the children.
