unresolved a transportatIOn faCIlIty charge, nOIse level momtonng, and access to

Regardmg the transportatIOn faCIlIty charge Yelm Processmg Plant agrees
to pay the $3,528 00 m four equal monthly mstallments of $882 00 The first
payment WIll be due no later than November 10, 1998, WIth three addItIOnal
payments made by the lOth of each succeedmg month.
Regardmg the nOIse level
Yelm Processmg Plant operates dUrIng normal busmess hours of 8 00 am to
5 00 pm dunng the weekdays Yelm Processmg has momtored the nOIse level
over the past year on a regular baSIS, at least once per month. Usmg a declbal
mom tor, Yelm Processmg Plant determmed that the nOIse level has not exceeded
the statutory maXImum of 70 decibals at property boundanes Further, the Plant
has receIved no nOIse complamts
Fmally, regardmg access to the SIte
Yelm Processmg Plant IS attemptmg to obtam access nghts as noted m the
ongmal SIte plan submItted. The CIty ofYelm has an mgress and egress easement
nght over thIS road. If negotIatIOns WIth the abuttmg property owner fall, Yelm
Processmg Plant would lIke to negotIate obtammg an easement from the CIty of
Yelm. The road IS currently used by CIty employees and the publIc to access a

ORDER OF APPROVAL
This Order of Approval is issued in accordance with Olympic Air Pollution
Control Authority's (OAPCA) Regulation 1, and WAC 173-400 which requires a
new project to use Best Available Control Technology (BACT) for emissions
control and not cause a violation of any ambient air quality standard.
Approval is hereby granted, as provided in Article 7 of OAPCA Regulation 1
and provided that the conditions stated below are met, to Yelm Processing
to establish a yeast drying plant in Yelm, Washington. Compliance with
this order and its conditions does not relieve the owner or operator from
compliar:ce with OAPCA Regulation I, Rf'W 7-0 94 Gr- any other emissions
control requirements, nor from the resulting liabilities and/or legal
remedies for failure to comply_ This approval does not relieve the
applicant or owner of any requirement of any other governmental agency.
This Order may be appealed to the Pollution Control Hearings Board (PCHB).
To appeal to the PCHB, an appeal must be filed with the PCHB and a copy

THIS ORDER IS ISSUED SUBJECT TO THE FOLLOWING CONDITIONS:
1 TECHNICAL SPECIFICATIONS: The spray dryer and associated equipment
shall be in accordance with the information and specifications as described
in the associated NOC application unless otherwise specified by condition
in this Approval Order. Devlations from the equipment types, materials,
and specifications described in the NOC application which have the
potential for altering pollution emission levels may constitute a violation

2 ETHANOL CONTENT' Yelm Processing shall facilitate determination of
the amount in percent by weight of ethanol in the yeast slurry provided by
the Pabst Brewery and any other major supplier of yeast slurry. Percent by
weight ethanol shall be determined using appropriate analytic techniques

3 COMPLAINT MONITORING: The owner or operator shall provide an on-site
contact person whom is available and capable of monitoring and responding
to air quality related complaints whenever the facility is operating. The
contact person shall be familiar wich the air quality implications of
emissions from the facility and with the conditions in this Approval Order.

3. SCRUBBER SLUDGE: Sludge from the wet scrubber shall be disposed of in

Comments
Because of the v2rious odor reiated complaints received about this plant, we conducted a inspection in order to
verify compliance with the facility's NOC Order of JI.pproval issued 6/16/97 The company is involved with the
drying of brewers yeast for distribution to be used in many different applications The equipment at the plant
consists of a injection dryer (operated at approx. 1600 - 1800 F). twin cyclones. wet scrubber (wetted filter type),
and a bagging unit Various complaints have been received by OAPCA regarding thA odor from the operation

Visual Emissions or Odors
The plant was not operating during our inspection so opacity or odors could not be observed Some odors were
detected coming from the building as we 3pprui..;ch the facility
Technical Specifications
Mr Ferguson walked us through the plant. Yeast slurry is first injected within a heated tube where the material is
volatilized and driod After the injection the flue gas is directed into a large steel tank which is enclosed within a
concrete vault and covered with sand Mr Ferguson stated that the enclosure is needed for retention of heat and
noise reduction The outlet is plumbed into the twin cyclones where the dried yeast is separated out. The gas
then runs through the scrubber and exhausts out a vertical stack. It was discovered during the inspection that Mr
Ferguson had not been using his scrubber during the last few days We explained that potentially this is a
violation of condition #1 of the Order of Approval
Ethanol Content of Slurry
We asked Mr Ferguson if he was tracking the content of his ethanol for each batch he processes He showed us
some analytical results from other batches but did not have the results of this recent batch Mr Ferguson stated
that this batch had been from the Olympia alcohol recovery plant and that the ethanol amount is most likely zero
We Oxpl8H1ed the requirement dnd told Mr Ferguson to keep a iog of ethanol content as required by the
condition
General
We explained the other conditions of the Order of Approval and advised Mr Ferguson to assure he is in
compliance with the conditions Mr Ferguson stated that he will no longer accept the yeast slurry from the

