RE. Grove Road Mini Storage - Grove Road Realignment and Frontage Improvements

Dear Ken.
The proposed expansion of the current mini-storage facility will add new traffic that will
compromise the safety of motorists entering and exiting Grove Road from Yelm Avenue The
current "skewed" alignment of the intersection will force mid to large size vehicles turning onto
Grove Road or Yelm Avenue to encroach into the opposing traffic lanes.
The proposed realignment of Grove Road is necessary because the frontage improvements to
mitigate mini-storage traffic can not be constru~ted to meet the applicable state and city design
standards without realigning the intersection approach to Yelm Avenue. The applicant's project,
frontage is along this section of Grove Road, thus the realignment becomes a necessary
element of the frontage improvements required for the expansion -project. There is precedent for
this requirement. The city has required the reall~mment.of several intersections (103rd Avenue,
Cullens/Coates) because new development impacted traffic operation and safety

To summarize, the realignment of Grove RoadJs, in actuality, a frontage improvement; is
necessary to mitigate the new traffic: and is consistent with city policy and requirements
imposed on projects that had similar impacts on local traffic.

NOTICE OF ApPEAL
The action before the City Council is a closed record appeal A closed record appeal follows
an open record administrative decision on a project permit application when the appeal is on
the record, and no or limited new evidence or information is allowed to be submitted
On February 10, 1999, a Site Plan Approval was issued in the above referenced land use
case The approval, issued subject to conditions, allowed the applicant to expand the Country
Storage Site located at 10535 Grove Road SE., Yelm, WA. The basis for the approval was set
forth in the Findings of the February 10, 1999 letter of approval
On February 22, 1999, the applicant submitted an Appeal Application for certain conditions of
the site plan approval decision Following are those conditions being appealed and the staff
response
CONDITIONS UNDER ApPEAL
Condition 1.b, of Site Plan Approval Letter (Exhibit 11).
Condition 1 b of the February 10, 1998, decision read
The applicant is responsible for all frontage improvements along Yelm Avenue East
and Grove Road, as a condition of approval in Site Plan Approval- SPR8129, February
6, 1995 Other than the improvements specified in c, below the applicant may defer
said improvements If improvements are deferred the applicant shall enter into an
agreement with the City waiving any right to protest the formation of a LID or
latecomer's agreement. At any time the City can require the deferred improvements be
constructed by the applicant.
In the appeal of the decision the applicant submitted that the last sentence of Condition 1 b ,
"At any time the City can require the deferred improvements be constructed by the applicant."

The sentence appealed is a summary statement of paragraph four in the Agreement, Waiver
of Protest and Special Power of Attorney (Exhibit V) No changes have been made to
paragraph four The sentence was added to the approval letter so that the applicant
understands the commitment required when signing the Agreement, Waiver of Protest and
Special Power of Attorney It does not add an additional condition to the deferral agreement
Condition 1.c of Site Plan Approval Letter (Exhibit 11).
Condition 1 c of the February 10, 1998, decision read
The applicant shall construct one-half street and frontage improvements on Grove
Road from the intersection of East Yelm Avenue to the south driveway access located
on Grove Road, per City of Yelm prepared plans and specifications for the Grove Road
Realignment. These improvements shall be completed at time of building construction
The remaining street frontage improvement requirements on Grove Road and East
Yelm Avenue may be deferred as described in b, above
In the appeal of the decision the applicant submits four points

1 The realignment of Grove Road is not a specific project identified in the City Transportation
Plan Grove Road is shown in the Transportation Plan as an element of the conceptual
location of the Y-3, Canal Road North Loop Study The Canal Road North Loop Study has
been underway for the last year and as a result the route has been modified and located east
of the Grove Road and Hwy 507 Intersection Also the realignment of Grove Road is not
Identified as a Transportation Facility Charge project

