SCHEDULE OF EXCLUSIONS FROM COVERAGE OF THIS GUARANTEE
1 '(} E'xC6'fJt to the extent that specific assurances are provided in Schedule A of this Guarantee, the Company assumes no liability for loss or damage by reason of the
b i following:
(a) Defects, liens, encumbrances, adverse claims or other matters against the title, whether or not shown by the public records,
(b) (1) Taxes or assessments of any taxing authority that levies taxes or assessments on real property; or, (2) Proceedings by a public agency which may result in
taxes or assessments, or notices of such proceedings, whether or not the matters excluded under (1) or (2) are shown by the records of the taxing authority or by the
public records.
(c) (1) Unpatented mining claims; (2) reservations or exceptions in patents or in Acts authorizing the issuance thereof; (3) water rights, claims or title to water,
whether or not the matters excluded under (1), (2) or (3) are shown by the public records,
2, Notwithstanding any specific assurances which are provided in Schedule A of this Guarantee, the Company assumes no liability for loss or damage by reason of
the following:
(a) Defects, liens, encumbrances, adverse claims or other matters affecting the title to any property beyond the lines of the land expressly described in the description
set forth in Schedule (A), (C) or in Part 2 of this Guarantee, or title to streets, roads, avenues, lanes, ways or waterways to which such land abuts, or the right to main-
tain therein vaults, tunnels, ramps or any structure or improvements; or any rights or easements therein, unless such property, rights or easements are expressly and
specifically set forth in said description,
(b) Defects, liens, encumbrances, adverse claims or other matters, whether or not shown by the publiC records; (1) which are created, suffered, assumed or agreed
to by one or more of the Assureds; (2) which result in no loss to the Assured; or (3) which do not result in the invalidity or potential invalidity of any judicial or non-
judicial proceeding which is within the scope and purpose of the assurances provided,
(c) The identity of any party shown or referred to in Schedule A,
(d) The validity, legal effect or priority of any matter shown or referred to in this Guarantee,
Definition of Terms.
The following terms when used in the Guarantee
mean,
(a) the "Assured" the party or parties named as
the Assured in this Guarantee, or on a supplemental
writing executed by the Company
(b) "land" the land described or referred to in
Schedule (A)(C) or in Part 2, and improvements affixed
thereto which by law constitute real property The term
"land" does not include any property beyond the lines of
the area described or referred to in Schedule (A) (C) or
in Part 2, nor any right, title, interest, estate or easement
in abutting streets, roads, avenues, alleys, lanes, ways
or waterways.
(c) "mortgage" mortgage, deed of trust, trust
deed, or other security instrument.
(d) "public records" records established under
state statutes at Date of Guarantee for the purpose of
imparting constructive notice of matters relating to real
property to purchasers for value and without knowledge
(e) "date" the effective date
2. Notice of Claim to be Given by Assured
Claimant.
An Assured shall notify the Company promptly in
writing in case knowledge shall come to an ,';ssured
hereunder of any claim of title or interest which is
adverse to the title to the estate or interest, cls stated
herein, and which might cause loss or damage for
which the Company may be liable by virtue of this
Guarantee. If prompt notice shall not be given to the
Company, then all liability of the Company shall termi-
nate with regard to the matter or matters for which
prompt notice is required; provided, however, that failure
to notify the Company shall in no case prejudice the
rights of any Assured under this Guarantee unless the
Company shall be prejudiced by the failure and then
only to the extent of tr.e prejudice
3, No Duty to Defend or Prosecute.
The Company shall have no duty to defend or prosecute
any action or proceeding to which the Assured is a
party notwithstanding the nature of any allegation in
such action or proceeding,
GUARANTEE CONDITIONS AND STIPULATIONS
4 Company's Option to Defend or Prosecute
Actions; Duty of Assured Claimant to
Cooperate.
Even though the Company has no duty to defend
or prosecute as set forth in Paragraph 3 above:
(a) The Company shall have the right, at its sole
option and cost, to institute and prosecute any action or
proceeding, interpose a defense, as limited in (b), or to
do any other act which in its opinion may be necessary
or desirable to establish the title to the estate or interest
as stated herein, or to establish the lien rights of the
Assured, or to prevent or reduce loss or damage to the
Assured. The Company may take any appropriate action
under the terms of this Guarantee, whether or not it shall
be liable hereunder, and shall not thereby concede lia-
bility or waive any provision of this Guarantee, If the
Company shall exercise its rights under this paragraph,
it shall do so diligently
(b) If the Company elects to exercise its options as
stated in Paragraph 4(a) the Company shall have the
right to select counsel of its choice (subject to the right
of such Assured to object for reasonable cause) to rep-
resent the Assured and shall not be liable for and will not
pay the fees of any other counsel, nor will the Company
pay any fees, costs or expenses incurred by an Assured
in the defense of those causes of action which allege
matters not covered by this Guarantee,
(c) Whenever the Company shall have brought an
action or interposed a defense as permitted by the pro-
visions of this Guarantee the Company may pursue any
litigation to final determination by a court of competent
jurisdiction and expressly reserves the right, in its sole
discretion, to appeal from an adverse judgment or order.
(d) In all cases where this Guarantee permits the
Company to prosecute or provide for the defense of any
action or proceeding. an Assured shall secure to the
Company the right to so prosecute or provide for the
defense of any action or proceeding. and all appeals
therein, and permit the Company to use, at its option,
the name of such Assured for this purpose Whenever
requested by the Company, an Ass~red at the
Company's expense, shall give the Company all reason-
able aid in any action or proceeding, securing evidence,
obtaining witnesses, prosecuting or defending the
action or lawful act which in the opinion of the Company
may be necessary or desirable to establish the title to
the estate or interest as stated herein, or to establish the
lien right? of the Assured. If the Company is prejudiced
by the failure of the Assured to furnish the required
cooperation, the Company's obligations to the Assured
under the Guarantee shall terminate,
5. Proof of Loss or Damage.
In addition to and after the notices required under
Section 2 of these Conditions and Stipulations have
been provided to the Company, a proof of loss or dam-
age signed and sworn to by the Assured shall be fur-
nished to the Company within ninety (90) days after the
Assured shall ascertain the facts giving rise to the loss
or damage. The proof of loss or damage shall describe
the matters covered by this Guarantee which constitute
the basis of loss or damage and shall state, to the extent
possible, the basis of calculating the amount of the loss
or damage. If the Company is prejudiced by the failure
of the Assured to provide the required proof of loss or
damage, the Company's obligation to such Assured
under the Guarantee shall terminate. In addition, the
Assured may reasonably be required to submit to exam-
ination under oath by any authorized representative of
the Company and shall produce for examination
inspection and copying, at such reasonable times and
places as may be designated by any authorized repre-
sentative of the Company, all records, books, ledgers,
checks, correspondence and memoranda, whether
bearing a date before or after Date of Guarantee, which
reasonably pertain to the loss or damage. Further, if
requested by any authorized representative of the
Company the Assured shall grant its permission, in
writing, for any authorized representative of the Com-
pany to examine inspect and copy all records, books,
ledgers. checks. correspondence and memoranda in
the custody or control of a third party which reasonably
pertain to the loss or damage. AI! information desig
nated as confidential by the Assured provided to the
Company pursuant to this Section shall not be disclosed
to others unless in the reasonable judgment of the
Company, it is necessary in the administration of the
claim Failure of the Assured to submit for examination
under oath produce other reasonably requested
information or grant permission to secure reasonably
necessary information from third parties as required

