After review and consultation with SCA Engineering, the correct number of new pm peak hour trips generated by the site should be 1.78 trips instead of the 17.84 previously stated. This would change the TFC to $1338.00. Site plan approval has been granted based upon the following findings of fact and conditions of approval. 1. Transportation Finding: Yelm is a small compact community most directly affected by two state highways which bisect the community. The two state highways are used by local residents for transportation throughout the city and for access to commercial and residential areas throughout the community. In lieu of widening existing streets, the City has elect to create certain alternatives, Y-1, Y-2, Y-3 which will avoid the need to significantly widen existing streets, and particularly Yelm Avenue. New developments do in fact burden the city's central streets, and unless the bypass alternatives are accomplished, the City would have to require developers to pay the cost of the internal street widening. The city plans show and the City finds that adequate facilities will be accomplished better and in a timely fashion by bypass facilities as a substitute for the widening of existing facilities. As a result, the City finds that the regional plans in fact benefit projects in all areas on the City and will accomplish the goal of providing adequate facilities to City standards within a reasonable time to serve the demands created by the proposed project. The development of the site as a park will generate approximately 17.84 pm peak hour trips Conditions of Approval: a. The applicant shall mitigate traffic impacts to the transportation system. Mitigation includes payment of the Transportation facility Charge (TFC) for 17.84 new pm peak hour trips generated by the project. The total TFC is $13,380.00 and payable at time of building permit issuance. b. The applicant shall be responsible for frontage improvements along its property frontage on Mill Road. Frontage improvements shall consist of half-street improvements for a Neighborhood Collector Street. 2. Storm Water Finding: The completed project will increase the amount of impervious surface on the site and on the adjacent street. Impervious surfaces create stormwater runoff. When uncontrolled and untreated stormwater runoff can create health and safety hazards. YMC requires all development to comply with the City stormwater Manual. Condition of Approval: The applicant shall submit a final stormwater report and plan, including site contours, for approval by the public Works Department. stormwater facilities shall be designed and constructed in accordance with the DOE Manual. Best Management Practices are required during construction. 3. Water Finding: The City's Water Comprehensive Plan identifies a portion of the City area for service. The project site is in the City's water service area and as a public park facility is required to connect to the City water system Condition of Approval: The applicant shall provide potable water at the site. A final utility plan shall be approved by the Public Works Department. 4. Sewer Finding: The City's Water Comprehensive Plan identifies the City and the short term urban growth area for service. The project site is in the City's sewer service area. Condition of Approval: Future construction of a restroom facility will require connection to the City STEP Sewer System. System connection fees will be assessed at the time construction occurs. 2. The applicant shall submit final utility plans for approval by the Public Works Department. 5. Fire Safety Finding: YMC requires all development to meet minimum fire flow requirements. Condition of Approval: Fire hydrant coverage, design and installation shall be in accordance with the city of Yelm Development Guidelines. The applicant shall submit a fire hydrant plan for approval by the Public Works Department. 6. Parking Finding: User's of the park can be expected to arrive at the park via personal motor vehicles. Minimum parking spaces and parking arrangements are necessary for the safe movement of motor vehicles into and out of such spaces. YMC requires all development to provide adequate parking and that parking lots meet the minimum standards as set forth in the City of Yelm Development Guidelines, Chapter 4 -Transportation, Section 4.F.110 Parking Lots. Condition of Approval: The applicant shall submit civil plans to the Public Works Department for review and approval. The civil plans shall include all applicable information as required in Chapter 4 - Transportation, Section 4.F.110 Parking Lots, in the Yelm Development Guidelines. 7. Landscaping Finding: Landscaping and screening are necessary to promote safety, to provide screening between incompatible land uses, to safeguard privacy and to protect the aesthetic assets of the City. YMC, Chapter 17.80 requires all development to provide on site landscaping. Condition of Approval: The applicant shall submit a Final Landscape and Irrigation Plan to the Planning Department for approval. The landscape and irrigation plan shall be in accordance with the Yelm Zoning Code, Chapter 17.80, Landscaping. Site Plan Approval is a Type II Administrative approval. An appeal of this decision can be filed within 14 days from the date of this letter, pursuant to Yelm Municipal Code, Chapter 15.49, Integrated Project Review Process. As used in this chapter: "Concurrency" means a determination that the facili- ties necessary to serve a proposed land development are in place or planned for and properly funded with a reasonable expectation that the facilities will be in place at the time needed to preserve adopted levels of service. "Development