The condition is the result of the intersections inability to operate at an acceptable safety level
with the increase in traffic to the intersection as a result of the new traffic generated by the
commercial use The applicant is required to construct 'Y2 of the intersection improvements the
remaining 'Y2 will be constructed by the owner of Yelm Builder's Supply
2 All projects are required to construct half street improvements along the project property
frontage The Yelm Development Standards, adopted by Ordinance 555, Section 4B 080,
Street Frontage Improvements, requires "All frontage improvements shall be made across full
frontage of property from centerline to Right-of-Way line
Previously, frontage improvements were required as a condition of approval for SPR8129,
approved on February 6, 1995 (Exhibit III) The frontage improvements required were
applicable to the entire parcel
The condition for the current project is a re-iteration of the original condition and is directly
related to the commercial development of the site since 1995
3 In June of 1994, Yelm Builders Supply was issued a site plan approval with conditions
One condition of approval was "Owner agrees to sign a waiver of protest for future
improvements on Grove Road and Yelm Avenue" This condition legally obligates the property
owner to participate in the realignment and frontage improvements to Grove Road at such time
the City warrants the need
4 The increase in traffic from the proposed project site (existing and proposed) and the
adjacent Yelm Builder's Supply creates a decreasing level of safety at the intersection and
warrants the need for the realignment to occur at this time The City is requiring that a portion
of the original deferred improvements be constructed at this time with the remaining
improvements to be constructed at a future date It is not unreasonable or unfair for the City to
consider safety and level of service when requiring developers to make improvements This
condition is consistent with the original condition of approval requiring frontage improvements
to the site

SUBJECT: SPR8129 - Site Plan Approval
On Monday, February 6, 1995, the Yelm City Planning Commission
granted approval of the Site Plan application for Yelm Mini Storage
located at the northwest corner of Grove Road and SR 507. However,
the following conditions of approval were set by the Planning
Commission:

The watermain extension must be constructed and
completed prior to occupancy to meet fire flow
requirementsi

Grove Road and SR 507 right-of-way dedication as
required by the City of Yelmi
The applicant shall contribute financially to the Five-
Corners intersection improvement and/or Y-2 alternate
route as specified in the 1992 Yelm Comprehensive
Transportation Plan. SEPA mitigation for traffic
impacts are as follows:

THIS INSTRUMENT is entered into this day of

between the CITY OF YELM, a municipal corporation, hereinafter referred to as the
"CITY", and
hereinafter referred to as the "OWNER".
WIT N E SSE T H:
WHEREAS, the OWNER holds record title to the following described property
located within Thurston County, Washington:
and WHEREAS, the CITY has required as a condition of approval of the
OWNER's site plan/subdivision for said property that the OWNER participate in the
construction of certain utilities and/or street improvements as they directly relate to
said property and the OWNER desires that said requirement be delayed until projects
are formulated for the joint participation of other affected owners.
NOW, THEREFORE, IT IS HEREBY AGREED BETWEEN THE PARTIES as follows:
1. The CITY will delay its requirement for too immediate participation by the
OWNER in the construction of certain utilities and/or street improvements, subject to
the conditions set forth hereinafter.

2. The OWNER will financially participate in the following utility and/or
street projects on an equitable basis with other affected property owners.
Sanitary sewer system improvements;
Storm water system improvements;
Street improvements;
Street lighting improvements;
Sidewalk improvements;
which improvements are more specifically described as follows:
3. The OWNER hereby waives all rights to protest against future Local
Improvement District (LID), Utility Local Improvement District (ULlD), or Latecomer
Ordinance and Agreement proceedings for the construction of said improvements
described in Section 2 herein. For purposes of this Instrument, "rights of protest"
shall mean only those formal rights to protest contained within the LID, ULlD or
latecomer Ordinance and Agreement statutes, except, however, nothing herein shall
constitute a waiver by the OWNER or the OWNER's heirs, assigns or successors in
interest, of the right to object to the OWNER's individual assessment amount or
latecomer charge or to appeal to the Superior Court the decision of the Council
affirming the final assessment roll or latecomer ordinance and agreement, which rights
are specifically preserved.
4. The OWNER hereby grants and conveys to the City Engineer of the City
of Yelm, or his successor in interest or designee, a Special Power of Attorney to
exercise any and all rights of the OWNER, including any purchasers, mortgage holders,
lien holders or other persons who may claim an Interest in the property described
hereinabove, to accomplish the following: At such time as a local Improvement
District, Utility Local Improvement District, or latecomer Ordinance and Agreement
is proposed that would cause said improvements to be made available to the
OWNER's property described hereinabove, to exec.ute a Petition on behalf of the
OWNER for the creation of such LID, ULlD or latecomer Ordinance and Agreement.
This Special Power of Attorney is granted in consideration of the CITY executing this
Instrument, and shall be a power coupled with an interest which may not be

