In respect to the Washington State Department of Transportation project to remove
approximately 120 linear feet of culvert pipe and the earth berm covering the pipe
adjacent to Yelm Creek on the Wheeler property the City has determined the project to
be exempt from the Shoreline Substantial Development Permit.
The project as defined is consistent with the exemption criteria as specified in WAC
17327 040 (2)(0)(i)(p) Removing the sediment blockage at the outfall and retrofitting
the drainage system to remove sediment before it reaches the creek is identified as a
high priority restoration project in the Yelm Creek Flood Hazard Management Plan and
is consistent with the local shoreline master program
A Mitigated Determination of Nonsignificance for the project was issued on October 29,
1998 Mitigation requires the applicant to obtain and HP A permit from the W A State
Department of Wildlife and Fisheries
If the scope of the project should change please notify me to insure an exemption is stili
applicable
The City will need to review the plans to ensure compliance with The Shoreline Master

Thank you for the opportUnity to comment on the mItIgated determination of nonslgnIficance
for the removal of approximately 500 cubic yards of sedIment and dredged materials from
Yelm Creek (SEPA No 8225), located at Yelm Creek, approximately 350 feet upstream from
the FIrst Street brIdge as proposed by the City ofYelm PublIc Works Department. We
reviewed the envIronmental checklIst and have the folloWIng comments
Erosion and sedIment control IS a key to preserving habItat and preventIng denudation of a
developIng area. The folloWIng practice IS recommended
Source control best management practIces such as plastic coverIng, mulch, temporary
seedIng, and phased clearIng should be used to control erosion durIng construction.
ErOSIOn control measures must be In place prior to any clearing, grading, or constructIOn
These control measures must be effectIve to prevent soil from beIng carried into surface water
by stormwater runoff. Sand, silt, and soIl will damage aquatic habitat and are conSIdered
pollutants.

Instructions.
The State Environmental Policy Act (SEPA) requires all governmental agencies to
consider the environmental impacts of a proposal before making decisions The
purpose of this checklist is to provide information to help identify impacts from your
proposal, to reduce or avoid impacts from the proposal if it can be done, and to help the
City decide whether an EIS is required An environmental impact statement (EIS) must
be prepared for any proposal with probable significant adverse impacts on
environmental quality
This environmental checklist asks you to describe some basic information about your
proposal The City will use this checklist to determine whether the environmental
impacts of your proposal are significant and require preparation of an EIS You must
answer each question accurately, carefully and to the best of your knowledge Answer
the questions briefly, but give the best description you can In most cases, you should
be able to answer the questions from your own observations or project plans without
the need for experts If you do not know the answer, or if a question does not apply to
your proposal, write "do not know" or "does not apply" Complete answers to the
