AND SPECIAL POWER OF ATTORNEY

THIS INSTRUMENT is entered into this ~ day of June

between the CITY OF YELM, a municipal corporation, hereinafter referred to as the
"CITY," and
Diana BlanQ
hereinafter referred to as the "OWNER"
WITNESSETH
WHEREAS, the OWNER holds record title to the following described property
located within Thurston County,Washington
Beginning at the intersection of the Southerly line of Jones Street and Westerly line
of Solberg Street; thence south 37 Degrees 56' West along said Westerly line of Solberg
Street 125 feet; thence North 53 degrees 30', West 100 feet thence North 37 Degrees 56'
East 125 feet to said southerly line of Jones Street; thence South 53 Degrees 30' East
along said Southerly line,1 00 feet to the true point of beginning (Also know as Lot 7 and
Lot 8 in Block 11 of unrecorded Solberg's Addition to Yelm), records of Thurston County,
Washington
and WHEREAS, the CITY has required as a condition of approval of the OWNER's
site plan/subdivision for said property that the OWNER participate in the construction of
certain utilities and/or street improvements as they directly relate to said property and the
OWNER desires that said requirement be delayed until projects are formulated for the joint
participation of other affected owners
NOW, THEREFORE, IT IS HEREBY AGREED BETWEEN THE PARTIES as
follows
1 The CITY will delay its requirement for the immediate participation by the
OWNER in the construction of certain utilities and/or street improvements, subject to the
conditions set forth hereinafter

2 The OWNER will financially participate int he following utility and/or street
projects on an equitable basis with other affected property owners
_ Sanitary sewer system improvements,
_ Water system improvements,
_ Storm water system improvements,
---.lL. Street improvements,
---.lL.Street lighting improvements,
---.lL.Sidewalk improvements,
~ Other-Planter strip and landscaping- per the local access residential standard,
which improvements are more specifically described as follows
The owner agrees to participate in site frontage improvements to Solberg Street.
Improvements shall be from centerline of the right-of-way and along the property frontage
Improvements shall be constructed to a local access residential standard The property
, owner shall dedicated the necessary right-of-way for said improvements along the property
frontage The property owner shall also provide a 10' utility easement behind the public
right-of-way
3 The OWNER hereby waives all rights to protest against future Local
Improvement District (LID), Utility Local Improvement District (ULlD), or Latecomer
Ordinance and Agreement proceedings for the construction of said improvements described
in Section 2 herein For purposes of this Instrument, "rights of protest" shall mean only
those formal rights to protest contained within the LID, ULlD or Latecomer Ordinance and
Agreement statutes, except, however, nothing herein shall constitute a waiver by the
OWNER or the OWNER's heirs, assigns or successors in interest, of the right t object to the
OWNER's individual assessment amount or latecomer charge or to appeal to the Superior
Court the decision of the Council affirming the final assessment roll or latecomer ordinance
and agreement, which rights are specifically preserved
4 The OWNER hereby grants and conveys to the City Engineer of the City of
Yelm, or his successor in interest or designee, a Special Power of Attorney to exercise any
and all rights of the OWNER, including any purchasers, mortgage holders, lien holders or
other person who may claim an interest in the property described hereinabove, to
accomplish the following At such time as a Local Improvement District, Utility Local
Improvement District, or Latecomer Ordinance and Agreement is proposed that would
cause said improvements to be made available to the OWNER's property described
hereinabove, to execute a Petition on behalf of the OWNER for the creation so such LID,
ULlD or Latecomer Ordinance and Agreement. This special Power of Attorney is granted in
consideration of the CITY executing this Instrument, and shall be a power coupled with an
interest which may not be terminated This Special Power of Attorney shall not be affected
by the disability of the OWNER
5 If the OWNER fails to perform in good faith in accordance with this
Instrument, it is agreed that the CITY may discontinue utility service to the property
described herein, after giving 20 days notice thereof and an opportunity for hearing thereon,

owner(s) of the property described herein and has/have full power to commit said property
to this Agreement, Waiver of Protest and Special Power of Attorney
7 This Instrument constitutes a covenant running with the land and shall be
finding on all heirs, assigns, transferees, and successors in interest.
8 For purposes of RCW 35 43 182, and any LID or ULlD thereunder, the
effective term of this Instrument shall be a period of ten years from the date hereof For
purposes of RCW 35 72 and RCW 35 91, and any Latecomer Ordinance and Agreement
thereunder, the effective term of this Instrument shall be a period of fifteen years from the
date such an Ordinance and Agreement becomes effective

and WHEREAS, the CITY has required as a condition of approval of the OWNER's
site plan/subdivision for said property that the OWNER participate in the construction of
certain utilities and/or street improvements as they directly relate to said property and the
OWNER desires that said requirement be delayed until projects are formulated for the joint
participation of other affected owners
NOW, THEREFORE, IT IS HEREBY AGREED BETWEEN THE PARTIES as
follows
1 The CITY will delay its requirement for the immediate participation by the
OWNER in the construction of certain utilities and/or street improvements, subject to the
conditions set forth hereinafter