terminated. This Special Power of Attorney shall not be affected by the disability of
the OWNER.
5. If the OWNER fails to perform in good faith in accordance with this
Instrument, it is agreed that the CITY may discontinue utility service to the property
described herein, after giving 20 days notice thereof and an opportunity for hearing
thereon, or may, pursue other equitable or legal remedies.
6. The OWNER hereby declares that is/are the
sole owner(s) of the property described herein and has/have full power to commit said
property to this Agreement, Waiver of Protect and Special Power of Attorney.
7. This Instrument constitutes a covenant running with the land and shall
be binding on all heirs, assigns, transferees. and successors in interest.
8. For purposes of RCW 35.43.182. and any LID or UUD thereunder, the
effective term of this Instrument shall be a period of ten years from the date hereof
For purposes of RCW 35.72 and RCW 35.91, and any Latecomer Ordinance and
Agreement thereunder, the effective term of this Instrument shall be a period of
fifteen years from the date such an Ordinance and Agreement becomes effective

The City Traffic Engineer is working on the design and shol,Jld have the civil drawings completed
in approximately four weeks. As soon as possible, the City Traffic Engineer will contact Steve
Hatton with the new tight-of-waylocation. As we discussed the new right-of;way will require a
modification to your building siies to meet the minimum setback requirement of 15 feet.
Also,as we discussed a landscape plan for your property fronting Hwy 507 and Grove Rd will be
required The minimum width of the landscaping strip is 5 feet and will need to be designed to
effectively camouflage or hide the chain link fencing
This letter is simply to confirm our understanding, from our meeting on June 3, 1998, in respect to

Dear Mr Repnow'
The City of Yelm has completed its review of the above referenced project. Site plan approval
has been granted based upon the Mitigated Determination of NonSignificance issued June 4,
1998 and the following findings of fact and conditions of approval
1 Transportation
Finding Yelm is a small compact community most directly affected by two state highways
which bisect the community The two state highways are used by local residents for
transportation throughout the city and for access to commercial and residential areas
throughout the community In lieu of widening existing streets, the City has elect to create
certain alternatives, Y-1, Y-2, Y-3 which will avoid the need to significantly widen existing
streets, and particularly Yelm Avenue New developments do in fact burden the city's central
streets, and unless the bypass alternatives are accomplished, the City would have to require
developers to pay the cost of the internal street widening The city plans show and the City
finds that adequate facilities will be accomplished better and in a timely fashion by bypass
facilities as a substitute for the widening of existing facilities As a result, the City finds that the
regional plans in fact benefit projects in all areas on the City and will accomplish the goal of
providing adequate facilities to City standards within a reasonable time to serve the demands
created by the proposed project.
Conditions of Approval
a The applicant shall mitigate traffic impacts to the transportation system Mitigation
includes payment of the Transportation Facility Charge (TFC) for the number of new
pm peak hour trips generated by the project. Based on an addition of 12,520 square
feet the TFC is $6,945 00 The TFC is payable at building permit Issuance