activity" means any construction or ex- pansion of a building, structure or use, any change in use of a building or structure, or any changes in the use of land, that creates additional demand and need for public facilities. "Development approval" means any written authorization from the City which authorizes the commencement of develop- ment activity. "Land development" means any action with respect to a parcel of real property which requires plat approval pursu- ant to RCW Chapter 58.17 or site plan review approval through Chapter 17.84 of this code, or master plan develop- ment approval through Chapter 17.62 of this code. "Land division" means the action of dividing land for sale or lease, whether through the subdivision process identified in RCW Chapter 58.17, the city's binding site plan review process, or any other process which results in the creation or modification of the boundaries of a proper- ty for purposes of development. "Owner" means the owner of record of real property, although when real property is being purchased under a real estate contract, the purchaser shall be considered the owner of the real property if the contract is recorded. "Project improvements" means site improvements and facilities that are planned and designed to provide service for a particular development project and that are necessary for the use and convenience of the occupants or users of the project, and are not system improvements. No improve- ment or facility included in a capital facilities plan approved by the governing body of the city shall be consid- ered a project improvement. 129-40/129-41 (Yelm 2/97) 15.40.020 "Proportionate share" means that portion of the cost of public facility improvements that are reasonably related to the service demands and needs of new development. "Public facilities" means sewer service, water ser- vice, parks, schools, and roads are the public facilities for which the city will make specific findings of concurrency based on the comprehensive plan. "Service area" means a geographic area defined by the city in which a defined set of public facilities provide service to development within the area. Service areas shall be designated on the basis of sound planning or engi- neering principles. "System improvements" means public facilities that are included in the capital facilities plan and are designed to provide service to service areas within the community at large, in contrast to project improvements. "Transportation facility charge" means payment of money imposed upon development as a condition of develop- ment approval to pay for public facilities needed to serve new growth and development, and that is reasonably related to the new development that creates additional demand and need for public facilities, that is a proportionate share of the cost of the public facilities, and that is used for facilities that reasonably benefit the new development. "Transportation facility charge" does not include a reason- able permit or application fee. (Ord. 580 §1, 1996). 15.40.020 Process. A. Whenever a reviewing authori- ty is asked to consider the approval of a division of land for sale or lease or the approval of a site plan, the re- viewing official shall make a written determination of concurrency in connection with facilities proposed or available for the project. B. With respect to each of the public facilities identified above, concurrency shall be established and determined as follows: 1. Sewer: a. The project is within an area approved for sewer pursuant to the adopted sewer comprehensive plan for the city; b. Improvements necessary to provide city stan- dard facilities and services are present or are on an ap- proved and funded plan to assure availability in time to meet the needs of the proposed development. 2. Water: a. The project is within an area approved for municipal water service pursuant to the adopted water com- prehensive plan for the city; b. Improvements necessary to provide city stan- dard facilities and services are present or are on an ap- proved and funded plan to assure availability in a time to meet the needs of the proposed development. 129-42 (Yelm 9/96) 15.40.030 3. Parks: The project meets the requirements of the city fee-in-lieu requirements for parks, Chapter 14.12 Yelm City Code. 4. Schools: The project sponsor provides a letter from the local school district that the school facilities impacted by the proposed development are present, or are on an approved and funded plan, to assure that facilities will be available to meet the needs and impacts of the proposed development. 5. Transportation: a. The project makes on-site and frontage im- provements, consistent with city standards for utilities, curbs, gutters, sidewalks, bicycle lanes where appropriate, and roads necessary to serve the proposed project consis- tent with safety and public interest; b. The project makes such off-site facility im- provements, not listed on the capital facilities plan, as are necessary to meet city standards for the safe movement of traffic and pedestrians attributable to the project. Where a developer is required to oversize an off-site fa- cility for a project by more than ten percent of the need generated by the proposed project, the city may consider a developer reimbursement contract as authorized by state law; c. The project makes a contribution to the facilities identified in off-site comprehensive transporta- tion plan, in the form of a transportation facility charge based on the list of projects specified to be constructed within the next six years, or as partial credit against such charge, constructs a portion of the six-year facility, in which case a credit shall be given for the reasonable cost incurred therein, but not to exceed the extent of potential savings to the city; d. Appendix A to the ordinance codified in this chapter is the traffic report identifying the transporta- tion facility charge for the six-year road program in place at the date of the adoption of said ordinance. Such traf- fic report is to be updated no less than annually,. by July 1st, of each year; provided, however, the plan in effect shall remain in effect until a successor plan is fully adopted. (Ord. 580 §2, 1996). 