2, The OWNER will financially participate in the following utility and/or street
projects on an equitable basis with other affected property owners

which improvements are more specifically described as follows
The owner agrees to participate in site frontage improvements to Washington Street.
Improvements shall be from centerline of the right-of-way and along the property frontage
Improvements shall be constructed to a local access residential standard The property
owner shall dedicated the necessary right-of-way for said improvements along the property
frontage The property owner shall also provide a 10' utility easement behind the public
right-of-way
3 The OWNER hereby waives all rights to protest against future Local
Improvement District (LID), Utility Local Improvement District (ULlD), or Latecomer
Ordinance and Agreement proceedings for the construction of said improvements described
in Section 2 herein For purposes of this Instrument, "rights of protest" shall mean only
those formal rights to protest contained within the LID, ULlD or Latecomer Ordinance and
Agreement statutes, except, however, nothing herein shall constitute a waiver by the
OWNER or the OWNER's heirs, assigns or successors in interest, of the right t object to the
OWNER's individual assessment amount or latecomer charge or to appeal to the Superior
Court the decision of the Council affirming the final assessment roll or latecomer ordinance
and agreement, which rights are specifically preserved
4 The OWNER hereby grants and conveys to the City Engineer of the City of
Yelm, or his successor in interest or designee, a Special Power of Attorney to exercise any
and all rights of the OWNER, including any purchasers, mortgage holders, lien holders or
other person who may claim an interest in the property described herein above, to
accomplish the following At such time as a Local Improvement 'District, Utility Local
Improvement District, or Latecomer Ordinance and Agreement is proposed that would
cause said improvements to be made available to the OWNER's property described herein
above, to execute a Petition on behalf of the OWNER for the creation so such LID, ULlD or
Latecomer Ordinance and Agreement. This special Power of Attorney is granted in
consideration of the CITY executing this Instrument, and shall be a power coupled with an
interest which may not be terminated This Special Power of Attorney shall not be affected
by the disability of the OWNER
5 If the OWNER fails to perform in good faith in accordance with this
Instrument, it is agreed that the CITY may discontinue utility service to the property
described herein, after giving 20 days notice thereof and an opportunity for hearing thereon,

6 The OWNER hereby declares that Diana Blano @are the sole
owner(s) of the property described herein and has/have full power to commit said property
to this Agreement, Waiver of Protest and Special Power of Attorney
7 This Instrument constitutes a covenant running with the land and shall be
finding on all heirs, assigns, transferees, and successors in interest.
8 For purposes of RCW 35 43 182, and any LID or ULlD thereunder, the
effective term of this Instrument shall be a period of ten years from the date hereof For
purposes of RCW 35 72 and RCW 35 91, and any Latecomer Ordinance and Agreement
thereunder, the effective term of this Instrument shall be a period of fifteen years from the
date such an Ordinance and Agreement becomes effective

The Yelm City Council has granted a Conditional Use Permit for your daycare located at 203 Solberg
Street. The permit is for both Phase I and II as described in the staff report dated May 18, 1999 The
permit was granted based on the following findings of fact and conditions of approval
.1. Transportation
Finding Yelm is a small compact community most directly affected by two state highways which bisect the
community The two state highways are used by local residents for transportation throughout the city and
for access to commercial and residential areas throughout the community In lieu of widening existing
streets, the City has elect to create certain alternatives, Y-1, Y-2, Y-3 which will avoid the need to
significantly widen existing streets, and particularly Yelm Avenue New developments do in fact burden
the city's central streets, and unless the bypass alternatives are accomplished, the City would have to
require developers to pay the cost of the internal street widening The city plans show and the City finds
that adequate facilities will be accomplished better and in a timely fashion by bypass facilities as a
substitute for the widening of existing facilities As a result, the City finds that the regional plans in fact
benefit projects in all areas on the City and will accomplish the goal of providing adequate facilities to City
standards within a reasonable time to serve the demands created by the proposed project.
Conditions of Approval
a The applicant shall mitigate traffic impacts to the transportation system Mitigation includes
payment of the Transportation Facility Charge (TFC) for 25 pm peak hour trips generated by the
project. The total TFC for Phase I is $12,000 00 and payable at building permit issuance The
total TFC for Phase II is $6,750 00 and payable at building permit issuance
b The applicant shall be responsible for all improvements to Solberg and Washington Streets as
required by the Yelm Development Guidelines Improvements shall include core road
improvements, planter strip, sidewalk, street lighting and landscaping as required for a Local
Residential Access Street. The applicant may enter into an agreement with the City for the deferral
of improvements Enclosed are the Waivers of Protest for improvement deferral If you would like
to defer the required improvements please have your signature notarized and return to the
Planning Department for recording
2. Water Supply
Finding This project site is currently served with City water It is not anticipated the project would require
any additional water capacity
Conditions of Approval
a Each phase of the development shall be monitored by the City for a 6 month period to determine if
additional water capacity is required
3. Sewer System
Finding This project site is currently served from the existing Sewer Treatment Plant. It is not anticipated
the project would require any additional sewer capacity