and Grove Road, as a condition of approval in Site Plan Approval - SPR8129, February
6, 1995 Other than the improvements specified in c, below the applicant may defer
said improvements If improvements are deferred the applicant shall enter into an
agreement with the City waiving any right to protest the formation of a LID or
latecomer's agreement. At any time the City can require the deferred improvements be
constructed by the applicant.
c. The applicant shall construct one-half street and frontage improvements on Grove
Road from the intersection of East Yelm Avenue to the south driveway access located
on Grove Road, per City of Yelm prepared plans and specifications for the Grove Road
Realignment. These improvements shall be completed at time of building construction.
The remaining street frontage improvement requirements on Grove Road and East
Yelm Avenue may be deferred as described in b, above
2. Sewer System
Finding The City's Sewer Comprehensive Plan identifies a portion of the City area for service
The City is pursuing additional land areas or approval and the extension of facilities
Completion of such activities is dependent on grand and developer funding, as well as planned
bonding and existing public funds The status of such plans and funding sources must be
considered in any review of concurrency Developer extensions and or dedications, latecomer
agreements, oversizing agreements, and the creation of local improvement districts may all be
considered In the event of a new funding source, however, concurrency is not found until the
funding source is in fact in pace - e g award of a grant, a binding letter commitment for third
parting funding, or the successful formation of a local improvement district.

a The applicant shall connect to the City STEP sewer system when the lines are available
to the site The applicant shall enter into an agreement with the City waiving any right
to protest the formation of a LID or latecomer's agreement.
3 Storm Water
Finding YMC requires all development to comply with the City Stormwater Manual

a The applicant shall connect to the existing stormwater facility as shown on the
preliminary site plan
4 Fire Safety
Finding YMC requires all internal roads within a development to meet minimum fire access
requirements

5 Landscapinq
Finding YMC, Chapter 17 80 requires all development to provide on site landscaping
Conditions of Approval
a Landscaping around the perimeter of the site is required and where street frontage
improvements are constructed The applicant shall submit a Final Landscape and
Irrigation Plan to the Planning Department for approval The landscaping plan shall
include requires from the previous site plan approval, SPR8129, dated February 6,
1995 No construction shall begin prior to the Planning Departments approval of the
Landscape and Irrigation Plan No occupancy shall be granted until the landscaping
has been installed and approved by the Planning Department.
Site Plan Approval is a Type II administrative approval An appeal of this decision can be filed
within 14 days from the date of this letter, pursuant to Yelm Municipal Code, Chapter 1549,
Integrated Project Review Process
The Site Plan Approval is valid for eighteen (18) months from the date of this letter If you

As you may remember last spring the Site Plan Review Committee reviewed an application to
expand the above site After review by the SPRC, it was determined that Grove Road would
need to be re-aligned as part of this project. SCA developed the re-alignment and road design
and forwarded it to Steve Hatten, the project engineer
Steve revised the site plan to incorporate the new design and the additional area needed for
right-of-way Attached you will find the revised plans and a copy of the draft SPR approval letter
Please check your own files for additional information previously distributed during the initial
review of the project. A site plan review meeting has been scheduled for January 27, 1998
Please bring any conditions of approval in written format to the scheduled meeting The
Planning Department will be sending the applicant an approval letter no later than February 1,

The City of Yelm has completed its review gf the above referenced project and has issued a
Determination of NonSignificance (DNS ) The comment period for the DNS expires on June 19,
1998. Following June 19,-1998, the City is prepared to grant a conditional site plan approval for
the above referenced project .
As you are aware, the intersection of Grove Rd and Hwy 507 needs to be realign~d for safety
The City Traffic Engineer is working on the design and should have the civil drawings completed
in approximately four weeks. As soon as possible, the City Traffic Engineer will contact Steve
Hatton with the new right-of-way location. As we discussed the new right-of-way will require a
modification to your building sites to meet the minimum setback requirement of 15 feet
Also, as we discussed a landscape plan for your property fronting Hwy 507 and Grove Rd will be
required The minimum width of the landscaping strip is 5 feet and will need to be designecl to
effectively camouflage or hide the chain link fencing
This letter is simply to confirm our understanding, from our meeting on June 3, 1998, in respect to
the realignment of Grove Rd and the landscaping requirements along your property frontage
Following the expiration date of th~ DNS, you will receive a more detailed and comprehensive