APPLICABILITY. New and modified eqUIpment and operations whIch emIt air pollutants wlth10 OAPCA's JUrISdIctIon
(Thurston, Mason, Clallam, Jefferson, PaCIfic and Grays Harbor CountIes) are subject to pre-construction reVIew and
approval by OAPCA pursuant to the Washmgton Clean AIr Act, RCW 7094 Sweat furnaces, pamt spray booths,
manufacturmg processes using resin, plywood and lumber mills, combustion eqUIpment, bOIlers, rock crushers, and hot
mIX asphalt plants are just several examples of the many types of aIr pollution sources that require pre-construction
approval by OAPCA Please consult OAPCA for a complete IIstmg of eqUIpment types requmng pre-constructlon
approval
Pre-constTUctIon reVIew and approval is faCIlItated through a NotIce of Construction (NO C) applIcation. Final approval
of 3. NOC applIcation generally takes from 30 to 90 days for OAPCA to issue
NOC APPLICATION PROCEDURE. With10 thIrty days of receIpt of a NOC applIcation, OAPCA will eIther notify
the applicant 10 writmg that the applicatIon IS complete or notIfy the applIcant 10 wrItmg of all addltlonal mformation
necessary to complete the applicatIon Withm SIXty days of receIpt of a complete applicatIon, OAPCA will either Issue

The City of Yelm has competed the site plan review for the above referenced project. Site plan
approval has been granted based upon the following findings of fact and conditions of approval
Please note, All final civil and construction drawings must be submitted to the Public Works
Department for approval Occupancy can be obtained upon the City's final inspection and
approval of all improvements and the satisfactory completion of all conditions of approval
state hereafter
1 Transportation
Finding Yelm is a small compact community most directly affected by two state highways which
bisect the community The two state highways are used by local residents for transportation
throughout the city and for access to commercial and residential areas throughout the community
In lieu of widening existing streets. the City has elect to create certain alternatives, Y-1, Y-2, Y-3
which will avoid the need to significantly widen existing streets. and particularly Yelm Avenue New
developments do in fact burden the city's central streets, and unless the bypass alternatives are
accomplished, the City would have to require developers to pay the cost of the internal street
widening The city plans show and the City finds that adequate facilities will be accomplished better
and in a timely fashion by bypass facilities as a substitute for the widening of existing facilities As
a result, the City finds that the regional plans in fact benefit projects in all areas on the City and will
accomplish the goal of providing adequate facilities to City standards within a reasonable time to
serve the demands created by the proposed project.
Condition of Approval
The applicant shall mitigate traffic impacts to the transportation system Mitigation includes
payment of the Transportation Facility Charge (TFC) of $750 00 per pm peak hour trips
generated by the project. The project IS estimated to create 4 7 additional pm peak hour trip
to the City Transportation System The total TFC for the project is $3,528 00 The TFC is
payable at occupancy permit issuance

Finding: Yelm Development Guidelines, 4G 110, requires access and parking areas to be surfaced
with asphalt, conqete or similar pavements and shall be graded and drained as to properly dispose

Site access shall be either from NP Road at the location of the current driveway or from the
driveway on the adjacent property to the west. For access to occur from the adjacent
property the applicant shall provide legal confirmation of an ingress/egress easement and
shall enter into a maintenance agreement with the City of Yelm for the existing access road
All access/driveways. parking areas and loading_ areas must be paved per City Development
Standards Civil drawings must be submitted to the Public Works Department for review
and approval prior to construction
3 Stormwater
Finding: Yelm Development Guidelines, ChapterS, requires all stormwater runoff be pretreated prior
to infiltration

A presubmission conference is an opportunity for applicants, developer(s) and/or consultants to meet
with city staff to discuss preliminary studies or sketches of a proposed project. At the conference the
staff will make available information relating to the proposed development. The intent is to identify and
eliminate as many potential problems as possible in order for the project to be processed. without delay
The conference should take place prior to detailed work by an engineer or surveyor, however a site
drawing must be submitted that has sufficient information to allow for evaluation. Discussion topics will
include such things as Yelm's Comprehensive Plan. street design, storm runoff and retention, Shoreline
Master Program. zoning, availability of sewer and water, development concepts. other requirements
and permits, and the environmental impact. Staff notes are prepared and available to review There is
no charge for this meeting Meetings are held each Wednesday This request form should be
submitted by 5:00 p,m. at least one week before the preferred meeting date.