a. Each phase of the development shall be monitored by the City for a 6 month period to determine if
additional sewer capacity is required.
b At this time it is unknown if a grease trap will be necessary The City will continue to monitor the
STEP system and if at anytime in the future the City determines a grease trap is required the

provide ADA accessible access

care facilities generates 11 67 new peak hour trips per every 1,000 square
feet. As proposed the development would generate 25 new pm peak hour
trips (Phase I - 16, Phase II - 9) The total trips for Phase I reflects a credit
of 1 trip for the existing residential use
9 Parkinq Chapter 1772, Off-Street Parking and Loading, requires one
parking stall per each ten occupants (Places of assembly without fixed
seats.) Maximum occupancy is 50 (45 children and 5 staff) which requires
a minimum of 5 on-site stalls
The applicant proposes 3 on-site parking stalls, 6 off-site parking stalls (for
staff) and a drop-off/pick-up area The applicant has entered into a parking
agreement with McDonald's for the 6 off-site parking stalls
10 Wastewater The project is currently served with existing capacity from the
Sewer Treatment Plant. It is not anticipated the project would require any

ZONING CODE AMENDMENTS: WORK SESSION - Cathie stated that she
would like to go over the changes from the last meeting/work session
Cathie talked about the first issue-Secondary Accessory Dwellings John
Thomson asked Cathie - if a family member is living in an accessory dwelling
unit, and they pass away - what happens? Cathie said technically the unit
would either need to remain a family unit or be removed from the sight. A
signed affidavit would help to ensure that secondary family units do not turn
into rental units
Ray Kent asked what can be done if the affidavit is violated? Cathie stated
that an order to vacate could be issued, but again it is a difficult situation
because it isn't monitored or policed Cathie also said that at her next "City
Update" presentation to the MLS Group, she will include this topic

Consistent with City of Yelm Ordinance 580, Concurrency Ordinance, a day
care facilities generates 11 67 new peak hour trips per every 1,000 square
feet. As proposed the development would generate 25 new pm peak hour
trips (Phase I - 16, Phase II - 9) The total trips for Phase I reflects a credit
of 1 trip for the existing residential use
9 Parking Chapter 1772, Off-Street Parking and Loading, requires one
parking stall per each ten occupants (Places of assembly without fixed
seats) Maximum occupancy is 50 (45 children and 5 staff) which requires
a minimum of 5 on-site stalls
The applicant proposes 3 on-site parking stalls, 6 off-Site parking stalls (for
staff) and a drop-off/pick-up area The applicant has entered into a parking
agreement with McDonald's for the 6 off-site parking stalls
10 Wastewater The project is currently served with existing capacity from the
Sewer Treatment Plant. It is not anticipated the project would require any
additional sewer capacity
11 Water Supply The project is currently served with City water It is not
anticipated the project would require any additional water capacity
12 Drainage/Storm water The City adopted the DOE Storm Water Manual as
the City standards for storm water treatment and control As proposed the
impervious surface on the site in under 5,000 square feet and would not
require stormwater treatment or retention