in the above paragraph, unless prohibited by law or

l>)1ie Company under this Guarantee to the Assured for
that claim,
6. Options to Payor Otherwise Settle Claims:
Termination of Liability.
In case of a claim under this Guarantee, the
Company shall have the following additional options:
(a) To Payor Tender Payment of the Amount of
Liability or to Purchase the Indebtedness.
The Company shall have the option to payor settle
or compromise for or in the name of the Assured any
claim which could result in loss to the Assured within
the coverage of this Guarantee, or to pay the full amount
of this Guarantee or, if this Guarantee is issued for the
benefit of a holder of a mortgage or a lienholder, the
Company shall have the option to purchase the indebt-
edness secured by said mortgage or said lien for the
amount owing thereon, together with any costs, reason-
able attorneys' fees and expenses incurred by the
Assured claimant which were authorized by the
Company up to the time of purchase.
Such purchase, payment or tender of payment of
the full amount of the Guarantee shall terminate all lia-
bility of the Company hereunder, In the event after
notice of claim has been given to the Company by the
Assured the Company offers to purchase said indebted-
ness, the owner of such indebtedness shall transfer and
assign said indebtedness, together with any collateral
security, to the Company upon payment of the purchase
price.
Upon the exercise by the Company of the option
provided for in Paragraph (a) the Company's obligation
to the Assured under this Guarantee for the claimed loss
or damage, other than to make the payment required in
that paragraph, shall terminate, including any obligation
to continue the defense or prosecution of any litigation
for which the Company has exercised its options under
Paragraph 4, and the Guarantee shall be surrendered to
the Company for cancellation,
(b) To Payor Otherwise Settle With Parties Other
Than the Assured or With the Assured Claimant.
To payor otherwise settle with other parties for or
in the name of an Assured claimant any claim assured
against under this Guarantee, together with any costs,
attorneys' fees and expenses incurred by the Assured
claimant which were authorized by the Company up to
the time of payment and which the Company is obligat-
ed to pay
Upon the exercise by the Company of the option
provided for in Paragraph (b) the Company's obligation
to the Assured under this Guarantee for the claimed loss
or damage, other than to make the payment required in
that paragraph, shall terminate, including any obligation
to continue the defense or prosecution of any litigation
for which the Company has exercised its options under
Paragraph 4.
7 Determination and Extent of Liability.
This Guarantee is a contract of Indemnity against
actual monetary loss or damage sustained or incurred
by the Assured claimant who has suffered loss or dam-
age by reason of reliance upon the assurances set forth
in this Guarantee and only to the extent herein
described, and subject to the Exclusions From Coverage
of This Guarantee,
The liability of the Company under this Guarantee
to the Assured shall not exceed the least of-
(a) the amount of liability stated in Schedule A or
in Part 2;
(b) the amount of the unpaid principal indebted-
ness secured by th~ mortgage of an Assured mortgagee,
as limited or provided under Section 6 of these
Conditions and Stipulations or as reduced under Section
9 of these Conditions and Stipulations. at the time the
loss or damage assured against by this Guarantee
occurs. together with interest theron; or
(c) the difference between the value of the estate
or interest covered hereby as stated herein and the value
of the estate or interest subject to any defect, lien or
encumbrance assured against by this Guarantee,
8. Limitation of Liability.
(a) If the Company establishes the title, or
removes the alleged defect, lien or encumbrance, or
cures any other matter assured against by this
Guarantee in a reasonably diligent manner by any
method, including litigation and the completion of any
appeals therefrom, it shall have fully performed its
obligations with respect to that matter and shall not be
liable for any loss or damage caused thereby
(b) In the event of any litigation by the Company or
with the Company's consent, the Company shall have
no liability for loss or damage until there has been a final
determination by a court of competent jurisdiction, and
disposition of all appeals therefrom, adverse to the title,
as stated herein,
(c) The Company shall not be liable for loss or
damage to any Assured for liability voluntarily assumed
by the Assured in settling any claim or suit without the
prior written consent of the Company
9. Reduction of Liability or Termination of
Liability.
All payments under this Guarantee, except pay-
ments made for costs, attorneys' fees and expenses
pursuant to Paragraph 4 shall reduce the amount of
liability pro tanto,
10. Payment of Loss.
(a) No payment shall be made without producing
this Guarantee for endorsement of the payment unless
the Guarantee has been lost or destroyed, in which case
proof of loss or destruction shall be furnished to the
satisfaction of the Company
(b) When liability and the extent of loss or damage
has been definitely fixed in accordance with these
Conditions and Stipulations, the loss or damage shall be
payable within thirty (30) days thereafter,
11 Subrogation Upon Payment or Settlement.
Whenever the Company shall have settled and
paid a claim under this Guarantee, all right of subroga-
tion shall vest in the Company unaffected by any act of
the Assured claimant.
The Company shall be subrogated to and be
entitled to all rights and remedies which the Assured
would have had against any person or property in
respect to the claim had this Guarantee not been issued.
If requested by the Company, the Assured shall transfer
to the Company all rights and remedies against any per-
son or property necessary in order to perfect this right
of subrogation, The Assured shall permit the Company
to sue, compromise or settle in the name of the Assured
and to use the name of the Assured in any transaction
or litigation involving these rights or remedies,
If a payment on account of a claim does not fully
cover the loss of the Assured the Company shall be
subrogated to all rights and remedies of the Assured
after the Assured shall have recovered its principal,
interest, and costs of collection.
12. Arbitration.
Unless prohibited by applicable law, either the
Company or the Assured may demand arbitration pur-
suant to the Title Insurance Arbitration Rules of the
American Arbitration Association, Arbitrable matters
may include, but are not limited to, any controversy or
claim between the Company and the Assured arising out
of or relating to this Guarantee, any service of the
Company in connection with its issuance or the breach
of a Guarantee provision or other obligation, All arbitra-
ble matters when the Amount of Liability is $1,000,000
or less shall be arbitrated at the option of either the
Company or the Assured, All arbitrable matters when
the amount of liability is in excess of $1,000,000 shall
be arbitrated only when agreed to by both the Company
and the Assured. The Rules in effect at Date of
Guarantee shall be binding upon the parties, The award
may include attorneys' fees only if the laws of the state
in which the land is located permits a court to award
attorneys' fees to a prevailing party Judgment upon the
award rendered by the Arbitrator(s) may be entered in
any court having jurisdiction thereof.
The law of the situs of the land shall apply to an
arbitration under the Title Insurance Arbitration Rules,
A copy of the Rules may be obtained from the
Company upon request.
13. Liability Limited to This Guarantee;
Guarantee Entire Contract.
(a) This Guarantee together with all endorsements,
if any, attached hereto by the Company is the entire
Guarantee and contract between the Assured and the
Company In interpreting any provision of this
Guarantee, this Guarantee shall be construed as a
whole,
(b) Any claim of loss or damage, whether or not
based on negligence or any action asserting such
claim, shall be restricted to this Guarantee,
(c) No amendment of or endorsement to this
Guarantee can be made except by a writing endorsed
hereon or attached hereto signed by either the
President, a Vice President, the Secretary, an Assistant
Secretary, or validating officer or authorized signatory of
the Company,
14 Notices, Where Sent.
All notices required to be given the Company and
any statement in writing required to be furnished the
Company shall include the number of this Guarantee
and shall be addressed to the Company at 114 East Fifth