15.40.030 Determination and payment of the transpor- tation facility charge. A. The transportation facility charge shall be based on the per peak-hour trip rate iden- tified in the report from transportation trip calculations based on a transportation report consistent with city stan- dards. B. City standards shall include: 1. Standard transportation assumptions as identi- fied in Table 1 attached to the ordinance codified in this chapter; 129-42a (Yelm 9/96) 15.40.040 2. For facilities not on the standard transporta- tion assumptions, the Institute of Traffic Engineers Trip Generation Manual for the most recent year; 3. For projects with nontraditional peak hour im- pacts or different from standard projects modelled in said Table 1, a special report, based on generally accepted traffic engineering principles may be submitted and consid- ered. C. Credits shall be given to reflect the projected impact on the community system such as, traffic decreases where an existing facility on site is removed or replaced, and traffic reduction systems which are binding and likely to remain effective for the life of the project. D. Credits may also be given for projects which cre- ate a significant economic benefit to the community, in- cluding industrial or manufacturing uses with an excess of five hundred trips per day. The size of the credit shall be measured at an appropriate percentage of the anticipated annual tax revenue increase to the community and available for capital contribution to transportation facilities on the approved plan as a result of the project. E. Payment of the transportation facility charge shall be as follows: 1. For projects involving the division of land for sale of lease: upon the issuance of a building permit for construction of each lot of record, for the traffic attrib- utable to that lot, 2. For projects approved through site plan review: upon the issuance of the building permit authorizing the construction of any phase, for the traffic associated with that phase, 3. For any project over one hundred peak hour trips per day: the fee may be paid in installments, at the municipal rate of interest in effect on the day of building permit issuance, with fifty percent being paid at the issu- ance of the building permit and the balance paid within twenty-four months, recognizing the lead time for the city to bring major projects on line. (Ord. 580 §3, 1996). 15.40.040 Accounting and anneals. A. All fees col- lected under this chapter shall be placed in separate ac- counts for the dedicated purpose for which collected. Such funds may only be expended for identified facilities on an approved plan, and must be spent within six years absent a specific situation where the city can justify a longer period. B. If an applicant desires to challenge the calcula- tion or assessment of any fee, such fee shall be paid under protest and the permit may be issued. Appeals shall be heard by the city council upon a de novo hearing. C. Any such appeal shall consider the issues raised, the proper fee to be assessed, and the necessity to find 129-42b (Yelm 9/96) 15.44.010--15.44.020 concurrency as a precondition to any project approval. The proper fee to be charged on appeal is determined: (1) by compliance with the terms of this chapter, and (2) if for any reason the terms of this chapter are found inappropri- ate, such fee as necessary to assure concurrence for all facilities identified herein, but not to exceed the fee collected pursuant to this chapter. (Ord. 580 §4, 1996). Chapter 15.44 VESTING OF DEVELOPMENT RIGHTS Sections• 15.44.010 Intent. 15.44.020 Definition. 15.44.030 Vesting of development rights. 15.44.040 Limitations not restrictive. 15.44.050 Building permit requirements. 15.44.010 Intent. It is the intent of the city to comply with RCW 19.27.095 by defining when a valid and fully complete building permit application for a structure exists for the purposes of establishing the point of vest- ing of development rights. {Ord. 555 §6{part), 1995). 15.44.020 Definition. For the purpose of this code, a "valid and fully complete building permit application" means the following requirements have been met for any construction project: A. I City of Yelm, Cochrane Park Consulting Engineers Storm Drainage Analysis & Report n U n u r--, n Storm Drainage Analysis & J4eport U ~ SECTION 7 PROPOSED PROJECT DESCRIPTION ~ Cochrane Park is located south of Yelm Ave. on Mill Road in the City of Yelm. The park is a constructed wetland park with three wetland cells, a fish pond, restroom facilities, and kiosks. ,-~ The eight acre site has 18 parking stalls and two handicapped accessible parking stalls. `J The property is located in: Section 30, Township 17N, Range 2E W.M. r-, Increase in stormwater runoff resulting from the addition of paved surfaces will be mitigated by ~ an infiltration basin sized to infiltrate 100% of the 100-yr, 24-hr design storm. ~, The runoff from the pavement will be directed to a conveyance pipe which will carry it to a u biofiltration strip and then to a retention basin located on the Fire Station property across the street from the park. It will then be infiltrated in a basin that will be reshaped to