D. STAFF RECOMMENDATION
Staff recommends that Daycare Facility, CUP-99-8235-YL, be approved, based on the
findings in Section C, and subject to the conditions in Section D of this report.
1 The applicant shall submit a final parking lot plan for approval by the Public Works
Department.
2 The applicant shall mitigate traffic impacts to the transportation system Mitigation
includes payment of the Transportation Facility Charge (TFC) for 25 pm peak hour
trips generated by the project. The total TFC for Phase I is $12,00000 and payable
at building permit issuance The total TFC for Phase II is $6,750 00 and payable
at building permit issuance
3 The applicant shall be responsible for all improvements to Solberg and Washington
Streets as required by the Yelm Development Guidelines Improvements shall
include core road improvements, planter strip, sidewalk, street lighting and
landscaping as required for a Local Residential Access Street. The applicant may
enter into an agreement with the City for the deferral of improvements
4 One parking stall on-site shall be designated as ADA - van accessible The stall
shall be a minimum 16' x 20', signed and striped
5 Each phase of the development shall be mOnitor for a 6 month periord to determine
if additional water and/or sewer capacity is required
6 At this time it is unknown if a grease trap will be necessary The City will continue
to monitor the STEP system and if at anytime in the future the City determines a
grease trap is required the applicant shall have one installed to City standards

The Yelm Building Department has completed its review for the remodel at 203 Solberg Street
and has issued a building permit. Issuance of the permit is with the understanding that
completed plans for the next phase expansion will be provided to the Building Department and
all ADA requirements, if not already addressed, will be in compliance at the completion of the
next phase
It is important that you understand the building permit is completely independent of the
Conditional Use Permit needed to operate a daycare center and does not insinuate that the
building can be occupied as a day care center
If you proceed with the remodel prior to receiving a Conditional Use Permit from the City Council
all the improvements will be done at your own risk. Occupancy as a daycare center can not
occur until the City Council has approved a Conditional Use Permit for the site, any conditions of
the Conditional Use Permit have been satisfied and a final inspection of the premises by the

The PublIc Works Department has the followmg comments relative to the
proposed daycare SIte to be located at 203 Solberg Street SE
WATER:
The proposed SIte IS currently connected to CIty servIces and IS served by
a 3/4" residential servIce water mam located on Solberg Street (tills may
need to be upgraded If service demands require it). The property WIll be
changmg from resIdential to commercIal use and the monthly fee WIll
mcrease accordmgly We wIll momtor monthly consumption reports for
the next SIX months so that we can assess usage and deternune If
addItional ERU's need to be purchased.
SEWER:
The proposed site IS currently serviced by the City's sewer S T.E.P tank
system. The property wIll be changmg from a resIdential to commercIal
use and the monthly fee WIll mcrease accordmgly We wIll momtor
monthly consumptIOn reports for the next SIX months so that we can assess
usage and determme If addItional ERU's need to be purchased.
Also, there may be a need to mstall a grease trap If the cookmg menu
mcreases beyond "normal" resIdential use

Per the D O.E. Stormwater Manual.

Chapter 17 72 Day care - 1 stall for each employee, plus short term
parking area (# of stalls to be determined based on occupancy), plus
pick-up/drop-off area
ADA requirements-
Landscaping Chapter 17 80, Type II, III and V
Type II landscaping is used to provide visual separation of compatible uses
Type II landscaping is required around the perimeter of a site, which has
compatible zoning and adjacent to buildings to provide visual separation of
compatible use and soften the appearance of streets, parking areas and building
elevation
Type III landscaping provides visual relief where clear sight is desired This
landscaping includes street trees and vegetation required with frontage
improvements and along pedestrian walks for separation of pedestrians from
streets and parking areas
Type V landscaping is required for all storm water facilities (if required)
A conceptual landscaping plan is reqUIred with application for Site Plan Review
and Special Use Final landscaping and irrigation plan is required as element of

The City has adopted a Transportation Concurrency Ordinance which
requires new development to pay its fair share for needed improvements
due to growth The Transportation Facility Charge (TFC) is charged
based on the new per pm peak trips generated by the development. The
Ordinance provides a default table that the applicant can use to
determine new pm trips generated To determine the projects impact and
fee use the following formula for each use proposed
Day care
11 67 x square feet + 1,000 x $75000 = TFC
The TFC IS payable at issuance of a building permit.
If the applicant feels the proposed use would not generate the default
number of trips as designated in the TFC Ordinance an analysis prepared
by a Washington State licensed Engineer can be submitted to the City
for review and consideration
Environmental checklist required for all buildings in excess of 4,000 sq ft.
or more than 20 parking stalls associated with the building
Special Use, Chapter 17 66 requires a public hearing with the
Planning Commission and approval by the City Council Minimum
application reqUirements are located in Section 17 66 070 Please
refer to the application form supplied by the City for a detailed list
of contents A project of this size can expect completed review in
approximately 60 -75 days Land use approval will contain
conditions of approval that the applicant must complete prior to
receiving a building permit.
Following land use approval the applicant is required to submit civil
construction drawings to the Public Works Department for review
and approval and satisfy all conditions of approval Upon
satisfactory completion of all conditions the applicant can submit
building plans for approval