WARRANTY AGREEMENT
KNOW ALL MEN BY THESE PRESENTS That
WHEREAS !<.~D . -::c,..;C , (hereinafter referred to as the "Owner"), has
applied to the City of Yelm, a' political subdivision of Thurston County of the State of Washington,
(hereinafter referred to as the "City") for the approval by the City of a certain plat of a subdivision to
be known as rt:a.t n<" !-k.;r /...+s 01\ I 3 ,a copy of which plat is attached hereto and made a
part hereof as "Exhibit A" 0 whIch saId plat are shown areas offered by the Owner to be dedIcated
to public use as streets, alleys and other rights-of-way, and other public faCilities and Improvements,
and
WHEREAS, it IS necessary in the interest of public welfare that the areas so offered to be
dedicated be constructed in accordance with the specifications hereinafter set forth, and
WHEREAS, in accordance with the terms ofRCW 58.17 and Title 16 of the Yelm Municipal
Code, the City has adopted subdivision regulations which require that all improvements be
constructed in a manner consistent with the City s development regulations,
NOW THEREFORE, to induce the City to approve said plat and to accept the dedication of
said areas as public streets, easements and other improvements, the Owner does hereby
unconditionally promise and agree to and with the City as follows.
The Owner unconditionally warrants to the City, ItS successors and assigns that, for a penod
of twelve (12) months from the date of final plat approval, the improvements required to be
constructed and dedicated to the public under the terms of the plat will be free from defects
and that the work will conform with the requirements and specifications of the Development
Guidelines of the City Upon any breach of the foregoing Warranty and without limiting the
City's remedies for breach of warranty the Owner agrees to promptly repair or replace any
defective work, at no cost to the City and to provide all labor, equipment and materials
necessary therefore, at no cost to the City
2. In the event the Owner shall fail or neglect to fulfill his obligations under this agreement, the
City shall have the right to construct or cause to be constructed, repaired or replaced pursuant
to publIc advertisement and receipt and acceptance of bids, said streets, utilIties and other
improvements, as shown on said plat, and the Owner shall be liable to pay to and indemrufY
the City upon completion of such construction, the final total cost to the City thereof,
mcluding but not limited to engineenng, legal and contmgent costs together With any
damages, either direct or consequential, which the City may sustam on account of the failure
of the Owner to carry out and execute all of the provisions of this agreement.