accept this `~ additional flow. u Facility sizing and design calculations are in Appendix B of this report. r-, u SECTION 2 EXISTING CONDITIONS r-, The total site is approximately 8 acres of which .34 acres will be converted into impervious ~ surface and the rest will be converted to a constructed wetland park which will enhance the vegetation of the site and minimize runoff. The areas surrounding the parking area and the ,--~ restrooms will be vegetated with grass and landscape plant material. These planted areas will not create any considerable runoff. To the north of the project is a church. The church `J property is sloping away from the site and will not contribute to the stormwater on site. The r-, property to the south is undeveloped and should not contribute runoff to the site. There are no well defined downstream drainage courses. It is evident that in the existing condition storm u runoff percolates rapidly and very little leaves the site. ~ With these improvements to the frontage on Mill Rd. the runoff from half of the roadway will be ~ included in the sizing of the treatment and drainage facilities. The contributing impervious surface is .18 acres. Therefore the total impervious surface as indicated in Appendix B is 0.52 r' acres. SECTION 3 INFILTRATION RATE /SOILS REPORT `~ Site soils are identified by the Soil Conservation Service Soil Survey of Thurston County, ~j Washington as a Spanaway gravely sandy loam, a Type `B' soil. This soil is characterized as very deep, somewhat excessively drained and formed on terraces. r-, ~ An investigation of the site soils was performed by Skillings-Connolly, Inc. and in essence verifies the presence of the Type `B' gravely sandy loam soil for the site. n U n LJ r-, u n u n ~ Infiltration tests were performed in the vicinity of the proposed basins. The soils were found to be dark brown to gray brown, very gravely, medium to coarse sand. The soil was very n consistent throughout the three infiltration test sites. Therefore, all infiltration surfaces can ~ safely be assumed to exhibit the characteristics described. ~ Upon examining the test hole it was determined that the soils on site will have a infiltration rate in excess of 20 in/hr or more. A conservative infiltration rate of 15 in/hr was used for design to U include a factor of safety for possible siltation of the drainage basin's bottom over time. r--, ~ SECTION 4 WELL AND SEPTIC SYSTEM ,~ The site will be served by City of Yelm sewer system. There is a STEP System line on Mill Road that will be connected . u ~ SECTION 5 FUEL TANKS ~ There are no known underground storage tanks in the immediate area. r-, u SECTION 6 BAS/N DESCRIPTIONS AND FACILITY SIZING The drainage basins were sized and analyzed using the Department of Ecology's guidelines for ~' the 6 -month, 24 -hour design storm. Water Works, a drainage design software, was used to u size and analyze the design. Since Water Works used the 2- year, 24- hour design storm the facilities will be sized conservatively. Additionally, as previously described, conservative r-, infiltration rates were used for the design calculations. Please see the calculations in Appendix ~ B section of this report. r-, The drainage from Mill Rd. frontage will be intercepted and directed to the conveyance system ~ along with the rest of the on-site area runoff from the parking area and adjacent sidewalk. The stormwater from the basin will flow over approximately 800 square feet of grass filter strip for a r, minimum length 80 feet which fulfills the DOE requirement (see sheet "biofiltration treatment" in Appendix B). After treatment of the stormwater a drainage basin will be used to infiltrate the `-~ water into the ground. r' The drainage basin is an irregular shape that is 3.0' deep, by 80' long, by 40' wide, with side ~ slopes of 4 horizontal to 1 vertical. A check on the required volume for the 100-yr, 24-hr storm event is calculated to be 1494 cubic feet. To this volume we will need to add the runoff ~' contributed by the basin on the Fire Station site or 300 cubic feet for a total of 1800 CF. This u volume is exceeded by the basin design volume of 4550 cubic feet. During the 100-yr, 24-hr design event the level of the water is expected to be less than 0.9' in the basin. More than a '~ foot of freeboard is supplied in the design of the drainage basin due to the hydraulic profile of ~, the drainage from the park. ~ Because of the high permeability of the site soils, it is anticipated that there will be no post- development runoff from the site. ~, v r-, U r--, n u r-~ ~ SECTION 7 ANALYSIS OF THE 100-YR FLOOD n v The site is not subject to flooding during a 100-yr, 24-hr storm event, nor will development of the site contribute to flooding on downstream property. SECTION 8 AESTHETIC CONSIDERATIONS FOR FACILITIES The filter strip will receive the runoff from the asphalt pavement at the Fire Station property. The filter strip and the pond area at the Fire Station will be reshaped and replanted during construction. The drainage basin will have sides sloped of 4 horizontal to 1 vertical and will be replanted with grass to blend into the surrounding landscape. The area around the pond will be landscaped to improve the appearance of the facility. r--, `~ SECTION 9 DOWNSTREAM ANALYSIS ,--~ A downstream analysis will not be necessary for this site because of the high probability of infiltrating 100% of the 100-yr, 24-hr event. U r-, SECTION 10 COVENANTS, DEDICATIONS, EASEMENTS `--' The storm management facility for this site will be owned and maintained by the City of Yelm Public Works Department. A maintenance agreement should be executed to ensure future r--, maintenance of the facilities.