Whereas, the OWNER has constructed unprovements, mc1udmg but not hnuted to,
buildmgs, pavement, and stormwater facilitIes on the property described above. In order
to further the goals of the JurisdIction to ensure the protectIon and enhancement of
Yehn's water resources, the JurischctIon and the OWNER hereby enter mto tins
Agreement. The responsibilitIes of each party to tIns Agreement are IdentIfied below
OWNER SHALL
(1) Implement the stormwater facility mamtenance program mc1uded herem as
Attachment "A"
(2) Implement the pollutIon source control program mc1uded herem as Attachment
liB"
(3) Mamtam a record (in the form of a log book) of steps taken to unplement the
programs referenced m (1) and (2) above. The log book shall be available for
mspectIOnbyappomtmentat 103 i<uJ(lL~Vr 5'~ - \<qlvlIe.rw!l The log book
shall catalog the actIOn taken, who took It, when It was done, how It was done,
and any problems encountered or follow-on actIons recommended. Mamtenance
Items ("problems") hsted m Attachment "A" shall be mspected as specIfied m the
attached InStructIOns or more often if necessary The OWNER IS encouraged to
photocopy the mdIVIduaI checklists m Attachment "A" and use them to complete
Its inspectIOns. These completed checkhsts would then, m combmatIOn, compnse
the log book.
(4) Submit an annual report to the JunsdictIOn regarding unplementatIOn of the
programs referenced m (1) and (2) above. The report must be submltted on or
before May 15 of each calendar year and shall contam, at a mmnnum, the
followmg'
(a) Name, address, and telephone number of the busmesses, the persons, or the
:firms responsible for plan rmplementatlon, and the person completmg the
report.
(b) Time penod covered by the report.
(c) A chronologIcal summary of actiVItIes conducted to unplement the
programs referenced m (1) and (2) above. A photocopy of the apphcable
sectIons of the log book, WIth any addItIonal explanatIon needed, shall
normally suffice For any actIVItIes conducted by paid partIes, mc1ude a
copy of the mVOIce for services.

THE JURISDICTION SHALL
(1) ProVIde technIcal assIStance to the OWNER m support of ItS operatIon and
rnamtenance actIVItIes conducted pursuant to ItS rnamtenance and source control
programs. SaId assIStance shall be proVIded upon request and as JurisdIctIOn tune
and resources pernnt.
(2) ReVIew the annual report and conduct a IlliIlllIlum of one (1) SIte VISIt per year to
dISCUSS performance and problems WIth the OWNER.
(3) Review tIns agreement WIth the OWNER and modIfy It as necessary at least once
every three (3) years.
REMEDIES
(1) If the JunsdIctIon determmes that maintenance or repair work IS reqUIred to be
done to the stormwater facilitIes existmg on the property, the JunsdIction shall
gIVe the owner of the property WIthIn whIch the dramage facilitIes are located, and
the person m control of saId property, notIce of the specIfic rnamtenance and/or
repair reqUIred. The DIrector shall set a reasonable tune (in most Instances not less
than 1 0 days) in which such work is to be completed by the persons who were
gIVen notIce. If the above reqUIred maintenance and/or repair IS not completed
WIthin the tune set by the Director, wntten notIce will be sent to the Owner of the
property m whIch the dramage facilitIes are located and the person m control of
SaId property statmg the JurisdIctIon's mtentIon to perform such mamtenance and
bill the Owner for all incurred expenses. The JunsdIctIon may also revoke
stormwater utility rate credIts for the quahty component or mvoke surcharges to
the quantIty component of the Owner bill If requIred maintenance IS not performed.
(2) If at any tune the JunsdIctIon determmes that the eXIStmg system creates any
rmmment threat to pubhc health or welfare, the JunsdIctIon may take l1lll11edIate
measures to remedy SaId threat. No notice to the persons listed in RemedIes (1),
above, shall be reqUIred under such CIrcumstances.
(3) The OWNER grants unrestncted authonty to the JunsdictIon for access to any and
all stormwater system features for the purpose of performing mamtenance or repaIr
as may become necessary under RemedIes (1) and/or (2).
( 4) The persons hsted m (1), above, shall assume all responsibility for the cost of any
rnamtenance and for reparrs to the stormwater facility Such responsibility shall

TIns Agreement 15 mtended to protect the value and desrrabihty of the real property
described above and to benefit all the citIZens of the JurisdIctIon. It shall run with the land
and be bmdmg on all partIes havmg or acqwrmg from OWNER or Its successors, any
nght, tItle, or interest m the property, or any part thereof, as well as their tItle, or interest
m the property or any part thereof, as well as therr herrs, successors, and asSIgns. They
shall mure to the benefit of each present or future successor m mterest of sald property or
any part thereof, or mterest therem, and to the benefit of all CItIZens of the JurisdictIon.

INTRODUCTION
What 5 Stonnwater Runoft?
When urban and suburban development covers the land WIth buildmgs, houses, streets
and parkmg lots, much of the native topsoil, duff, trees, shrubs and grass are replaced
by asphalt and concrete. RamfaU that would have soaked directly mto the ground
instead stays on the surface as storm water runoff makmg Its way mto storm drams
(mcluding man-made pIpes, dItches, or swale networks), stormwater ponds, surface
and groundwater, and eventually to Puget Sound.
What 5a Stonn Drain and how does it work?
The storm dram system for most developments mcludes components that carry, store,
cleanse, and release the stormwater These components work together to reduce the
impacts of development on the environment. These Impacts can mclude flooding
whIch results in property damage and blocked emergency routes, erosion wInch can
cause damage to salmon spawmng habItat, and pollution whIch harms fish and/or
drmkmg water supplIes.
The storm dram system provIdes a safe method to carry stormwater to the treatment
and storage area Swales and ponds filter pollutants from the stormwater by physically
settlmg out particles, chemically bmdmg pollutants to pond sedIments, and
biologically convertmg pollutants to less-harmful compounds. The ponds also store
the treated water, releasmg It gradually to a nearby stream or to groundwater The

Stormwater runoff needs to be treated because It carnes litter, oil, gasolme, fertilIZers,
pestIcides, pet wastes, sedunents, and anytlung else that can float, dissolve or be swept
along by moving water Left untreated, polluted stormwater can reach nearby
waterways where it can harm and even kIll aquatIc lIfe. It can also pollute
groundwater to the extent that It must be treated before It can be used for dnnkmg.
NatIonally, stormwater IS recogrnzed as a major threat to water quality Remember to
keep everythmg out of stormwater systems except the rainwater they are desIgned to
collect.

Stormwater facilItIes can be attractIve as well as functIonal. They can proVIde both
actIve and passIve-use recreatIon areas and open space for wildlIfe Perhaps you've

PRACTICES
POLLUTION PREVENTION FOR HOMEOWNERS
PURPOSE
Many products and practices commonly used m and around our houses are hazardous
to both the enVIronment and us. Many of these products can end up m our stormwater
systems and groundwater TIns document gIves alternatlves, where possible, for those
types of products and practlces. The Best Management Practlces (BMPs) described
here, mclude "good housekeepmg" practlces that everyone can use.
RECOMMENDED POLLUTION CONTROL PRACTICES FOR
HOMEOWNERS
It has been said that the average home today contams more chemIcals than the average
chermcallab of 100 years ago When many ofthese chermcals are used mdustrially,
they can be subject to vanous health and safety standards, yet these same substances
are used freely and often carelessly m our homes.
The BMPs m this sectIon are divided mto four categones. Household Hazardous
Wastes, PestIcIdes, Remodelmg, and Septlc Mamtenance. Each sectlon mcludes
information on available alternatlves.
HOUSEHOLD HAZARDOUS WASTES
Many of the clearung agents, solvents, pohshes, etc. used commonly m the home are
consIdered hazardous. These products may be toXIC, corrOSIve, reactlve, flammable,
and/or carcmogemc It IS crItlcal that these products are handled wIth care and are
properly dIsposed. A hst of common household hazardous materIals IS presented m
Table 1
In addItlon, many hazardous household chemIcals persIst for long perIods oftIDle m
the environment. Manufacturers may truthfully state that a product IS
"bIodegradable", most products are bIOdegradable, but what IS important IS the rate at
wluch they are broken down and the products they are broken down mto The term
"bIOdegradable" on its own IS rmsleadmg at best, unless the product IS rapIdly
degraded mto harmless substances.
It IS IDlportant to note here that the term "bIOdegradable" currently has no legal
defimtlon m tlus state Tlus means that any product can use tlus term accordmg to the
manufacturer's own defimtIOn. Tlus defmItlon may not be at all sImilar to the
consumer's perception. The followmg ideas will help you reduce the risks of
stormwater and ground water contammatlon from many household products

HOUSEHOLD PRODUCT MANAGEMENT
1 Read the label of products before you buy them. TOXIC product labels will carry many
wammgs. Either bypass such products or buy them m small quantItIes. If you cannot
use the entIre product, try to gIve It away mstead of dISpOSing of It. Thurston County
penodIcally facilItates product exchanges for leftover paints and other hazardous
wastes. Call the Thurston County Health Department at 754-4111 for more
mformatIon.
2. Buy only those detergents that contam lIttle or no phosphorus. Phosphorus can cause
algae blooms if It IS washed mto lakes or streams. Most detergents that are low or
phosphate free are labeled as such.
3 Use no more than the manufacturer's suggested amount of any cleanser More IS not
necessarily better
4 Products such as oven cleanser, floor wax, furruture polIsh, dram cleaners, and spot
removers often contam cheIllicals that are tOXIC. Buy the least tOXIC product available,
and use a non-toxIC substItute If one can be found. Ovens, for example, can be
cleaned by applymg table salt to spills, then scrubbmg WIth a solutIon ofwashmg soda
and water Table 2 lIsts SubstItutes for many commonly used household products.
If It IS necessary to use a product that contams tOXIC chemicals, use the product only as
dIrected. Do not combme products, as they may become more dangerous when mIXed
(example' mixmg chlorme bleach and ammoma produces dangerous gases) Use eye
wear and rubber gloves as appropnate.

5 CheIllicals left over from some actIVItIes, such as photography and auto repaIr, are
hazardous and should not be flushed down the smk. TIns IS espeCially Important If
your home is hooked up to a septIc system. TOXIC cheIllicals can kill the bactena m
the tank that treat sewage and pollute water supply wells.
6 Be sure that all contamers are clearly marked.
7 Common (not automobile) battenes are one of the largest sources of heavy metals
(such as lead, mckel, cadmium, and mercury) found m landfills. Instead of throwing
them away, dIspose of them at a hazardous waste collectIon SIte.

AUTOMOTIVE USAGE, CARE AND MAINTENANCE
From a waste management standpoint, automobile mamtenance IS best done by
professIonals at facilrtIes deSIgned to handle, store, and dispose of the waste products
properly Many of these facilItIes do an excellent Job of dealmg With waste oils,
antIfreezes, other fluids, battenes and tIres. They often charge a small fee to cover the
added expenses, but It'S worth it. However if you repaIr your car at home, please
consIder these helpful tIps.
I Cars should be servIced regularly Any leaky lines or valves should be replaced.
2. Dumpmg oil, degreasers, antIfreeze, and other automotIve hqUIds mto a stream or a
storm dram VIolates CIty, county and state laws or ordmances. Do not dump them onto
the ground because they will end up m stormwater runoff or m groundwater Do not
use oil to reduce dust levels on unpaved areas. Instead, recycle used oil and
antIfreeze. Keep them m separate contamers. Call the Recyclmg Hotlme at 1-800-
RECYCLE or call the Thurston County Health Department for the locatIon of the
nearest recycling center, or call your local automotIve servIce centers to see lithey
take oil for recycling. Some may also take used oil filters.
3 Wrap empty oil or antifreeze contamers m several layers of newspaper, tIe securely
and place m a covered trashcan. AntIfreeze IS sweet tastmg, but pOIsonous to people,
fis~ pets and wildhfe.
4 Sweep your driveway mstead ofhosmg It down. FlUIds and heavy metals assocIated
WIth automobIles can bUIld up on dnveway surfaces and be washed mto local surface
or groundwater when drIveways are hosed down.
5 When washIng vehicles, do so over your lawn or where you can dIrect soapsuds onto
the lawn or another vegetated area to keep the soaps from washIng mto the storm dram
system or local surface water Your stormwater pond cannot cleanse soapy water
from washed cars.
6 Small spills of oil and other flUIds can be absorbed by using matenals such as kItty
lItter or sawdust. Wrap the used kItty lItter and any contammated soil m a plastIC bag
and then place It m the garbage.
If a spill reaches surface water, you must notIfy the nearest regional office of the
Department of Ecology ImmedIately! The Southwest RegIonal Office number IS 407-
6300 or call 911 There are fines for failure to notify the appropnate agency when a
spill occurs.

7 De-Icmg chermcals (vanous types of salt) can harm concrete less than three years m
age, burn vegetatIo~ and be corrOSIve to cars and other metal objects. De-Icmg
chermcals and their addItIves can be tOXIC. (Cyamde IS formed from the breakdown of
a common antI-cakmg agent used m de-icing chermcals.)
Urea salts are an alternatIve to other types of salt de-Icers, but great care must be used
m applying them. These salts contain large quantIties of mtroge~ whIch can severely
burn plants and encourage algae growth m lakes and/or Puget Sound, if over-apphed.

PESTICIDES AND FERTILIZERS
PestIcIdes (such as msectlcIdes and herbIcIdes) and fertilIZers are commonly used by
homeowners m theIr quest for bIgger, healtl11er plants and greener, lusher lawns.
These chermcals are often overused. Homeowners often apply too much chermcal at

the wrong trme, such as before heavy rams or any trme the plants will not be able to
absorb all the chermcals. These chermcals are easily introduced mto stormwater
runoff and can cause algae blooms (fertilIZers) or kill off aquatIC orgamsms
(pesticIdes)
Fertilizer management
FertilIZing a lawn can be done m an envIronmentally sensItIve manner Here are some
ideas.
1 Before fertilIZmg, test your soil's pH. ThIs can be easily done by usmg kIts that are
available, or through tests proVIded by WSU CooperatIve ExtensIOn. Use only the
recommended amount of fertilizer, and add any soil amendments, such as lrme, that
are recommended m your test results.
2. Use fertilizers that are appropnate for your area, and for the type of plants you are
growmg. Work the fertilIZer mto the soil dIrectly around the plant's drIp lme. By
mcorporatmg the fertilizer m the soil, there will be less likelihood of contaminated
runoff Contact the Thurston ConservatIon DIstnct to find out tills mformatIon.
3 Water before fertilIZing. Water enough to dampen the ground thoroughly, but not
enough to cause surface runoff. Dampenmg the soil prevents fertilizer from being
washed from the surface of dry soil m the first ram or watenng after applIcatIon
4 Many soils can benefit from the use of organic fertIlIzers such as compost or peat. Not
only do these substances add nutrIents to soil, they also mcrease the porosIty of the
soil and mcrease ItS ability to hold water
5 Slow release fertilizers (willch are generally resm-coated) can be used m addItIon to
orgamc fertilizers. They are not mobile in the soil, and are only applied once
Integrated pest management
Rather than bnngmg out the sprayer whenever a pest infestatIon occurs m the garden,
consIder usmg Integrated Pest Management (also known as IPM) IPM emphasIZes
the evaluation of all factors including environmental effects before chermcals are
applIed. PestIcIdes should only be used as a last resort. Some of the tactIcs that can
be used to decrease or elImmate the use of pestIcIdes mclude
Use of Natural Predators, Pathogens: Because chermcal sprays generally kIll many
beneficial msects instead of Just the target pest, it may be necessary to mtroduce
natural predators back mto the garden. Ladybugs, lacewmgs, predatory wasps, and
nematodes are all commerCially avaIlable. Garter snakes and toads are also predators
and should not be elImmated from the garden.
There are some bacterIa, viruses, and msect parasItes that are specIfic to pests and will
not harm other msects or arumals. A commonly used bacterIum m the Puget Sound
area 15 Bacillus thurmgIensIs (Bt), willch IS mtended to control mfestatIons of tent
caterpillars. Products contammg Bt are available at your nursery

Habitat Changes: Many tunes a change of habItat can control pest InfestatIons.
Removal of old trres can cut down on the mosqUIto population by removrng a
converuent water-filled locatIon for them to breed rn. Crop rotatIOn, even rn a small
garden, can reduce the number of pest InfestatIons. Removmg last year's leaves from
under rose bushes can cut down on the rncIdence of mildew and blackspot, as these
fungI overwmter m dead leaves.
Timing: Crops that can overwinter (such as leeks or carrots) should be planted m the fall.
Tills gIves them tune to become establIshed before pests anwe m the sprrng.
Mechanical: Many eggs, larvae, cocoons, and adult insects can be removed by hand. Be
sure that the InSect IS properly IdentIfied pnor to removmg It so those benefiCial
msects are not destroyed m error Drownmg msects m plain water or spraymg them
WIth soapy water are alternatIves to squashIng them.
Resistant Plants: Plants that are natIve to tills area are often more reSIStant to pests and
chmate, etc. than are introduced plants. Many plant cultIvars have been developed
which are reSIstant to such dISeases as vertic ilium wIlt and peach leaf curl. Grass seed
nnxes are also available for lawns that need much less watermg, mowmg, and
chelllical use.
Growing Conditions: Plants, such as hostas, that reqUIre some shade are more
susceptible to pests when they are growmg m the sun. Plants that are not properly
fertilIZed or watered are less vigorous m growth and tend to attract pests. Plants that
prefer an aCId soil, such as azaleas, will perform better and be less susceptible to pests
when they are grown m soil WIth the proper pH.
Chemicals: ChemIcals are a small part of the IPM plan and should be applIed only as
needed after reVIewing all other alternatives.
Pesticide management
When use of a chelllicalIs the best or only OptIOn, follow these SImple gUIdelmes.
I Know what pest you are spraymg for Use the pestIcIde accordmg to the
manufacturer's mstructIons and buy only the quantIty needed. Many pestIcides have a
lnnited shelf life and may be useless or degrade into even more toxic compounds if
kept on the shelf.
2 Do not apply more than the speCIfied amount. Overuse can be dangerous to your
health as well as the health of WIldlIfe and the enVIronment. If more than one
chemical can be used to control the pest, choose the least tOXiC. The word "cautIon"
on the label means that the chemIcal is less tOXIC than one that IS labeled "warrung"
3 Do not spray on wmdy days, m the mornmg of what will be a very hot day, or when
ram IS likely to occur HerbICIdes can dnft and mJure valuable ornamental plants rn
eIther yours or your neIghbor's back yard. Do not water heavily after applIcatIOn.
Plants should be lIghtly watered BEFORE applIcatIon to prevent burnmg of the
folIage, and to help evenly spread the chelllical.

become illegible m thIs chmate and may have to be taped onto the contamer
6 Federal law now requrres that all pesticIdes be labeled With the appropnate dIsposal
method. Leftovers should never be dumped anywhere, mcludmg a landfill. Take
unwanted pestIcides to the County's hazardous waste collectIon days or Hazo House at
the landfill.
7 Empty contamers should be tnple-rInSed and the rInSe water used as spray Once
contamers are tnple-rInSed, they are not consIdered hazardous waste and may be
disposed of in most landfills. However, call your local landfill before puttmg the
container m the garbage.
8 If a pesticide IS spilled onto pavement, It can be absorbed usmg kItty lItter or sawdust.
The contammated absorbent should be bagged and labeled and taken to Hazo House.
9 If the pestIcIde IS spilled onto dIrt, dIg up the dIrt, place It m a plastIC bag and take it to
Hazo House.
10 Many pest control compames and lIcensed applIcators have access to pestIcIdes that
are more tOXIC than those available to the consumer Check with the company before
they spray indoors or outdoors to find out what spray they will be usmg and what
precautIons, IT any, are necessary after the operator leaves.
HOME REMODELING
Remodelmg uses some of the most tOXIC substances found ill the home Pamts,
preservatIves, strippers, brush cleaners, and solvents all contam a WIde range of
chenucals, some of whIch are suspected to be carcmogens (cancer causmg) These
products should never be dumped m a landfill or put down a sewer or septIc system.
1 When buildmg a deck consIder using wood mstead of concrete. Wood deckIng allows
ramwater to <lnp onto the ground below, keepmg It from becommg surface runoff.
2. Decks and SIdewalks can also be built out ofbnck mterlockmg pavers or modular
concrete. If these surfaces are placed on a bed of well-drained soil gravel or sand,
ramwater can mfiltrate mto the around through them.
3 To reduce dISposal problems, buy only the amount you need. Used turpentme or
brush cleaner can be filtered and reused. Pamt cans should be allowed to dry and then
be dIsposed of durmg a hazardous waste collectIon day or at Hazo House

SEPTIC SYSTEM CARE AND MANAGEMENT
While septic systems do not seem to have a dIrect relatIonslup WIth stormwater runofI,
they can m some mstances be related.
1 Roof drams and stormwater runoff should be dIverted away from dramfields. Excess
water reduces the capaCIty of the dramfield to absorb effluent from the septic tank.
2. Water from hot tubs should not be dramed mto a septIc system all at once. They are
not deSIgned to handle large volumes of chlormated water EIther use the water on
plants m the yard, or dram the hot tub slowly over a penod of days.
3 SeptIc tanks should be pumped regularly Ponded water, damp places m the yard, foul
odors and/or a dark gray or black soil color may mdIcate septIc dram field failure.
Effluent from a malfunctIonmg septic can cause dISease and nitrate problems m
groundwater For septIc system asSIstance, contact the Thurston County Health

BEST MANAGEMENT PRACTICE ffiMP) - Structures, conservatIon practIces, or
regulatIons that illlprove qualIty of runoff or reduce the illlpact of development on the
quantIty of runoff.
BIOFIL TER (SW ALE) - A WIder and flatter vegetated verSIon of a dItch over whIch
runoff flows at uruform depth and velocIty BIofilters perform best when vegetatIon
has a thIck mat of roots, leaves, and stems at the soil mterface (such as grass)
BIOFILTRATION - The process through whIch pollutant concentratIons m runoff are
reduced by filtenng runoff through vegetatIon.
BUFFER - The zone that protects aquatIC resources by provIdmg protectIon of slope
stabilIty, attenuatIon of runoff, and reductIon oflandslIde hazards. An mtegral part of
a stream or wetland ecosystem, it provides shadmg, mput of orgamc debrIS, and coarse
sedilllents to streams. It also allows room for variatIon m stream or wetland
boundarIes, habItat for wildlIfe, and protectIon from harmful intrusIon.
CATCH BASIN - An mlet for stormwater set mto the ground, usually rectangular and
made of concrete, and capped With a grate that allows stormwater to enter
CHECK DAM - A dam (e.g., rock, earthen, log) used m channels to reduce water
velocitIes, promote sedilllent depOSItIon, and/or enhance mfiltration.
COMPOST STORMW A TER FILTER - A treatment facilIty that removes sedrment
and pollutants from stormwater by percolatmg water through a layer of specIally
prepared bIgleaf maple compost. Clean water eXIts the bottom of the facilIty through a
pIpe, while stormwater flows in excess of the facilIty deSIgn overflow the compost bed
and bypass the faCIlIty
CONSTRUCTED WETLAND - A wet pond WIth dead storage at vaned depths and
planted WIth wetland plants to enhance Its treatment capabilItIes.
CONTROL STRUCTURE OR FLOW RESTRICTOR - A manhole and/or pIpe
structure With a flow-regulatmg or metermg deVIce such as a weir or plates With small
holes known as onfices. TIns structure controls the rate at whIch water leaves the

CRITICAL AREA - Areas such as wetlands, streams, steep slopes, etc. as defined by
ordmance or resolutIon by the JurIsdICtIon. Also known as envrronmentally sensItive
areas.
CULVERT - A conveyance deVIce (e.g., concrete box, pIpe) wInch conveys water
from a dItCh, swale, or stream under (usually across) a roadway or embankment.
DEAD STORAGE - The volume of storage m a pond below the outlet wInch does not
drain after a storm event. Tlus storage area proVIdes treatment of the stormwater by
allowmg sedrments to settle out.
DETENTION FACILITY - A facilIty (e g, pond, vault, pIpe) m wInch surface and
storm water IS temporarily stored.
DETENTION POND - A detentIon facilIty m the form of an open pond.
DISPERSION TRENCH - An open-top trench filled With nprap or gravel that takes
the dIscharge from a pond, spreads it out, and spills (bubbles) the flow out along ItS
entrre length. DISperSIon trenches are used to srmulate "sheet flow" of stormwater
from an area, and are often used to protect sensItIve adjacent areas, such as wetlands.
DRAINAGE SYSTEM - The combmatIon of Best Management PractIces (BMPs),
conveyances, treatment, retentIon, detentIon, and outfall features or structures on a
project.
DROP STRUCTURE - A structure for droppmg water to a lower elevatIon and/or
dISsIpatmg energy A drop may be vertical or mc1med.
DRY POND - A detentIon facility that drams completely after a storm. This type of
pond has a pIpe outlet at the bottom.
EASEMENT - A nght afforded a person to make lImIted use of another's real
property TypIcal easements are for pIpes or access to ponds, and may be 15 to 20 feet
WIde.
EMERGENCY OVERFLOW OR SPILL WAY - An area on the top edge ofthe pond
that IS slightly lower m elevation than areas around It. Tlus area is normally lmed WIth
riprap The emergency overflow IS used only if the prunary and secondary outlets of
the pond fail, m the event of extreme storms, or lithe mfiltratIon capabilIty ofthe
pond becomes sIgruficantly dIminIshed. If the emergency overflow ever comes into
play, It may mdIcate the pond needs to be upgraded.
ENERGY DISSIPATER - A rock pad at an outlet deSIgned to slow the velOCity,
spread out the water leavmg the pIpe or channel, and reduce the potential for eroSIOn.

FREEBO ARD - The vertIcal dIstance between the desIgn hIgh water mark and the
elevation ofthe top of the pond. Most ponds have one to two feet of freeboard to
prevent them from overflowmg.
INFILTRATION - The soakmg of water through the soil surface mto the ground
(percolatIon is essentially the same thmg) Many ponds are desIgned to mfihrate or
retam stormwater, and thus do not have a regularly used dIscharge pIpe.
INFILTRATION FACILITY (OR STRUCTURE) - A facilIty (pond or trench) whIch
retams and percolates stormwater into the ground, havmg no dIscharge (to any surface
water) under normal operatmg condItIons.
JUNCTION - Pomt where two or more dramage pIpes or channels converge (e g., a
manhole)
JURISDICTION - OlympIa, Lacey, Tumwater, or Thurston County (as apphcable)
LINED POND OR CONVEYANCE - A facilIty, the bottom and SIdes of whIch have
been made impervious (usmg, for example, a plastIC lmer or clay/silt soil layer) to the
transnnsslon of liqUIds.
LIVE STORAGE - The volume of storage in a pond above the outlet whIch drams
after a storm event. ThIs storage area provIdes flood control and habItat protection for
nearby streams.
MANHOLE - A larger version of a catch basm, often round, WIth a solid lId.
Manholes allow access to underground stormwater pipes for mamtenance.
NATURAL CHANNEL - Stream, creek, nver, lake, wetland, estuary, gully, swale,
ravme, or any open condUIt where water will concentrate and flow mtenmttently or
contmuously
OIL-WATER SEPARATOR - A structure or deVIce used to remove oil and greasy
solids from water They operate by usmg gravity separation of liquids that have
dIfferent densIties. Many catch basins have a downturned elbow that prOVides some
oil-water separation.
OUTF ALL - The pomt where water flows from a man-made condUIt, channel, or dram
mto a water body or other natural dramage feature

STAFF REPORT - SUMMARY STATEMENT AND DEPARTMENT RECOMMENDATION.
Staff recommends the City Council approve the above referenced project as forwarded by the Yelm
Planning Commission
A. PROPOSAL
Project Applicant: Rainier General Development, Inc
Proposal 13 - Duplex Lots, Final Plat Approval for Prairie Heights, Division III
Location East side of Vancil Road south of Yelm Avenue
B. BACKGROUND
The Yelm City Council approved, with conditions, a preliminary plat for the above referenced project
on July 18, 1994 The project was approved for 13 lots and up to 13 duplex units
C. PLANNING COMMISSION ACTION
The Planning Commission reviewed the Final Plat at their January 19, 1999, meeting for compliance
with the conditions of approval placed on the preliminary plat. The Planning Commission found that
the conditions of approval have been satisfied and recommends the City Council approve the final
plat for Prairie Heights, Division III, with the following exceptions
Public Works Department Punch list
1 Stormwater swales have been constructed to City standards, however due to the time of year
it is not possible to seed them at this time The developer has installed sod on the floor of
the swales, but the side slopes are exposed dirt, The Public Works Department has agreed
to allow the developer to seed the slopes in April After April 30, 1999, no building permits
will be issued until the developer seeds the slopes
2 The original seal on the internal street is faulty, however due to wet and cold weather the
street cannot be re-sealed at thiS time The developer is responsible for re-sealing the
Internal street in the plat. The developer has bonded for this work,
D. COUNCIL ACTION
The City Council may take on of the following actions Approve the final plat as forwarded by the
Planning Commission, approve the final plat with modifications or require the applicant to complete
the items on the Public Works Department punch list prior to final plat approval

1) In the dedication "Rainier" is misspelled.
2) In the easement and reservations, change "operations .. to "operation" and

3) The year 1998 shows up several times
Sheet two
4) In the line table for line #4 change the length 4995 to 50.27
5) The symbol for monument set indicates that 5 monuments were set. I think only
one was set for this subdivision.
6} Show the bearing along the east line of lot 13, the south line of lot 13 and the
south line of Jot 1
7) The distance along the north line of the subdivision 661 61 should be 631 61 It's
obvIous that they are dimensioning from centerline but the requirements state that the
dimensions of the plat boundary should be shown.
